"And so the answer is news. is is down the road But meanwhile the process of of education and debate continues. I'm sure we'll see various bills of blocked as we go forward by by republicans. And i don't know what strategy eventually will end up choosing but i have confidence that fifty people in the room. Who have kim on the principles of government vying for the people component accidents ballot-box campaign on veterans. Your policy education policy housing policy. Better job creation are going to figure it all right one more question and that is in that is this as part of the strategy is part of the strategy to have popular bill after popular bill after popular bill. Come to the floor for a vote and go down in a ball of flames because of republican obstruction in an effort to educate the public. About why the filibuster needs to be done away with so that voting rights and gun control and minimum wage and immigration reform can actually get through passed on the president's desk and signed into law been intentional strategy in that we would regardless of the filibuster be putting these bills on the on the floor i think the republicans would be a little more hesitant to obstruct them knowing that a'moment when there are very favorable position again from republican perspective republicans. Hands day win tails. Democrats lose so they love that. They're going to be a little hesitant to Basically give us a ammunition. Some they'll be more cooperative than maybe somebody having this conversation means and of getting fifty six or fifty votes on background jets sixty We'll have to see but when we put bills like that on the floor now absolutely what. We hope we get sixty votes. Yes we will hope that Will vote against essentially a block us. Probably because that's been mentioned forte historian power. Is that if you paralyze the senate when there's a democratic white house that makes a better case for replacing the the democrats republicans it's a very cynical. Very destructive jerry anti-democratic philosophy not about solving problems for the people. It is about she or power politics but it's worked for him but now he has to be a little bit cautious about how how it proceeds. So maybe we'll get those sixty votes. On those those same bills it would have been obstructing before senator jeff merkley of the great state of oregon. "Level playing field on talking. Filibuster all right. Let's talk about senate minority leader mitch. Mcconnell who He's given a couple of interviews now. We're in a speech on the floor where he basically said democrats. If you do this you know you will report you so that you are trading down a dangerous line on a on the homes and smug podcasts. He said quote. I think if they destroyed the essence of the senate the legislative filibuster they will find a senate that will not function and then he goes on to say it could turn the senate into sort of a nuclear winter not the aftermath of the so called nuclear option or the aftermath of the so called nuclear option is not a sustainable place. And this from the man who's done nuclear option many times So You no it's a fine speech but it's just not accurate. He's not admitting that he has used a nuclear option. Use it and change thirty hours of debate to our so he can pack. The lower courts. Used it to allow simple-majority to put people on the supreme court after basically obstructing obama's nominee For the better part of a year If anyone's destroyed the senate it's mitch. Mcconnell his strategy of obstruct and delay my husband's deeply deeply damaging. Let's think about this. Under when president johnson was majority leader. Johnson in six years majority leader. He had to file one motion one in six years to close debate. Because the senate understood the sentence a simple majority body and that to do obstruct. data's piracy. That's where the term filibuster comes from. It means piracy so then comes along read and And mitch mcconnell decides maximum obstruction and so in six years. Guess how many times hearing. We had to file emotion to close debate. I'm guessing you'll underestimate the number. I remember that time it was everything. It was everything everything four hundred times. Jonathan and each one of those times can eat up a week of the senate's time because you have because it was intended to be used very rarely exceptional circumstances when the pirates and take our the senate which meant you have to wait two days the hold a vote on closing to be and if you succeed closing debate you have spent up to number thirty hours in debate before you get to a final vote which is all week of senate time. Four hundred times as six year period while fifty two weeks times since six years is three hundred twelve. Either i mean. He basically completely paralyzed the senate. He is the destroyer of the senate as legislative body and so that that that crime rest on his shoulders. Creating great journalism is expensive. Which is why. We are so grateful for our subscribers. Who support are important. Work if you haven't already please consider subscribing to the washington post you can get a whole year of unlimited access. Just one dollar a week. Get this offer at washington. Post dot com slash. Subscribe so my colleague at the washington. Post ruth marcus. Had a column the other day where she basically said democrats. Be careful. Because if you do away with the filibuster to pass your priorities. Voting rights equal rights. For lgbtq americans gun control which. We haven't gotten to yet that now given what's happened in atlanta and boulder than is now front and center again that if republicans come in and take over the senate they'll compl- then their priorities. They're going to steamroll them through. What do you make of that. That notion that democrats shouldn't do away with the filibuster for fear of what republicans would do when they're back in the majority. Whenever that is i want to terror out some of my hair on that column because route did not identify the fact that republicans have already turned down the filibuster on their own priorities and so they have what they think is a perfect situation. Because it's kind of heads. They win tails democrats lose. So that's why mitch mcconnell likes the way it is. He's he's already gotten rid of the filibuster new priorities. He doesn't really want to policy on health care. Housing education living wage jobs. You equality of opportunity immigration taking on climate change. He's very happy is his core. Base are powerful organizations that want corporate power and tax cuts from the rich. He has the ability to pack the court to put in federal society members to pursue the corporate side and he has ability to new tax rich. He's pretty happy camper so That's that's a much more accurate. Framing of the situation than ruth put forward. Okay so then. What about this though. It's susa groups like planned. Parenthood and ney row. They've relied upon the filibuster to protect abortion rights. They've been kind of. They've been silent noticeably silent during all of this debate so do abortion rights. Organizations have more to fear if the filibuster is gone. I hear you on judges and tax cuts but when it comes to a woman's right to choose that is a priority for a lot of republicans to do away with the majority of support Reproductive rights across the country and so the the republicans have been happy to pursue this through the courts and through through states where they have a predominant presence but but they are nervous about taking this the national issue. They think they'll get crushing the elections if they do so so. The risk is probably modest. But let's say that that they decided to go crazy on this front A one if it's a talking for buster we would have the ability to obstruct them the same way they can us under a talking filibuster and you know we put out the african protect now reproductive rights so they would have to for a long period of time for many weeks they would have to be fighting for something that is that they would lose a suburbanites process country and they paid the price of the next election. They wouldn't even succeed in getting it done. They'd have to have the transacted. to begin with. They happen signed pretty enormous glacier g on this week for them is a losing national of physician so the risk is minimal and then when it comes to gun. Control background checks concealed. Carry all of these things that have enormous popular support background. Checks has ninety percent approval rating among the american people. And yet it can't get anywhere in in congress and certainly not in the senate is getting a gun control. Bill worst doing away with the filibuster to get past well. We had a mansion. Germany bill that got fifty six fifty eight votes Reforms made sure didn't get sixty but there was substantial republican support for it and Same with the the the dream act fifty but not not sixty closing. The wage gap between men and women So on and so forth. I don't think it's really about any one issue after you go part s. one. I mean we do have our constitutional responsibility and the ballot box. I mean not only is it. A fundamental right of all americans participate but but obstructing ballot. Hawks has also been an enormous source of systemic racism. We've just come off year in which we talked about systemic racism well obstructing. Black voters is the primary objective. I mean the systemic. Racism is aimed at college students at.

"The people act in the senate. Senator merkley is a fierce defender of democracy and a champion of putting people ahead of corporate interests as a us. Senator from oregon. He's taken on wall street special interests and even his own party leadership to make sure that the american people always come first is an that refreshing and later in the show you will have a chance to ask. Senator merkley your questions about before the people act now to do so please use the q. And button at the bottom of your screen. We'll get to as many questions as we can. In the time that we have senator thank you so much for being here with us. Today very welcome. It's great to be with you. Thank you for focusing attention on this. Of course of course. Thank you for all your hard work on this. I really wanna talk about the for the people act and what happened this week but i think to get there. Can you first tell us about your thoughts on the state of democracy in america today and why we actually need a for the people act. You bet i think in every republic you you have a tension between government Directed by the people through the ballot box in their elected representatives and a group of very powerful privileged individuals who hate that idea and so they wanna use all the mechanisms of power to control where the nation goes that means reams of lawyers at means it huge numbers of lobbyists that the drug industry alone has three lobbyists in dc for every single member of congress it means me campaigns to shape the vision of where we go at it means using every tool. They have to influence elections. So that's where we come down to really the heart of this battle and what we have is basically state government saying let's return to pre nineteen sixty five and put laws in place that make it very hard for targeted communities to vote. Let's make it hard for black. Americans of communities of color college students tribal members to vote. Now that is really unethical. It's racist it takes us deep into the past and they're defending it in the same way. Jim crow has defended which was rights but the states. Do what they want even if it violates fundamental democratic or human values. So we're in big trouble. And one of the tool sues gerrymandering. Gerrymandering is drawing district's to favor one party over the other and that results in a complete assault on equal representation and a lotta cynicism about the validity of representation. A second tool is money so billionaires inc's can run money through a whole series shell groups and then basically do those incredible amounts of attack ads that we all see on the receiving end. It's china drown out the voice of the people with this huge flood of dark a corporate money. And then you have these direct attacks on people voting and the the theory is this limit voting to election day because on election day. It's very easy to make it hard for people to vote reduce the number of precincts in targeted communities. You understand them. You move their location every two years. We put them where there's no parking you cut the hours in the evening. All of these and you put out misinformation about about whether locations are when the vote is being held one of the most diabolical things i saw was a strategy of putting out Social media. Sorry you missed the vote week when the vote was actually the coming on tuesday and so the remedy that is early voting remedy vote by mail. Which is why. President trump hated vote by mail. Because i want to use these instruments of manipulation for the powerful. So we're in big trouble and this act before the people that addresses each and every one of these provisions restore the integrity of elections and the power of the people in america. How did we get here. You know I kind of pinch myself and say is this really happening. But my i'll tell you my theory on this often interpretations but what trump did in his campaign and in his four years in office was make things acceptable as strategies whether it was white supremacists. demonstrations Attacking a black american demonstrations it basically pin people against each other Based saying that Immigrants who commit crimes that at a lower rate than people born in america are all rapists and murderers now words basically creating a significant commission on about attacking people of color and their rights. I think trump took us back to pre nineteen sixty five. And so your theory is that you think that that our elected officials feel emboldened because of trump's strategy and tactics yes and a piece of the added which was very big piece was to say. Hey this last election was won by him and so therefore state legislatures go out and do these things Because hey there were fake. Vote by mail ballots There were fake early voting and all of that has been investigated and it's untrue but it is to create the facade argument feet of saint. No we're not trying to be racist. Were just trying to increase the integrity of elections And so it's it's It's kind of diabolical But but that big lie as reverberated. Through what trump called trump media the radio stations the right channels the social media That convinces a lot of people. Oh yeah hey we. We need this form of action or that form of action counter. What trump was describing. Even though what trump was describing is ally. Let's talk about solutions. How does that the act solve these problems. Well let's start with gerrymandering piece. It creates independent commissions across the country equally divided between democrats republicans and independents little bit for the listeners. Yeah you bet. So with every ten years where we have a census You have to decide how to how to split up your your state into districts of of equal size so that you have maybe five members of congress. You need five districts and the way you draw. Those should not favor one party over the other. Favoring one party over the other is gerrymander and so If if you basically have independent commissions it's very effective and saying hey you got reach agreement The dis venice after reach agreement. About what is a fair of boundaries for these districts therefore auditions. Don't don't choose their voters. Voters choose their politicians As.

"Much for coming on the podcast. You bet bye should be with you. So from what i understand you are in the in the senate and the democratic caucus you are. You're mr filibuster reform. You've been working on this a correct me. If i'm wrong since at least two thousand eleven and from what. I from what i've read you and then senator. Tom udall had put forth a proposal. Filibuster reform proposal and nothing happened. What was that proposal. Well in two thousand eleven we put up a rule change that would have converted as the senate to the talking filibuster restoring strengthening division of debate in the senate because after the five rule change you ended up with this silent invisible obstruction and people. Say why is it. Senate not doing anything while because somebody's about what do you mean there's no there's no one speaking on the floor and that's silent. No effort instruction Has really deeply damage. This place and i did throw myself into that discussion. When i came back to the senate essay coming back senate in two thousand nine. U.S. Senators Seek Sanctions Against Honduran President

"Year, thousands of people from Honduras come north to the U. S Mexico border and then into this country because of poverty and violence at home. The Bible administration says it wants to get to the root of the problem so Hondurans can build better lives there. But it turns out the root of the problem may lie inside the hunter and government. Now Democratic senators want to put sanctions on Hunter and president one Orlando or non Dez for alleged human rights abuses in corruption. Reporter James Fredrick is in Mexico City, and he's been following this story. Hey, James. Hey, how you doing? Good. What would these propose sanctions do? So this bill was introduced by Senator Jeff Merkley of organ and other you know, kind of progressive leaning Democrats, and it basically starts by saying President Juan Orlando Hernandez is under investigation by the U. S. For allegedly accepting bribes from an aging drug traffickers. So that's where it starts. And then it lays out this whole list of crimes that Hernandez and his party has been responsible for since the 2009 coup in Honduras. Corruption, embezzlement and then violence against its own population. Protesters, journalists activists, freedom of speech has been really clamped down there. Most importantly, the bill says the U. S. Has been complicity in this because we have been an ally of this government of for a long time, and it says that if we want to address these root causes Of migration from Honduras. We have to do this so these sanctions would freeze Hernandez's U. S visa freeze his assets and it would ban the U. S from exporting things like firearms, tear gas and other things to the 100 government. What's going on inside of the country that is making so many people feel like they have no choice but to leave. There's just a general sense of fear and desperation. Fear comes from street gangs that extort and murder people. It will, but it also is fear of the police and the 100 military Hondurans don't feel like they have anywhere to turn for protection. And in desperation is poverty. Hernandez is accused of embezzling lots of aid money towards Honduras. And so that's money that didn't go to poor Hondurans. On top of that they were devastated by two hurricanes last year, so Things are so bad in Honduras right now. I spoke to Elmer Gomez, who is 100 and seeking asylum in the U. S right now about the news, and I asked him to explain a bit. What if none, This is decisions mean for hundreds every day. That is, the future of the album is more so. Gomez says that Hernandez on Lee makes decisions that will personally benefit him or the people around him. He never acts for the good of the people. And Gomez reiterated. They just have nowhere to turn for help. They constantly feel like they're either being chased by criminals or the government. The other thing that Gomez mentioned is that he didn't want to migrate, and that's what I've heard from lots of people. They don't want to leave home. They just feel like they don't have any other option. And so if the U. S was to put sanctions on, Hernandez, would that happen anytime soon? It's unlikely it's going to happen soon. I think the interesting thing to watch for is that the State Department could actually just decide a lot of these things without passing this bill. I spoke to some experts They think that's unlikely as much as anything because the U. S. And Honduran governments are so intertwined right now that just slapping these sanctions on very quickly. Is going to be hard to do. So there's a lot of unwinding of this U S hunter and relationship and really a need for the U. S government to confront the relationship it has had with President Hernandez for all these

Portland Protests: Local Leaders Urging Feds to Leave

"In Oregon Governor Kate Brown and other officials are calling for the removal of federal law enforcement officers from the city of Portland. The Trump Administration deployed those forces, saying they are there to protect federal property in the city amid ongoing protests. But this week, officials from across the city and state and their congressional representatives have raised serious objections to their tactics. After camouflaged federal agents went into the streets with tear gas and tactical gear. Arresting protesters and taking some away in unmarked vans without the protesters have said explanation among those critical of the federal deployment in Portland, Oregon, Senator Jeff Merkley and he is with us now from Portland. Senator Merkley Thank you so much for speaking with us today. You're welcome, Michelle. Good to be with you. Well, you and three other members of Congress wrote last night to Attorney General William Barr and the acting Homeland Security secretary, Chad Wolf calling for these agents to be removed from Portland. Tell us briefly why you issued that calling. Have you gotten a response yet? This is an extraordinary circumstance. The customs and border protection and the marshals are deploying people to the streets of Portland. They're doing so at least the CBP forces, customs and border protection. They are marked just with a generic police. You have no idea who they who they represent. And then they're outside beyond the boundaries of the federal buildings, grabbing people on the streets, throwing them into unmarked vans, not disclosing even at that point, what agency they represent. This is the type Of unmarked paramilitary presence that you would expect in a dictatorship, not in a Democratic republic. It's absolutely terrifying to people. It's unacceptable. It has to end.

Sen. Richard Burr Faces Lawsuit Over Timing Of Stock Sale

"Water members of Congress going to do about stock trading by themselves. Revelations about Senator Richard. Burr raised this question. Our colleague Tim. Mack revealed that Senator Burr gave dire warnings about the pandemic to an exclusive group. A month ago that was a time when the president was downplaying the threat then propublica revealed that Burr also sold a lot of stock before the market crashed. Npr's Tim Mack still on this story. Tim Good Morning. Hey Good morning should lawmakers be trading in stocks at all well some lawmakers believe that they should be allowed to do that at all at lawmakers in the House of introduced what they call the band conflicted trading act. Now that's a bill. I championed by Jeff Merkley of Oregon in the Senate. It would prohibit lawmakers from trading individual stocks so along with Congressman Joanna Goose and Congresswoman Alexandria. Cossio Cortez Congressman Raja Krishna. More `they is one of the lead sponsors of the legislation. I think it's time that the public knows that their members of Congress are not profiteering. Off of you know information. They gained through their public service. It's not fair and it's not right. Democrats are the initial co-sponsors to the legislation but given the bipartisan outrage at Burr's actions they have some hope that Republicans will join them and to be clear this is telling lawmakers you can still have money. You can still try. A Mutual Fund Index Fund not individual stocks. Could PROFIT OFF OF INSIDE INFORMATION? Now this is not going to apply to Senator Booker if it becomes law. Because he's done what he's done but he's being sued isn't it? That's right Allan Allan Jacobsen of California was a shareholder in Wyndham hotels and resorts one of the stocks that bursts sold. And he's alleging that Senator Burr exploited information available to him as a senator for personal gain. Thomas O'Brien is lawyer representing Jacobson. And he said that they are trying to take the lead holding burr accountable. Back there. We're not waiting. For the Federal Government Regulatory Agencies. Were moving forward to remedy the wrong. With senator straight against are not I should note. I reset senator. Burs office for comment for the story but received no response Previously. He said that he relied only on public news stories to make his decision to dump stocks. He's also asked the Senate ethics committee to open an investigation into his own. Actions could face other scrutiny. Well the big question is whether the Justice Department and or the Securities and Exchange Commission will open up an investigation based on the facts. We already know in the public domain so to answer that I tried to ask around to people who had some experience in this manner. I spoke to Katie Goldstein. Who used to hold who used to lead these sorts of investigations in the US Attorney's Office for the Southern District of New York? When I first read the allegations the thought that crossed my mind was it seems likely to me that there will be a grand jury investigation of this conduct. The circumstances were such that. I thought it was likely that. Us Attorneys Office. Perhaps the southern district of New York would open an investigation. So that's her view and her estimation but to be clear there's no evidence to the actual investigation has started. I also reached out to the Justice Department and the SEC. And they had no comment so a couple of things going on people saying there. Oughta be a law and also maybe impressions about whether Burr broke an existing law. Tim thanks so

CBS news learned this week that former vice president Joe Biden is likely to enter the twenty twenty presidential race Moore from CBS news political correspondent, Ed O'Keefe or the final stages of that decision. I can make is by working to make the Senate of. Full partner in this. This bald agenda to save America. I am comfortable with barriers involve vehicles fences, there are appropriate places where question here. Dan. What is how do you make a vehicle wall? Has anyone figured that out? This is like an zombie movie where they stack vehicles up and you've got to try to escape around. What is a vehicle wall? I've no idea what that means. But again, this is the games. "Excited about I'm telling you, we let Democrats let me love the younger people love them too. Because I think it has a lot to do with the means of Obama has attitude and stuff like that. They love they lo-. I'm I'm sorry. I'm just telling you there is an affinity for Joe Biden. They'd like the guy I like him still. I mean, I don't agree with some of the, but he's the most qualified person in the country. I'm just saying has nothing. They'd like, Joe Biden Sherrod Brown. Don't you like him? No, he can sit. Well, well, they can all go have a Paolo Hillary Clinton for all. I care right now. Jeff Merkley, I don't even know who he is. But he can go. Oricon Tim Ryan the congressman from Ohio. Okay. Nancy pelosi. Ago. You can hang out, you know, he can go to the little kids table and John Hickenlooper can go fishing. Yeah. There's no way we're going to have a president Hickenlooper. That's just wrong. How about Jay Inslee? He's got a shot. Terry mcauliffe. I don't know why. But. Steve Bullock, governor of Montana beta overwork, he has a great shot. Great shot telling you after this stupid diary. He has a great shot. I would not be surprised. Eric Holder is there's like four guys left. He'll be one of the four Eric Holder. No shot. He's going to be at the table. But you'll be knocked out. I'm guessing early on. Yeah. Because he's got so much. Abrahams. Oh, she's the one that failed in Georgia right now. She's not gonna she's doing this state of the union response doesn't. That's how that's how Barack Obama got his start. Yeah. Bush's not that great of Iraq Obama. No. She didn't talk Broncos. Great when he spoke though. But I mean, that's. You want wanna look at it? That's what kind of cut made him comparing the Hilary. Hilary Mitch Landrieu. I don't know who that is. The mayor of New Orleans one of the Landrieu family has visit a sister was Senator anyway, Andrew gillum. No. No chance. He's a Bill de Blasio. No, no, no. Why didn't like them that much in New York? Who said they don't like him. He got reelected you got reelected, but they don't like him. The rest of the country won't vote. That's for sure. But I don't think the rest of the country are both any of the people. We just named. I think Joe Biden is the only one. I think betas like a UK. Smoke and mirrors. But nobody really knows or cares. And again. I'm not saying that he came out. I'm just be one of the finals watch at the final table. Well, Cory Booker be at the final table. Cory Booker has a great shot at the moment will be at the final table. She'll be close. I don't think people are the front runner low. We start digging Kamala. She's there's stuff that hasn't gone out there yet that when it gets out there at the fact that she prosecuted parents for their kids truancy. Yeah. But see, but they won't make Democrats line. Exactly. Elizabeth Warren come on. I think. You're welcome. Point you Billy, do I think that? Made of American table. But I'm just in my opinion at this point there used to be a fast. I don't know because they didn't know as much maybe she was a wildcard they thought or whatever when the whole birdie thing, but at this point. No, I don't think so. India thing does the only really young one that has a chance. I think he can straight talk to the youth. There's a reason Obama already reached out to him and spoke to him in private, you know, Biden also reached out to them spoken to improve the team has already talked to him. I'm telling you. There's something going on with beta that I have a strong feeling he will be pig. And it may be a great or if they can spin it where he can maybe become president. They might because he's young looks good. He knows how to talk. He knows when he's speaking his points. He knows how to. Ted Cruz, one of the least likes. To try to win that part of Texas hard. When's the last summer's democrat net that district prior to him? It's the democrat CDs in the Senate Senator congressman anymore. But when he was going after tech, Ted Senator that's the whole state. Yeah. But it's hard. So if he can't win the whole state of Texas. How's it going countries? I'm just saying he came close man anybody who can't be Ted Cruz is a loser. Anyway, let me lost already. So let's take a break.
