The biting cold of the night air makes her chills and aching muscles feel even worse. She is thirsty and tired. She needs to go to the bathroom, but she needs to ask for permission. Good morning Defense lawyers have now made their case for three men on trial for killing ahmaud Arbery They say that Georgia man wanted to make a citizen's arrest and that the suspect who fired the fatal shot believe he was acting in self defense Prosecutor Linda Dakota asserts that something else was on the minds of the three white defendants All three of these dependents made assumptions Made assumptions about what was going on that day and they made their decision to attack a monarchy in their driveways Because he was a black man running down the street Let's discuss this case with Aisha bell Hardaway She is a former prosecutor who now teaches law at case western reserve university in Ohio welcome to the program Good morning Thank you for having me What evidence brings race into this Well race has been talked about quite a bit throughout this trial The description of the individuals suspected of being on the English property over the months leading up to the killing of ahmaud Arbery somewhere black There's a notably a white couple with a bag seen on the property And so and so the jurors have heard a few different times about the description of suspected individuals on the property I guess we should remind people Arbery was supposedly looking at something on this vacant property where there was some construction going on and that is why the defendants say they found him suspicious Yes for sure But the mention of race is detailed by both prosecution witnesses and defense witnesses throughout the trial And so it would be naive for anyone including prosecutor Donna kaski to think that the jurors failed to pick up on the racial components present in this case Is it tricky to bring it up explicitly because however much we know the history of race in America and know the race of the individuals it's hard to prove in court what was in somebody's mind Sure absolutely The lived experiences of this juror of this jury and the individual's jurors is going to weigh heavily on how they hear and interpret the arguments made by all of the lawyers in the courtroom The hope is that you know prosecutor Donna caskey I think her hope would be that she's read the jury accurately and that no one would be put off by by her assertion you know that this is essentially racial profiling that led to the coronary confrontation and killing of mister Aubrey But that remains to be seen Oh that's fascinating So you might as a prosecutor are for that matter as a defense attorney be explicit about this or just let it sit there and be implied depending on your best guess of what's in the minds of the jury members That's right That's right So let's talk about the defense here Travis mcmichael the man who actually fired the shot said he was acting out of self defense and here's his lawyer Jason Sheffield Let's listen You are allowed to defend yourself You are allowed to use force that is likely to cause death or serious bodily injury if you believe it's necessary I have to note Kyle rittenhouse in Wisconsin pleaded self defense in the jury agreed the other day are the circumstances significantly different here Sure they're significantly different Simply as it relates to whether or not anyone was actually attempting to encounter the mcmichaels already Bryant I find it really interesting The clip that you just played if you listen to that that defense lawyer skillfully paused and inserted his client's name into an incomplete description of the Georgia self defense law And if the jurors were only paying attention to that particular clip which many I think hung on yesterday during closing arguments they might walk away with a false impression of what Georgia self defense law allows Well let's talk about that law specifically and also about race This race is I think a thorny question If you're a white person and you believe that you are in danger and acting in self defense and part of the reason you believe you're in danger is because you're confronting a black man is that still a legitimate self defense claim in Georgia Not to use deadly force In order to use deadly force you have to reasonably believe that it was necessary to prevent the same meaning to prevent deadly force It doesn't permit the use of deadly force when confronted with anything less than deadly force So a bald and baseless fear that of deadly force is insufficient to successfully assert the use of lethal force under Georgia's state law I believe prosecutors get to make a rebuttal today in a sentence What is the final point you'd make if you were prosecuting She needs to humanize mister Arbery and she needs to make it clear that these defendants acted in concert Ayesha Belle Hardaway professor at case western university thanks so much really appreciate your Travis mcmichael one of the three men on trial for the murder of ahmaud Arbery in Brunswick Georgia last year took the witness stand in his own defense yesterday And pierce W Elliott has been following the trial She's in Brunswick this morning good morning Debbie Morning A lot of people have seen the graphic cell phone video of this killing which is really central to the prosecution's case What did Travis mcmichael say in his defense Well he testified that he and his father Greg had armed themselves and went in pursuit of ahmaud Arbery in a pickup truck because they saw him running down their street he said they wanted to question Arbery about neighborhood break ins after he'd seen Arbery a couple of weeks earlier in a home construction site But Arbery wouldn't stop mcmichael described turning the truck around several times to try to catch up with Arbery as he was running away He said Arbery looked angry with clenched teeth eventually mcmichael got out of his truck with a shotgun and there was a struggle I shot What He had my gun He struck me it was obvious that he was that he was attacking me that if he would have got the shotgun from me then it was the life or death situation That was his defense attorney Jason Sheffield asking the why mcmichael's answer there was he was acting in self defense Sheffield also spent a lot of time asking mcmichael about what he called law enforcement training that he got as a petty officer in the U.S. coast guard his actual job was that of a mechanic And that's interesting Did prosecutors ask mcmichael about this Yeah that was one of the things that prosecutor Linda Donna koski zeroed in on was that training In particular whether he was trained on a defendant's rights under the Fifth Amendment You learned as part of your time in the military that you can't force people to speak with you That's correct And that if someone walks away you have to let them walk away Yes She also asked him about whether or not he was making assumptions about crime in the neighborhood based on rumor She got met Michael to admit that he did not call 9-1-1 before leaving their house and going in pursuit of Arbery That call was not made until just moments before he was killed People are watching this trial very closely How did folks react to mcmichael's testimony yesterday You know outside the courthouse after the testimony had wrapped up for the day Arbery's mother Wanda Cooper Jones said she actually appreciated hearing mcmichael's testimony As it gave.

"Us and death to antifa That unite the right rally in 2017 ended in violence with the killing of Heather heyer In opening statements in the civil case last week against the organizers one defendant dropped racial slurs in referenced Adolf Hitler's mein kampf in a federal courtroom This week opening statements are also expected in the murder case against father and son Gregory and Travis mcmichael along with William roddy Byron The white men are accused of murdering ahmaud Arbery a black man jogging in the neighborhood Central to jury selection were questions on race from the defense as a sign of whether a juror could be impartial Do they believe the confederate flag is a racist symbol Do they support the Black Lives Matter movement Here's defense attorney Jason Sheffield posing a question to potential jurors Who here agrees that people of color are not treated fairly or equally in the criminal justice system The trial against Kyle rittenhouse is also underway He was 17 when he crossed state lines with a semi automatic weapon He was underage so it was not legal for him to have a gun And he shot and killed two people and wounded another at antiracist protests in Kenosha Wisconsin that erupted after a police officer shot a black man in the back repeatedly Rittenhouse is claiming self defense In that case the judge has already ruled the people rittenhouse killed and wounded can't be called victims Here's judge Bruce Schroeder in court The word victim is a loaded loaded word And I think alleged victim is a cousin to it While the victims here weren't black they were at protests in the defense of black lives says Ashley woodard Henderson Co executive director of the highlander research and education center in Tennessee and a leader in the movement for black lives She says watching the three cases unfold We're seeing the disproportionate impact on black lives It's saying whose lives matter and our valuable and whose are not We're seeing judges say that the prosecution can not call the folks that were murdered or that were injured by shootings at those folks can't be called victims but that the prosecution can call them arsonists Looters rioters et cetera Brandon busky is the director of the criminal law reform project at the American civil liberties union One of the main things that unites this when you look at the allegations is you know these are these are all defendants either in criminal cases or in the civil case in Charlottesville who have been accused of actions in service of trying to defend the legacy of white supremacy and white dominance in this country And I think that's one of the most striking things that links all of these trials He points to the white vigilantism in the killing of ahmaud Arbery and the folk hero status of rittenhouse who killed people He crossed state lines to a place he's not from arm to confront antiracist protesters and people crowdfunded to pay for his defense One of the other common threads that I think we need to pay attention to here is the complicity of law enforcement Now now obviously these were not cases of police directly shooting individual as what happened with the uprisings of the past number of summers not just with George Floyd References the concerns and allegations about law enforcement's complicity or willingness to ignore threats in each case The outcomes of these three court cases will be referendums on race and white supremacy in this country he says but the emboldening of white nationalists and white supremacist groups Those under currents are going to require a much broader social reckoning than what these trials can provide When he's watching for are the narratives being spun in court and what the jury's ultimately decide about who deserves to be punished Leila Fulton and pyrrhus You're listening to all things considered from NPR news At four 18 you're listening.
