"We have some construction and stuff going on in the office and so if you hear some background noise please forgive me I can't wait until they leave to record the podcast so you made us hear some noise in the background and it's just GonNa be what it is we just moved into a new podcast studio which is actually a brand new office building is going to be some construction of background noise for a little while and I can't just keep delaying the podcast every time we hear some noise you know I don't know if you heard this story of a man in Los Angeles elderly white man a rich democratic donor named Ed Buck and for years so many local activists and organizers in lost in and around Los Angeles continued to say that black men particularly young gay black men were going into Ed Bucks home in Los Angeles and dying over and over for again multiple black men were going into this man's home and were basically we still aren't to the bottom of the story they are going to his home and dying of drug overdoses and Drug Interactions I'm just a lot of shady stuff going on in this man's home and so many local activists and organizers including mark good franchise mechanic and others were saying like hey some body needs to intervene because black men are going into this man's home and not coming out alive and this wasn't like conjecture or speculation or supplied it was fact we know the men's names and as local organizers and activists continued to beg for the police for the district Ernie's office to intervene they did nothing in part because this man is donating to their campaigns finally just finally this past week Ed book was rested but the recent arrest of Ed Buck highlights the two very different criminal legal systems at play in Los Angeles under Da Jackie Lacey and neither of them is keeping black people safe lacy who is again the county's first African American da she prosecutes wealthy white people reluctantly and infrequently but prosecute people of color excessively and incessantly whether they are witnesses victims or defendants DA lacy treats non white people over and over again a second class citizens and lacey faced exactly this sort of criticism in the wake of Ed books recent arrest two years ago Djamil Moore died of a drug overdose in a West Hollywood apartment owned by Ed Buck who again is a wealthy well-connected political donor there in Los An- Jalousie this January Timothy Dean again this is after Djamil more already died in Ed books apartment this January Timothy Dean died in the same load occasion under the same circumstances both men were young black gay financially vulnerable by the time of deans breath Los Angeles district attorney Jackie Lacey was already aware of bucks pattern of victimizing she already knew it literally people would be outside of her office every day for hundreds of days straight saying pay attention to what's going on at Ed books home most if not all of Ed Bucks targets were impoverished gay men of color now after Djamil Moore's death other men fortunate enough to survive books abuse actually reported their trauma to county investigators family members and activist and local community members implored they all but begged Da. Jackie Lacey to take the victim's story seriously but later refused to file charges of any kind and she just flat out refuse to take any action against buck and again while she refused take action somebody else died again in his home in the years between the deaths of more in Dean she refused engaged with the victims and she literally made many of them feel like they were the criminals in the situation and she failed to warn their communities and protect vulnerable people who continue to go to this man's home and not come out the same congresswoman Karen Bass who I love and respect so much Democrat from California Congresswoman Karen Bass is amazing she summed it up when she said this she said Lacey's inaction in response to the deficit Ed Books Home had a message that was loud and clear black gay lives obviously don't matter to her in lacy's apparent indifference to black and brown lives it's not new books case is but one in a long list of stories in policies that have really pockmarked her tenure incentive message that she's just not interested in keeping black communities safe when black and Brown people are accused of crimes lacy waste no time at all bringing the full wait of her office down upon them she listened to this she has sought the death penalty exclusively against people of color no white people have ever been charged with the death penalty in her tenure she refuses to prosecute law enforcement despite hundreds not dozens but hundreds of police shootings during her tenure which have disproportionately involved as you already know the victims of color she also has a long well documented history of opposing any reforms whatsoever that are aimed at criminal justice issues that again disproportionately impact people of Color and I wanNA give you some additional context on Jackie Lacey's handling of the bookcase as well as a record on some of the other issues that I've mentioned because we are about to support a different candidate an opposition candidate running against her this right let me break that down breakdown treatment Jackie Lacey's treatment of victims in the Ed bookcase is really symptomatic of problems. She's had her entire tenure although lacy who is gearing up for an election although she publicly claims to support reform really as long as it doesn't jeopardize public safety that's what she says her actions and really a her inaction throughout her entire tenure have consistently shown otherwise she doesn't support reforms the handling of bucks case fit it's an old disturbing pattern of lacy failing to hold people accountable when they harm black folk not only has this woman Karen Bass refused to endorse Jackie Lacey even though she endorsed Jackie Lacey Twenty twelve congresswoman maxine waters has done the same thing refusing to an Dorset County Supervisor Markedly Thomas Refuses to endorse her. And we've had some high profile suicides recently Kate Spade. Anthony bourdain v. And I wanted to bring Jennifer Jones Leon because you are the journalist. I am not and one of the angles here and the people at world suicide prevention day of put out this sort of factsheet, I guess, and it's kind of a bit of a Arabic's a finger wag at the media. But it's definitely a set of tips and tricks about how to report on suicide without making the problem worse. So that's why I want to get your reaction. So one thing is that. And they say that studies have found certain kinds of news coverage can increase the likelihood that certain vulnerable people will kill themselves. So they're actually saying you could report on something in a way that pushes somebody over the edge to actually doing it. They're not saying you could report on suicide in a way that would make somebody who's not thinking about killing themselves. Suddenly think about killing themselves, but someone who's kind of right on the line. Yeah. So one thing they say is when the story explicitly describes the method. That that can aggravate the situation for somebody. Totally agree. When you have a dramatic headline as opposed to a more neutral headline. The example, they give is this headline Kurt cobaine used. Shotgun to commit suicide. You got two things little sensationalist. But also telling you in the headline how he did it as opposed to the headline being Kurt cobaine dead at twenty seven. And so that's one thing is not you may not realize I'm not saying you. But sometimes the media may not realize that they are either giving people ideas for how to do it. And also that by sensationalizing, it some people internalize that as glamorizing it. I don't think the media is ever glamourising suicide. At all. But in the mind of someone who's already depressed and despondent and thinks their life has no meaning they can internalize it the other thing they say is that the media could do more when there is a high profile suicide they can do more to talk about prevention and where to get help. Now, I feel like I mean, I've heard the coverage here, and it seems like always you say here's the suicide prevention hotline or whatever, but they're saying that you should actually spent like instead of say talking to a family member of the person who killed themselves. Instead, you should bring on a psychologist. You should talk to them and get a quote from them about how to help someone who may be suicidal. What do you think about that? Do you like what level of responsibility? Do you think the media has been reporting on suicide in well, it's kind of a fine line because I think that it is our responsibility to report the facts? And if the facts are that someone committed suicide, then I don't think that that's irresponsible to save at that person committed suicide to romanticize the method in which they used that would be completely irresponsible. You know, they. Say the Robin Williams story, and I think a lot came out about how he committed suicide. And I think you touched on it. Once you say, he was found to you know, whatever way, and then you move on from it. I don't necessarily know that I think it's the media's responsibility every single time to bring on say, a mental health expert to discuss tips and tricks and stuff like that. Because then I feel like that opens. You know, it's sort of it's going to snowball into then isn't it our responsibility for every single story that comes out to if a man shoots his wife. Shouldn't we be talking to mental health experts about somebody going over the edge? Should they have a volatile marriage? I mean where where do you draw that line? Yeah. And that's obviously they're they're skewed heavily because suicide prevention, of course. All right. Thank you, sir. And we'll get news from you in a second. But then when we come back, what do you do? In fact, didn't didn't they just show this? That movie, you know, the movie the bad seed. Yes about the kid who's, and I think Rob Lowe, just did a remake. Of, today would even affect murderers rapists and, every other horrible person imaginable it it was snuck. Into a budget trailer Bill some, weeks ago nobody saw this coming wasn't made public wasn't covered in the media at all and You can see what kind of chaos this would bring if it was fully implemented so let's talk to. Voice this speak about it and I appreciate the opportunity As. Far as you know what, do, the revisions looked like I imagine negotiations, are still going on? Or they're still possible hospital you could revise the revisions so but the the best of your, knowledge what's the current status Well the current status right now, is eighteen ten is the law can in other words. Someone could walk into court right now and ask the court were diversion and the court under the law would send someone out for evaluation and then make a determination and I want to be very transparent. With your listeners I believe that, there are people who have a mental illness who were in county jail who should be diverted because they. Have a health issue and their charges are not, what you would call serious in? Their conduct charges are not serious but we haven't been able to. Reach a lot of them, because, we don't have places to send them, and also we don't There's a lot of cases LA county is the biggest the largest county and it has about five thousand people in. The prison in the jail who, have a serious mental illness but what eighteen ten did is it just went so far that it essentially. Shifted everybody into that Into that line And, by doing that it harms the good diversion efforts that are going on in various different offices that are. Led by prosecutors so what the amendment does is it puts very reasonable. Controls on, it it says let's not. Talk about murders let's talk about rapists child molesters People who. Are charged, with a series crowns where we know judges. Aren't going to divert them but but it but instead let's have, some let's have counties build the infrastructure through their board, of supervisors to divert. People into places where, we're all be safe and they will get treatment but also let's let's have some common sense about this. Let's make sure that they don't have access to firearms being diverted let's. Make sure, the victims who are harm. Get restitution and so isn't this If this Bill was to stay as is this. This is too much For local government to handle this this is way too much, it will I, predict clog up courts with a lot of, frivolous claims and that's why although I'm extremely supportive of mental health diversion I'm worried about this Bill because a couple of things one is that we'll spend a lot. Of time litigating mental illness on almost every criminal case that comes through but but but the second more and. More important thing about this Bill is there, are places that were there so. Small where the county is so small they don't. Even have a psychiatrist they don't even have the infrastructure to, do it and so I would create, quite a, bit of chaos that but the amendments into the administration's credits they really, really listen the amendments Really provide a way to safely to talking, about the revision the revision revision can, I ask, you something though right Please I don't trust anybody have a hell does this happen to. Begin with you've you've got an? Entire Democratic supermajority legislature it. Sneaks this in. When no one's looking and the governor's signs. It they all approved? Of, the original version at that moment they all think this. Is a great idea how, can that be, well you know, the the process itself is a separate argument whether this process. Was fair would have liked we would've liked but. They, voted for it. And, the day he signed it they? Thought this was a good way to go I that's that's terrifying well how can I argue with that but, when I, am saying is time is of the essence if. This amendment doesn't get? A number by Friday then we we're going to have to live with eighteen ten what does that, mean what that means? Is that people need to get? On the phone and call? Their legislature? And ask where is the amendment two AB? Eighteen ten to do what is the. Amendment do does it does it keep? Certain defendants from entering The program at all. I, don't, think anybody. Wants, to see murderers rapists and all? Other terribly violent people even get a crack at this well that's exactly what it does is it says if, you're charged, with murder voluntary manslaughter a registered sex crime then. You don't get a? Crack at this but it also allows counties too often and the even more restrictive and that's an, important option for counties? Because there are certain counties what? Does that mean county to? Opt in? Allows your board of supervisors to craft Craft a mental health diversion program that that works that can be. Supported in that protects public safety so gives the county's more control over this okay We just had an arsonist suspect it the Cleveland national forest right mental health history going back twenty five years sorry he clearly disturbed and he sets fire. Burns about ten or twelve cabins twenty thousand. Acres Right twenty thousand people were. Were. Evacuated he's obviously gonna make a mental health claim what what allows a judge to say No You you don't get the mental health. Diversion you must go to trial as he's. Got he's got a psychiatrist who's vouching, him and the psychiatrist is. Right the guy is. Nuts, well, well, John let's give judges a little bit of. Credit I, mean after the recall of the judge in Santa Clara, county what judges don't let that guy go. Free? Really what judge is going to divert is the judge gonna be overturned on appeal because the way the law is the arsonist has the right to diversion if he has a mental illness that is connected to his. Crime and clearly this guy does, well he has a right to ask for diversion that it's always the judges. Call so he's going to be the judge's call on this. One but but but let me let me say for because that's exactly what I'm talking about is those cases are not the kind of cases where we ought to be talking about diversion because that guy's. Dangerous He's probably dangerous in the future but there are a lot of other cases can excuse me John where Where the charges are not as serious. Not nearly as serious where we can safely divert people into treatment and we want to think about that we really should because what's? Happening, now is even the share what kind of. Charges, you think should be eligible for mental diversion program well let's let's, talk about arson for a second now the arsonists that you talked about did a lot of, damage endanger but oftentimes I'll, get a mental health case where it's, a family situation where someone is delusional they're in their, own house and they set a piece of clothing their own clothing on fire and, their and their apartment?
