It's been just over one month since the Supreme Court decided Dobbs versus Jackson, women's health organization. A decision that rolled back abortion protections that had existed since roe versus wade, and a decision that gave states the power to ban abortions. Kansas and Indiana are among the first to begin to figure out what abortion access will look like going forward. For more overjoyed by NPR's Sarah mccammon hi, Sarah. Hey, why not? So let's start in Indiana where a special session beginning this week has brought an abortion ban Bill to the fort. What is in that Bill and what is unique about Indiana's approach. So before the Dobbs decision came down on June 24th, more than a dozen states already had trigger laws in place. Those are the ones written to go into effect if roe were overturned. Others had older laws from before the rote era on the books or legislation that had been passed in more recent years, but blocked by the courts, those states all spring into action to try to implement those laws in various ways, but Indiana is the first to hold a special session following this decision in an effort to try to pass legislation on abortion in this new post raw world. So the outcome of this session could be seen as a bellwether for other Republican majority states that are looking at trying to push through new bands through their own legislatures in the coming months. And vice president Kamala Harris met with Indiana lawmakers before the start of the special session. And she referred to a prominent high profile case that's been in the media in recent weeks. This is the one involving the ten year old rape victim who came from Ohio to Indiana for an abortion several weeks ago. The idea that in some states a woman or a child would have endured such an act of violence and then to suggest that she would not have the autonomy and authority to make a decision about what happens to her body. Is outrageous. So let's dig in Sarah a little bit deeper on what's going on in Indiana. What exactly is being proposed in that Bill? The Indiana bill called SB one would ban nearly all abortions from the beginning of pregnancy as currently written it does include some exceptions for victims of rape or incest and to save a patient's life. And those exceptions for rape and incest are an especially heated issue in Indiana right now because of the highly publicized case of the ten year old girl from Ohio, who traveled there for an abortion after being raped. Here's an exchange between democratic state senator Greg Taylor and someone who came to comment on the bill, a man named Brian shrank, who described himself as an anti abortion evangelist. Today's Supreme Court of the United States expressly took away a constant right from the American people. That had already recognized. It didn't limit it. I simply took it away. That's never been done to a right so important to so many Americans. Republicans, including former president Trump and former vice president Pence, applaud the high court decision, Pence says roe is now in the ash heap of history. Trump told Fox News, things would work out for everybody. CBS Linda kenyon in Washington says it all happened because of a ruling backing a restrictive law. The case involved Mississippi's sole abortion provider Jackson women's health organization, which sued the state after lawmakers passed a restrictive ban on abortions after 15 weeks into pregnancy with no exceptions for rape or incest. Rowe guaranteed the right to an abortion until the point of fetal viability. But Mississippi's ban would take effect far before that. Missouri is now moved to enforce a state abortion ban, Planned Parenthood clinics in Wisconsin have stopped procedures. The only abortion clinic in West Virginia is no longer performing them. Some states are going to have a battle for a couple of years because of a divided government and it may take a while to figure out what their law is going to be. So this is certainly not settled in any direction by any means. With things now changing fast, the Senate Judiciary Committee says it will hold a hearing on abortion next month, the recent polls have indicated a majority of Americans wanted to preserve roe versus wade. "We did know that the abortion case was taken up by the United States Supreme Court, the third branch of government article three, 9 justice on the Supreme Court in that way for a 150 years, the current regime wants to change it. And they want so essentially the issue is this is that Mississippi has passed a law that outlaws abortion at 15 weeks. The Mississippi solicitor general has decided to take that law and defend it through court, the pro abortionists, the people that are on the side that it's not a human life, it's just something else called the cells, the center for reproductive rights, they're arguing out in front of the Supreme Court. Now, I'll be very honest. My expectations were low. I'm a very pro life individual. I speak out about the scourge of abortion. We've done that on many different occasions here on this program and on our podcast. In fact, I encourage you to check out the Seth Gruber conversation from this last weekend. Connor, what great timing that we posted Seth Gruber when we did? We were holding on to that sets of dear friend. He is one of the most articulate pro life activists. I encourage you to check out that podcast, the best case against abortion you will hear. And I did not expect to have much action. I expected the justices actually Alito and Thomas I expected to probably draw a line. I didn't expect some of the middle justices like Gorsuch or Kavanaugh or Amy Coney Barrett to start to signal that they were somewhat sympathetic with the Mississippi abortion law. Now we have a lot of sound that I want to get to here. We have a lot of different kind of cuts that I want to get and the name of the case because you're going to be hearing this time and time again is Dobbs versus Jackson's women's health organization. concerning a Mississippi law that bans most abortions after 15 weeks That law contravenes roe versus wade and if the Supreme Court lets it stand that would effectively overturn row Yesterday I talked to Nancy north of the president and CEO of the center for reproductive rights Her legal team is representing Jackson women's health organization before the Supreme Court this week This Mississippi law was passed back in 2018 it directly violates roe versus wade What did it take three years for the Supreme Court to review it Well this has been making its way through the court since we filed suit just really moments after the law was passed It was easily struck down by both the district court and the Court of Appeals But the Supreme Court waited quite a long time to agree to take the case but we're here now and it's really a watershed moment about whether the Supreme Court is going to uphold long-standing protections for the individual liberty of abortion access that profoundly impacts women's lives help and future Profoundly impacts women's lives health and future you are talking about very high stakes Why is this particular case so important If Mississippi's law is upheld the only way the court would be able to do that would be to essentially overturn roe versus wade There's no consistency between the Mississippi law and row In fact Mississippi enacted the laws of test case to eventually seek the court to overturn roe versus wade Since the Supreme Court decision in roe V wade the court has been clear that the court holding a vote is that until the point of fetal viability the government while it may have regulations on abortion it can't ban it entirely It has to ultimately let the woman make the decision for herself considering all the profound health and life implications So the Mississippi 15 week ban is weeks before 9 weeks before viability and it sets up this test case about roe V wade I'd like to ask you a question about public opinion There was a poll taken by market university law school suggesting that 37% of people favor bands on abortions after the 15th week of pregnancy which is what this law essentially does Is it possible that the Mississippi law may be in line with public opinion on abortion in this country What's important about public opinion is that 70% of the American public don't want to see row overturn And indeed Mississippi voters rejected a person to the law when they had a chance to vote on it One in four women in the United States has an abortion So whatever people answer in the polls when they have to make the decision themselves the reality is every pregnancy is different and those who find themselves making a decision at the 15 week marker later have individual circumstances for that Mississippi only has one abortion clinic in the entire state and I know there are people who will wonder what would this law really change given that access is already so restricted Well it is true Mississippi does have restricted access There is just the one clinic in the state that we represent Jackson women's health organization And Mississippi some of the most restrictive laws in the United States A lot of hoops for patients to go through No coverage under Medicaid And so it is hard for women to access button based still do And the reality is if you take away the only clinic in a state people have to cross state lines And as we're seeing right now in Texas where unfortunately there's a law in effect that clearly violates vote versus wade doesn't provide abortion care after 6 weeks We're seeing people having to cross state lines This is the first abortion case that the Supreme Court has heard since justice Amy Coney Barrett was seated She's a known opponent of abortion rights Do you believe that will play a role in the outcome Look we are arguing before the court that really there is only one outcome in this case that's consistent with the rule of law And that is for the Supreme Court to uphold the Mississippi law I mean it is a critical moment for the Supreme Court including for all of the justices and they all testified about the importance to the rule of law of precedent and following precedent because it can not be politics or ideology So we'll be appealing to every single one of the justices to follow the rule of law in this case which has been the law of the land for almost 50 years When can we expect the Supreme Court to finish deliberating and deliver a verdict Well it has been the case in abortion cases that often it's not until the last day of the Supreme Court's term which is at the end of June So that might be the expectation here But the court is able to decide this case as well as the Texas case whenever they come to a decision after oral argument
