"I am your ring master James Sears yesterday the Attorney General announced that he is going to sue Google it reminded me of a conversation that I had last year with the miss Christine Jones this Christine Jones formerly of go Daddy she's a world expert on technology law we welcome her to the center ring of the conservative circus the Attorney General has made the announcement that he is suing Google for their data gathering and tracking practices now now you and I covered this awhile back Christine Jones can you give us a refresher did I want to know what you think about this lawsuit Hey good morning James always good to be in the range with the remasters thank you for having me and I did listen with interest yesterday when you were talking to mark Brnovich about the lawsuit that the state of Arizona bride and it's always a little chilling when you really start to look at what is being collected about you but you engage online and you and I spent some amount of time trying to train people and you know trying to bring attention to the fact that there really is an embarrassing amount of information that's held about you by people who service issue news so that I you know I guess the bottom line here is if you don't want people to track you don't use it but you know we can get into a little bit of more of the specifics about what we think that's what it is going to accomplish when you talk about do you know if you don't want people to track you don't don't use it but we're being told that Facebook can track you and Google can track you even if you don't use their platforms is that true well you know you and I as we say you and I talked about this in the past and we all walk around with a little tracking device for the most part in the form of the phone and even when you don't have a service honor you're not logged in they're still a microphone in there still a camera and show most of what you can what you engage in as being being listened to a recording you know that because sometimes when you go online and you had either a search experience for our conversation did advertising popped up exactly designed to address the thing that you were just discussing right so you know what's happening now that the suggestion that we all leave our phone home or we all turn up every device is that realistic right so the point being is you know how to find without online about you and know how to delete it yeah well we said when we talk about that I think this is what the Attorney General is going after with Google's because I mean it if you were just as simple as having up often on switch or maybe a three step process that would be fine but what that video we did together it was way more expensive the thing that you had to do and we start talking about Google it's even worse I would even say Christine Jones is damn near impossible for you to disconnect from from these services it's virtually impossible to disconnect and as you know because we spent a lot of time going through sort of a tutorial about just on stage but how to get information disconnected and deleted it takes an enormous amount of effort and you have to go side by side by side right with Google if even a little bit worse because if you're not a relatively savvy user and you're not actually going into your history in clearing it and going into a recorded conversation the clearing them they sort of laugh in order and are collected in perpetuity and what you say in any given conversation might not be private you might not care you're a public figure what you what you say is recorded in printed and shared and your rosters had the conversation a minute ago about being an influencer you want people to know what your say but the problem is the collection of everything taken together all the people you know all the people they know every place you spent every restaurant eat nap all of that collectively forms the context about you and enable algorithm and now artificial intelligence to actually predict your behavior and the behavior of the people around you and worse it allows those platforms to influence your behavior and that is a dangerous position for us to be in it and sort of white Attorney General Brnovich brought this lawsuit and I think also in addition to being in a fight with Twitter it's why president trump issued default executive order yesterday let me ask you about that real quick Christian Jones that Christian Joss is formally of go Daddy a world expert on technology law we're talking president trump is going after the CD eight two thirty yeah I believe that's bad that means they're trying to say that Twitter is a publication like a newspaper and that way it opens them up to lawsuits do you think this is a good move by the president by the administration what twenty not everybody is an expert on section two thirty of the CDA I mean we've been trying to fix this thing for over a decade now and it's very difficult right because if you think about that the mind numbingly huge number of entries that are going on online every day it's impossible for anybody to monitor right what I'm up to hundred billion tweets every year so it's not like Twitter can go read every tweet right that it's not humanly possible but the problem with the CDA is it gives this nice safe harbor neutral platforms that were never intended to to monitor or change or have judged on content they were just there to make a free open exchange of ideas you are the content creator what you put out there is your responsibility here's the rub when Twitter becomes an arbiter of Facebook becomes an arbiter than they make themselves more like a newspaper and newspapers news reporting agencies are required to vet the truth of the think they publish in a Twitter wants to put themselves in that position by saying what you said was true or not true by fact checking things that you're putting out there I think that the president's opinion pieces is not true and here's here's better information about it they walk right into the trap the CDC doesn't protect and that's exactly what the language of president trump's order does it provides a pathway for regulators to strip platforms like Twitter and Facebook of the protections under section two thirty that I think is why the move by our Attorney General and a by president trump is down right brilliant we have another Lachlan may shift from lord does see at seven forty eight and we also have the conservative circus clown of the week there's no way to to argue around us we are in unprecedented times and there is a palpable fear of the un known however there is a silver lining and that is.
