"This's America changed forever from the CBS Audio Network. I'm Gil Gross. The United States is deep in a debate about police procedures and reforms. It's not a new debate, but it's one of the many sorts of debates and flare up after incidents and Then recede again after a few weeks, But not this time combination of videos and police chiefs and mayors, frustrated by efforts at reform in the past, seemed to have left the country in a mood to do something. This week, the House passed a police reform bill headed to an uncertain fate in the Senate. Congressman Jim McGovern is a Democrat and chairman of the House Rules Committee. Jim Good to have you with us. How are you? I'm doing fine. Happy to be with you before we get to the Justice and policing act and some of the things that are being considered in Congress. What do you think has changed Because we've had incidents like the incidents in the news before. We've had this conversation before, But it seems the public mood is very different. You're right. I mean, this is Not unique. Unfortunately, we've seen these kinds of murders happen Time and time again. You know, one of the things that I think made a difference here is that young teenage girl videotaped all of this for the whole world. To see anybody who watched that video had to be horrified. And as a result, I think you've seen unprecedented outrage at these protests have seen incredible diversity and the pressure is built on Congress to do something, and I think you know we have this moment, which seems a little bit different than in the past. Where we're actually gonna do something. I mean, what usually happens after these tragedies is that members of Congress issued a press release is saying or this is terrible, and we have to do it. Do something about systemic racism in this country, and then we move on to the next subject. But this is different than the Congressional Black Caucus, led by Jimmy Karen Bass is done an incredible job of putting together the George Boy Justice of policing after 2020 which I think takes a step step in the right direction. But you know what? The American people are waking up to injustice, and I don't know all the factors to make this moment Attorney point But thank God it is attorney. You're one of the many co sponsors of the Justice and Policing act. Can you explain to us what's in it, and then we can go through some of these points, one by one. I mean, there's a lot of different things in it. I mean, there's efforts to end racial religious profile. Found a better choke holds and no knock warrants. Limit limiting military equipment. Way have a program that where the Pentagon can provide equipment to our local police departments, and we've seen everything from tanks to grenade launchers being provided the local police departments and You know our citizens They're not enemy combatants on you shouldn't treat them as such. There's an effort to to deal with qualified immunity. No police accountable in court when they violate people's civil rights, a never to investigate police misconduct, more transparency by collecting data on police misconduct and use of force. I mean, there's a lot of other things in there, and this is not everything that needs to be addressed, but it is a step in the right direction, and I think it's a meaningful step in the right direction. Let's go through some of those things. But first, you know the general question that people are wondering about. We're talking about federal legislation. Things like banning choke holds at the federal level, but Many of these things we're going to be controlled by laws at the state level and how much control does the federal government have over that? Well, I mean, the federal government can't provide assistance in aid and incentives for local Jurisdictions to comply. I mean is, you know such a thing as carrots and sticks, But I think what's what's what was happening at the local level. I can't even talk about it in my own district is that there's a growing awareness that a lot of these issues are really local issues that need to be addressed by the federal government could play a powerful role in helping create a climate and providing the incentives help make it more likely that our local jurisdictions will do the right thing. You mentioned the program from the Pentagon, where Surplus weaponry could be bought by police department. These are mainly weapons that were made meant those military weapons. How did this seemingly get out of hand at the point where local police departments are that don't even have enough servers say to record all of the video that may be record by police camps. How did this get to the point that these military grade weapons were being used? I think the initial impetus for this came after things like 9 11 where people were afraid local police forces would be facing terrorism on a level that they hadn't seen before. But This seems to have grown to an extent and in areas where It was really not considered when this program started. We'll look like many ideas, well intentioned, you know, he got out of control. I mean, you know, President Obama try toe for this, But, you know, all police departments are not all the same. But there were some that you know when they see new equipment, even if it's you know, weapons, even its equipment. Useful war. I mean, you know they apply for they try to get it. On again. We have departments that have amassed military equipment That really is equipment that is meant for fighting wars and, you know, dealing with enemy combatants not dealing with with our citizens. Policing shouldn't be. You know a few things the same way we view the role of our military. And unfortunately, some jurisdictions that has that has been the case. You mentioned transparency and the idea of a national police misconduct registry. I think this is something came as a surprise to a lot of people that if I'm a police department in one city, and somebody applies to Be a police officer. Very often. I have no way to find out if they have been accused of misconduct. In another police department somewhere because thes records were not public, even to them correct. It's ridiculous. I think it came as a surprise to a lot of people, but that's been one of the problems. I mean, you had some bad police officers that have moved from one department to another department to another department who have terrific records. Now, I don't know whether You know those who hired them? We're aware of some of their records. But the bottom line is, my guess is that in many cases they didn't and they just brought their bad behavior from one department to another. And look, I think it's report for the public to know whether or not there are police officers..

all the disagreements I have with president trump for all his policies his tweets and his rhetoric that I deeply disagree with I never wanted our country to reach this point I do not take any pleasure constitution this is about protecting our national security and safeguarding our elections that's why the intelligence committee has been gathering evidence and hearing testimony like any friends words is a sad day for all of us for me personally I'm sure for all of my colleagues on the rules committee and for the institution as a whole today's resolution set forth a process for impeaching the president of the United States it's not a fair process it's not an open process it's not a transparent process but instead is limited and a close process with a pre ordained outcome impeachment of the president is one of the most consequential acts that the house of representatives I can do and it should only be done after the fullest consideration and yet over the last month without a vote and with only the speaker say so committees having been engaged in a closed impeachment inquiry on what amounts to nothing more than a partisan fishing expedition at least today the majority's admitting what we know and have known all along that the house was not following an appropriate process for impeachment I do not think the process were setting for in this resolution is a fair one either that's not fair to the president of the United States it's not fair to the house of representatives and it's not fair to the American people the process laid out in the resolution before us is different from the process used for both president Nixon in nineteen seventy four and president Clinton in nineteen ninety eight today's resolution provides fewer process protections and fewer protection for minority rights then what we've seen in previous impeachment efforts at our mark up yesterday Republicans tried to change that we tried to offer constructive amendments that made the process more fair it would give rights to the minority that would give rights to the accused and that would ensure due process for everyone Republicans offered seventeen amendments and not one not one madam speaker was accepted not one we offered amendments that would align the subpoena powers in this resolution with the subpoena powers used for president Clinton unlike then as the Clinton inquire re today's resolution does not provide for co equal subpoenas not power instead of grants the minority the right to subpoena witnesses a material only with the concurrence of the chair with no such limitation on the rights of the chair to issue subpoenas we offer the membership would change that but the majority rejected both of them and each of them in turn we offered an amendment that would allow all members the right to fully access committee records this is common sense for doing something as serious as impeaching the president the member should have the right to see what records the committee produced so that they will know what they're voting on yet the majority rejected that we offer an amendment that would require the chairman of the rules committee to promulgate procedures to allow for the participation of the president and his counsel in proceedings of the intelligence committee the oversight committee the foreign affairs committee this right was granted to president Clinton in nineteen ninety eight yeah it's not present here and the majority again rejected the amendment I think the difference is clear today's resolution fails to give the minority the same rights as were present during the Clinton impeachment and it fails to offer the same due process protections they were given the presidents Nixon and Clinton and in the latter case I note those rights were given by a Republican house to a democratic president today's resolution shows a democratic house failing to give the same protections to a Republican president now speaker the unfairness is clear this is not a fair process nor was it ever intended to be it was preordained from the beginning without due process and without a fair process of respect for minority rights I do not believe the American people regard will guard this process is legitimate a legitimate process is one that offers protection for everyone involved and without those protections this will be seen as just another partisan exercise won the majority of been pushing since the very first first days of the hundred and sixteen Congress we can do better than that madam speaker the rules committee should have done better than this but since the rules committee didn't the house from us and with that madam speaker Irish opposition to the measure and reserve the balance of my time Tom Cole is the ranking just like under Nixon and Clinton and the Judiciary Committee the president's council can submit additional testimony or evidence for the committee to consider the president is in his counsel can attend all hearings to raise objections they can question any witness this going is going beyond Nixon and Clinton this resolution allows the president's counsel to ask questions at the presentation of evidence under our procedures the ranking minority members of the Judiciary Committee and the intelligence committee may issue subpoenas of authorized by the committee by committee vote these are the same subpoena powers that the ranking minority member was given during Clinton Nixon a resolution allows for greater member participation then underpass impeachment proceeding procedures including a robust process for the minority to propose witnesses and even issue subpoenas if authorized by a by committees and and and let me just say I think that the fact of the matter is I don't either is any process that we can propose that that Republicans who prefer to circle the wagons around this president and prevent us from getting to the truth would accept I ask unanimous commitment you know I'll also add this Mr. T, I think there's a certain element of social media. That's coming into play here. I think you have you certainly have a good people in congress that are more interested in making a statement on social media and seeing how many likes or re tweets they're getting rather than, hey, let's get face to face in congress here and yell at each other the way it used to be done in the good old days. Negotiation process here you had the Senate reconvening for the first time yesterday, but my Christmas and that session lasted four minutes. Three four minutes. There's green day songs but last longer than the session they had yesterday in the house met for just as brief period of time even having Scalise on the floor say that lawmakers should not expect any votes for the remainder of the year. So they they tried to get Jim McGovern up there from Massachusetts to force consideration on that same stopgap funding Bill that would fund the rest of the government yelling. And then stop this shutdown portion of things but Republicans weren't gonna recognize him. So we're literally at a standstill rights. Yeah. But the problem here is that you didn't go back to ninety five with the Clinton one that was a policy based shutdown that was over getting funding done in the budgetary issue concern between President Clinton and Newt Gingrich. This is not that this is President Trump promising a wall for his election and not being able to have funding for the past two years for trying to get either funding now or make a stumbling roadblock of some kind of the Democrats that are coming in on January third. But I think the challenge there is Democrats are prepared for this. And I think what they're doing what they took yesterday that time that they had over the four minutes. And then they had all this time to sit down and talk. They've been coming up with plans to include three different approaches for funding the government, and none of them include proposed money for President Trump's border wall. But they want to be able to come to the table on January third and say here are three different things. We can do right now to get government back on track to stop any concerns about the financial markets and concerns there in about how stable the US is. And we're doing it showing how we can govern responsibly compared to what's going on over in that chaotic White House. I think that's the PR move. They're going to try to bring to the table here.
