Statistically wise like what his productions going to be as he changes roles from from. You know the jacksonville defense to this defense. But really if you watch film. He is more of a thumper he's going to be that guy who can who can mix it up in line take on blockers stuff to run. He's not bad in coverage either at least at the level he's playing now which is kind of the second to third string Players for the other team is what he's been facing and he's shown pretty. "Was that a one time thing and he will never ever do it again, because of either medication or treatment or time or the evolution of disease, or you know, is ticking time bomb? Is that something else that's going to happen? And, you know, a lot of times, you know, I don't think it's unrealistic to think any of these people, for example, that have been, you know, the that are subject of this are going to be put out on the street anytime soon. These are people with serious mental illnesses. And so, you know, they're likely to be in that system for a long time. But the question becomes, you know, when do they get out and for psychiatry, that's when they? Present. No further danger to themselves or others in there, symptoms, or condition is under control in that doesn't correspond to a particular sentence on the other hand that may be longer than a traditional sentence, because, you know, one somebody serves full-time, they're no longer under supervision anymore. You know they get out early on probation. They'll be on probation, but once that's over. It's over and soda supervision of them, the mental health system. It reminded, you know, famously been talking about it for years, being basically short Abed's at a variety of different levels of risk, and so on. And what about that? I mean, we're going to suddenly start relying on the mental health system. More to pick up people who might historically been taken care of by the criminal Justice system. And what does that mean why I think it's a constant tension between the two worlds a hand. You know, it's always been this kind of question of do we have the facilities. In the criminal Justice system. It's the same question because they can't make you do, for example, therapy, so times we see people are sex offenders that go through the system and refused there in any way, shape, or form and can't make them do it. And they're limited on what they can do it depends on what facility you're at. But yeah, the meant certainly this is a big question for the resources of Vermont's mental health, hospitals and treatment centers. Sara from Waterbury is on the line. Good morning, Sarah. Yeah, I just stepped away from the phone, or may have missed something that was related to my question. I was wondering regard to Mr. Heinz. It's my understanding, which not be accurate that, you know, it's on his condition is controlled through medication. And so what is, you know, if he's not taking that medication he might be more of a risk, and I wondered how that's handled when he's not incarcerated. That's a really tough question. Obviously there, there are issues now would we'd probably very quickly. Get into confidential medical confidentiality, actually, as to whether an individual is taking his medication or not. So maybe difficult to find out. Exactly what the status is of any individual in the system that would be one aspect of it. And, and but I know meanwhile on the other on the other side of that equation, there is some question of public accountability here. I mean obviously very note, notorious incident attributed to this to this man. And does that enhance a sense of public public accountability should there be more more disclosure after something like that happens in individual cases hard to hard to know? Exactly. I do not know you know how this individuals medication regimen. Waxes are Wayne's or whatever I just, I don't have any information daddy of any thoughts on how you would how should the state respond to that question like that? Well, I you know, I think within any type of persons treatment plan like he has there's a requirement that he take his medication. And if he doesn't or there's evidence. That he's not. They can go to court and I used to work for judge who used refer some of these mental health hearings is take your med cases because you can go to court and make somebody take their medication. If they're if they're not or they, you know, that could be the underlying for recommitment. So I mean there are I don't think this is person is probably sort of free wheeling around. I think there probably is some sort of psychiatric component that he is regularly attending to. I mean at the very least to have these medications he has to have regular physician treatment. And if there's evidence that he's not following that treatment than, you know, there can be steps taken to forcibly either return him to some medication or to commit him. Does that help? In the last few minutes, we have to go here on the give and take between the governor and, and the chimney county state's attorney Sarah George this week. The don't seem to be happy with each other yesterday today. What's going on here? I would imagine not. Well, it's, it's interesting. I mean, the governor has done this in a few cases where he's taking a very public stance about something involving the legal system. And, you know, he has not sort of gone through back channels. He's made it as a public issue, and has stated these concerns very plainspoken manner, and I think one that, you know, is aimed, not necessarily at, at the person, receiving it, but at the public to, you know, you know, articulate his concerns in this case, you know, Sarah, George is the Jenin county state's attorney, and she has. Has the final say in her office? The governor can't order her to do something otherwise than what she's done. She is the final say, nor can the attorney general. I think what the governor's letter has basically said, is attorney general take a second look at this, and because the general does have independent authority to bring a criminal action under the same. Statutes, I wanna stop you there and ask you about that really nail it down. Because my understanding is, for instance, MS George's letters in these cases said they would be dismissed without prejudice, which I gather means that they could be refiled charges. Okay. So, so that means that the Torney general is free. If, if he and his office, wish to step in and say, for whatever reason jitney county state's Arnie's declining to prosecute here, we're going to prosecute. Correct. Okay. And that's and that's typical. I mean that's the overlapping a thority that the attorney general a lot of states attorneys have. And, you know you saw that, for example, in the herring case where. The state's attorney was recusing his office and the general stepped in and took over the case that made sense there because right, state's office was quite involved in, and then, you know. And in this type of situation. I mean, you know, governor Scott's letter is, I would say, more political than legal articulating concerns that our concerns of the general public, they're not he doesn't have legal authority to oversee these cases. But he's our ticketing concern that he feels needs to be articulated. And then, you know, he sending it to turn general. But again, he can't make the attorney general do anything additional either the general may review this and say we agree with the state's attorney for these reasons or they may come to a different decisional together. And by the way, I did reach out this morning to TJ of these general of Vermont, to ask them to see if he would be willing to come on the show and talked about this and see whether he might as office might take these cases very short notice. I knowledge and so I apologize for that short notice, but TJ Donovan was unable to join us this morning. Perhaps we can follow up with him next week. Sure, other media. Making similar inquiries to the attorney general, we may hear something today about what he's what he's saying in terms of his willingness or, or ability or feeling like there is any reason to, to sort of second. Guess jitney county state's attorney here, wouldn't expect an answer this week from from his office, because, you know, let's be honest, it's really going to be the criminal division within his office. It's going to take a hard look. And while you know, the insanity defense has this sort of non medical language in practice, and in reality, and these cases, it's all about the experts and submit a valuating the expert review and it's, you know, I think Sir George is decision was really based upon the expert witnesses that she had the reports that they had received they looked at the legal standard, but, you know, evaluating the credibility of these expert witnesses and the likelihood that they would be believed by jury given this medical history. That's not something I don't think his. Office is necessarily going to be able to solve turnover on a quick base of snap judgment. Okay. Yeah. That makes sense. But I mean I ask their Joe shower. But I don't know how we stumble into any conversation on our show the most famous person that you have stood next to at a urinal. And so this is funny because I blurted out Bobbio hito many of the Mets in the eighties lived in my town when I was growing up. So I saw Barco thin McColl's all the time. But anyway, might you remember this Michael junior? You remember we did the fantasy marathon many many years ago. Right. Absolutely. And so for me growing up. It was really like the first time they had been up in Bristol and Adia. ESPN, and I grew up a fan, obviously, ESPN and watching all these guys, and I gotta tell you. I remember texting Vitor so many strange things happen during that during that twenty four thirty six hours Mike ever we were locked in that room. I found myself brushing my teeth in a bathroom with Tom Waddell. I found myself taking showers and the dungeon somewhere and Bristol Connecticut. Go Joe, Toby Schefter told me there was a shower in their go Joe shower as well you have to be thankfully. But I remember standing next to to try wind up who is not here today. And I was standing next to him at a urinal, and texting Dan, I grow up your big fan of all these guys who are on ESPN. And I remember I remember texting Dan saying, hey, I am standing at a urinal and to my right is Trey wingo, and to my left is Adam Schefter and three cellphones. And it was the greatest day in history my life. I don't even know what to say to that. I'm speechless lame. I drew the fact that Stu gods who is not that much younger than Trey wingo grew up a huge fan of Trey wingo. Gotta gotta kicks this one.
