Which is a newsletter. Available each day. He's also author of the book Obsession Inside the Washington Establishments. Never ending War on Trump, Byron. Good to Have you back. Good. Good to Be Here, guys. Thanks very much, Yes, that you've got a lot going on, obviously. And in your latest daily Nemo, you dive into some of these legal arguments and they're really in some ways process arguments. From various Republicans, particularly in the Senate about the upcoming impeachment trial. We know that the impeachment article being transferred over the Senate today with a start date on the trial. February the ninth, so a bit of a delay there, which is what some of the Republicans have been asking for. They've gotten it before we get into some of the other ancillary questions and details about the trial. It seems like and this is based on your reporting. What a fair amount of the Republican opposition to a conviction here in this impeachment trial will be rooted in the question of whether or not it's even appropriate or permissible. To host a trial like this against an official who's no longer in office. Walk us through some of the details and some of the relevant history on this. Well, there's there's been a big debate before Donald Trump River appeared on the scene. There was a big debate over whether a former official can be impeached and tried and removed from office. OK, so the The Constitution, says. Quote Article two section for the president, Vice president and all civil officers of the United States shall be removed on from office on impeachment for and conviction of treason, bribery and other high crimes and misdemeanors. So we hear we've heard that Ah lot and Republicans. In this case we're going to say Well when it says the president shall be removed. That means the president. There's only one of them at a time, and Donald Trump is not the president. Besides removal. The you know an impeachment is the Constitution's main methods for removing a president who's committed some sort of serious misconduct. Removal is irrelevant and Donald Trump's case because he's been out of office. His term expired on January 20th. So Republicans were going to say, Why are we having this big trial to remove a president who is already gone? And Democrats are gonna say well, there's an additional penalty. An impeachment if if someone is impeached and convicted, the Constitution says that punishment will not go beyond shall not extend further than two removal from office and disqualification to hold and enjoy any office of honor trust or profit under the United States. That means a federal office like the presidency or senator member of the House. So Democrats going to say that the president's the former president Trump's actions were so serious in the first couple of weeks in January That he must be forbidden from ever holding office again. And that's what the big fight is about. And what you there the way you phrase your question, I think is correct, Which is I think there's some Republicans were going to say, Look, we don't even have to get to the merits of this case. That is whether the president incited insurrection because it's just a fact You can't impeach Ah, president who's already Out of office and they might make the argument is well, Byron even if there are people arguing, yes, they can write. It is legally permissible. They might summer arguing that you and people can come back and say OK. For the sake of argument. Let's say yes, you can do this. And obviously that mean the trial's gonna happen. So it looks like the process of Lisa's moving forward. There's also the prudential question of, should you it does is there A good reason to do this right if he's already gone, and for for some who are very critical of trump on what happened after Election Day, all the way through January, 6 in particular. Touchstone. There is going to be accountability and then for others, it's going to be okay. Whatever you think of what happened, And to be sure, Trump acted badly. And maybe we could have discussed a censure. But why are we wasting all this time to remove someone from office who is already removed from office because his term expired? And I guess you know you want to maybe get to 67 votes, which I think will be very hard to do to convict the guy to then bar him from office, which only takes a bare majority, but the prerequisite is conviction. On and you can also Debate whether or not that's the right decision there as well, because, you know, I think I've been very critical of President Trump on what he did what he said the lies about the stolen election and fostering the environment that lead To that violence in the siege on the capital, But I also sort of feel like if voters decide four years from now that they want him back. I kind of believe that should be up to voters in the United States right to to the citizens of this country, as opposed to up to, you know 51 or 50 senators, plus a tie breaking vote. That's sort of how I'm wrestling through some of these questions on I just wonder on the threshold question. Byron of whether or not this is Even allowed it. All right. I've heard arguments on both sides. Constitutionally of this. There's on Lee one tiny precedent right in today involving a non president who resigned from a position of power. Tell us about that and how it might be relevant here or how it might not correct. First of all, we should say that there is no precedent at all for this in the sense of former president being tried from people's just never ever happened, But they do point to a case of a Cabinet officer, a man named William Belt. Knapp, who was the secretary of war in the 18 seventies and the Grant administration. He was accused very credibly is guilty as hell probably of financial corruption. And so on. On this day that put the house is scheduled to vote to impeach him. And a couple of hours before the scheduled vote. He goes to the White House and resigns. He goes to President Grant Any resigns, and then he says, Well, hey, you can't impeach me. I'm a Warmer official. Well, the house went ahead on impeached him, and then it goes to the Senate, and there's a big debate over well, he's a former official. Can we impeach him or not? And they have a vote. And that's a it's a majority vote of the majority says Yes, we can him impeach him. So then they have a five month trial pretty long deal and he's acquitted because you know that you have to get to a two thirds vote to convict and they didn't get to that. And the reason they didn't get to. It was that there were a lot of senators who believe that it was not in their jurisdiction that he was a former Um, a former official and not in their jurisdiction. So is maybe not about it was not about the guilt on the merits necessarily was about Should we be doing this here? Under these auspices for this purpose, given the fact that this former official is indeed former. So this sort of vote the votes against conviction on that principle rather than the facts of the case. Correct. I think he was. There was consensus that he was guilty of what he's accused of. Now, here's the thing. So that is the one president that Democrats will point to here. But there's a lot of other presidents of officials either being impeached or being threatened with impeachment or impeachment has begun. The process has begun, and they resign and then Congress just drops it. Most of all, obviously the biggest issue. Biggest example of that is President Nixon, who resigned in 1974 ahead of impeachment. But most impeachments in this country involved judges and there've been like close to 50 judges who are either under investigation or impeachment had begun. And they resigned. And then nothing was On, even though his judges they could possibly hold a position under the United States in the future, But they were like qualify. Alcee Hastings opted. Alcee Hastings is a Democratic congressman from Florida. Who is himself an impeached federal judge for bring a bribery and corruption. I believe if memory serves, and he was able to then move on and run for the house and women, and he's been there ever since. He was in peace and removed but not banned from holding future office and the voters in Florida decided to send him to the house. And there is so there you have that there are these two questions. There's There's yes, there is one president in the belt nap case before impeaching a former Cabinet secretary. But then there's all these other examples like dozens of examples of Congress deciding to drop an issue once the person has resigned, and by the way, you'll you'll hear Democrats say, Well, gee, if we don't Try President Trump. Then president resigned right before impeachment and escape all punishment, as if resigning is not a rather large punishment for president. You might wanna ask Nixon about that. But the fact is, that's not even an issue in the Trump case because he did not resign. He served out his full term terminated at noon on January 20th. And now he's the former president.

I believe but when you talk about what works. Maybe they're not looking at just northern colorado Because they feel and and really they they are kind of on a maybe on a bigger scale. I mean is that fair to say with whether disc distribution so to me and this is something that i would be curious. I'd love to sit the normal juicy bits next to it. I don't think that i don't think personally. I can. t determine the difference. I think you might because the like. I said if you put your hand over the top of the cup and then swirl it and trap those vapors in there and then just put your nose right up to it you might see oh my. There's an awful lot of hop aroma. That one but not as much on this next one and it it you see how it yeah no. I just a lot more danger when you do that. Then you thought it did and it's because you're really concentrating those hopper on this right in into your nose double hop why. How about that. So dry hopping is usually after fermentation. After at least the initial stages of fermentation you're going to throw hops into that. And let them sit there and get more hop oils and things added to the beer after it's been processed through the fermentation wet hopping. Which is actually. Just hopping is done during the boiling process. Where you boil the wort while you're before you even start to do the fermentation and you add the hop oils. To make bitter can't be heat makes things bidder hop wheels get bidder when the heat and so a normal hopping glad bitterness and dry hopping. We'll just add the oily aromas and flavors. When i've always i guess it might be what i call it but i. I know fresh shopping hopping. I've always kind of called the same but those are when you when you have hops. You dry them out. I pick them. And that gets all the water out of them. And then usually pelt is moore something but what hopper or Fresh using straight off the vine literally pick them and throw them in the beer. What's the pros and cons of this. You get a greener flavor on the wet up. Midday tastes more. Like is as if you were choosing a hop cone right off the vine as opposed to really extracting those those Dried flavors that are leftover after the processing of the hawk eye a preference both of l. e. opened this by the ever present but wet hopping can be done as a dry hot stage or during the boil you can add wet hops. It either one of those two. I think it depends on the beer style. And the whole it's profile. You're looking for the word is dry hopping more unique me because you see people market. The dry dry hopped this or try. How you don't see what on anything right is is wet. Hobbies is up is more consistent. And i may. It might add more preservative powers to the beer so they left. The beer might last longer but it basically it just adds more bitter. If that's mostly the reason why you do this to add a battering components. So here's a here's another dumb question. We'll come into dumb questions with chad. And tanner chad's questions drink. Beer i know but so i learned this in my brew class but the other half escapes me right now because we've been doing. Wapa's when you when you put it's not the hops when you put them in that determines can you put let me rephrase it came if you put hops in earlier or later can determine a the flavor or be the smell and characteristics or is it a combination of. Yes so it can do both so when you would. He put in the hops later. That's more for smells at correct. Yeah so the early hops mostly bettering in that bidding translates to flavor. That's the bitterness of the beer. Okay that's your. That's your bitter comp onto backs up your mall and then anywhere around forty five thirty twenty minutes. There's going to be a flavor that's never came and then anything after that's mostly aroma but everything it's mostly because it doesn't always work that way and hops are different depending on the structure the hops but yes in early speaking with anything to add to that or i would just say that. It doesn't look great for liquor stores to be saying this as the we know liquor sales were up a lot in twenty twenty so they're one of the industries that made money in two thousand twenty. There weren't a ton of industries that can say that. So when you come out and say this already You know. I'm a little skeptical about what they're going to try and say here because we've got industries that are still still struggling to survive days into the new year the owner of morgan's liquor in denver sat down with his financial books the pandemic the pandemic gave him a small boost in twenty two thousand sales but troubling slide continued. His customer count continued to decline. My dollars were up. The rings on the register were baker but my customers were still trending down I've been on a big were big downward trend ever since january of twenty eighteen. So what what Jim archibald thinks is the problem. it's because of two things. A pair of laws that took effect in the past five years that expanded sales of full strength beer two grocery stores a lot bigger liquor retailers to dominate the market once reserved for mom and pop owners. This i agree with this will hurt alcohol sales for liquor stores. We thought going into twenty twenty the start of in january before we knew anything. Anything else was going to go on We thought the biggest concern facing talking about On brew talk was literally worried about liquor stores and if they were going to be able to compete now that target and target yeah target walmart some of these other big retailers gas stations can sell full strength beer. If new legislation is approved an existing laws will allow some retailers to add even more affiliated liquor stores starting at twenty twenty two. This is where i disagree. I don't think that the delivery and to go cocktails. I don't think that's going to have much of an impact at all on liquor stores. I really don't because you can get them to go from a restaurant but you're not going to go specifically to a restaurant call and say hey. I just want some beer i just want. I don't want any food because you have to order food along with it And i feel the majority of people when they're going to pick up something to drink. They're they're not going to be going to a restaurant to pick that up they're going to go to the liquor store get in get out and get to wherever they're going a lot of still with this pandemic and i believe that it will stay that way for a while Meaning most of twenty twenty one. That people will not be going out as much still so. I don't think that the to go cocktails and the delivery Really is is the thing that should hurt liquor stores. I think in fact that delivery service should really be helping liquor stores as they move forward. The new laws approved in two thousand sixteen to expand who can hold liquor licenses and another two thousand eighteen to expand beer sales at grocery stores. Gas stations and big box retailers represented the most significant changes to the states alcohol laws since prohibition the shifts in the retail landscape created distinct winners and losers a reality governor lawmakers noted at that time of the legislation's passage In now says the table for more potential changes in the twenty twenty one legislative session. I don't worry about twenty twenty two. I worry about next month and the month after that and who's going to open the next store it's just a matter of time the ink on that New laws barely starting to dry and they're are changing at least two. Liquor store owners and other retailers will were. It will cut into their business. I don't think it's going to be that big of a deal. People don't will not go to restaurants just to pick up their beer and leave. That's that's not going to happen if you have if you need something. If you need some alcohol you're going to go to the liquor store if you want food and alcohol great. You might go to the restaurant. But i cannot imagine that. The number of sales of the percentage of sales for people who want that is going to be big enough to cut into what the liquor stores are doing. We know the economic recovery for restaurants. Taverns is going to be years and want to make sure they have all the tools that they need to restore colorado's food and beverage. Seen bridges explained the greenwood village democrat also plans to reintroduce legislation that failed in the two thousand twenty seven to allow liquor stores to add more locations. The legislation is controversial because it reopened the much disputed compromise that led to the changes five years ago.
