"Away from the police. So why didn't he just stop and do with the police asking him to do? I couldn't hear that. All I heard was screaming screaming, my ears is ringing so It was all muffled. If the police were fighting mean if they were, they were tasing me. I was stopped walking away from them and and they would have my attention. I mean, I had not left or tried to run at that point. That when a Taser me I have my hands up. No, he most certainly didn't And In fact, the reason that Blake was able to quote walk away from the situation is that officers realized he had gotten the knife from his pocket into his hand and was waving it at them. This was when they decided to distance themselves from him for their own safety. This was when they drew their guns on him. Former Madison police chief Noble Wray was brought in as a use of force expert in this case, and last week he outlined exactly what was really going on in this struggle. Um Of the officers. Two of the officers are believed that they have seen a knife and they described in their reports. The primary officer involved in this officer shifty has not seen the night. He believed that Blake is going for a weapon, and he describes that in his report. So What you have is that you have a struggle going on. When you have two officers believe that they have seen the night. They describe it in two different ways and back around, and it is at this particular time. That, uh, struggling suits there on the right side back on the right side of the vehicle. They have backed away. They have taste them. Struggle, uh, can continues. And then at one point time when they're back on the right side again, this officer moronic who Shouts. At night. They see the night. See the night. It is that that point where the officers create distance states setback with their with their firearms, and that's what you see on the video. That is the actual facts to which Jacob Lake himself agrees. There would have been no dispute over the facts of this shooting. In fact, Blake and every witness that was on the scene told the exact same story. Blake was lying throughout his interview with Good Morning America and either Michael Strahan and the Good Morning America producers who are researching this story didn't do due diligence, Heck, any diligence in researching this or they were intentionally trying to manipulate their audience by presenting so incomplete a story Has to be factually inaccurate. Let you take a guess as to which one they were doing, because they, of course, gave the last word to Ben Crump. Likes attorney or critics who were going to say, Well, he's had run ins with the law in the past. He doesn't deserve any sympathy. If you are black person in America, and you are not perfect. Then they say, Oh, it was justified. It's like I shouldn't have to be Angels. Um No. Let me remind you of all the things, Mr Crump. That your client admitted to mention Jacob Lake would be a star witness. Okay, absolutely necessary Witness if anyone was to say that officers, Chesky was going to be charged with criminal behavior You would absolutely need to put Jacob Blake on the stand, No doubt about it. And so the question would be. Are there a lot of things? He agrees with the officers on and there is, he admits he got into an argument with the quiche A Booker. He admits he wouldn't give back the car keys. He admits he was armed with a knife. He admits he physically struggled with the officers. He admits he twice ripped out the Taser probes. On continued on in not complying with the officers. He admits that he was attempting to get in the driver's seat of the SUV. But Blake, of course. Was an angel in all of this. Just ask him in the very last thing you here in the Good Morning America story. We know your kids who were in the car. Have you had any conversations with them about this sense? It all happened. I've explained to him that broke down, so I'm like Daddy can die, but For some reason I did in that day. He lived so that he could spread apparently, Ah, whole lot of lies on national television..

Because you know, in the national anthem only this show you people can see when the game starts. So we decided we know that when the game starts, people gonna be paying attention. "This is one of the biggest mistakes that is out there. I will tell you that the election has changed me. And what it has changed in me is something that's long to an extent bothersome and that is is that I've always viewed the show that I do. For the shows that I do. I can reach lots of people. I know that I have opinions. I have thoughts, but the style right? I'm I'm not a red Mika. I used to be a red Nika, right? What I found is that if I bring it down a little, and I just engaged the way I know how to I I reach more people. People connect to it better than if I'm just, you know. Yelling, screaming all those kinds of things, right? I guess it works for some people. It doesn't work for me. This is work much, much better in the success proves it right And I know that I can reach people this way. What the election is told me is that maybe not Maybe Tony, your audience 74 million people. And maybe just maybe things that you have been discussing about content and culture are very true. But it just needs to be focused. And people will eventually come around because they'll be like, Hey, what's that cool stuff over there, Right? It's like when you see a line in front of Russian must be a good restaurant. I'd better get online. That's now my entire methodology. Just it's the old Steve Martin line. Be so good that they can't ignore you. My focus is on this. This group of people, some of them willing to chance on a plane agreed. Not the thing I would do. Why? Because when you're on a plane, there are rules. Sit there. Be quiet Peanuts don't cause a problem. It's a plane. I wanted to take off. I wanted to land. I want everyone to live. Get off the plane. Once you get off the plane, do anything you want. You be as as angry or as whatever as you choose on the plane, you act the part of the lady or the gentleman. That's what you do so now. I don't approve of such a thing. I don't deny that those people are infuriated. Which brings us to this real interesting constitutional question about the Electoral College challenge, and I'll get into that. But first one of the big stories from yesterday no charges against the officer who shot Jacob Lake. Jacob Lake Black Man, Kenosha, Wisconsin. Was reaching into his car. And police shot him seven times. That's the way the story gets told. That's not the entirety of the story. The entirety of the stories that Jacob Blake was in a place he wasn't supposed to be. There was a restraining order against him from this woman. Hey, was there Jacob Blake would not listen to police. He would not obey commands at all. Jacob Lake had a weapon in his hand. He had something in his hand. I'm gonna call it a weapon until someone can prove to me otherwise. Jacob Blake went to the front of the car, opened up the driver's side and leaned in supposedly a knife on the floor board as well. That could have been what was in his hand. Police telling him to stop and he wouldn't stop in the car. Three Children now. You want to just say? Well, why the police shoot him seven times or do you want to ask the question? Why did he not listen? Why did he not listen? What's what's the purpose? What was the point of that? I've made the argument that one of the things that we've done is that we have excoriated police to the point where the police are afraid to take action. And then we have so told the populace that the police are racist bigots. This that and the other that they feel involved in not to listen to the police. Because, after all, they're racist bigots. What have you So the police are unsure of how to act and the suspect is guaranteed that someone's gonna take video making the police officer look guilty even if they're not listening. That's a pretty ugly position to be in. And for a lot of people is gonna take away. Um, you know, Rational conversation. Three kids in the car. He wasn't listening to cops. He opened the door and he reached him. He starts turning. If the officer thought that he had a weapon officer is going to fire If he had just gotten his car and run offices over. Would that have been okay? Well, nobody would have gotten shot. That is a nonsense garbage trash answer. Now. I'm not going to argue that Wisconsin is going to have to explain to the people of Wisconsin exactly why there were no charges filed. This, that the other they're going to have to get onto the same page about was he holding a weapon? Was he reaching for a weapon difference between the state police and the prosecutors? But it's not okay. They just think of this In one view. It's not acceptable to say Well, cop guilty know there are times where the cop is guilty. I'm pro cop. I'm not pro bad cop. I'm not pro abusive cop, and I find too many cops be way too abusive. I say so. I absolutely say So, For example, I've had people get on my case about no knock warrants. I oppose no knock warrants. My job's not taking police officer's job easier. I was asked by police officer about this directly. And I said, point blank nose to nose conversation. Polite. No stones conversation. My job is not to make your job easier. I don't give up my right so you can do your work. If you can't do your work, Okay? I'm not giving up a single right? The police not doing Which I think is a very acceptable imprudent way to think. But we're now into the place where we're not listening to commands. We utilize the police for a purpose. And that leads to the whole conversation of Well, we really need to define the police know we need to rethink pleasing No. You meant defund the police. We get you We heard you. You think that all cops are racist and all cops are bigots was the black lives matter? Contingent does And I'm not talking about your neighbor Who's black, are you If you're black, I'm talking about actual, the organization. The Marxist organization. Black lives matter what they think. And this is what they put out there. And they're academics who totally agree with this and politicos. I totally agree with this one. Of course, this isn't true. Are there. Probably cops who exist to our races. Sure, an anti Semite. Sure, an anti gay sure and anti white, Sure, and anti black Sword E could say the same things about politicos and bank managers. "I'm Dave Freeman 6 35. It's morning edition from NPR News. I'm Noel King, and I'm Steve Inskeep. Let's work our way. Slowly through the fax from Kenosha, Wisconsin, the district attorney there, announced yesterday he will not file charges. Against the officer who shot Jacob Blake. Video from last summer shows Blake, a black man climbing into a car at the end of a dispute. When White Officer Rustin Chesky grabs his shirt and fire seven times, Blake was paralyzed. Joining us from Kenosha as NPR's David Schaper following the story of no charges, either David Morning, Steve. Why would the prosecutor not file charges here? Well, District attorney Mike gravely said. First of all, he noted that this decision could spark outrage and protests as we saw last summer, and so we went to great lengths to demonstrate why he couldn't charge Officer Chesky. Or any other officer that was on the scene of the shooting, and he spent more than two hours detail in the investigation and all the evidence and great gravely said this is essentially why he did all that. Everybody has seen the video. And so, from their perspective, they have tried this case at their computer screen or in their living room. As a professional. I am called upon to talk about how to try this case. In a real courtroom. Essentially gravely says that that means he's got to consider all the evidence not seen in that short 22nd video snippet that he has to present to a jury. Okay, He's true. He's right. He's absolutely correct. That video often doesn't capture everything, but I just watched the video again. I mean, you have a man who is moving away from the officer climbing into a car. His shirt is stretching as the officer grabs it, and then the officer Fires, although granted the car doors sort of in the way. What is the video not show? Well, what you're not seeing there is that you can actually see in the video. It appears that the Jacob Lake has something in his hand. You can't really tell what it is. Gravely, says Blake is holding is a small knife, and you can also not see because of other officers in the picture and obscuring him in the car doors in the way that he apparently turns back towards the officer who is tugging at his shirt. And so this is why gravely says that it's Thea officer Cesky feared for his life that the Jacob Blake was going to stab him. And so, he says, This case is really all about self defense, and whether or not he can prove to a jury beyond a reasonable doubt that the officer Was not fearing for his life and that he did not shoot Blake in self defense. Has Jacob Blake or his family? Have they said anything? Blake's father, Jacob Lake Sr. Says he's not surprised by the decision. This is kind of what's been happening all over the country, and he was outraged at a news conference in Chicago with the Reverend Jesse Jackson and others. That Rainbow push coalition like sharply criticized that prosecutors to our long justification for not charging the police officer. I don't care how long you talk. In front of a microphone. There's no justification what was done to my son. What was it like to be among those protesters last night? It was. It was a pretty, a small group, but they were allowed their boisterous They were angry and frustrated by this decision to not file charges. They say that they will continue to make their voices heard until they see some real change and policing. NPR's David Schaper. Thanks so much My pleasure, Steve. In Los Angeles County. "Center picture in that slide was the picture taken from the driver's side floor board and that knife as you saw was open at the blade, right, so that's an open bladed knife. It was found exactly, uh, at this scene on the floorboard of that vehicle. Right? So I described you that both officers described this motion from my perspective. Another valuable piece of information in terms of whether the defense or privilege of self defense is available is that Officer Arenas offers to D. C. I That from his vantage point that I showed you right at the car window. He also felt that it was necessary to fire to be able to save resting Officer Chesky from being stabbed. He offers to D. C. I didn't have to do this, but does say I would have fired my gun as well. Had I had a ability and open shot, because exactly what I saw thinking that That officer Cesky was was a mere a couple of feet away from being stabbed in that situation. Now a couple things matter to me. Officer, Cesky says. We were all aware That Jacob Lake was armed with that knife. We separated away from him, officer says. He says I never felt it was appropriate to shoot my firearm just because he displayed that weapon. Officer. Cesky does not say I felt it was appropriate to shoot my fire him because he was about to flee in a vehicle. He doesn't say any of those things, he says the on Lee time the first time I felt it was appropriate to fire my firearm. Is the on Lee time. Jacob Blake showed any offensive intent. And that's when he made that motion where he was bringing his hand over towards me to stab me with the firearm. Officer. Chef Ski shoots Jacob Blake seven times. Okay, this has been thoroughly discussed. That's a fact that certainly known to the media. What the media may not know. And again. I've heard the narrative many, many times over the last few months where people say Jacob Blake was shot in the back seven times. What we did was we went to Brian Peterson, who was the medical examiner in Milwaukee. So D c. I went to him. They had him look at the medical reports and the X rays. Quite appropriately. The ER doctors in this case we're not prioritizing where entry wounds or exit wounds were because they were trying to patch up and do the fabulous job of saving Jacob Lakes life. Right? So we asked a neck spurt to come in who usually looks a case is obviously when people are deceased, right? A medical examiner and we asked him the way in. And the opinion he is offered is that four of the wounds Harder. Jacob Lakes back But three wounds are too Jacob Lakes left side. Three of the entrance wounds. Ardor. Jacob Lakes left side. Okay, so again. Officer Cesky fired seven times. It is absolutely appropriate for the public. And any of us to consider. Well, is that Seven shots excessive. Is that too many shots. And here's where noble Wray again offers his expertise. He will go. He went into some detail in his report, and I believe we'll talk a little bit today about why seven shots would happen and why that was it is within what he would consider a reasonable range of shots. Most importantly, officer Cesky says, I continue to fire until Jacob Lake dropped the knife because I am trained to fire until the threat stops. So here's what happens, according to the officers. What happens is that Jacob Lake makes this motion. Okay, He's fired on and we know that Jacob Lake ultimately ends up seeded in the driver's seat of the vehicle. We also know that his right hand has the knife. And that is dropped on the driver's side floor board. So if you think about the defense in this case, if you think about how they will talk about this case, right are the physical evidence based on entry wounds consistent with what the officers say. Well, if you go to stab someone Portion of your body that is exposed is the left side. That's what is facing an officer, officer Schatsky, who was firing the shots. I'll show you a diagram of where those shots were located on the body. This is again the best estimate here is Officer Peter Sorry Brian Peterson, the doctor offering that opinion. So you can see those primary entrance wounds right under that armpit. Okay on the side, three of them there. So if the natural reaction of anyone being shot at Is after that occurs. You're turning away from the shots. Then it would be at least a rational argument by the defense to say That is why There are also shots to the back right because they have moved back and we know his body comes back to facing the officer in the back because he becomes seated there now. We have no way of determining which of those seven shots come when so? We don't know the order, right? I'm suggesting to you simply that there is a rational, logical scenario. That anyone defending this case along for these officers would be able to use this physical evidence. I'm describing To be able to persuasively tell a jury. This is consistent with what these officers have told you about what occurred. Okay? And you will hear Officer Cesky said. I stopped firing when there was no longer a threat. Um You'll hear also that Officer Cesky had 10 more bullets in his gun at the point D c. I comes across him so clearly he has not fired the empty all the chambers of his weapon. Hey, stopped volitional e firing that weapon. He indicates why or when he did that? I want to mention one other moment that mattered to me. I don't know if it will do you, but I just thought it has to do with the tremendous difficulties and challenging of modern policing. In the era that we're thinking about today. Officer. Cesky says that after he finished shooting That Jacob Late came to seated situation. He put his weapon away. Immediately tried to determine whether any other weapons were a threat. And then he pulled out. Jacob Blake and immediately began life saving measures on him. That's also reported by the video Agra for In this case, who says a civilian witness, those officers took him out immediately and began to help him. And here's a moment that I thought mattered because it talks about all the things that we are demanding and expect of officers. Because This is seconds after Take a Blake. According to Officer Cesky is moving a weapon to try to stab him. And after Officer. Cesky has fired his weapon and Jacob Lake. Chesky says Blake kept saying on the ground. I'm going to die. And she s key kept saying to him. You're gonna be okay. As they waited for the ambulance. Here's the officer. And man who were just in what is what kind of mortal Conflict, right? And now the officer's role. Is to be the consoler to be the person who tries to get him through those grievous injuries. That is the varied, complex conversation. We need to have about law enforcement in America today. Because Officer Cesky Seamlessly war, both of those hats. At the moment in this incident without delay without pots here. Blake. Jacob Lakes family is speaking. This is his uncle speaking live in Kenosha across this nation.

"He's unarmed, contradicts even what he himself has said multiple times to investigators. Officers also yell and citizen witnesses here. This Drop the knife under what circumstance would they be so specific? Unless it was a knife that they saw a man. Listen, having briefly listen to that enhanced audio. All of those things lead lead. The investigators lead myself. We noble Wray to say in controversial a credible, incontrovertible evidence. Sorry. That he's armed with a knife in this situation. So what happens next so obsolete? Chesky again, confronted with the information we know so far has additional decisions to make at the point. We just left that video. Officer says he knows that an armed man With a felony warrant. Was just forcefully resisted arrest. Appears to be about to flee in a vehicle. It is a disputed vehicle, and there's a least one child in the back. Those are all facts that officer Cesky has in the context of a domestic abuse case at the point, he has to decide what to do next. And at that moment Officer Schatsky decides to reengage up till now Officers have distanced themselves. Because a knife is possessed by Jacob Lake. So the question is, should an officer reengage should he put himself back in harm's way by going and getting close again to an individual who is armed with a knife? Officer Cesky decides to do that. He grabs the T shirt off Jacob Lake. Why does he do that? Well, he tells you he tells us that he did that because now the approach and entry is into the vehicle, Sir Cesky says. And I'm quoting are trying my best to quote him. I don't know what he's gonna do. Is he going to hurt the child? Is he going to take off in the vehicle? Are we going to be in a vehicle pursuit with a kid in the car? Willie, hold the child hostage. All of these things or things he is considering they're running through his mind, way, puts himself in harm's way and grabs the T shirt of Jacob Blake. At that same time. Uh and then we'll let me just say, First of all, a use of force expert Noble. Wray finds that decision to re engage based on the factors that Chesky cited in my quote. Use of force expert Noble Wray has made the finding that was a reasonable decision to re engage at that time, obviously risking at that point There'd be further confrontation and the potential for harm. So this is the moment in this picture you're going to see now. This is the moment where Officer Cesky decides. I've got to re engage. At this same time, Jacob Lake tells investigators I have switched the knife. Which was in my left hand. And I have moved it to my right hand because he opens the door with his left hand. So now we know the knife has moved to his right hand for what he says to D. C. I And also the fact that this door is opened with the left hand. This is the moment where officers Chesky makes a decision. I can't let him get in that car without being back in harm's way. This next picture is what happens next. Right? And again. You've all seen this in a video. Both officers, Chesky and Officer Arena's report. What happened next was Jacob Blake twisted his body. Moving his right hand with the knife towards Officer Cesky. So what he and they demonstrate this. So they say What he does is he takes again. The knife is now in his right hand. And he goes under his left. And makes this kind of movement, so he switches his torso back towards Officer Chesky. Both officers say that occurred So Officer Schatsky is the one who's got the T shirt. Obviously, he's in a perfect position to observe that Officer Ramos is looking through the car window. He's also in a perfect position to observe that Okay? Both of them say that's what happened. Unfortunately, when we view the video Officer Ramos and that car door are in our way and don't allow us to see what happens to the rest of the body of Jacob Blake. In this case, so I submit to you. Here's where the video fails us because it doesn't provide us any information or ability to take a look at whether that twist of the torso occurs. What we do know is that there are two civilian witnesses who also say they see a movement that I think will any defense attorney for these officers would certainly argue, is consistent with what the officers see. Okay. Why is this important Because then this is not just officers saying this has occurred. This is other civilians on the scene, who based on their vantage point are also able to add this perspective. Witness, D. C. Who indicates he is socialized before with Jacob Blake. He has on friendly relations with Jason. Jacob Blake says Just hey, saw Jacob Lake trying to get in the car. Hey, heard he saw Jacob Lake, ignoring officer's commands and ultimately, hey, saw Jacob Lake. What he says is twists his tour torso toward the officer from right to left. And then he heard the shots. He describes that twisting of the torso motion as sudden and rapid. He's down the street again at a vantage point that is less obscure than our video In terms of the doorway or the officer. There's also a witness right across the street. Age, She says. She sees Jacob Lake walking very fast around the street side of the car. He opens the car door. The police officer was behind him, and the police officer pulled it. Jacob Lake shirt. She says. Jacob Lake then turned slightly, and the police officer started shooting. Was a picture here where we have an arrow to where she's located. Remember this shooting occurs over on the driver's side of this vehicle, so I'd suggest you her vantage point is a very good one. And clearly a defense attorney. Defending officers in this case and talking about the privilege of self defense would have these civilian witnesses is key witnesses in their case..

Some On The Right See 17-Year-Old Charged With Killing 2 Kenosha Protesters As Hero
"Riton House, the 17 year old charged with killing two protesters in Kenosha, Wisconsin, goes before a judge tomorrow for a preliminary hearing. Rittenhouse has become a hero to some on the right. Sean Johnson of Wisconsin public radio reports on those pushing that narrative. After Kenosha police shot Jacob Lake, a black man in the back multiple times. The city erupted into protest on August 25th Kyle Rittenhouse made the 20 mile trip to Kenosha from his home in Antioch, Illinois. Rittenhouse, a lifeguard and a vocal supporter of police said he was there to protect the local business and offer medical help if needed. He walked through the crowds that night with an air 15 rifle strapped to his chest. What happened that night is disputed and will eventually be hashed out in court. But a full scale public relations blitz is underway by some of written houses supporters. A group called the Fightback Foundation released a dramatic video compilation of cellphone footage from the night of the shootings. It claims Riton House fired his gun on Lee after being chased and attacked. Narrator speaks of Rittenhouse being sacrificed by politicians. But it's not Kyle Riton house there after their end game is to strip away the constitutional right of all citizens. To defend our communities, our personal property. Our lives and the lives of our loved ones written houses cause got the attention of conservative media figures. Here's former Florida attorney general Pam Bondi, on Fox News. What's it coming, too? In these liberal cities? When teenagers have to go out there to try to provide aid? The Fightback Foundation says it's raised almost $2 million for Riton House. The group's chairman, is Linwood, a prominent attorney who made a name for himself representing Richard Jewell in the 1996 Olympic bombing case. Longtime Wisconsin defense lawyer Dean Strang, who is not involved in this case, says the teens, attorneys may well argue self defence, but it has nothing to do in the first instance with being the hero. It has everything to do with whether you will be held responsible for killing other people or you want.
