"And one thing that Matthew Morgan, the executive director of the Oklahoma Indian gaming association said to me, and I said, you know, to other people that, you know, this is an industry that tribes are an industry that are not leaving the state. Like you would have a car manufacturer or a battery manufacturer an electric salary man. You find it good. That's not going to go away. Tribes are there. Right. Allison, I'm curious. There's so much buzz right now in Oklahoma. And I think a big thing or a big factor here is that the tribes are involved in this election. So seriously, to unsee governors did and are people talking about that a lot and do you think that's one of the reasons why we're hearing so much about the native vote right now in Oklahoma? Oh, for sure. Without a doubt. And I think, you know, you will, you know, I think you'll continue to take care of them. I mean, if he gets elected, I think, is still going to be an issue. And here's another thing, you know, we haven't really talked about the attorney general's race because it's not really getting our drum in. Won the primary election this last June. In fact, like right before the Castro we have to decision came out. And he positioned himself as being very pro tribal sovereignty. And in fact, you know, I remember the choctaw nation, chief Gary baton. Congratulations, congratulating him. And saying that this was a win for tribal sovereignty. So if it does win, he's going to have an attorney general in that office that isn't that is very going to not going to be like John O'Connor, the current attorney general who filed all of those petitions to the Supreme Court for kestrel huerta. Drummond positions himself as being a friend to the tribes, although I will say that he has a very complicated relationship with the osage nation. But, you know, I think it's going to be interesting no matter what happens. Alison, another quick question, and this is an interest in me a lot that Oklahoma gubernatorial candidate joy hofmeister. She actually switched parties to run against incumbent Kevin Stanton. She was a Republican. So do any of the tribes have concerns? Are they worried about where her political loyalties ultimately lie? I mean, there was a few people that we reached out to that said that they're not going to vote for her. Republican, they're going to vote Republican down the ticket. That's just what they believe in they don't want to vote for a Democrat or they're not going to vote at all. They don't like either choice. That's, you know, just a few people that said that. So that can't be discounted. I think, you know. I'm not sure that there is any concern about her switching parties or loyalties. I think really, again, the biggest issue is having somebody that's going to be able to work with the tribe. Okay. Okay, gotcha. Folks, it's a great show today. We're talking all about the upcoming election next week in Oklahoma. If you've got a question, if you've got a comment, what are you waiting for? One 809 9 6 two 8 four 8. We'll be right back. The game of stickball comes from North American indigenous people and local and national leagues continue the tradition. It's a combination of fierce competition and cultural connection. "Be the site of one of the biggest upsets of the midterms. That may seem like the sign of a flailing GOP in a place where the party should be at its strongest. But it's more complicated than that. That's because stitz democratic opponent joy hofmeister, the superintendent of Oklahoma's public school system, was a lifelong Republican until last year. I was a Republican longer than governor stitt was registered to vote. She tells time. I'm fiscally conservative. I'm aggressively moderate. Always have been. In other words, she's a Democrat in name only. The latest polling has hofmeister with a slim three point lead over stead, according to the Oklahoma City based firm ascend action. The tight race is largely the result of a series of missteps by stitt, from scandals that have plagued his administration to a bitter feud with Oklahoma's 39 American Indian tribes. Stent also signed into law one of the country's most restrictive abortion bills, which has drawn some pushback even in conservative Oklahoma for its banning the procedure in cases of rape, incest, and when the mother's health is at risk, and he oversaw one of America's highest COVID death rates with roughly 17,000 lies lost. Hofmeister, H 58, says she switched parties because she wanted to challenge it, but knew trying to do so in the Republican primary would be futile. Governor stitt has hijacked the Republican Party, she adds. He is pandering to extremism. Campaign did not respond to multiple requests to comment for this report. Oklahoma political analysts suspect hofmeister's party switch has paid dividends in a race where most Democrats won't stand a fighting chance. I think her being a lifelong Republican makes her more palatable to a lot of oklahomans, says Rachel Blum, a politics professor at the university of Oklahoma. But as hofmeister's campaign has been building momentum, more Republicans have been coming to its rescue. On Monday, desantis endorsed him, and on Tuesday, Cruz is holding a rally for him in Oklahoma City. Who founded the financial services firm gateway first bank before entering politics, also loaned his campaign roughly $1 million over the weekend. It's yet another sign that Republicans are spending resources on a race that only a few months ago they would have considered an afterthought. The governor's political troubles began in his first year in office when he filed a lawsuit to renegotiate the state's gambling compact with the tribes and collect more state revenue from their casinos. The move created a major confrontation with a powerful constituency in the state. Oklahoma has one of the nation's highest percentages of American Indian citizens. At roughly 10%, according to the latest U.S. Census data, the tribal casino operations are also a pivotal part of the state's economy. Since nearby Texas doesn't have gaming, Oklahoma's southern border is littered with casinos, including the world's largest casino in thackerville.

Doug Examines the Governor's Race in Oklahoma
"Turn to one now that is, I think, in the end is going to hold for the Republicans, but it is far closer than frankly, it should be. Mayor for Allen, who was the governor of Oklahoma, run in 2014. She won by 15 points. Kevin Smith, who is the current governor of Oklahoma one by 12 points just four years ago. And now this race is a dead heat. As far as polling goes, it's a dead heat. This is also one of those races where the national environment is, I think, affecting an inversely a little bit. Kevin said, he's been a great supporter of not only Republican conservative colleges, but also criminal justice reform, making sure his state is getting the most bang for their buck as far as when it comes to punishing those who do wrong. But yet also making sure that there is a way for them to come back home to get jobs to stay out of jail, all things that conservatives should be about. And it's really interesting in this race you've had the Democrat joy hofmeister who has been attacking Kevin Smith for basically doing things that Democrats have talked about for a long time and that is reintegration and using criminal justice system to actually help people break the cycle of violence and break the cycle of pain in their own life. This is a very much of a disappointment and the idea that from governors actually taking a stand on issues that matter, Republicans have got to come together in this race. I think they will. Mark Wayne Mullen is on the Senate side here and he's going to win and cruise to this election fairly easily. James lankford is well. I think this will pull this into the Oklahoma governor's race and that you'll see when this one. But

"This is national native news. I'm Antonio Gonzalez. Authorities in Wisconsin and Michigan have now signed off on the menominee Indian tribe's nomination of a site to the National Register of Historic Places. Danielle kading reports that's drawn backlash from some who say it's a veiled attempt to stop the back 40 mine. Historic preservation boards in Wisconsin and Michigan have approved the nomination of Onam Oman, the site includes the 60 islands area where the tribe once lived on the menominee river. Menominee tribal chairman Ron corn senior says it contains the tribe's dance rings and burial mounts. We're trying to protect our historic and cultural places. We're trying to protect the resting place of our ancestors. It's also where gold resource corporation wants to mine gold and other metals for the back 40 project. Michigan Republican and state senator Ed mcbroom says listing the site would add more hurdles to the permitting process. Suddenly, they're only up here to stop this mine and this is just their latest trick in the bag to do so. Corn says the tribe is opposed to the mine, but insists the nomination is about protecting cultural resources, a mining company executive says they will avoid disturbing archeological sites. For national native news, I'm Danielle kading. A group of native people in their allies gathered outside the Kansas City football team stadium on Monday to call on the team to change its name and end the use of Native American imagery. The NFL Monday Night Football game between Kansas City and the Las Vegas Raiders was played on indigenous people's day. The Kansas City team released a statement in recognition of indigenous people's day, saying in part that the team is having dialog with local and national groups to identify ways to educate and raise awareness of American Indian communities. Demonstrators say the statement to them holds no true meaning or value. Galene crouser is the executive director of the Kansas City Indian center and is one of the organizers of demonstrations held during football season. I thought their statement is just more propaganda that they put out there to make the fans believe that what they're doing is okay by native people and it's not. And that's why we have to come out here and make that stand every single time. So that doesn't get lost in the rhetoric. Raiders fan Christian Cuevas came over to show his support. And I've seen this on TV that you guys want to change it in, but it's real out here. And I support it and you should change the name. You don't hear no other team being called, you know. That'll work, you know? But it's pretty interesting when I believe you guys should change it. Demonstrators are members of not in our honor, a group of native leaders, tribal college students, and native community members in the greater Kansas City area. They advocate against the use of native imagery in sports and media. In native vote news, leaders of the 5 largest tribes in Oklahoma on Tuesday will publicly endorse democratic candidate joy hofmeister for governor of Oklahoma, tribes have been at odds with current Republican governor Kevin stitt over a number of issues, including the historic U.S. Supreme Court ruling in the mcgirt case, which reaffirmed reservation boundaries. The Cherokee chickasaw muskogee choctaw and Seminole nation say, hoffmeister, respects tribal sovereignty and say, she's committed to working with Oklahoma's nearly 40 federally recognized tribes, in a statement to press, its campaign says the governor has the support of thousands of tribal members across the state. The 5 tribes represent more than 800,000 tribal citizens, the tribes say they're looking to build safe communities strong economies, a stable workforce, well funded education, investments in infrastructure, health, wellness, families, and communities. The tribes are making the endorsement during an event in Oklahoma City. I'm Antonia

"Know. I don't know there's a lack of education that push the happens and you can only do so much and from my lived experience as a lobbyist in oklahoma. You can only do so much when we don't allow for public testimony which is one of the most anti-democratic thing. I think mama very fortunate. My last job in my position. I i supervise staff in arkansas and then had a direct colleague in kansas and missouri and to see like how legislatures play out. I used to work for planned. Parenthood those permanent ab- rasco. Every bill had a hearing every bill. How to here so so it goes back to like the the process right like what it wouldn't mean in oklahoma where be where we are in oklahoma if needed opportunity for public testimony. No how selective it is. Of course because i remember One day i was having to be capital in twenty nineteen. i believe. There's an abortion bill app eddie. And they in the author. I think he was the one. They're like. People could contestant abortion years later or sued provider When you're talking about at the committee the author could bring people to testify against that. Ms mus inflammatory gory. Just heart-wrenching had an abortion. I didn't want it and it's like sister. I don't think this. I don't think we're talking about the same. But it's just very selective an exclusive. I mean that's by nature what they do it. I mean it's very much planned in gift. That part like that is why because the moment that we are transparent with you know with the public the moment we let the public see how legislation is actually made and how is actually really behind closed doors unfortunately is the moment i think oklahoma would stand up and say no we deserve a an open and transparent government And that's the least we can do So i mean it's by design and i get it but i knew ivy into how their emails are the ones that are exempt from this request. Fray i mean the first starters in terms of Rinsing so in. Arnold may know better than me but i mean it was only until recently where we were able to even have archives of the recordings of you right. That's that's not something where people are like. Oh we'll just get the archives. In years ago i ever loved is not the same in each chamber either. Yeah that's ridiculous on keep searching for some colonel of silver live in here. Oh that's makes it's a metaphors isn't it. But at any rate you know. I just i keep thinking there are upcoming younger generations of women in this state in the country who have to be totally leaked shot at what is taking place in who may have never paid a whole lot of attention to what's going on at the state house much less in bc who suddenly are having a an awakening to auditors. And i would think that those who can do that can continue to beat this drum and and because it's good for them politically are going to find out that they've ridden that horse way too long. I agree i completely agree. And i'm hoping As one of the one of the things that i've seen as young folks in a whole different and a whole lot of barriers really like leaving And we're really looking forward to that. We we recently homes well in across the state. We had The the rallies against all these antiabortion bills and to see young folks out there is great and i really hope that you know. I hope that folks have been in the game as long as i have not. A elite can't do this. You can't do that. You know and really bring them in and accept their innovation and their boldness and they're willing to try and they're not going to have the obstacles won't be from activists that said well. We tried that. It didn't work so that's one of the hopes. Also hope that they're willing to you. Know dig in. Because if there's ever a time where i could see folks i don't wanna run for office like i don't want to be part of politics. It's kinda now right like there's nothing sexy about being Politicians right now and you know people it. It's a scary thing by all means are who wants to that headache but definitely hope they can see past that engaged to say like if i really to make a difference then i need to be at that table and let me back up. Not even say at the table. I hope they turn the table over. They chop it off. That's where i really hope the table like or just say we'll bring her own table in yokneam. Come and if you want to. It's not trying to be at. That table is trying to make our own like it. So i do think there i fear there's a little trump fatigues still though in this country and even here in oklahoma and in sort of trump land. I think there are a lot of people are like limoges. Catch my breath for a little while which may be you know the political genius behind those who pushed a lot of this stuff this year thinking that people were so worn out from all that that it a lot of activists Who would normally be in the fray or say. Can i segue to something that just happened today. As an example of what. You're talking about arnold joy hofmeister announcing her run for governor end announcing she's running as a democrat and people are all up in their feelings about this like all over the place. I serve my i. I have my feelings about it. spoiler alert. I'm very supportive. But when i think about it if she had ran as a republican she would have to be endorsing john bennett and what he symbolizes as republican state of oklahoma and it is the worst. Most beer lynch form as so-called republicanism Nowhere near you know maybe goldwater barry goldwater hybrid public and right in so when you think of what stands in as May maybe should baby. She is a moderate conservative democrat. But that's like oklahoma right. I mean so. So i just think of like what that means that you see a very prominent statewide candidate Record of how. She votes on things. I i know we have connie johnson running. She hasn't voted on anything in a really long time But we have joy hofmeister who has a very clear and present record In in my mind she repudiated disa- extremism. But that's also leading to bills like these these abortion bills in this state. It'll be interesting to see where it goes right if she wins. But i don't know to me. There's a clear line so because.

"First term republican. Us rep. Stephanie buys in central oklahoma's fifth congressional district and earlier this month hauser's republican state superintendent joy hofmeister abruptly switched parties. It hopes of becoming the democratic nominee to take on governors. Who better to help us. Sort through all the political calculating and help us separate the contenders from the pretenders than someone who successfully steered himself through the electoral minefields former governor and now democratic national committee. Man david walters who it just so happens was our very first. Observer cast guests on february eighteen. Twenty twenty the audio is terrible. The debut was unforgettable somehow survived for eighty episodes. Now thanks to governor wolters keen insights in episode. One psalm. Back and listen to that. I'd like to hear some keen insights provide us lord. No doubt about that. So let's start with joy hofmeister because that is my goodness. We have a lot of ground to cover. But i haven't say anything like that really at that level. What can you tell us. Give us the inside scoop inquiring minds want to know. What can you tell us. Well i know it was a it was a long it was i think people have. The impression happened overnight. It was a long thoughtful process. That i i believe. Superintendent off meister went through along with her husband. Jerry and their family and I frankly thought about three months ago that it was that it was done and then And then she decided that she was so worried about her responsibilities. I think taking care of the kids in when he got several hundred thousand showroom that you're responsible for in the superstructure government is not allowing Folks like erred properly. Protect them as they thought they needed to be. Giving local school boards responsibility. I think he was so focused on that she just was not ready to make that decision but then within the last month obviously she decided to go forward and i you know i wouldn't. I wouldn't central to that. But i was aware of it in had an opportunity to visit with her on on occasion or two and so delighted that she decided to do that. I know she reached out for advice. Counsel from a number of people but you know in the end it was just a it was just a raw act of courage and an expression of independence and And i frankly. I'm i'm i really admire what she has done. Because i've heard some democratic actress like oil. You know she's just using the party Label do they know where we live. I mean who how how d- behind your name on a statewide race so it's so it's When i say curry i'm by by mean it. I mean it's a. It's an uphill climb but but the mechanics of the race. Look pretty positive we could take. We could You know designed the best democratic candidate you could find who's been in the party forever and You wouldn't be as competitive in my view as joy. Hofmeister is going to be and then we can talk about morbid but i just i just want to say that i'm you know i. I knew her a little bit. But i know her better. Now and Very impressive smart. independent thoughtful. Leeann kind articulate. She really You can tell you know you can tell when a candidate feels it in their heart and soul and And she does. There's there's no alterior motive. There's no super strategy here. He's not trying to polish your credentials for national ron or any of that. She just wants to solve these problems. And as as of the problem the solutions to the problems we face are really quite simple. If you find somebody that has the courage to step up and present the solutions. And that's that's worry falls short. So many times people get skipped so wrapped up in the politics either of their national party or otherwise. And i think she's going to be free of that. Then we'll be able to to address the issues of we face no com seven. Or do you really think. Because their criticisms i've seen of her switching to democrat Have one being Why can't we run a real progressive and kid could i. Real progressive means win statewide race in oklahoma. And does it really matter in your eyes. if she's moderate slightly lefty far radical left. Know i mean what. What is your take on this idea of. Why can't we write in real progressive. I'm not sure what all those labels are. But let's say that real aggressive as a You know there's the you know me four point for you you know i can sit there and listen to see for example and and there's not a thing. She says that i disagree. With think bernie sanders does a phenomenal job of framing characterizing. The issues presenting it. And you know by the time you get to the end of his speech you're commenced of as to what the right path is. Why look at those as being sort of ideal progressives but but in in oklahoma. If you put somebody up there that is just stay d. Just a progressive. Just somebody who is going to be on in left of center if he will They're gonna they're gonna lose the rural areas by forty percent. They'll lose them by thirty to forty percent and we can't make up that difference in urban areas and and depending on who's on the ticket and the time new ticket we got a midterm election here You know there's going to be a level of enthusiasm more than likely higher on the on the other side and And so it's a it's an uphill fight. Whatever you do but imagine if you have a problem solver a thoughtful person somebody who's values on education and healthcare and on A host of other issues is going to be much closer to the democratic. Party's values than than the republican party. And i think that's kind of where she got to. But imagine that person stepping out of a ahead or not stepping out of but coming from a statewide elected position as republican. I can't tell you how many people ran into the said. Oh my goodness i turn. I change parties because i admired joy hofmeister. I wanted to also beat janet teresi back in the day and so they changed parties. Vote for off meister in the in the primary against maurici and in the number of people who didn't change back we've already seen a bit of a blip on democratic registrations and it's those people coming back from having changed a registration reporter originally in that primary and so So what we're going to see. My my view is that you're going to have ten or fifteen percent. Maybe it's twenty. Maybe it goes much higher than that. But but i think that's in that.

"That after the show. Free point two billion money. Well yeah i mean it is it is let me most important thing is state does is. We don't have to handle national defense. We educate them world to that. I don't know it seems the better. It's a miles away but it seems matter all of a sudden somebody was running for office. We didn't know they were. i think. So what it tells you what we think about education and oklahoma. When we're forty eight per pupil spending rights that we always have to say we have invested. We gave teachers much needed raise three years ago but we are looking at things comprehensively high. It's not just about giving kids get putting kids in the schools. We have to address the trauma in all the obstacles that they face before they come into the classroom. It's not just about getting teachers a raise. It's about showing respect for teacher corps and invest in new teachers at emi teacher education and in professional development for all the emergency alternatively certified. Teachers can't just be a single magic bullet market-friendly decision policy here. We've got to do a lot of things together in strategically and to do that. We have to believe that our public schools can work. We have to believe in this next generation. Kids all of them. Not just the ones loo start with all the advantages it's interesting You mentioned that market market driven strategies right like sector. I say healthcare is one. There should be no decision. Market market principles should not apply to health. Care the same way right. Adhesion is the same way. And so then when you think of what happens on these so-called market based principles being applied to a public good like education. This is when you get gobs. Y'all who's like kevin state who doesn't even his own kids to pri- to public school extreme trying to tell us what we should do with our public schools I don't know what the invisible to the mark i don't know these adam smith interventions enemy of the time we let market-driven principals drive the banking industry to such heights that they caused the great recession. Two thousand eight wasn't lucky. The government was there to bail out the banks. And i mean if you think. Kind of like what safeguards we have in place right now too because we have seen a case that he and what kevin will do when he gets his hands on your agencies that are by and large not privatized right. He ought control of five remaining state agencies that were not privatized and my running thesis is he was going to privatize them. I've been right so far But i mean safeguards that we have in place as bifurcation of the department of education is not run by the governor. It is not run by a governor appointee although it certainly does get steered by his appointees to this but i mean these are very precarious checks right like there and i mean what are the odds. We're going to get a piece of legislation or how however it has to work with that. Be a joint resolution with that. Have to be a state question to get joy. Hofmeister position constitutional we'd have to amend the constitution to be atlit So but they would If one's man was going to win the election estates right the that would be necessary. Area do observe that as soon as the federal government handed cares. Act dollars over to the state. He did as much as he could. Put those dogs who private school kids much possible. I mean it's unfortunate for him. He has a record. You know like in the record like we know what he will do. We know his philosophy is we. No it has governing principles are its privatization it's centralization of power and privatization benefits a few those who are already connected and close to the close to the table. Well imagine when i was gonna ask were to really talking about here is. You're talking about statistically. I know eighty percent or more of oklahoma students who basically are going to be left behind. You're not only talking about urban students in the cores of oklahoma city and tulsa version. Which you really talking about rural oklahoma to and you have all these were rural legislator heavy under the dome the way that redistricting has drawn up And you have a whole group of people who don't seem to understand that there that the crown jewels of their community the reasons for existed in many parts of oklahoma or about to get blown up. Yeah it's one thing to have an open transfer system that moves kids out of district ada district the but if we go to a voucher system if we make vouchers universal and that's the rumors. That's where we're headed next. Then we're gonna move lot of public dollars into crowded schools and that means that the pie gets smaller all the public schools. Okay maybe you can benefit from the battery of their private schools can be to your community but in most of oklahoma there are no private schools. So you would think world Resist this the last round of elections. The the biggest opponents to these kinds of policies mysteriously lost primary elections. And i think a lot of people legislature took warning that if they got in the way of this also they'd be targeted That's really unfortunate bat. here's looking at you. Were on shore. I miss your arm and we all remember what happened to daryl censure bartlesville an excellent Strong independent voice in the republican party.

"More nation to batter state educational leaders generally and superintendent joy hofmeister in particular. She's been a favourite target upset because she refuses to kiss his while. Let's say his rain and he's long feared that she was the one republican who could derail his reelection ambitions. you'll recall. It was less than three weeks ago. That stood demanded. An education agency are even though it's arguably one of the most often agencies in the state government. The timing of it couldn't have been a coincidence. The governor is smart enough to know an audit like this probably can't be completed before the twenty twenty two gubernatorial campaign lineup is finalized leaving an innuendo filled shadow of wrongdoing over hofmeister meisters regime and should we mentioned that sticks cabinet secretary for education wants to be the next state. Superintendent public instruction so to help us understand everything. That's going on here. We invited state representative john. Walters join us. For this week's it's overcast a former longtime history trip tosses booker t. washington high. School waldron knows a thing or two about public education. Because he's seen a bigger to. John is really going on here. I'm reminded that fresno thanks for having me happy beyond the show. I'm reminded of the lawyer is defending man accused of killing his parents in vienna's defensive ladies and gentlemen of the jury pity this poor orpheum i mean. The garner seems to be trying to take advantage of of actions perpetrated or of general philosophy that tends to work against our public school system to further demonize attack public school system so we had a global hamic. It still raging. It's still making things very difficult for our students. And it's putting pressure on our systems at their weakest points to kids in poverty. Schools are in distress schools with the inadequate taxis. Because we're the middle of record teacher shortage neighborhoods without wi wi fi all trying to function but to do ordinary under extraordinary circumstances seem to be blaming them for not being able to keep under all this pressure all to advance nagenda. That will move more public dollars into private hands. So it's easy to be pretty cynical. About what the crowd. What's going on here in the larger pieces. Moving the ambitions of april seeking higher offices. The pity is that it affects her kids now. Our school system our modern day system. School accountability is very data hungry. It depends on testing to provide data to show that the systems bureaucrats are putting into place is working and unfortunately we see a lot of disruption that data system over the years the ada f system we use has been changed frequently so that we don't have good longitudinal data over the entire period of operation to make apples apples comparison show. We're making improvements..

"Approval of Pfizer Covid booster shots and all day hearing is underway and a recommendation from the independent panel is expected later today. There's a controversy over whether Covid boosters are needed. Boosters are supported by the Biden administration. Deputy State Health Commissioner Keith Reid says there have been a steady decline in the past couple of weeks in the seven day average of new Covid 19 cases in Oklahoma. It's possible that a downturn in reporting over the Labor Day weekend is contributing to this decline. And we'll know for sure over the coming days if it continues, But we continue to be optimism. "The little i'm arnold hamilton editor of the oklahoma observer. And i'm marianne martin and this is observer. Cast your weekly deep dive into oklahoma politics policy powered by the oklahoma observer. Democracy foundation today is august thirtieth and the kovic numbers for the state. Where seventy eight hundred. For the past three days This marks yet another precipitous rise and increase in cases around the state. It's no coincidence. That higher education reconvened a week ago. our schools across the state have reconvened. An schools have been in session and the one and kind of interconnecting piece between all of that is that none of them are allowed to Mandate masks in the classroom agencies are aren't allowed to mandate masks but most importantly our school children are not required to wear masks in class so a teacher cannot say all students must wear a mask. Miss classroom And it has put a lot of educators and parents In st staff across across oklahoma in a really uncomfortable position about what to do. And we've talked about this here on observer This is a result is a state senate bill sixty eight but the past couple of weeks. We've seen the biden administration step in acknowledging that there are a number of states across the nation that have implemented bans on masking in schools. This comes as specifically the bottom. Half of the nation sees a drastic increases in cova cases. the same states that are getting just got lashed by hurricane ida this weekend have hospitals completely full That now cannot respond to those in need because of the hurricane And these are states that all tend to have Masking bands in their schools and so Within the past couple of weeks the us department of education has issued. I a letter and then today announced an investigation into states with masking bands in their schools. Today we found out that oklahoma is one of those states that is now the subject of civil rights investigation from the us department of education To get an understanding of what this means What this kid portend for students in oklahoma we are um very fortunate to be talking with state. Superintendent of instruction joy hofmeister once again One day we're gonna talk about beautiful budgets. Unhappy kids in classrooms and all the wonderful big things that we want to do with our schools But stay we're talking about a civil rights investigation for our special needs students So a superintendent hofmeister. Thank you for joining us thank you. It is really good to be with both one day. we'll do. We'll have a happy episode. I believe it in my bones. We will have a happy episode. I'm ready for that meeting in one day. Just not today. so Superintendent can you walk us through the timeline of these letters from the department of education. And then maybe tell us what they actually mean for state school systems. There was a letter that alerted all states. that there could be future saps coming related to The need for more. You know more Widespread mask wearing in Various school districts all across the country today This morning a letter came specifically directed from the office of civil rights to oklahoma As a result of The state law that was passed which is really preventing schools from there for from completing their duty to protect students and also Having children with their full opportunity to learn And particularly with a focus on children with disabilities So we are not surprised by the civil rights investigation. How will The oklahoma department of education be working with the us department of education in this investigation. I'm not really sure what will be. requested But i think this is really focusing in on the inability for local school districts to have a mask requirement with outbreaks of the delta variant and in conjunction with their public health officials. So with that being prohibited Then you can see that. The sets up a scenario for civil rights violations for particularly children with disabilities and other Federally protected student groups. So i feel like we should maybe explain why we're talking about these these children in particular. Why is it all children and covered under this. What why how. Why are they zeroing in on The for children with special needs into savell. I think that From a physical standpoint of the protection that Cove ed Public health strategies Our our fiscal mask wearing or Facial shields were ensuring that people are vaccinated that come in contact with students that cannot have a mask or Do not have the ability to have those own protections voluntarily On themselves and so we do have a duty. A legal duty to protect children and We also in schools have The duty to and responsibility to provide an opportunity to learn Where everyone is Treated the same where it's not differences based on stats and That's a particular focus with the federally protected. Student groups children with economic disadvantage children with disabilities are homeless. Children children with english learners So there's a variety of directions. This could go. But i think it's really focusing more on the inability of local school districts to provide that protection due to a senate bill six fifty eight. I have thoughts. I'm just trying to gather them together. Are well so obviously. What is of utmost concern here is. That lives are at stake. We're seeing the Delta marian outbreak particularly hitting a children hard of course of our public school students in oklahoma were not yet at age where they can be vaccinated yet. But it's also sort of implicit in all this. Isn't it that that That oklahoma's The oklahoma legislature's decision to you know basically bigfoot local control here can also result in a fiscal penalties for the state and it's not as if public schools oklahoma are awash in cash. In and you know have more run right and You will see me. Come unglued if this has any kind of financial penalty for school districts that had no say in this piece of legislation and what that might mean for the children they serve and i would also say that it is typically The position of the us department of education to seek courses of.
