"And impairment of the local economy There's an organization called save greeley's water. They've submitted petitions for ballot initiative that would ask voters whether water sales exchanges subrogation trades or leases or more than five years by the city. Should i be required. Undergo a comprehensive engineering study before being taken to the greeley voters. Another ballot initiative would ask voters whether the purchase or leasing as well as providing of any groundwater and recycled wastewater should undergo a similar process. Well this sounds like they've got enough signatures they Most have at least thirty one. Oh one turned in forty three thousand one hundred one. They turned in four thousand two hundred. They're probably valid and it'll make the ballot. But here's the problem with this thing. And i agree with the city of greeley that this is a very troublesome ill fought in. Ill advised piece of legislation Here's why water is something that is really a property right We in the whole citizenry. Some of his own water some of us do not those who own it make it available to those of us who don't have it we can rent it or we can buy it from our city treated so that we can drink it and so on these water rights though are really important here in colorado The i got involved in this thing. And i couldn't believe that i went to the website of this outfit called save grease water. It turns out. They have put a document on their website of something that i wrote as an opinion piece for the fort collins colorado and in two thousand fourteen and i have yet understand what it is that i wrote that they think is important enough to put it there because i never mentioned greeley in what i wrote. I was writing about halligan reservoir. Now those of you who understand the way the putin works right up at what they call gateway park which used to be the old fort collins treatment plan that's now turned into fort collins municipal park up there That's where the north of the puzder comes into the main stem. The north fork coming from areas up higher. Oh even around beaver meadows that that whole area in that part of the county It all runs incomes together right there and from that point on you've got the poodle river greatly enhanced as it were by the north fork but before the water gets through the north fork into the main stem. There are two dams up there. One is called seaman reservoir. The others called halligan. Reservoir city of fort collins owns halligan reservoir. The cd agree on seaman. And there are discussions all the time. About how those two water rights that fill those reservoirs on the north fork work together and and that's fine. I mean it's it's all good that they have those water rights. But here's the point of this whole issue of water law. It has very complex. It's based on decrees and so on In the piece that i wrote and let me see if i can grab it here. I called it. Halligan hassle could lead to water fight and this was back in two thousand fourteen. Let me just quote to you from what i wrote. Then you can see what you think this may have to do with what this saved. Really water organization is trying to do with their ballot issue. I start out. Mark twain is often quoted. Liquor is for drinking. Water is for fighting given the loss of one thousand nine hundred five conditional water right to thirty three thousand four hundred sixty two acre feet of water on in the north fork of the poodle river due to the city. Waters lawyers failure to file a required report. It seems to me that some kind of a fight could ensue. Well yes the. These lawyers did not file in a timely way to preserve a water right and as a result. A nineteen eighty-five conditional decree that for colin zone. Suddenly became a two thousand thirteen decree. And according to this story by kevin dugan who's no longer with the colorado embiid a good guy and a good reporter he talked about how this could actually diminish the value of that water. But it's all talking about fort. Collins water in halligan reservoir. It's not talking about anything to do with greeley's water He he described what happens in colorado water rights in. This is a very very important thing to understand if you're into water and you know what i'm talking about if you don't listen because this is how it works and it's described as and this is what i put in my in my story It's compared to people with different size bowls getting in a line based on the year of their claim to receive water from established source in. It's kind of like fillon. Fillon their their bucket The people who are in the front of the line get their bucket completely filled to whatever size there bucket. Is they get it all. Then as you work your way down the line to people with a less senior right to that water they may or may not get their bucket full as a matter of fact that the end of toward the end of that line everybody at the beginning of the line with the senior rights their book at full there is somebody there who's going to get a portion of their bucket full and everybody from that point in the line on gets nothing. The water is not divided equally by everybody in the line. What it is. It's put their according to their right in their date. And so having an eighty five contri- conditional decree would be better than a two thousand thirteen but those are both so down. The road so to speak in terms of decrease water decrees began in colorado in the eighteen sixties in actually greeley's in a good spot because on the puzder greeley has some water rights. That are the very most senior among the most senior water rights on the poodle river cough for collins tests. I'm pretty good ones to. There's are not as good as greeley's but but they're still good rights and they get filled up. Most of the time well halligan. Reservoir was being discussed as an possibility to expand it. And at this time. When i wrote this in two thousand fourteen the army corps of engineers who determined all this stuff. We're in the process of doing environmental impact. Statement on the expansion of halligan by fort collins and Also the north putin irrigation company. They use that water as well and have rights. They're nowhere in this story. Do i ever see greeley. Do i ever say semen. Do i ever say anything. And i end the story that i wrote this little wilson opinion piece actually and i said then there is the statement by colorado. There's the water resources. David nettles in an email to the colorado quote there could be periods when in one thousand nine hundred five would be an effect but not two thousand thirteen right but that will happen a few days a year at most. He's trying to say that even though these lawyers screwed up and didn't file on time and had to come back and get a lesser decree that this is so far down the list that it may not be even an issue. And then i go back to my my point that One thing's for sure waters for fighting the so. I guess what. Maybe these save the greeley water. People are talking about or that. They're just fighting. Like i said everybody would but we have fought over water historically in northern colorado ever since my great grandpa dug a ditch to get water out of the little thompson river when he homesteaded near birth. I mean it's just been going on. That's what we have. Water rights are major and the price of water in northern. Colorado has just escalated immensely immensely. But we've got people with thought forethought foresight who created water rights for us. Here we've got the big thompson project. Could you imagine what would happen today if somebody said. Yeah joe this is a great idea. We're going to go over on the west slope and we're going to pipe some water all the way from grand lake and we're going to build two reservoirs downstream from grand lake so that we can pump the water back and keep grand lake full all the time with the runoff that runs into those other reservoirs grabby in shadow mountain to be specific and then we are going to drill. Dig a tunnel right underneath rocky mountain national park. It's going to be over eleven miles long. Len point one levin point two miles long. it's going to be nine feet in diameter. You could drive a jeep through there. And they do by the way I wanted to that trip but nonetheless how would that. How would that do today. If somebody said yeah. We're going to do that. But those are the people here in greeley to bmw far for instance. Who is a hero in my mind to make this a place that we can all live because without that water that comes through the big thompson without doubt water that comes down the polluter without that water that saved up as high as joe wright reservoir halligan reservoir seaman reservoir on the putter in. It's different Tributaries we we would be in bad shape. Folks here we. We couldn't live her. We just couldn't live and all the fields that you see out there that are so lush and green and growing things that we can eat would be no more. They couldn't exist. You can't even grow at decent. Greece graph greece grass grass cropping in colorado with the with the moisture that we have so anyway. Yeah waters for fighting. But i'll tell you what you need to fight against. You need to fight against his goofy idea. That's being put forward By save greeley's water then this is all based on the aquifer up in the terry ranch and it. This is a brilliant idea by the way to have the terry ranch aquifer come into the greeley system. It's it's genius genius do it. Let do it whatever these guys want. Don't vote for it. That's just my suggestion and I'm kind of set to go here. We're going to be back here. Just a few closing words right here on mornings with gail john clarkin northern colorado's voice one.
