"During his now infamous trial, January 6th defendant, Jacob chansley, AKA the Q shaman, faced some very hefty sentences. These included a 5 year prison sentence and a fine of up to $250,000. In law, such fines are levied as a form of restitution in order to compensate for costs such as damaged property, medical bills, resulting from personal injury, or even to pay an opponent's legal fees. The concept of reparations is that it is a form of punishment that can also help to repair the damage that was done by the accused. It's important to note, the government can not find you with reparations out of the blue. You have to be guilty of a crime. It's good the Chancellor wasn't ultimately hit with the full amount as a quarter of a million dollars for most people can't be raised easily. People work their entire lives and still can't save that much money. It's such a large amount that even someone as gullible as judge Lambert, a man who genuinely believed the Q shaman was somehow the breath from destroying America's democracy forever. Thought the penalty was overkill. Lately, there's been another shaman in the news, only this shaman has two ends, shaman Walton is a member of the San Francisco board of supervisors. A body which voted unanimously last Wednesday to approve a plan to give $5 million to every eligible black resident as part of the city's plan to make reparations for slavery. The plan was a way to go before final approval, like every other member of the board, shaman Walton wants to see it through. He says, quote, we have to stay focused and stay together as a community, he says. Because now it is a 100% more prevalent that we can not be separated or divided. Let's stay the course. Because a $5 million payday for me is almost here. It might be pertinent to point out that shaman Walton himself is black. And something also tells me he will be included among those deemed eligible for the payout.

Are there any legal ramifications? Can we get this guy out of prison who's given 41 months? What happens to everybody else? You're the expert. Is this just a political win or is there something deeper going on here? Well, there's got to be analysis look as a former federal public defender who challenged the DoJ out DoJ on so many cases in federal court about what we call Brady violations, violations by the DoJ prosecutors for failing to intentionally disclose exculpatory evidence and evidence of impeachment. So it's called Brady and giglio. Let's put the legal parlance aside. What due process the constitution the Supreme Court demand prosecutors in the DoJ must turn over all evidence that even might be evidence of innocence and evidence of impeachment. They don't have to use their judgment to answer the question. It's just a maybe. 41,000 hours of videotape said is evidence.

"Joey, you mentioned this word and trap meant. And you also mentioned the uphill battle in which you're trying to navigate against swamp judges and swamp juries and the whole kind of contaminated D.C. environment. The question I have is this. I mean, it seems finally that there is new information coming out about January 6th. Tucker Carlson, of course, had some videos a week or so ago. Let me start with that because there was new information on the shaman guy Joseph a Jacob chansley, but there was then a sort of, as far as I could tell, an abrupt halt in the videos. I mean, if you have 40,000 hours of footage, it's preposterous to me that you'd find three clips. Speaking, honestly, do you think that Fox kind of got to Tucker and shut him down? Because expectations were so high. And while what was delivered, the first day was pretty impressive, it appears like what? That's it. There's nothing more. What are your thoughts about this? So my inclinations are, I think I share with the general public shares, right? Tucker's team is incredibly talented. They did in their defense have a limited time to go through the stuff we've been going through this stuff for two years. They had a few weeks, but within that time they were able to focus on Jacob chansley and lies about all the specific. I thought he did a good job there. I did think that on the second night that something distinctly different happened. There are different theories about that. One theory is that the producers of the higher ups at Fox News likely shut them down. I think that that makes sense. I can speak from experience and having gone on Tucker's show. You know, I had been over the target on his show with regard to some similar matters and I kind of got shot down too. And when you're over the target, people get very uncomfortable and the powers that be tend to pull the plug on situations like that.

Have these defendants had access to all these tapes before their trials or their plea deals? Do you know? No, the answer is no. I'm believable. And Jacob Chan sleeves story it is, is particularly heartbreaking Mark, and I followed this since the spring of 2021. Listen to this. You're an attorney. The DoJ was ready to go with charges. He was indicted by a grand jury Mark 5 days after January 6th. The first grand jury indictment against Jacob chansley was handed down January 11th, 2021. With serious charges like civil disorder, obstruction of an official proceeding. They didn't even have any evidence against him yet. And Mark throughout 2021, the DoJ repeatedly blew through discovery deadline that they told the court they were building a special platform. So all the defendants and their attorneys could access all the digital information. Of course, this is one of the most, this is the most recorded event in American history. But they arrested people first, got evidence later and still to this day, the defendants do not have access to the footage that the House Democrats kept under seal for two years and that Tucker's team had access to the past few weeks. It's amazing what one election can do, isn't it truly, so let me ask you this. I assume lawyers had raised some of them, with some of their clients had raised the issue of access to these tapes before. And what's going on with these judges? I mean, I assume some of them are going to raise it again if they didn't raise it the first time. The judges here mark is you can imagine are the real villains. DoJ only gets away with whatever the judge is let them. And this D.C. district court has acted as nothing more than a rubber stamp for the government, allowing them to mislead the court in terms of their discovery obligations. And now we even see judges, there was a woman found guilty today of numerous charges. She immediately filed a motion to delay her trial so she could access this video and the judge said no, that's all right. You know, maybe we'll need to see it, but it's not relevant to your case. This man is going to be the new chief judge of the D.C. district court. He's in Obama .2. Correct. And he will replace really the despicable barrel Howell. Another Obama point. Yes, yes. So it's really a banana republic style environment in Washington, D.C.. And how does the judge know it's not relevant? Is he looked at all the tapes? We now know that the committee members didn't look at all the tapes. Right, of course not. Because most of these tapes, again, have been archived by Congress. You had 14,000 hours marked at captured what happened between noon and 8 o'clock. That is the capital please turned over to the FBI early 2021. But how Democrats asked capitol police to archive the entire 24 hour timeline. So you can only imagine things that would have popped up, say, you know, 11 o'clock that morning, 10 o'clock that morning, if there were people planted inside the building, what was happening on capitol grounds, but these defense attorneys have only been able to see what DoJ has allowed them to. I want the public to understand. That if you're an aggressive competent defense attorney, you want access to all the information so you can go through it with your client. You want to know if their FBI undercover agents there so you can point out that the FBI entrapped or something like that. If you're a court and you don't allow access and you allow that kind of discovery, you're not allowing due process. You can't defend your client. And that's what's taking place here generally, right? That's absolutely what's taking place in has been unfortunately so many of these defendants have been left with really poor counsel. Jacob chansley is one of them. His attorney Albert Watkins should never have forced Jacob into pleading guilty to obstruction without all of the evidence, but he sold this guy down the river. He said horrible things about Trump supporters that they were short bus people. He blamed Donald Trump for the event. The defense lawyer? Yes. The defense lawyer. And now a couple of members of the oversight committee, coma among them. As I understand it, they want to take a look at the jail. And the way the meteorite this up is absolutely disgusting. You've been all over this, has anybody from The New York Times ever taken a look at this D.C. jail, do you know? No. They have not. No. Reporters have no idea. And that's in their backyard. It's right down the road. That's right. Although, Mark, you have people, no, they're beat reporters who are covering these trials and hearing. They could walk to the jail from the D.C. district courthouse. They don't care because they're regime puppets. There are going to mimic think about this mark journalist this week outraged at transparency and truth. Tucker Carlson didn't make up any of the videos he didn't reenact things at the capitol. You know, with people dressed up like Jacob chansley or Brian sicknick, this was legitimate government owned video. In journalists instead of condemning people like Chuck Schumer for calling for Tucker Carlson to be taken off the air, they instead are going along with this thinking that this is some kind of a threat. The Tucker Carlson is releasing government video that shows a different side of what happened on January 6th. And they just keep lying about the deaths that happened that day to police officers. There were none.

But we can also say as believers in the constitutional republic and liberty and freedom for all, that because some bad things happen doesn't mean that you get to throw people in jail just because you don't like their politics and then hide evidence. Now as an attorney, you can attest to my audience correctly, correct that Brady violations are withholding exculpatory evidence Leo, that's kind of a really big deal, right? I'm not crazy. Dan, you are spot on Brady is a constitutional Brady versus Maryland. Big case. It is a mandatory requirement for the prosecutor to turn over all as copulatory evidence. What Tucker has displayed on his show the last two nights that QAnon, man, who he was asking. That's what I'm talking about. Yes. And for that evidence not to be produced, you're talking about the prosecution being sanctioned and some type of referral. If I was at individual's attorney, I would ask for an immediate solid immediate rich and have that case reconsidered. Immediately, that unbelievable. I mean, Leo, he got the guy we're talking about, Jacob chansley, they called the QAnon shaman by media people and that Chewbacca costume or whatever it was. Keep Leo, he got four years in prison. I mean, I don't understand what is it now? Just answer me one question as a lawyer, because I know this area is a little bit gray. We'd Brady material, in other words, the requirement by a government prosecutor and an agent to turn over evidence of someone's innocence. If I'm in a prosecute Jim for Robin a bank and I find out he was in Acapulco when the bank in Maryland was rob, I'm obligated to turn that over. Having said that, the argument, Leo, some people have used this while they turned over the library of whatever it was, 41,000 hours of video. No, no, no. You're not allowed to play cute Leo. You're not allowed to bury a document in 6 truckloads of documents. A document you know exists and points to Leo Terrell or Jim's innocence and then say, oh, we gave you three truckloads, my fault. You didn't see it. I'm not crazy, right? You're not allowed to play cute with evidence like that. You can not play the needle in the haystack game They have they have an affirmative application. I can't say it any clearer. They have an affirmative obligation to make sure they go through all that evidence and they have an obligation to turn over that evidence. They have to do the homework. Very control custody of all the evidence. They have an affirmative obligation and there is no excuse for it. I'm telling you that that man not only has a chance to have that case reversed. He's going to have a nice civil lawsuit. I'm not trying to promote that, but he has a nice little lawsuit because of their obligation. It's constitutional. It is Brady's versus mirrorless. Every civil rights attorney, every criminal attorney knows that case at every prosecutor knows that Dan yeah and every agent a police officer does too, Leo because you'll want you I think what the public who didn't do what we did in that line of work needs to understand is if you're a federal agent or an attorney and you're found to have violated the Brady requirements, that's disclosable and additional cases in the future. So when Dan bongino say federal agent Dan bongino is on the stand, that's going to be used to impeach me in every single case from that point on. So if you go hot and Brady fight, yeah, go ahead, Leah, sorry. Let me go what's that further? If then by Judy got caught with holy Brady evidence, Dan bongino is a cancer to the department because they can't use it anymore. They're going to use that for impeachment and they're going to go back and look at all your other cases. So for example, you're a dead man walking. You're no good. The fire your ass right away. Yeah, they'll fire you right now. And they tell you that in the federal law enforcement training center, they're clear about that, that if you get nailed on giglio or Brady said, you're gone. Carlson used snippets on his show of police surveillance video provided by House speaker, Kevin McCarthy, to put his spin on the riot. This morning, Politico congressional reporter Kyle Cheney, with reaction from the GOP and capitol police to what Fox and Carlson showed just this week. So just by way of explanation, the capital of police chief rarely weighs in on these issues that are so pitched and often framed in partisan terms because they don't like to be in that fray. So it was really remarkable when he came out and said, what Tucker Carlson did was misleading and offensive and that wildly mis portray the actions of capital police on January 6th. And so he took a very forceful stand he called a disturbing he called just completely erroneous portrayal to an extent that he's correct that a lot of what Tucker Carlson described was not an accurate depiction of you actually viewed a good amount of these tapes and seeing these trials, but he was not alone. It was Senate Republican to sort of rally behind the capitol police chief and said what Tucker Carlson did was whitewash essentially what was a violent and horrific day in American history. Some of the footage shown by Carlson that is getting a lot of attention is police officers leading Jacob chansley through the building. He is very much one of the most memorable figures from the riot, the guy with the fur hat, horns, face paint, shirtless, walking through the hallways. What's going on with that footage where there is no conflict, it was very selectively chosen and it does appear that the officers are calmly walking with him or leading him somewhere. Now, I'd love to hear from those officers directly and maybe we will at some point, but what the chief said was look, at that point in the riot, the officers were vastly outnumbered by writers in the building and outside. And what they were doing was employing tactics to deescalate. They were not trying to be confrontational people. In fact, they were trying to use influential people like chansley, who people were looking to for guidance to tell them to maybe encourage people to leave the building. So it wouldn't be shocking that they would be telling them, hey, can you go over here and talk to these people, help them get out? And also what Carlson did was omit moments that were much tensor when championing with part of a standoff with capitol police, the outside the Senate chamber when he was on the Senate deus writing a menacing note to Mike Pence that was this later discovered. Carlson got exclusive access to 41,000 hours of surveillance video from that day from House speaker Kevin McCarthy and last night on his show, Carlson portrayed the event as mostly peaceful and described President Biden and former House speaker Nancy Pelosi is liars when they called the attack a deadly insurrection. Okay, joining us live is CBS News congressional correspondent Scott mcfarlane, who's been following this. Some of the footage shown by Carlson showed that guy that a lot of people remember, the one with the horns and face paint, what was the footage showing? Yeah, that's the QAnon shaman. A man named Jacob chansley from Arizona who pleaded guilty to federal charges in a serving time in a federal prison till July. The footage shown by Tucker Carlson last night is actually somewhat similar to other excerpts we've seen in Department of Justice videos that have been shown in open court. There are times on January 6th, 2021, Sean and Shayna, where some of the defendants are just walking around, there are moments when there's a quiet moment, but then there's fighting. There's brawling. There's a tax against police. The violence January 6th came in waves. It was episodic. It wasn't continuous and Tucker Carlson, according to the capitol police chief, cherry picked excerpts to fill a narrative that is just not true. 41,000 hours, which means you can show anything, basically. So are we learning something new from Carlson's presentation or from the folks that you're talking with? Is it indeed a false impression of what went on that day? Nothing newsworthy in the excerpt shown last night because what was shown last night was a closed case. Jacob chansley admitted he breached a police line, admitted he riled up the mob with a megaphone and that he walked up to Mike Pence's desk in the Senate chamber and left a potentially threatening note. So that's a closed case. Brian sicknick, the capital officer who died was focused on by Tucker Carlson last night. Medical examiner, D&D died of multiple strokes and sickness family says he was in perfect health before he was attacked by the mob January 6th. So we're not treading into or plowing into new ground here, but I'll say this, Sean. There are 1000 January 6 cases by my count 300 of them. 300 accused of assaulting police. This was a widespread violent event. Can we switch gears for a moment and talk about tomorrow's hearing in the house on the origins of COVID? What do you hearing about that? Shane, this is where the House Republican majority is launching. It's now Republican controlled subcommittee on the COVID pandemic. They're going to begin unequivocally into the Wuhan lab leak theory. That's going to be at the start of their investigation. They believe some of the most recent reporting, buttresses claims that that's how COVID originated. And they're going to spend time and they're going to spend effort tomorrow digging into that theory at a formal hearing. The chairman of that committee, Brad winstrop of Ohio tells me he thinks if they get to the bottom of that will be better positioned to prevent a future pandemic, this is where this committee is going in this Republican led U.S. House. "Committed vandalism. You've seen their pictures again and again. But the overwhelming majority weren't. They were peaceful. They were orderly and meek. The U.S. capitol police chief, Tom manger, said Carlson quote cherry picked from the footage. And that his, quote, commentary fails to provide context about the chaos and violence that happened before or during these less tense moments. And today, Senate minority leader Mitch McConnell said he agreed with him. It was a mistake in my view for Fox News to depict this in a way that's completely at variance with what our chief law enforcement official here at capital thanks. Carlson claimed that he checked with capitol police before airing any of the footage, but multiple sources on Capitol Hill told CNN that Carlson show only gave them one clip to review and not the others. So what's in this new footage? We'll go through each of his claims and give you the facts of what we know and what we don't know. One of Carlson's major talking points was that Jacob chansley, known as the QAnon shaman, walked through the capital without pushback from police. He played a video where chansley walks directly through a pack of officers and a separate video where two officers are walking on either side of him. We don't know if the officers tried to talk to chansley because there's no audio in these videos. But we do know that in court documents, prosecutors say that capitol police officers repeatedly tried to engage with chansley and asked him to leave, but that he wouldn't listen. Video from that day shows officers following chansley around the building and an officer walks into the chamber with chansley and continues to ask rioters to leave. Capitol police officers have also testified that they felt outnumbered that day and were worried that engaging with the mob would further escalate the violence. Another key point for Carlson was officer Brian sicknick's death. Sicknick, you may recall, was attacked with pepper spray on January 6th and physically fought members of the mob. He died the day after the insurrection from a series of strokes. A D.C. medical examiner ruled that he died of natural causes, but said, quote, all that transpired on January 6th played a role in his condition. Carlson claimed footage showed sicknick, healthy and vigorous. That's a quote there of how he described it after he was attacked by the mob. CNN can not verify that the footage came after the attack, as we don't have access to the footage, which is the problem when the House speaker selectively offers just one organization the video, the sicknick family blasted Fox News and argued that the footage shows how he was able to valiantly, quote, resume his duties after being attacked by the mob. U.S. capitol police chief Tom manger also chimed in against Fox quote, the department maintains as anyone with common sense would that had officer sicknick not fought valiantly for hours on the day he was violently assaulted, officer sicknick, would not have died the next day. What else is Carlson trying to present to the audience? Well, he continued to fan the flames of that false conspiracy theory that January 6th was a, quote, false flag attack, staged by the federal government to make Donald Trump look bad. He also criticized the January 6th House select committee for leaving out this footage in their presentations and hearings. Adam kinzinger, who now is a commentator here at CNN, a former Republican congressman, and a January 6th committee member defended the panel's work on CNN this morning. Because I think we set history straight on the committee. But look, in terms of saying that we've hidden this footage, oh, we had one of the most transparent hearings in history with the most footage we've ever shown in history and every single almost witness that came in front of us was a very partisan witness. They were all Republicans that came in front of this committee. Footage that Carlson thought was, quote, edited deceptively by the committee was the video that went viral of Republican senator Josh hawley running away for safety. The committee you may recall showed Holly running away on a loop with a spot shadow on him and Carlson aired footage from right before that moment that showed multiple lawmakers also running away. To that claim, kinzinger said this. You look at like, okay, one of the things he said, Josh Holly was running, yes. But so was every other member of the Senate, like, okay, yeah, 'cause there was violence that day. For his part, Holly said today that Tucker Carlson's use of the January 6 footage was quote great and proves in his mind that the committee had a motive to quote target conservatives. I mean, I think it just shows what a lie at all was. I mean, in that particular instance, the video was edited. And I think that January 6th committee has deliberately tried to create the impression that most folks who came here were terrorists. And that's wrong. And I think a lot of this footage just proves that. Obviously, that is quite a different tune than we heard from Mitch McConnell earlier and that we are seeing inside the Republican conference. But clearly, that is not the view of all Republicans, as Holly is example number one of that. And as of the time, we recorded this podcast around 3 o'clock in the afternoon today, we still have not heard from speaker Kevin McCarthy. As for Donald Trump, the former president and current presidential candidate, he applauded Carlson's coverage on his truth social platform, saying he and others are totally innocent and to quote let them go free now. He said a quote whole new and completely opposite picture has now been indelibly painted. Carlson promised to air more footage on his show tonight and McCarthy's office has promised to make the footage more widely available.

There are prosecutors for the federal government, the equivalent of an ADA or a city state's attorney at the city level., but let's just stick with federal court. It is your obligation. It is not voluntary. You could be subjected to very, very serious sanctions, even depending on the degree of potential criminal liability. For not turning over evidence to a suspect in a case being tried, that may be exculpatory or evidence of his innocence. That's not an option. Folks, you know, I love it. You'll get some liberal media goon right now. Who's spent absolutely no time studying anything other than 13th century women's studies and sub Saharan Africa, whatever it is. Lecturing me on how the federal system works. Do you have any idea what a violation of protocol administrative procedures and the law? It is, if an assistant United States United States attorney comes to a Secret Service agent or an FBI agent and says, hey, I need you to turn over anything exculpatory Brady material. And you willingly hide it? I gave you an example before to explain this severity of this. If I'm an agent accusing producer Jim of a bank robbery, yeah, I had to place Jim in the area that the bank was robbed, Jim's a customer at that bank. Jim sent an email to someone a week ago saying, hey, I really need money, whatever it may be. That's all evidence that's a fact pattern that could lead one to believe Jim robbed the bank. But then what if I find out Jim was in Acapulco when the bank robbery happened? It's on Visa on video. He has his credit card records to prove it. Or when I hide that, holy Moses. Now that's a dramatic over the top example. You have no idea how much trouble is a federal agent you'd be in. You'd be finished. You'd be finished. You would never be allowed to testify again in court without your credibility being shredded by every defense attorney you ever spoke to. You'd be funny. You'd be fired tomorrow. Yet it's really weird that this information didn't seem to be used by chance Lee's legal team. Now, I was reading some material online earlier from a guy who I think is legally involved with them. And what I'm getting from it, I hate to throw this out there because it's still speculation, but let me just fairly tell you I'm speculating because I'm not on the legal team. But one of the lawyers who claims to be involved with them is saying that what happened here is that the government is saying the AUSA and others. The prosecuting United States said, yeah, we turned it over. We turned the whole file over. Nano, no, no, no, no, no, no, that's not how this works, folks. I did this for over a decade of my life. Now, it's a gray area, fairly enough. It's a gray, it's not absolutely black and white here. But I'm 99.5% sure that any magistrate or judge. If you say, oh, he turned everything over and let's say you pull this trick, the government appears to be pulling now. Yeah, we turn the library of information over. Gee, it's not our fault that they didn't find it in the 72 million hours of video. That's not the way this works. If I have reams of paperwork and emails of Jim asking people for money, claiming he robbed the bank and I'm like, oh, here we go. And then in one of those emails, it's Jim in Aruba or Acapulco, the day the bank is rob saying, hey, Acapulco is great. And that email is on page, say 7000 of a 20,000 page, say, file I turn over to the government for his bank robbery case, and I don't tell them specifically it's there. And I bury it like a needle in a haystack. No, no, no, no, no. Come on, you lawyers out there. You know what I'm saying? Is it gray area here? But I don't know a serious magistrate, not politically inclined. And a lot of them are straight shooters here, or judges that would say, oh, that's fine. No big deal. Will you turn it over? If you knew it was there, there is no way. They didn't know this video existed. They should have pointed it out, given it to his defense attorney. Immediately. Immediately, as Brady material. So claim number one was that QAnon shaman was the chief rioter, right? This what he was on the cover of literally every magazine in America, every newspaper in America. He was a violent rioter who was attempting to assault police officers. He was a danger to himself and others. Well, Tucker showed footage last night that kind of blows that narrative up. The footage shows QAnon shaman, right? That was what he was named. The QAnon shaman. Walking through his name is Jacob chansley. The one who's wearing the horns and the weird walking around shirtless and carrying a staff and all of this, it shows that the footage shows him literally being guided through the capitol building by police officers. Being guided through the building by police officers, two of them walking through the entirety of the building. They're welcome to various doors. They're unlocking doors for him. They walk past 7 other police officers. They don't even look at him these 7 other police officers. They actually escort him to various chambers, various entrances of the main chamber, right? That's the chamber where he ended up planting himself behind the podium. And eventually they actually opened the door for him. I mean, that's an amazing thing. So he did the jailhouse interview with Tucker Carlson. He said the one series we're going to have is believing that when we were waved in by police officers that it was acceptable. The capitol police said that one of the officers that chansley was trying to deal with was trying to quote unquote deescalate the situation because he was outnumbered. But again, he walked past 9 police officers. At that point he wasn't outnumbered. In fact, at no point in this tape, are the police officers outnumbered. Why are two of if there are a number of why are there two of them and one of him? If the idea is that they were trying to deescalate, well, I mean, they could have just handcuffed him. I mean, they were like 9 of them there. I get police officers trying to do their job. I get that they were outnumbered that day. But they weren't outnumbered with regard to this guy when there are 9 police officers around one guy that doesn't count as outnumbering technically speaking. So here is the footage. And again, it's kind of shocking because the only imagery that you've seen of Jacob chansley, the QAnon shaman, is him bellowing from behind the podium, right? People hanging from the rafters over in the Senate chamber. But he was escorted into the building by the cops and then escorted around the building by the cops. What in the actual hell? "If you don't really believe that there is a now deeply rooted double standard of justice in this country. Let me give you a couple of cases to compare one against the other. You remember Jacob chansley, the guy with the big feathers and the guy with the ridiculous outfit on January 6th. Now this is a guy who went into the capitol and basically paraded around. No weapons, no assault, no, even implication of violence. He spent 317 days in solitary confinement. And he got 41 months in prison. The DoJ actually wanted more, but that's what the judge gave him. Now, let's compare his case. With the case of another guy, this guy's name is montez teriya Lee. And this is a guy during a George Floyd riot and antifa BLM riot. What did he do? He set fire to a pawn shop. Deliberately. He was an arsonist. And there was a man inside the pawn shop. Named Oscar Lee Stewart, 30 years old, who was torched to death. This guy was burned. And his body was found afterward he obviously inhaled fumes and he suffocated to death. As a result of the actions of this guy montez, teriya Lee. This is the black guy, I'm looking at a picture of him he's kind of holding his hand up in a kind of black power salute outside the pawn shop. He was obviously very proud of himself and what he did, and he was making a defiant gesture outside the pawn shop. Look, I'm the guy who did this. And now I want to read from the Biden DoJ's statement of the judge asking for this guy not to get a typical murder sentence. Not to get a life sentence, not to get a capital murder sentence because the truth of it is if you commit an intentional felony, and in the course of that felony, even though you didn't intend to kill that guy in the commission of the intentional felony you did kill that guy, it becomes a capital offense normally, normally. But for the Biden DoJ, these are let's just say understandable circumstances. And so the Biden DoJ wants 12 years for this guy for this crime, a crime that normally carries life. I want to read from the Biden DoJ's document. They say, mister Lee's a motive for setting the fires of foremost issue. Mister Lee credibly states that he was in the streets to protest unlawful police violence and was, quote, caught up in the fury. Now they say the DoJ as anyone watching the news worldwide knows many other people in Minnesota with similarly caught up, quote there appear also to have been many people who felt angry frustrated and disenfranchised and who were attempting in many cases in an unacceptably reckless and dangerous manner to give voice to those feelings, mister Lee appears to be in that category. And then they go on to say, he appears to have believed that he was, quote, in doctor king's eloquent words. Engaging in, quote, the language of the unheard. Now, Martin Luther King of one point said a riot is the language of the unheard and here you have the Biden DoJ invoking Martin Luther King to make this guy seem like not a nice guy, but someone who sort of got whipped up into a frenzy and we can kind of understand the cause because after all, he was fighting for social justice. And then the judge goes along with this. The guy gets ten years, which when you consider what he did is an absurdly light sentence. Here is the judge. The judge says two mister Lee. And contrast this again with the judges who have been excoriating the January 6th protesters, nonviolent protesters. Oh, you overturning you're trying to overturn election. You're trying to mount a coup. You're endangering our system of government. Here's the judge. Her name is wilhelmina Wright. She says to Li that you are, quote, more than the person who celebrated your actions on social media. You are more than the person who destroyed that business by fire. You are more than the person who set that fire that killed a man. In other words, the real mister Lee is not the guy who did those things. And then the basic idea is this is how she concludes so while there are no excuses for your actions on May 28, 2020, you have a chance to move forward and live a productive life. The judge is actually even though the victim is dead, saying to the perpetrator, you know, I'd like to see you go on. I'd like to see you become a better person. We don't have to judge you entirely about what you did on that day. You were sort of carried away. You were articulating, quote, the language of the unheard. So look at the kind of gentle understanding empathetic way in which the DoJ treats this particular case and then contrast it with the tight lipped glint in your eye anger that judges, including in one or two cases Trump judges have unleashed on protesters who showed up in Washington D.C. on January 6th to simply express their frustration

"Chansley known as the QAnon shaman is appealing his sentence of more than three years for his role in the January 6th capitol riot Joining me is Bloomberg legal reporter David yaffe bellany Tell us about the charges against him and what happened The charges against Jacob chansley are similar to the charges that have been filed against many of the rioters He entered the building in an unauthorized way he obstructed an official proceeding He pleaded guilty to that The big difference between him and some of the other rioters is just been this sort of notoriety that he managed to establish in the hours after the riot partly because he showed up shirtless tattooed with his horned headdress as he walked into the Senate chamber So in some ways he's not a particularly notable January 6th ascendant but he has this kind of symbolic importance that was established very early on So he was sentenced to 41 months The sentencing earlier month he got 41 months which is the joint longest sentence that a writer has gotten so far I mean not many of them have been sentenced but that's currently the sort of top tier of sentence that we've seen so far He gave a very long rambling and unusual address to the judge in that case in which he expressed remorse and talked about his admiration for Mahatma Gandhi and other historical figures It was very much in keeping with the sort of strange public persona that he's cultivated over the past year And that seems like it was going to be the end of it The judge said what you did here was horrific And also the prosecutor characterized that note that he left for vice president Pence as a threat So it wasn't just him running through the capitol Yeah I mean he hasn't been accused of violence which is a major difference between the charges that he's facing and what some of the more serious riot cases involved But yes he left a note on the dais that Mike Pence just deserted that read It's only a matter of time justice is coming His lawyer argued that that wasn't actually a threat the prosecutors argued that it was a violent threat to ten that was clear because of the context of what was going on So there's been a lot of arguments back and forth about that But yeah that was one of the kind of key accusations against him So is he now trying to take back the guilty plea So it's not entirely clear what's happening right now He's been represented since the early days post riot by a guy named Albert walk in the defense attorney He's been very kind of outspoken in his endorsement of Jacob chansley and then arguing that he's not actually a bad person that he's a peace lover that sort of thing But walk into essentially fired his chance with lawyer and replaced by a guy named John pierce who's representing a lot of other capital rioters in this kind of sprawling investigation And earlier today pierce filed a notice of appeal saying that champley is going to challenge the sentence at the appeals court level in Washington We haven't seen the kind of full text yet of what translates saying what his argument is going to be one potential option would be to argue that he was inadequately counseled by Watkins as original lawyer So that's something that we're anticipating kind of looking out for is more filing with the doctor in this case That 41 months that was less than the 51 months that the prosecutors had requested even though it was one of the stiffest handed out so far That's right And that's partly because I think translate gave a very kind of authentic address to the court You know he showed that he was remorseful and I think that resonated with the judge as he handed down the sentence It seems like it's a long stretch to think that he's going to be able to challenge his sentence when the sentence was in the guidelines was in the framework was less than what the prosecutors wanted and he was fully represented by a lawyer So it just seems like an uphill battle and kind of strange It is kind of strange to enormous mon.
