Ousted U.S. attorney details push by Barr to resign post or be fired
"Attorney leading investigations into President Trump's allies has told the House Judiciary Committee that Attorney General William Barr pressured him to resign. Jeffrey Berman, the former federal prosecutor for the Southern District of New York, is providing the panel in a closed door interview with a detailed account of extraordinary standoffs of his June departure, according to his opening statement obtained by the AP. He said bar repeatedly urged him to take on another position. At the Justice Department. On the
Epstein's alleged accomplice Ghislaine Maxwell set to be arraigned next week
"Maxwell. epsteins closest associates. And helped him exploit girls. who were as young as fourteen years old? Mental played a critical role in helping Epstein to identify the friend and groom minor victims for abuse. In some cases, Maxwell participated in the abuse herself. Okay if you thought the Jeffrey Epstein case was over after his apparent suicide in his jail cell last year. Thank again you'll remember that Epstein was the disgraced financier and convicted sex offender who socializes powerful men like Prince Andrew Bill Clinton and Donald Trump on Thursday, his longtime associate d'alene Maxwell, was arrested and charged for allegedly helping Epstein recruit groom, and sexually abused girls as young as fourteen years old. She has denied any wrongdoing. Here's more of what the US attorney from the southern. District of New York had to say about it. Max will and Epstein had a method. Typically. They would befriend these young girls by asking them questions. About their lives, pretending to be taking an interest in them. They would take them to the movies. And treat them to shopping trips. Maxwell would encourage these young girls to accept offers from Epstein to pay for their travel and their education. Making these young victims feel indebted to Jeffrey Epstein. Developing a rapport with Victims Maxwell then try to normalize sexual abuse with a minor victim. Joining me now. Our our sisters in Law Maya Wiley Professor at the new school and NBC legal analysts Barbara Maclead, former US attorney and MSNBC contributor and Joyce vans, also a former US attorney, and also MSNBC contributor so ladies first I love the all female panel, but I will say starting out I used to be a field producer for America's most wanted, and my beat was covering missing and exploited children. On, this and ask you if you could. How important is the role of the person WHO's The enabler? The person who is recruiting these young girls and my experience, that person was integral to abuse cases when I was a journalist covering these types of cases so. What what say you on that? Yeah. You're absolutely right, tiffany. This is this person and the person who plays the role that. Just Lane Maxwell accused of playing is a Predator is just as culpable as. Jeffrey Epstein or anyone else who sexually assaults anybody? The reason it's so critical to have a person play the role maxwell is accused of is because it's manipulation gain. We have three hundred thousand young people in this country estimated to be sex trafficked domestically, and what that means is finding young kids met male and female. We shouldn't pretend that it's just girls here. In this country who are vulnerable, who need help who need the support of a system hasn't provided it. These are young women who were disadvantaged in many different ways, and what the role that Maxwell played was to play on their need. Get them to trust and being a woman who does that is particularly important, because if you're a vulnerable young woman, you're more likely to let your guard down and believe that the person who is offering you help means it so her role. Is Pivotal in enabling essentially the victimization of a lot of young women and girls, and it happens all over the country. One of the things that so important about this arrest is that predators who are powerful too often go unpunished. So something I found interesting reporting coming out of the Tampa. Bay Times highlighted that this case is actually being handled by the Office of Public Corruption Unit so I. WanNa ask you, Barbara. What does that say about the scope of this? Nation is that. Link to anyone in the current administration. Is it possible that Labor Secretary Alexander Costa's entangled in this break it down for those of us who don't necessarily know how the inner workings of the Southern District. It's a really interesting detail. Tiffany of the press release that was put out by this other district of New, York. This is also true when the case was originally just against Jeffrey Epstein that the public corruption unit is involved, that's a unit that has specialized training and expertise to deal with public officials who get charged there a lot of nuanced issues that arise when public officials are involved and so it says to me that this case. Case at least touches in some way public officials. Now as you said we know that Alex Kosta had some involvement with this. We don't know that he is a subject or a target of the investigation, but his involvement in negotiating sweetheart plea deal a number of years ago. With Jeffrey Epstein could be a reason. We also know that Prince. Andrew has been implicated as recently as last month Jeffrey Berman. The former US attorney recently ousted. Ousted was demanding an opportunity to talk with him and Prince Andrew was a dodging that request to be interviewed. It may be that he is only a witness and not a subject or a target, but this no doubt touches some people who have positions of power, and that could explain why the involvement of public corruption unit or could be others as yet unknown I think four names I be looking at immediately or not public. Public officials, but enablers as Maya, was talking about. If you look at the plea non-prosecution agreement that was negotiated with the Southern District of Florida back in two thousand eight. You'll see the names of four individuals that Jeffrey Epstein specifically wanted to protect. Those are very likely to be people who were enablers recruiters I'd want to get to the bottom of their role. and I think that this case is not done being charged yet. I want to turn the Joyce. Barbara brought up Berman and his abrupt firing. Do you see any connection here with what the dismissal of Berman and the FCC case? So, Tiffany I think it's very hard to know. We know that. The Attorney General Poll Day late Friday night effort to usher Berman out the door, unceremoniously in the southern district of New York and that didn't work became public when Berman refused to go along and instead of having the Attorney General's political appointee in place. We ended up with a woman who was. was already in the office, a career employee, a career prosecutor who will hopefully be playing things straight up so it's difficult to make any sort of direct political line there what we do know is that this is the classic type of an indictment that looks like prosecutors aren't done. It looks like they're headed in further direction, and that's something that there could perhaps. Perhaps be powerful. People who are interested in shutting off when I say it's a classic indictment. What I mean is this indictment comes in six counts, and there's a I can't. That's a conspiracy count and the maximum penalty. There is five years, but there are also substantive counts and conspiracy counts of enticement and transportation of minors, and those counts actually range from ten. Ten years to lifetime sentences, and so as MS Maxwell, is forced to confront the potential charges. She's looking out. Does she want to go to prison for the rest of her life, or is she willing to cooperate and become a witness and look at lesser charges? Perhaps five year sentence that I think will give some powerful people some reason to sleep poorly. All right. Am I GONNA? Go back to you. What do you think that gain maxwell will do you anticipate that she? Said they say. It's hard to know. We're looking at a case as both Barbara Jo of a choice have said where there are powerful people connected to Maxwell and Epstein. There's the mysterious death of Jeff Jeffrey Epstein that has still raised questions in people's mind. And I think the question becomes. Where do you feel more vulnerable? Do you feel more vulnerable from law enforcement, or do you feel more vulnerable other ways we don't really know. We're not going to know, but the one thing we do know and I think is important to remember is this is an over for the victims? This is only the beginning of what will be a very deeply difficult. Possibly re traumatizing process that they have really bravely stood up and faced down despite the fact that I don't think there's any illusion for them. They will have to protect themselves from further victimization in the way, in which the defense will be mounted for Maxwell. So if there's any decency at all left in this woman, she will certainly spare them.
Democrats wrestle with how hard to go after Trump's scandals
"A little more than four months until the election and the scandals that Democrats after they impeach President Donald Trump have mostly tried to look away from there now piling up and they do feel like they have to do something. I mean, it's just kind of an onslaught of scandals coming out of the trump administration right now so I think they want to be careful and how they go about this. They do want to investigate what's going on. They do want to call attention to it, but they're certainly not going to try to impeach the president again or try to impeach the Attorney General, although some members have called for that. Instead what we're going to see, is the hold hearings and for instance general. William Bar is going to come testify before the House Judiciary Committee at the end of next month. That's going to be a really big deal. You know I think for them. It's a fine line between. How do we call attention to this and also not step on our own electoral message, which is here's what we're doing for voters. Here's why you should bring us back. We're not just the party of investigating trump. We do actually want to get things done for you. Yeah I, want to jump into that in a second, but for those of us who have been living under rocks. Can you just quickly numerate some of the many many things that have? House Democrats up in arms that they they want to look into well. It's kind of an endless list, but. For instance the firing of the Manhattan prosecutor Jeffrey Berman over the weekend. He. The Attorney General issued a statement on Friday night, saying he was stepping down, and then Berman issued his own statements that what I'm not stepping down and then so bar had to actually fire him right, and that was this whole controversy this weekend, so the reason that people are speculating that bar got rid of. Berman was because his office in Manhattan has. Investigated a lot of trump related scandals everything from trump's former fixer. Michael Cohen Hush payments to. Porn stars, and then Rudy Giuliani the trump inaugural committee I mean you know a lot of links to the trump world, so that's one thing that they're definitely gonNA look into and it's. It's not too long ago. That an attorney general resigned over over questions of improper political influence over the hiring and firing of US attorneys select. That's that's a big deal. That's a big deal and that's one. I mean. Bar Is. There's a whole list of things with bill bar that I think I don't even know if they'll have time. They're hearing next month to get into everything. Because bar has really politicized the Department of Justice in a way that we haven't seen in some time and has taken steps. Many of his critics say to try to insulate trump from numerous scandals when they say that DOJ should be an independent body right so. That's one and then there's John Bolton's book which there's a whole string of allegations everything from the Ukraine scandal, which Democrats did impeach trump over to claims that trump requested China. Help Him in the twenty twenty election to other claims that he offered to help quote fix a problem The Turkish president was linked to a bank that was being investigated by the Manhattan Office that we were just talking about so there's a whole list of allegations in Bolton's book. They WanNa look into, and then you know the house. Judiciary Committee on. Wednesday had. Some whistle blowers from DOJ testifying about the DOJ's decision to You know to drop the charges against Michael Flynn. But also but also Roger Stone Oh my God. Oh Right? Yeah, no, there's so much! It's hard to keep track of anyways. There were two whistleblowers that testified before the house. Judiciary Committee on Wednesday about the DOJ decision to drop charges against Michael Flynn and other accusations that the Department of Justice recommended certain sentencing guidelines, which many considered were very light against. Against Roger Stone because of how close he west of the president, and that he was treated differently than other defendants, because of his relation to the president, so these are all things that the House majority is going to look into in the next several months in the run-up to the election, but are we going to see bill bar impeached or anything like? Like that. No, it's GonNa be more about hearings and television clips and things like
NYT: Inside Barr's Effort to Undermine Prosecutors in New York
"I could keep you here for half an hour. Talking about this Jeffrey Berman the breaking news tonight about the US Attorney's office and how Jeffrey Berman? I feel like I, have under described how heroic he is in this story as we know it so far with attorney general embarked from the start according to the New York Times reporting tonight that you covered so well turn general Bar, trying to interfere with the workings of that office, especially in the Michael Cohen case, which Oh by the way, includes individual one donald trump, who is accused in all of those documents of directing the crimes. Michael Cohen was committing. And that's the case, but we discovered tonight. The William Bar is trying to interfere with as soon as he got the job. And if there is a systematic effort inside prosecutors offices to let the president's tendrils extend to prosecutorial decisions for there to be political pressure on how cases are resolved and brought or not brought among other things, the judiciary should know about that, because in some cases, judges may want to correct for that or investigate that or figure that out, if prosecutors. Are being import tuned in that way and so I realized that prosecutors are. Constrained in terms of what they can tell us the public, but when cases are getting messed with when there is interference in the same way that it's a really serious thing to intimidate a witness, or to do other things that obstruct justice if the obstruction of justice is happening. From the upper echelons of the Justice Department at the direction of the president. We need to know about it and this New York Times story tonight with these incredibly well sourced anecdotes about what's been happening inside Sdn Y. I feel like it's the first crack of starting to see that and more prosecutors. More people who know what has been happening inside prosecutors offices with stuff need to squawk and need to let us know, or we can't help fix it. At according if tonight's polls are correct today's new. York Times polls if they are correct. At noontime on January. Twentieth Donald Trump will become available for indictment as individual one in that case, because he will no longer be president of the United States and one of the big questions about that cases. What happens what happens when Donald Trump, if donald trump leaves office at the end of the first term, does he immediately affect? Get indicted in the southern district of New York for the same charges. Michael Cohen has gone to prison for. Four. which US Attorney's assistant, US attorneys have spoken overtly in court in terms of his criminal liability for those acts I mean it. It's It's it does not get more serious than that. In terms of whether or not, this is a country that is built on the rule of law or not, and what we've seen the attorney general due to the US, Attorney's office in DC which decapitated and took over and used it as far as we can tell to squelch cases related to the president, and to go to to bring about unusual and extra-legal lenience for the president's associates in that office. We are now seeing the same attempt on the new. York prosecutor's office and we're learning tonight all this backfield information about how much pressure they have been facing. For months since bar has been in office, I mean it, is it? This is John Mitchell stuff I mean this is, this is as bad as it gets in terms of the administration of Justice and so far Jeffrey, Berman did succeed in fighting off this pressure in incredibly heroic style, and getting his deputy installed as his successor of who he trusts in generally people trust to continue his work. It's just been the the story. Jeffrey Berman has to tell is the most remarkable story that I just can't wait for.
U.S. prosecutors open criminal probe of opioid makers, distributors
"The Wall Street Journal reported yesterday that Federal Prosecutors I have launched a criminal probe of opioid makers and distributors. The investigation aims to decide whether pharmaceutical companies intentionally allowed OPIOID painkillers to flood communities. This sort of criminal investigation is usually reserved for drug dealers and cartels so this is pretty major. If the investigation results in criminal charges it could be the biggest prosecution of drug companies. He's that have allegedly contributed to the OPIOID epidemic Akilah. What are the companies that are involved in this? And how far has this investigation gone already. Yeah so six. Companies have confirmed in in regulatory filings that they received a grand jury subpoenas from the US Attorney's office in the Eastern District of New York. There's probably more but we do know about Johnson Johnson. TV If a pharmaceutical industries and mckesson Corp Ammiel Pharmaceuticals Mellon crowd and resources. Bergen Corp they have better. Yeah without headed out. This is a criminal investigation instead of a civil one on the show. We've talked about the big civil case involving Purdue Pharma Company paid a two hundred seventy million dollar settlement and its legal battle against Oklahoma Tiba also agreed to pay that state eighty five million now shortly after those settlements Purdue Pharma filed for chapter eleven bankruptcy. What makes this case different than all those other ones? So according to legal experts that the Wall Street Journal spoke with criminal charges require prosecutors to prove an effort to willfully fully end intentionally avoid requirements like reporting signs. You know like suspicious orders. For example that could indicate the drugs were being used for non medical purposes under the controlled Substances Act whereas civil charges can be brought to executives and companies for failing to report those signs passively in other words. The attorneys Ernie's general have to prove these companies intentionally hid the red flags about how the drugs are being distributed and misuse and communities across the country Earlier this year when federal federal prosecutors filed similar but smaller criminal cases in Manhattan and Ohio against a pharmaceutical distributor and a couple of executives Manhattan. US Attorney Jeffrey Berman Said said quote executives of a pharmaceutical distributor and the distributor itself have been charged with drug trafficking wild. Yeah wow so. This is a big deal. And it's part of a movement towards reparations for communities that have dealt with this opioid crisis but what comes next question to your point about this being moved towards repairing what's been lost more than four hundred thousand Americans have died from overdoses from legal and illegal opioid since one thousand nine nine. That number comes from the some federal statistics six so obviously millions of dollars won't be enough ray. Several of the companies being investigated have already tried to reach settlements in the forty eight billion dollar range but if the ninety settlements from big tobacco or any kind of indication we should be looking in the hundreds of billions of dollars range much of the money one against big tobacco unfortunately went into budget gaps in different states rather than to you know rehabilitation and crisis services. So there's a lot to pay attention to with the money. How much of it is coming? And where exactly exactly the funds will go at the end of all of

Trump Says He Didn't Ask Whitaker to Change Hush-Money Probe
"Trump is rejecting a new report about him allegedly asking former acting attorney general Matt Whitaker if a change could be made in the investigation of Michael Cohen at the White House on Tuesday, Trump called it fake news. Donald Trump denies NYT report he tried to interfere in Michael Cohen probe
"That President Trump tried to interfere in the federal investigation of his former lawyer and fixer Michael Cohen. The president is now denying New York Times story that he asked then acting attorney general Matt Whitaker to put a Trump supporter in charge of the pro supporter. US attorney Jeffrey Berman had already recused himself from the investigation. And the times reports the president soured on Winokur when he was unable to make this happen. Auspey congressman Roque of the oversight committee and our correspondents analysts have full coverage of the day's top stories us, go straight to our White House. Correspondent Caitlyn Collins. Caitlyn take us through this truly remarkable report alleging that the president tried to influence the Michael Cohen investigation. Yeah. Wolf if you're starting to sense of pattern here. I'm not sure anyone can blame you an explosive report in the New York Times that claims that the president asked then acting attorney general mad. Whitaker to reach out to the US attorney in the southern district of New York and try to get him to unrequir- himself from overseeing that investigation into Michael Cohen hush money payments to women an investigation that is tied to the president. And this report wolf that the president today denied. Stunning report in the New York Times, claiming President Trump asked then acting attorney general Matt Whitaker to put someone who is supported Trump in charge of investigating hush payments made by his former fixer Michael Cohen. I think he's done a great job. Bombshell. Trump to nine today. No. Gave you that us. More fake news. A lot of a lot of fake fake news out there. No, I did the person Trump wanted in the job US attorney for the southern district of New York. Jeffrey Berman had ardor himself from overseeing the pro according to the times it's unclear how Whitaker responded, and there's no evidence he took steps to intervene despite telling us OC, it's that he knew part of his job was to jump on a grenade for the president still Whitaker remarked that the New York prosecutors required adult supervision, according to the times while Berman is recused from this probe. He has not recused from another that could touch Trump one looking into the president's inaugural committee the times adding Trump soured on Whitaker after his inability to make the change and he has since been replaced by Bill bar, but Whitaker could be facing bigger problems. He recently told a congressional committee under oath that the president had never pressured him regarding any. Investigations at no time has the White House. Ask for nor have I provided any promises or commitments concerning the special counsel's investigation or any other investigation. Whitaker is now under scrutiny by house. Democrats. Potential perjury today at DOJ spokesperson said he stands by his testimony and Trump is standing by him to very very straight shooter. I watched him during the hearing some of it. I thought he was exceptional since Trump told advisors deputy attorney general rod Rosenstein, assured him the Cohen investigation had nothing to do with him. The New York Times reports he has since wondered if Rosenstein was deliberately misleading him to keep him calm. The extensive report is also claiming Trump's told advisers and February twenty seventeen they should say he asked for Michael Flynn's resignation because quote that sounds better pressed by Sean Spicer, if it was true Trump reportedly. Responded say that say that I asked for his resignation, according to the times White House lawyers were so concerned about what Spicer said from the briefing room podium that they compiled an entire memo laying out his misstatements the White House counsel reviewed and determined that. There is not an illegal issue. But rather a trust issue. The report coming amid headlines that former deputy FBI director Andrew McCabe who was fired last spring briefed congressional leadership about the counterintelligence investigation. He launched into President Trump purpose of the briefing was to let our congressional leadership know exactly what we've been doing opening a case of this nature. Not something that an FBI director, not something that acting FBI director do by yourself, right? And that no one raised concern congress, and I told congress what we had done anyone object. That's the important part here. So that no one of Jack not on legal grounds, not on constitutional grounds. And not based on the facts. Now wolf the times also notes the president has had private conversations with Republican lawmakers about a campaign to attack the Muller probe something he's done over eleven hundred times and could very well serve as a public relations strategy in addition to a legal one will developments. Indeed, art, Caitlyn facts very much. Let's bring in our Justice reporter Laura Jarrett, and our chief legal analyst Jeffrey to then the Lord is President Trump's alleged request of Winokur to replace the person leading the cone investigation of struck to what some are suggesting could be obstruction of Justice the legal question in this case as always what was the president's intent if he wanted to have Berman on the case because he thought he was a better lawyer. And he thought that the US attorney zombie was not doing a good job that might be legitimate. But if he wants Berman on the case because he thinks he's going to protect him. Somehow, that's where we tread into the land of whether he's doing it for corrupt reasons and where obstruction could come into play. But the other point is that the New York Times lays out more. More than just the fact that he wanted Berman on the case, they lay out a month long campaign of trying to undermine the Muller probe. And
