What's in the Muller report? They don't have a concrete idea in part because they like the rest of us. Don't know what is in the report. So it's really hard to push back on or respond to something where you don't quite know the content. I will say some people I've spoken to there. There is a plan people are reading it's maybe perhaps less of a plan than you might expect. But they are sort of going through what they think are the most likely scenarios to come out of that report in reading different responses accordingly, but you can imagine. President Trump if it turns out that he is completely exonerated as he claims he will be having a very different response than if the report contains some sort of smoking gun which to be clear, no one in the president's or believes will happen. So if they react negatively to this reports, given the way we've. The way we've been seeing them react does that does that necessarily mean. Or can we interpret that as meaning that there's something bad in the report for Donald Trump? Whereas if they react positively and they wanna use it to their advantage. And that is a tell that they feel that they were exonerated can we read into their their behavior? Well, I think I think some of their behavior will be in response to what if any is actually made public by the attorney general so so that will be kind of clear and fairly transparent. But then people you talked to you would expect right now, are you might expect at least the White House to be incredibly nervous. As we mentioned this, the polite way to put it mixed messages tonight coming from Rudolph Giuliani, I'm whether or not Trump will answer Robert Muller's questions on obstruction of Justice. Earlier today, Giuliani told our guest, Jonathan Lemaire of the Associated Press that President Trump would not answer Muller's questions on obstruction of Justice in writing or in-person quote. That's a no go. That is not going to happen. Giuliani said, there will be no questions at all on obstruction. Meanwhile Giuliani tells NBC news earlier tonight, that obstruction questions are quote not ruled in or out. We have asked Jonathan Lemaire to stay with us for this conversation and joining in the conversation. Chuck Rosenberg, former US attorney for the eastern district of Virginia. Also a veteran, former senior official of the FBI. So Jonathan, because we're talking about your interview. It's been said one side of this matters, not what Rudy. He says, but when does it start mattering? These changes back and forth just and then the time since your interview with him? Yeah, I really Johnny. First of all, this is not the first time he's been inconsistent, right? And certainly his as much as he is title is president's lawyer. He's far more president's legal spokesman being more the public face of this, and part of that is to sort of move the goalposts onto what would need to happen for the president is sit down interview with with special counsel, but also to shape public perception as to what that interview could be eventually with. Of course, the endgame being Muller, we believe, write a report that end up DOJ to congress, and they'll make that decision and he's playing to those congress members into the people vote for them. That's where he is. That's his target audience, but as much as he gave mixed messages later tonight, he couldn't have been clear with me when we when we spoke earlier this evening, suggesting that two things that there would be no, ma- no questions about obstruction. The president would not feel them either in terms of sit down. Interview or written though he did not discount the idea that he would take some written questions on the Russia collusion angle, and that's in response to the Muller teams. Most recent letter just from a few days ago signaling that they would be up for written questions on obstruction. But Rudy was very careful again to change the move those goalposts just a little saying, well, we might be up for that that we really wanna talk about the idea of follow up questions. We want to know. We're not sure we're going to be agreeing to any five questions and we want to have that matter settled before the president answers. Anything at all. Okay. Chuck you're out in the Pacific, northwest, and thank you for taking time out of your trip to join us. Does any of what Rudy says matter? And my question to you is because Muller cannot speak and will not speak, what should we know about how the feds view all of this? Right. Good question. And I'll be polite to use the phrase mixed messages. Brian Rudy has been Mr. Giuliani has been consistently inconsistent. It's absolutely stunning, but. It's no longer surprising. But as a former federal prosecutor, I can tell you this while the Muller team would like to speak with the president. In fact, they'd like to speak with everybody who's involved at this investigation. They don't have too often in federal investigations. We don't get to talk to the target of the investigation. He's abroad or he won't speak with us or invokes is fifth amendment privilege not to speak with us. And so you can finish an investigation without speaking to the president. If Bob Muller decides he wants to push the issue, regardless of what Mr. Giuliani says, he simply issues a grand jury, subpoena and litigators that I don't know what he's thinking about doing because he won't talk..

"And that's let's assume that Bob Muller and his team actually do contemplate either cutting down the scope of the questions or offering some written questions in lieu of an actual sit down interview. It may. Very well be that. The the mother team believes that any questions being answered by the president would be important for two reasons. One, it may very well informed the investigation about among other things. The president's thought process, his subjective intent to see whether when he was doing the things he is alleged to have done. He was doing it with a corrupt intent, and then to I don't wanna be cynical, but it may very well be that Bob Muller and his team are willing to negotiate the terms of the interview a little bit just to have the opportunity to interview the president because I think we've all seen the president has real challenges being consistent in his answers from one day to the next from one tweet to the next and the Muller investigation team knows full well that if the president answers questions either in writing or in an interview setting. And he lies to federal investigators each time he does it. He violates eighteen United States code section one thousand one for lying to federal investigators and each time he does it, it carries up to five years in prison. So the Muller investigative team may very well want to give the president the opportunity to be his own worst enemy, Jonathan Lemaire Glenn one that we just mentioned Rick gates. His name is metaphors, longtime deputy. We know he, of course, also talking to prosecutors. What's the significance of why he suddenly is not going to be testifying, walk us through what that means in this trial and going forward. Sure. And actually, if we dig down a little bit more, I was a federal prosecutor for thirty years. I put countless cooperating witnesses on the stand, and if I was going to call that cooperating witness at trial, you can bet I would stand up in front of the jury and opening statements. And I would say, ladies and gentlemen, let me explain what a cooperating witness is. Let me let me tell you that even though the cooperating witness had his charges reduced in exchange for his agreement to testify truthfully against others. If he lies in court all. All of those charges are revived. He's facing more time in prison. He's facing perjury charges. He could be facing excessively after the fact charges if he lies in court. So the cooperating witness has everything to gain by telling the truth and everything to lose by lying even ally that might make it look like Mr. Manafort is more guilty. The reason I'm doing that in opening statement is because I want to be the one to frame for the jury, how to receive information from cooperating witness, will guess what? What I talked to people who watch the opening statement, the prosecutors in the eastern district of Virginia case didn't open like that. They open very generally on. Well, you'll hear some information about Mr. gates in crimes he committed. It may be that the prosecutors sort of lulled the defense team into thinking they were going to call Mr. gates and they may not call them at all. And I think you know, President Putin doesn't take tough questions from journalists, very often. He does occasionally have these really long press conferences. But I, I think that the having a tough question from an American reporter is probably not something he gets on a regular basis and he bristle that a little bit, and but he was also pretty direct. I mean to my last question to him when I asked, did you want President Trump to win the election? He gave a very clear response, which was yes, I did. And did you get from that because because because because what I heard was did you want President Trump to win the election? And did you instruct your people to help him? That was correct me if I'm wrong. That was the full question right. No, you're right. That is exactly right. That is the full question and I, I don't know how to interpret the answer. Yes, I did. I think there's one interpretation and it's probably the most logical, which is that he didn't hear the second part of my question. And the reason I think that's logical as he had spent a good chunk of his answer earlier saying there had been no collusion and the same way the President Trump had that said, I did. You're right. I said in my question, did you want him to win? And did you destructive wanted to help him? And his answer was, yes, I did. So you could interpret that as being not only did he response to the first question, but the second one is well. President Putin said several times or at least one time in this conversation that he's a former intelligence officer, and you know, some people interpreted that as a dog whistle. Essentially, listen, I knew what I'm doing here and I know what it is that I want you to get from this, and I understand very well how to answer these questions, even though supposedly your intelligence community has all this intelligence on us and has indicted twenty-five of my friends, but I'm still not going to say to you, anything that you can use to essentially put me in the in the heart of this. What was your thinking after he did the circuitous answer to your questions and your your colleagues questions? Well, you know, I just think I think President Putin is is very smart and very happy to show the confidence that he has, and he's a politician in addition to being a former spy and the KGB leader. And so he he knows how to get around tough questions, but he also knows how to show dominance. And I think I think it was a chunk of all of those things that he was displaying in those answers.
