Kyrie Nichols is a black guy lived in the area of Memphis and on January 7th of this year, he was in his car, according to police driving recklessly, although we haven't seen any video of that, the police nevertheless, and this part of it is on video, they pull them over and then they walk up to the car and yank him out of the car and tell him to get on the ground. He seems to be complying. He says, okay, okay, okay, man. And while he's on the ground, they tase him. They hit him with a taser at which point I think natural flight kicks in and he begins to run. So they chase him down and unbelievably. Beat him to death. So this is anyone who's seen the video, Debbie and I watched it. I watched, I'd watch one version of it yesterday I watched another version this morning. It's really hard to justify. In fact, David's reaction where she goes, well, this is worse than what Derek Chauvin did to George Floyd. This is inexcusable. However, the policeman, the four cops who did this, were black. There wasn't a white policeman involved at all. And so for the left, this has become a little bit of a problem. Obviously, it is a clear case. I think it's a clear case for anyone who sees the video. In this interview that she did with CNN, she was very measured in her words, but she was very honest. And she said that the taste is really bad. She was outraged. And the other quote that she said was, you will see acts that defy humanity and that the video in her words is alarming. And I'm going to defer here to the police chief because I haven't seen the video, but I'm going to trust her. And if she says that it's worse than the 1991 beating of Rodney King in Los Angeles, then Todd, we have to we should be going with that, I do not like videotape that's taken out of context. I was not just a snippet. I'd like to see the whole thing like you're saying, what led up to the original stop of the driver, how to see then get away, how do they encounter him a second time, what precipitates the beating and his mother, by the way, says that her son was quote beat like a pinata.

Well, listen, people need to know that the alliance defending freedom ADF. You guys are heroes, unfortunately, you're very important at this time in American history. We need folks like you. Fighting in the courts for the constitution. So we're great to we're grateful for what you all do and we're grateful for you in particular today for coming online because many people want to know what happened in the Supreme Court in the Supreme Court recently with the two rulings. So for people who really haven't followed the ruling specifically the one about the one that was struck down, I guess it was 6 to three. And then the one that was not struck down, tell us a little bit about those rulings. Sure. So back in September, President Biden announced that he was going to require the federal agencies to mandate vaccination. And his chief of staff even called this a workaround knowing that federal authority wasn't there to implement these requirements. And so the agencies, the federal agencies, began going one by one and requiring vaccination in areas that they could control. And the occupational safety and health administration, which is part of the Department of Labor, issued a requirement back in November that all private employers with 100 or more employees require those employees to be vaccinated or if they chose not to get vaccinated. They had to be tested every single week and they had a mask up if they were unvaccinated. So they sweeping mandate covering over 80 million American employees. Simultaneously, the center for Medicaid and Medicare services CMS issued a mandate requiring healthcare workers at 15 different types of facilities that receive either Medicare or Medicaid funds to be vaccinated with only very narrow exemptions. So that covered over 10 million workers. So right there, you have almost a 100 million Americans covered by federal mandates. And those were the two mandates that the Supreme Court took up at Earl argument on January 7th and issued decisions last week. The osha mandate, the one that covered the private employees, the 80 plus million private employees was struck down like you said 6 to three. And the Medicare and Medicaid mandate that covered healthcare workers was upheld by a 5 to four

Supreme Court to Hear Oral Arguments Over Vaccine Mandates on January 7

"Supreme Court yesterday agreed to take up disputes over the Biden administration's nationwide vaccine or testing COVID-19 mandate. This were large businesses, 100 or more, and a separate vaccine requirement for healthcare workers. The brief court order said that the court will hear oral arguments on January the 7th in two different cases. The court delayed action on an emergency request of both of these the plaintiffs were asking for an emergency ruling, the court denied that. And appeals court on Friday allowed the workplace mandate which covers about 80 million American workers to go into a fact prompting businesses and states and other business groups to ask the Supreme Court to block it. And the other case concerns whether the administration could require healthcare workers at facilities that treat federally funded Medicare and Medicaid patients to receive shots while litigation continues. So I guess we'll wait until after Christmas January 7th to see a resolution on this.

"Officials announced 2809 additional cases of covert 19 today and said that five more residents have died. The newly confirmed cases is the first known case of the UK Corona virus variant in North Texas. The more infectious variant was found in a Dallas man in his twenties with no recent travel history outside the country. The man is stable and in isolation. It's the third known variant case in Texas. The state's first known case of the B 117 variant was confirmed on January 7th and Harris County.

Yeah, cuz you know Glenn Kirsten believes it's illegal both on a state and on a federal level. You know that Georgia. I mean the state of Georgia could go after them. Now this guy's going to have so many so many legal problems. I mean as soon as as soon as that January 20th comes do you think he's going to leave the country before January 20th? I did not know. What wasn't I mean there was some indication that Air Force One was going to be go to Scotland. I guess I don't think Russia has much use for him anymore. If it comes out later if we get a little more data on on voter suppression via the post office than maybe at that point right now. No one's even really looking at it. So like the day after the election In most of the states most of the Swing States as long as it was postmarked by a certain day, even if it arrived a day or two after the election, it would still be counted but the post office delivery in the the Battleground States that had yet to be called was like 10% lower than it was anywhere else and that's and certainly they knew that Democrats were most were the ones who buy large numbers were wage were using vote-by-mail. So it would have a disproportionate impact on Democrats and it was a Washington Post article. I thought it was like sort of the best analysis. I had seen or the most striking members I'd seen of it, but I hope we'll see a lot more of that sort of analysis cuz I've also seen some people saying It wasn't that bad. You know, they were going to they were going to destroy the equipment anyway, and I don't know. So right now there's not a lot of pressure on him. I don't think no one's even looking at him. "And honestly, I haven't had time to double-check the numbers myself, but I would say this is worth looking at how about Kentucky? Because it really looked like Amy McGrath was going to beat Mitch McConnell. I mean you didn't see that's the thing. Yes. I mean every day every election is worth looking at and certainly with someone who's been as problematic as Mitch McConnell. I think that weighs into it if you have to divide up your resources on on where to spend money to try to make sure outcome was correct. That might be a good place to look. However The polls did predict a landslide victory for Mitch McConnell. So the he was named silver gave him and gave him a 96% chance of gaining and Amy McGrath of four percent chance to give you an idea that's based on his compilation of the polls and the exit polls also predicted a victory by ten points by Mitch McConnell. So he had a lower wage rate. The thing is what some people don't tell you is that she had a lower one like so just before the election he was up between 39% and 44% to 44% poll had a number for McGrath to and it showed her at 34% So he was expected to win that said according to the exit polls. He won by more than he was expected to win by so he was expected when club or heard by ten points and he caught her by like nineteen or something. So that's a pretty dramatic shift. It is where I'm not going to say. Any racism is we shouldn't look at we should look at it. Yes, but he's dead. That 18% number was largely his National approval which was very different than his approval in the state of Kentucky that the 18% number that's been going around and that The Raw Story reported on was for the most part from it was a national poll. I don't know it was her face or her floors or what but so what I guess what gets me is we do have real vulnerabilities in the system. We do have problems with a lack of transparency Trump and their allies actually got more transparency than most people get because they had So much money behind them that they forced and that they got recounts. We're smaller candidates may be down ballot candidates can't afford them and don't have the money to do that. And for the most part, I mean, I believe all of the recounts that they got and audits that they got a firm the result that is not to say that this was sufficient. I sufficiently transparent election off, but the Republicans really wrote the game the rules of the game, they wanted and not transparent election. They didn't want manual audits which would have brought transparency for all of these Races. They blocked legislation and in February of 2020 that would have required manual audits for all of these races. All of them were really meaningful ones. They blocked that so that I guess that's what gets me is their unclean hands on this issue. I'm not going to lie and say this would that I personally think that was was the most secure election ever or the most transparent election. I know some people are upset that he often takes the police line when he's deciding cases as an appellate court judge, you know and and Thursday that is something that we're going to have to address on the Civil Rights front moving forward in with respect to the new team being brought on at the Department of Justice, but I I think Merrick Garland dead Is a good pic he is like a quiet thoughtful circumspect guy. I'm hoping he's a bit of a quiet storm. And I'm hoping he will appreciate the need to hold all of these criminal politicians accountable for what they have done to us to this country to the immigrants who came here during the past four years. I am I'm optimistic with the pic. So the only thing that I am concerned about is that people are going to say like if Merrick garland does as we both think he should go after Trump and and and all the you know, all the correct page will involved in this corruption is you're going to go well people going to think that it's because I didn't get to be Supreme Court Justice. Are they going to you know, is he going to like try and some come back to that kind of you know, that kind of rhetoric? You know what I mean? Like, oh like I'm sure you could see like a Mitch McConnell going. He's just doing this cuz he he's mad dog. Didn't get you know, his Supreme Court Justice hearing that criticism will come but you know what he's been a prosecutor. He was a judge. He's been criticized plenty. I can tell you as a career prosecutor every consequential prosecutorial decision. I made I got criticized either by the defendant and his criminal Associates or by the victim and the community because I may be declined to bring a charge because the evidence wasn't there and understanding that the criticism is going to come regardless of what decision you make is very liberating because then you just get to make the right decision based on the evidence and the facts and the rules and the Constitution and you don't worry because you're going to get criticized one way or another. I don't think that criticism that will have any legs that because he didn't get his spot on the Supreme Court and because Mitch McConnell unconstitutionally kept him from getting the confirmation number During the Constitution says the Senate is to provide which still blows my mind that we let McConnell get away with that. I do not think people will be like well, then that's why he's going to prosecute Donald Trump for ten counts of felony obstruction of justice that Bob Mueller documented meticulously in the Trump Russia report. I don't think that criticism has any links. I'm happy to hear that. So do you believe then that Merit Garland is going to go after and do what's right. Is he going to go after them and do all the things that were outlined in in the Mueller report? Do you believe that he is going to uphold Justice? I don't see how a law-abiding attorney general can decline to hold this runaway criminal president accountable for his many crimes. So with that being my guide I have to believe Merrick Garland and the Department of Justice off. Hold Trump and the other criminal politicians accountable. I am hopeful that at a minimum the southern district of New York has an indictment ready to drop on Donald Trump's off Ed for what he did at the beginning of all this the beginning being the presidential campaign. He broke all kinds of campaign Finance laws in a conspiracy with Michael Cohen to hide deeply damaging information from the American voters, which is to gain unfair advantage in a presidential election that is wrong three times over and it's criminal two times over and if you don't hold a criminal candidate for president accountable for crimes, he committed to steal the presidency than what the hell is the point of having a rule of law. This is why Glenn I wanted you to be attorney general I I mean because wage No, you would hold them, you know to all of this and I worry again. I worried it's not only me Glen. I know a lot of people my audience I think most Democrats off, you know, and progressives are worried that The Democrats going to take the high road. Well, let's just put the past behind us and look forward and try and you know get some get us all together and have our office and John you don't you don't tell Crime Victims and we the people are victims of Donald Trump's crimes on the coronavirus front and otherwise, you don't tell a crime victim go hold hands with your your attacker your perpetrator. It's the exact opposite of justice and gosh. I hope Merrick Garland doesn't do that to the American people. Would he be your first choice? So I'm not concerned about the well Mitch McConnell didn't give Merrick Garland his confirmation hearing complaints. I'm less concerned about that. I'd be more concerned about people saying wait a minute women Donald Trump fired you Sally Yates and prepare our and ran you out on a rail in disgrace. Not really but this is the way the argument would go and therefore you cannot legitimately supervise an investigation into the man who fired you and ran you out of Washington. Now, the concern is the Department of Justice ethics office might actually offer an opinion that Sally Yates because she was fired, you know, she was shown the door by Donald Trump..

"And we would meet with every single police officer or agent who made the arrest the day before we would assess the evidence supporting the lock up and then we as the prosecutors had to decide whether to charge the case or defined to charge the case and think about that. We have 75 to 150 normally over the course of the last couple of decades. They only made 52 arrests during a mass Riot with with enormous property damage with assaults with disorderly conduct. How is it that they couldn't lock any song? Use people up now the flip side of that coin. I want to give law enforcement. It's do when you're in the midst of a riot. You don't want to take a lot of law enforcement resources away from that situation and there is an argument that if you start locking people up every person you lock up becomes a resource-intensive operation, you've got to get them safely transported down to Indiana Avenue where MPD headquarters are located you have to process them you then have to transport them to the central cell block for their first court appearance. I get it but none of that made sense. I've sat through so many protests and the aftermath of so many protests were there were tons of protesters arrested and John these are protests largely that occurred out in the street where you have heightened First Amendment protections as opposed to you storming into the capitol intending to commit an offense their job. Which happens to be a burglary and nobody gets arrested for any of that that makes no sense to me everything about the way this was policed stinks off. So so you think it was the calculation but by who by I mean who who is in charge of these police? I mean like he hasn't thing. So I just thought you said this is like the big day you would think they would have had like like I don't know what if it's a national guard but you'd think they would all expect this to happen wife who who was in charge of this clan. Well, I don't know who was in charge I can tell you ordinarily when there are these kind of joint operations with several law enforcement agencies, both Federal and DC local there are standing task forces and I've been part of these task forces over the years where you know, relatively high-level people in each of these years. Agencies get together in advance, they divvy up responsibilities. They cooperate they coordinate they will put one agency head nominally in charge, you know, but they're kind of equals among equals and anytime you have multiple law enforcement agencies involved in any operation trust me. There's a good bit of chest bumping that goes on and jockeying for the lead and all that kind of thing often. But when we no protests are coming up we know how to prepare for them. Well, we knew this was coming up. Yeah and nobody prepared for it. That's not an oversight. That's not an admission. That's a calculation. I can't say precisely who was in charge of coordinating yesterday's law enforcement efforts, but what I can say is we didn't really seem to have a Department of Homeland Security presence, right the way we had when it was black lives matter protesters, which were certainly the ones in DC at Lafayette Park were entire. Yep. Peaceful until bar set out to gas the protesters. So Donald Trump could cross the street stand in front of a church. He'd never attended and hold up a book. He'd never read right that was a largely peaceful protest and look at the police response to that yesterday was a lawless Riot nothing peaceful about it. And there was no law enforcement response and I have took away that at the feet of Donald Trump because ultimately when it comes to all of the federal law enforcement agencies Trump is the top man. The president is the top man with the exception of the the little police. They're actually under the control of Congress. They're the only federal law enforcement agency controlled by Congress not controlled by the executive branch ultimate the president. So that's who's responsible and whatever messages he sent out whether overt or with a wink and a nod the way Trump does like he had love for you to find me 11 a.m. Thousand votes to fall off the back of the truck so I could be declared the winner, you know, you know how he operates Michael Cohen told us how he operates. He said there was fraud he can never admit that he lost because he has a problem with being called the loser. How long did it take the democrats to decry that violence. In the name of social justice it was long after the democratic convention. The joe biden finally did just that. She got away capital police where In full pursuit and wound up at the capitol building where sadly one of the There was a gun battle that ensued and she'd lost her life as a direct result but again to see something like this unfold in real time scenes of rioters confronting police on the capitol steps and then scaling the sides of the building and sitting in lawmakers chairs and just causing destruction throughout the best word.
