That is a rare move for prosecutors. This is the first step in asking the court to declare that the trial court improperly sentenced Jason Van Dyke for the murder and aggravated battery of Liqun McDonald. To order a new sentencing hearing, not casting aspersions on on the judge. A question is whether the sentence was consistent with the laws of the state of Illinois. And it is our belief that the sentence was not this is a question of law, and it's an interest of Justice that the lobby followed no matter who the defendant can no matter who the victim is in a particular case. And that that is not a political question. That is a question of law. What's important to remember in? This case is that for so many different reasons there are really important issues that came forward not just in the trial of this case. But during the sentencing of this case, those issues would have come out whether it was during the appellate process, whether it was during the post conviction process, which could have come whether or not an appeal was filed immediately or not. But ultimately, it was to make sure that the law was followed in all aspects and this step by the attorney general, and I this morning is our effort to make sure that the law is applied equally to this case like it has been to every other case. Now, the judge sentenced Van Dyke in January two six years and nine months, of course, that court filing sets a motion legal battle in motion. That could ultimately result in the court, forcing.

"Jason Van Dyke was sentenced to sixty nine months. He was like he was a Chicago police officer killed seventeen year old. Lukewarm McDonald in two thousand fourteen shot him sixteen times. And he seems a little unnecessary. Yeah. Toland necessary. I my thinking is he probably just ran out his magazine. Otherwise, he would have kept going. That's a lot of shots that he could be out in as little as three years in the reason his his sentence includes time served. Oh, she's been waiting trial for a little bit. Yeah. He's been waiting travel a little bit McDonald's. Great. Uncle pastor Marvin Marvin hunter, but still he was still only sense like six ish years, right? Eight years nine months. Yeah. So I mean, that's by no means a hefty sentence. Fez, murdering murder. Yeah. So McDonald's a great uncle. He was the victim. Pastor Marvin hunter spoke immediately after leaving the courtroom, quote, I've been told time and time again that the citizenry of the county of cook is not going to be satisfied with the sentence. This anything south of twenty years. Hunter said, quote, However, I want to say to everyone everyone in the city of Chicago and across this country that if they'd sends him to one minute it is a victory is a victory because what has happened in this courtroom. Today has never happened in the history of this county, and it sets a precedent sends a strong message to unjust police officers that now you can and will go to jail if you're caught lying if you're caught breaking probably not though. Can't possibly not. I mean, this has been going Chicago's had corrupt cops since Chicago's Venice city. You're more likely to go to prison, if you're the governor of the state of Illinois, then you are a cop in Chicago. Oh that is so true. That is so true. There's more than what three years there's like at least three governors. Yeah. Illinois have gone to prison. Oh my goodness. Yeah. They they just keep. Well, he keep getting caught. That's the thing. Sure. You have to you have to not get caught if you're going to be a successful criminal. Well, unless you're a cop in which case if you get caught most of the time you get through my life. That's all they have to say that's get out of jail free card. Right. Doesn't matter. You know, what was happening all they say is I feared for my life, and then they can just blast away, and, you know, have virtual with no impunity. And it's it's terrible. It's terrifying. I appreciate these people's optimism. I really do. But I don't think this is I don't think this one conviction is going to open the floodgates it. Probably isn't going to be wrong about that. I mean, I'd love to have a bunch of corrupt cops in Chicago get brought up on criminal charges because number one that doesn't happen. Most of the time first of all in order to get convicted. You gotta have a charge brought, but in a lot of the cases they do their own investigation of whatever the situation was the police investigate themselves. And then they say everything looks fine. We check. Yes. I Blitzer happened in this case, I do remember a little bit of this like almost a year after the shootings they released. The dash Cam video nothing happened at this point. But there was so much outrage about it that a special prosecutor had to be brought in the dash Cam video that created the outrage. Yes. Okay. Because nobody knew what happened before that. Because all we had was the cops word can't trust that exactly so desk in video comes out special prosecutor comes in and actually filed charges unusual that on let alone the fact that the conviction happened, that's certainly unusual. But that happens on that already happened on top of something else. That's unusual which the filing of the chargers itself. Usually they just give the cop a paid or an unpaid vacation while they investigate the thing. Then they bring him back on most of the time. Sometimes if things get real sticky forum, if it looks bad they might ask him. To resign, which of course, usually protects his pension or protects his ability to go and get another job with another police department rather than if they fire and for so there's all these like slimy ways that they have to kind of just deal internally with bad behaving cops. That's the way it goes. So you have to get them charged in the first place, which almost never happens, then you have to have the conviction which again almost never happens because still even with all the police corruption that we've seen out there. They don't put somebody on a jury who's going to answer the quick because remember there's the VAR dear process where they select the jurors, and they ask them certain questions, and if one of the questions that they ask is well, are you biased against police officers? If anybody says yes to that that question. Yeah. Goodbye done gonna sit on that jury. So the kind of people that get picked for juries are the sort of milk toast standard. They got a career. They got John go to sort of people who have never heard any of this. I don't know that I don't know that there's endemic corruption in in law enforcement who have never heard any of this. You don't know the history believe cops. Yes, that's the huge. That's the worst problem here. So if you get the so in this case, you actually had a jury that was willing to disbelieve a police officer believe there is in the case of the video which I haven't seen. It sounds horrible. Was it was, but you know, and they actually did the right thing. And now the judge sentencing him give him an easy sentence. I don't know if it's in your story. But I heard somebody tell me that the judge made some kind of statement about how it can be tough for a police officer behind bars. And that was part of the reason why he gave the Senate I did not see that in this story. But I haven't I haven't actually read the whole thing. There are a lot of statements in here from from various, let's go to the phones. Here we got Larry listening in Indiana to WWF out of Evansville. Go ahead. Larry. Yes, sir. The renowned calling is is well, I let me let me agree with you. That officer that committed that murder. Should have been. To life. Risen should've been. Twenty thirty forty years. Whatever. That was an officer committed a crime. Should've been more severely not to fan. But I knew I wanted to dress up you said earlier that we're talking about terrorism. And then then you're talking about police, and you made the blanket statement, I think you said that's what they are the government..

"Jason Van Dyke in the shooting death of and now we could call it a second degree murder based on the sentence. It's very complicated way. I think it's gone too. Judicious job of explaining how he came to this decision. And why the aggravated battery charges that there were sixteen count for sixteen counts of aggravated battery here, which each count would carry a six year minimum term. He's taking those outage rolling them into a second degree murder charge. Which means that this now allows him to chart to to to sentence based not on the. The mandatory sentencing for aggravated battery. It's kind of a complicated. Legal jump rope that he just went through, but he did it. And so it's seven and three quarter years is what Jason Van Dyke gets now. He one months and because it's secondary murder. Stacey Sinclair from the Tribune is reporting a law requires them to serve fifty percent. So he could only serve fifty percent of that seven years in the aggravated battery he'd have to serve the entire six years. So this actually could get him out in just over three and a half years. And then there's a two year mandatory two years supervised release. Yeah. The defense was breathing a sigh of relief when he chose to mention the second degree murder was the route. He was going. Eric Eric Cuban there all morning long for WGN news, Eric can you hear me? Hi can Erica. Yeah. It's been an emotional day of testimony. I just wanted to get some of your thoughts. I it's been watching on the feed I've almost become over overcome with the motion. I mean, there's been some really personal testimony. What is your reaction been to it inside the courtroom is the tension is palpable as it seems on television. It actually is in this case. I mean, there was no question about it that it was a very emotional first half of the sentencing hearing, I probably some of the most emotional testimony came from forty nine year old Edward Nance who from about the moment, he stepped onto the witness stand was in tears almost shaking because of his experience. He said he was pulled over by Jason thank dyke several years ago said several surgeries because of the pain that he was he during in a lot of rest, basically with Jason Fane dyke with his shoulder surgeries. He didn't even wanna look at Jason Van Dyke when the prosecution asked him to point him out in the in the courtroom, and of course, right before we went to break there. We heard from Lou quantum McDonald's. Great uncle who who has been speaking. Tweets the public here as trial has moved forward. Kind of the family spokesperson if you will. And he read a statement of victim impact statement push. She would it as if it was being written by Liu McDonald's. It was his words. But he he wrote it in the first person as if he was look one McDonald's McDonald's, and she said that Jason Van Dyke murdered him. And that he should not go free. When he no longer has a life, which is very very emotional. And that is what the prosecution ended discourse in the sentencing hearing with a very powerful. And of course, the the first witness that they brought in was another person that had been pulled over by Jason Van Dyke several years ago, you said during a traffic stop Jason Van Dyke walk up to the car put a gun to his head and also use the N works in that exchange. Change on a traffic. Stop. That's what they opened with their close with the McDonald's. Great uncle on the stand saying that Jason Van Dyke really robbed the teenager of his life. Eric, I don't know if you've gotten a chance to look over at Jason Van Dyke at all the cameras that we see our only pointed at what's happening on the stand or or what the lawyers are arguing have you gotten any sense from body language or anything what might be going through his head. Obviously, you don't want to speculate. But can you give any sense of the feeling in the courthouse is certainly on the side of the defense table. He looks like he has to out this trial. Just a very stoic. Look a tastefully. He'll maybe say a few words to his attorneys is taking no to some of the witnesses are speaking. But for the most part, she just kind of looks down and doesn't have any real facial expressions at all on his face, regardless of what is being said. I mean, he is paying attention. You can tell that because he is taking notes. However, you can't see anything even try to really read what's going on to its mind because he just no facial expressions whatsoever. At one point one of the witnesses, actually when he was asked to identify Jason Van Dyke. He pointed over to the defense table, and he kind of smiled and he said, well he's wearing the right it's higher. And that of course, meeting that he was in department of corrections. I uniform and Jason Van Dyke did look up at that point. But didn't make any facial expressions toward the witness in really has remained store to out this trial. Now, the sentencing hearing as well, Eric, obviously, if you gotta go, you gotta go I understand. But I just wanted to ask do we have any sense is was lukewarm. Mcdonald's a great uncle the last witness. They're going to bring to have any sense if the prosecution has done and we're ready to get the defense. Witnesses next. The prosecution is done that was their last witness. They didn't enter a few other victim impact statements into the record. But they weren't read into the record. So now, we'll be the defense is turn. There's a good chance that we will hear from Jason van Dyke's wife at least one of his daughters. Both are in the courtroom today. There's a good chance that we may also hear from his father who's been by his side throughout this entire trial. And then we will hear from Jason Van Dyke himself. You will be given the opportunity to make a statement before the judge does hand down his sentence in this case. Now, what we've been told them what we heard from the defense is that their presentation will likely go about an hour. That was a ballpark figure that they gave the judge. So could go a little longer obviously could go a little shorter. But we are looking at another hour once we get back from lunch here about fifteen to twenty minutes. Eric, I know one of the I mean, the defense has a difficult role. They obviously want to when you've got witnesses on the stand who are emotional. You never wanna discredit that emotion. But you're also trying to poke holes or or cause a the judge to maybe doubt some of their testimony. Have they been effective at that? Or does it seem like at least it seemed like reminded that it is a struggle for attorneys to thread that needle. Yeah. I would say it's very hard to tell. I mean, I think one of the lines of questioning that Dan Herbert Van Dyke attorney has really gone after has been to say, well, your memory was better than than it is now is that. Right. And of course, everybody's memory was better when the incident actually happened, then, you know, in some cases up to ten years later, that's one line of questioning that he's going after the other is presenting them with the complaint that they filed at that time and asking them to go ahead and take a look at those complaints. And in some cases, there were differing facts as far as what they told the investigating officers at that time, and what they were testifying cheap today whether or not that defective or not that obviously is going to be up to the judge. I mean, some line of questioning just sitting in the audience and listening to the experience you understood what Herbert was trying to do was to try and make it look like he's getting to. Stories out of these out of these people, but. Yeah. The judge is obviously going to have to take a look at that statement. And what was said in court today under oath mind, you and decide what is more credible? Eric, you're doing great work there. We really appreciate it. Let's get back to it Eric run and obviously call on. And if you got anything else for us, okay? You gotta John absolutely. Before we go to the break. I just want to Lance from GW north got any quick reaction to that. I think one thing is thirty nine needle as an attorney. That's got to be a difficult job. I imagine that. I thought maybe they'd go at some of these witnesses a little bit harder. Because it's the judge that you're you're playing to your playing to jury that might be more susceptible to this idea of emotion, and overcoming that? I I don't know if you've got to watch any of the testimony firsthand. Did you see that difficulty playing out? I did. And Dan Herbert's, a very aggressive attorneys very capable, and he still has that prosecutors style in terms of his presentation in court. So I think part of this is also even though it's not a jury. You're also reading a judge and he's in the unenviable position now of having to ask for mercy for his client in. So even though it's a judge. You don't wanna be overbearing with a witness that the judge may base have sympathy for in want to treat with respect. And so you're not going to beat up and crossing.
