That's me of course your host and today we're here to tell you. The heartbreaking story of john jones was just seventeen years old when his six month old daughter. Jada ruiz died and shortly thereafter. The tragedy was compounded by the hubris of some in the medical establishment and legal system armed with the junk science shaken baby syndrome. And today i'm joined by the nominal co host. Avid listeners will remember. Greg glad from the junk science episode on roadside drug testing. He is the criminal justice fellow at americans for prosperity gregg. Welcome back wrongful conviction. I appreciate jason. Thank you so much for allowing me to co host. You know you. And i have gotten close over the last couple of months. I've been working on criminal justice reform since about two thousand fifteen now and to be able to do this today. And co host is really an honor. So i really thank you again. Well i'm the one who really should feel honored and not just because you've joined us but also because with us is one of the world's leading experts in the most troubling aspects of our criminal legal system shaken baby syndrome now. She was also featured on wrongful conviction junk science when we covered this subject the executive director of the center for integrity and forensic sciences kate. Hudson welcome back to wrongful conviction. Hi thank you so much. Jason hi greg and last but not least we have with us. Staff attorney at the ohio innocence project. The man who's representing. John jones. Donald caster donald. Welcome to wrongful conviction. Thanks for being here jason. Thank you for having me on. And we'll be joined very soon by john jones. Who's going to be calling in from lebanon correctional facility in ohio. But first let's get a little background on what john was up against when jada became unresponsive. Kate can you give a brief history on shaken baby syndrome. You know where it came from this hypothesis and then how did it start to enter. Its way into the criminal justice system as as a viable scientific theory to convict. Caretakers of murderer sure. Greg shaken baby syndrome was originally proposed a hypothesis to explain a phenomenon. That appears trich neurosurgeon. In great britain was seeing in his patients he would sometimes have infants. Who died or were seriously ill without a clear. 'cause without external trauma and yet the internal features looked a lot like kids. Who had suffered some kind of traumatic injury. So those findings were subdural hematoma which is bleeding between the coverings of the brain retinal hemorrhage which is bleeding at the back of the eye and encephalopathy cerebral birla dima which sort of acts together as one lag of what sometimes people call the triad cerebral denies brain. Swelling and encephalopathy is brain dysfunction. So dr gus kelch. The pediatric neurosurgeon was seeing these findings and kids. They looked injured on the inside but not on the outside and he thought that one reason for that might be a common disciplinary technique. In his home of northern england in the seventies which was shaking. and so what. Dr goth kelch said is that these medical findings could be due to shaking and dr goth. Kelch wasn't claiming to have the answers but rather that he was hypothesizing about what might be causing these findings so that started to evolve a radiologist in york john caffey built on that and he published articles saying the same thing right. That parents should be gentle with infants. But neither of these doctors suggested that the medical findings that they associated with shaking were exclusively diagnostic to shaking. Nor did they say that. There was a reliable way to place blame on a caregiver when a child had these medical findings right and show where was the switch than from vicious being a hypothesis or an unexplained phenomena to a verifiable medical diagnosis. That actually began convicting visuals of murder. Child there's a little bit of a gap in understanding between the mid to late. Nineteen seventy s and then when we start to see. These cases appear in published appellate decisions in the late eighties and we started to see prosecutors and pediatricians in particular also pathologists saying that when children had this collection of findings which is sometimes called a try of findings or a constellation of medical findings. That shaking could be diagnosed. And that's when it comes into the criminal legal system and we start to see the trajectory that we're on today where parents are wrongfully accused based on only the existence of a particular set of medical findings. And i mean to be totally clear. There's no debate about whether abusive shaking violent shaking. An infant is dangerous. It is and no one should do it. The debate is really weather. Shaking reliably explains the findings that are often attributed to it whether shaking can be diagnosed as the cause of those findings. Kate and doing my research for this. There is a large concentration of these shaken baby syndrome cases in the state of ohio. And so i. I just wanted to see if you had any explanation behind. Why ohio kinda had a higher rate of shaken baby syndrome cases than than many other jurisdictions across the nation Researchers aren't one hundred percent. Sure why some places have higher concentrations of diagnoses of spf than others. It's probably a combination of factors but some of those factors include prosecutors. Who are particularly aggressive in going after these kinds of accusations. The media attention certain cases receive in certain media markets and the child abuse pediatricians or forensic pathologist to work on these cases if they have a particular belief or bent than there are more likely to be more accusations of shaking within that person's jurisdiction our area of control in ohio is one of those places. Now we'll go to lebanon correctional facility to speak with a young man who was doing his best as a young teenager to raise three kids while finishing high school in the third largest shaken baby syndrome epicenter in the country akron. Ohio prepaid call from an inmate at eleven on correctional facility to accept this call. Press niro to prevent this call is from a correction facility and is subject to monitoring and recording. Shame on my father's will have the same regardless issues going through her own. Personal pilot's was a while she was always with us. But my grandma end up getting has given me when i was real sea. Just put us on a path to try to be as you said we could growing up. They're going to school. Always on arose came teenager national. I can't contact with my child's mother. I met her semi sixteenth. My fourteenth birthday and i signed with can see as later all christmas eve. Christmas so now fourteen. I'm expecting a child on the way. I knew that i had a responsibility so school.

"The pandemic made existing economic inequalities in this country even worse. So what does the biden administration plan to do about that. Npr's asia roscoe talk to john jones chief economist at the labor department and the first black woman to hold that job employers added more than nine hundred thousand jobs last month. That's a banner number for any administration and the unemployment rate dropped to six percent but general jones. The first black woman to serve as the top economists for the labor department says you have to dig further into those numbers whenever someone tells me a headline number or tells me the economy is doing really well. My immediate follow up question is for who and who's being left behind and who is not included. The answer as it has been for years is a lot of the country that is not white or male with the growth in vaccinations. Businesses like restaurants and hotels are making more money and hiring more people. Jones says that's good news for black. And latino women who are over represented in the leisure and hospitality sector. Still unemployment only failed to seven point nine percent for latinos and nine point six percent for african americans if the overall unemployment rate was nine point six percent for all workers we would be running around with our heads on fire that is crisis levels of unemployment and jones says that even a return to pre pandemic jobless levels will not be good enough for many people. During the trump administration the low unemployment that preceded. The pandemic was promoted as a top accomplishment. Here's former president trump. In his farewell address we reignited. America's job creation and achieved record low unemployment for african americans hispanic americans. Asian americans women almost everyone but even at those historic levels. How big was this win. For derek lewis in the in the grand scheme of things that heavyweight. The race problem in economics

"The American Economic Association or the A is the biggest and most important professional organization of economists in the country, and it recently made a statement saying that it had quote only begun to understand racism and its impact on our profession and our discipline. Black economists are severely underrepresented in the field of economics, according to a survey from the EA. Only about three percent of economists are black. Nearly half black economists say they have experienced discrimination in the profession, and only seventeen percent of black economists agreed with the statement that quote. People of my race are respected within the field, and this matters not just for the economics profession it matters for how all of us understand the whole economy and. And it matters how economic policy gets made John Jones is an economic analyst and the Managing Director for policy and research at the groundwork collaborative. What we have learned right now. Is that like we have a worse understanding of the economy because we haven't been listening to economists of color like we're actually worse at economics, because we have denied a voice to folks who understand the different way, so here's an example before the financial crisis of two thousand eight, the unemployment rate for black Americans started rising earlier and more sharply than the unemployment rate for White Americans. In fact, this often happens before recessions, and if there had been more black policymakers or black economists who were advising policymakers. Who understood this dynamic black workers are often the first to lose their jobs before a recession than it is at least possible that policymakers would've reacted more quickly to help the economy, and you might have also had new in different ideas for how to help the Economy John L. Herself along with the economist. Jared Bernstein recently published one such idea. It is a proposal that the Federal Reserve should focus explicitly on the black unemployment rate when it makes decisions about managing the economy, black workers restorick starkly have been roughly twice as likely to be unemployed as white workers, so according to Gino's proposal, focusing on the black unemployment rate would ensure that everyone benefits from A. A strong economy, and as for how to get more economists of color into the economics profession, Juno says one idea is for there to be more. Black economists included among the gatekeepers of economics at universities and economics journals, who are the editors at the top journals who are the deans who recruit new cohorts Janelle release this idea to an early experience of her own. When Economists Sandy dirty recruited her to Duke University, her own career and her contributions to economic ideas, she says might have ended up on a totally different path if he hadn't done that. Economics is a tool that's used to inform. Policy is very problematic, so a reckoning would mean that there would be a culture shift. Shift in economics, a number of block economists have also said that they were discouraged early in their careers from studying topics about race and racial discrimination, because they would not get published where they would not advance in the profession, recent study looked at the almost fourteen thousand research papers published between Nineteen, Ninety and twenty eighteen at in the most important economics journals. Journals. Only a hundred and five of those papers impurity tested for different kinds of discrimination, including racial discrimination, though fund is quick to add that there are some economists who have long been doing the work of trying to understand the effects of racism and racial discrimination on the economy. She points to journals like the review of black political economy which is published by the National Economic Association. It's just that this is not really widely read or widely embraced within the mainstream of the economics profession.

"Back in December of two thousand fifteen, the Federal Reserve decided to start raising interest rates. Just another way of saying that the Fed had decided to remove some of the support that it was giving the economy. The idea being that overall unemployment was low and economy just did not need as much support anymore. At the time, the unemployment rate for white workers was a very low four point four percent. But for black workers, it was eight and a half percent almost twice as high. So the Fed was taking away support from the economy when the labor market for black workers was still kinda scandalously tough, and that was not the first time this had happened John Jones is an economic analyst and the Managing Director for policy and research at the groundwork collaborative. The Federal Reserve whose job it is to. Make sure economy is working for workers has never done that for black workers. That is that is terrifying also that. A policy choice in a decision that we can make differently. And at the moment the Fed is once again providing support for the economy to help fight the recession from the coronavirus pandemic, which has been especially devastating for black workers as do now points out. It took ten years for black workers. Employment rates to raise by ten percent, and that will be wiped out in two months like that is how. That is how susceptible black workers are changes in the labor market. Something that takes a decade is wiped out in sixty days so naturally. Journal is worried about what will happen in the future when the economy starts recovering. Will the Fed once again start removing its support before the labor market for black workers has fully recovered. To avoid that outcome journal along with economist Jared, Bernstein has come up with a formal proposal that would compel the Fed to directly target the black unemployment rate, not just the overall unemployment rate,
