And then, of course you had some people start smashing windows that businesses Of course it was. But this is Portland to post they've had protest every single night for five months now, straight since the killing without a George Floyd, and it's no longer stopping the vote. Because I do believe that the the lawsuits administration has realized the voting is over. It's hard to stop the vote when you can't vote anymore. Now it's the recount Ah, and its invalidating the count of the vote. I guess it is invalidating the vote itself. So that's fair, man. You know what's stopping the vote? I'm gonna go back and say, Yeah, that's fair. Because if you are invalidating a vote, you stop that vote. Remember being counted. That may have happened in Portland, It was much less writing much more protest ng and celebrating but still declared an unlawful assembly in downtown L a last night. So this apparently with a bunch of black lives matter, activists who were celebrating the potential defeat the D, a Jackie Lacey to George Gascogne, and they all took to the streets of L. A LAPD.

As you mentioned the outset, they are still votes to be counted. But with that seven point advantage, Gaston looks like he is on his way. If things stay as they are now to a victory, and he's primed to do something to address the concerns off this movement, moving that, by the way, has been hammering Jackie Lacey outside her office here in downtown Los Angeles. For years for years for sure. You know, Lacey does trail gas going by about 200,000 votes, and they're, as you say, are still ballots left to count. But in spite of that, our people on the streets they're expecting a winner to be announced tonight. That's a good question. I mean, I spoke with folks and in my course of interviewing them, they were very confident that Gascogne had already won this election. Now again, we don't know that for certain the speakers who are addressing the audience, certainly a little bit more cautious about calling the race. But definitely this feels like a celebration, a culmination. Lydia sigh of relief for this movement that yes, they were ableto actually enact some sort of change, especially as the top at that target the job. That's top prosecutor here in Los Angeles, right? What you say It's sort of maybe a sigh of relief, and that may be a pause in what's happening with the movement. But what do you think is next for this movement? You know, as we said earlier, the goal from BLM was not just about Removing Lacey from office, right? You're absolutely right. And this has been brought up here over and over again tonight. I don't prosecute him for political reasons in order to get an office and to stay in office, and I think it's important for people to remember that at the Lake County District attorney's office has never looked the other way. We do in fact, look at these cases, but they're challenging their difficult. L. A District attorney Jackie Lacey during an ABC seven debate over the weekend, defending her decisions not to prosecute officers involved in fatal shootings During her eight years in office. Lacey is vying for a third term as head of the nation's largest local prosecutor's office. But she is facing her biggest challenge. Yet her opponent is former San Francisco D A and former LAPD assistant chief George Gascon. He is running as a progressive prosecutor and says more needs to be done to address racial bias in law enforcement. They're systemic racism of the system, systemic racism that comes from the very creation along force in this country, which was deeply and better in the institution of slavery and continue that way for many years to come. It is no accident. When you look at our jails and prisons, you see that they're mostly populated. White, black and brown people. It is no accident. When you see the use of police deadly force. Most of the time. The recipient of the force are black and brown people. In the wake of nationwide protests over high profile police killings this year. How to prosecute police misconduct is now the central issue in the race.

And when she got the position, she was the first African American woman to be D. A and she was thought to be Or was going to be a reformer of police. She was from the local community. She was educated in the South land and at least how she Brent, her original campaign. She was going to be a reformer. Then she got into the office and then reality sets in. And and here's the reality. I think that People are loath to admit it. And most of the criticism against Lacey has to do with the prosecution of police officers who are accused of engaging in unlawful police con conduct and also dragging her feet as faras pursuing certain prosecutions of people like Ed Book who was a Democratic Um ah Contributor financial contributor. Those were the main criticisms of Jackie Lacey. But here's the problem with such expectations, at least in regard to prosecuting police officers. We can not Keep expecting. District attorneys and depending on where you live, it could be county in nature could be city in nature. We can't expect these prosecutors to work with police departments Monday through Thursday. And then on Friday turnaround and prosecute some of those same police officers. That they have these relationships with. You can't do it. I mean, that's kind of the whole point of having internal affairs. You don't have the police investigating the police would be a conflict of interest. And a district attorney is an extension if you will. Of the Justice Department, in the sense of is not a member of the LAPD, but they work in such close proximity to each other. It would seemingly be A conflict of interest, and I think it was served both parties. When I say both parties it would give at least the appearance of a degree of objectivity. And you have a better chance at having results, which would be Maura above reproach. You don't necessarily have to feel that the district attorney is in the bag for police. I think that would be one thing to solve the problem. But the reason I'm talking about this is L. A mayor Eric Garcetti. He's done what politicians do they follow their own interests, and he has removed his endorsement of Jackie Lacey, and now put it on her opponent. George Gascogne in this contentious D a race And if you know anything about Gascon, he's a former member ofthe LVPD. Former San Francisco A D A. And now this race, which is something I've been following very closely If you would have asked me. In fact, I was asked on Fox 11 back in March. Whether Jackie Lacey had any chance to lose. I would have said no. In fact, in that primary, she got more than 50% of the votes before the night was over. And It just seemed like she was going to be a shoo in to win. And as time has progressed and because they've been mohr protest because we've seen Mohr of a presence of black lives matter and their connection specifically to this race. It has made it politically untenable for Eric Garcetti and interned, Um Jackie Lacey into a toxic figure as Faras Association. So politically, I get it. Why? Eric? Guard City is basically saying, Jackie, I can't be seen in public with you anymore. You're just, you know, not popular enough. You're gonna make it very difficult for me to run for reelection. I get that That's the politics of it. What is really, though strange is the boldness in which she said You know what? Jackie Lacey even though I Did endorse you a few months ago. You know what? I'm going to go ahead and un endorse you and take the next step and endorse your opponent. It's not unusual to see someone pull back their endorsement. It is really unusual to see an endorsement UN endorsement and then endorsed the competition. And so Eric Garcetti is now supporting Jack George Gascogne in this D a race which is just weird to me. Given how it's come to this point, you have to really be, um You have to be politically toxic for a mayor to do that, because He's not going to get any support from Jackie Lacey ever again. So the mayor better hope. Jackie Lacey loses or this is going to be real difficult for him going forward so that that was something that you should really watch. I originally thought that Jackie Lacey, there's no chance that she was going to lose. Now the political winds are all moving against her in a perception since that also the case against her husband for pulling a gun on black lives matter. At like five in the morning. Didn't help and people may be on two sides of the argument whether he should, whether he could weather was legal or not. All I'm saying is, it's bad for anyone running for re election. That's the point because politics is mostly about perception. How people feel about you not who you are, how people feel about you. And at this point Most in City Hall will probably tell you Jackie Lacey is a liability for them. And so people are keep, you know, growing Lee distant and moving away from her, But I don't remember a time in which the mayor has endorsed one D a Pull that endorsement and then turn around and immediately endorse an opponent just because of the political winds. "Look like in Los Angeles, and they don't believe Jackie Lacey can be part of that. Now that makes room for Lacey's opponent in the November 3rd election. Former San Francisco district attorney George Gascogne, who's positioning himself as the progressive alternative. But he also faces criticism for unprosecuted police killings and other decisions on his record. KCR W's Jerome Campbell spoke to backers of each candidate and others interested in this race about what's at stake, and he's here with us right now. Hey, Jerome. Hey, Steve. So lay it out for us to Rome. How do Jackie Lacey and George Gascogne compare Well. Both of them have served as D A's and have had long careers in the criminal justice system. Lacey was an attorney in the Los Angeles district attorney's office since 1986 and then got elected to run the office in 2012. Gascogne was appointed D a in San Francisco in 2011 and decided not to seek re election in 2018. He also served as an assistant police chief in L. A. As well as a police chief in Mesa, Arizona and San Francisco. They both have also taken a lot of heat on their records on how they've been handling. Police kill ex. Both candidates have not been Bringing charges against officers who have killed people. Let's start with Jackie Lacey. In one notable case, a man named Rosario Mac, who was at the Baldwin Hills shopping centre was shot and killed by LAPD. L. A's own Police commission found the officers violated policy because they shot Mac while he was already down, and Lacey still did not pursue charges against those officers. Man in San Francisco. There was also a controversial case where a man named Mario Woods was killed by police. But prosecutors said there was insufficient evidence for the shooting. Gascogne did not bring up tried this against those officers, either. All right, Jerome. So how do the candidates address? Not charging these officers who have killed people. You mentioned one where the guy was already down. Things like that. I mean, people have been protesting against Police violence for eight years now voters I would suspect really want an explanation about this, right? Yeah, well lacing Gascogne have said that the lives right and makes it hard to charge officers. But Gascogne is the only candidate who's brought up a solution. He's appointed a strongly ray inversion of stay Assembly Bill 3 92, which would have barred law enforcement from using deadly force unless they don't have any other option. What happened to that bill to a B 392? Well, that bill ended up losing a lot of its teeth and was weakened through amendments, but Gascon is pushing himself as the progressive candidate in this race. And here he is talking about it with an interview with Casey R. W's Madeleine brand from February, people being poor living in a tent of via mentally ill in the street. It's not a solution of the criminal justice system is going a half good answers to. He's also about reducing mass incarceration, getting rid of cash, bail and increasing mental health services, especially when a large portion of our inmates in L. A county face mental health issues. Gascogne also co authored prop 47, which changed several non violent felonies to misdemeanors, which is a big push in the criminal justice reform movement, because people will be serving less jail time for those misdemeanors. Well. Jackie Lacey is the first African American DEA in L. A county, the first woman to serve in that role. She also have the support of her predecessor who was a Republican Steve Cooley. Anna and I wonder the fact Jerome that she is the first black woman to serve in this role that that positioned her to be a reformer. Well, that was how she initially sort of framed herself even in this election. She said that she was more of a tempered reformers. She was going to bring some changes, but incrementally and a lot of her accomplishments are definitely more with the office on the line Order side. She's been in the office in 2012. And just last year, she added the mental health division of the DA's office to address mental health in the jail system, and this year she dismissed tens of thousands of marijuana convictions. Here's Lacey from another conversation with Madeleine Brand. I'm progressive. I'm just my attitude is, though I care about the safety of the community, and I think it's important that when you implement progressive ideas that they be ideas that are well thought out, uh and well implemented so that you don't have people hurt or don't have, uh, the safety of your community to tearing. Now, Some of her critics say these changes air coming conveniently close to the election. She still faces heat for her position on the death penalty. She's sent 22 people to death rows, and she's been in office, all of them people of color. Meanwhile, 51% of the county voted to repeal the death penalty in 2017 with prop 62 So Jackie Lacey didn't have enough support in L. A to win the primary race outright. In March, she came just under 50% that pushed her into this runoff coming up with George Gascogne. Since then, the black lives matter. Movement really took off in the wake of the George Floyd killing in Minneapolis. Where is where is Lacey support coming from now? Whoa! Mostly coming from the establishment. She's got people like city attorney, My fewer U. S Congressman Adam Schiff, as well as the Los Angeles Police Protective League, The elope union. Lazy support is essentially want a steady hand for the department and someone who won't be swayed by protesters. Or at least that's what former councilman and police chief Bernard Parks says who endorsed Jackie Lacey. Here he is. When you think about the impact that the D A's office makes on the lives of everyone in the L, A town you would expect you're going to try to put a person in with a proven record of success, as opposes, saying, I got some ideas, and I'd like to try them on you guys. Meanwhile, Gascogne is supported by many Democratic organizations both locally and in Northern California. Plus Senator Bernie Sanders and Democratic vice presidential nominee Kamala Harris, which comes as no surprise, considering he took her seat as the San Francisco de Ay when she was elected as California's attorney general in 2010. So in November, there going to be a lot of folks obviously watching to see if President Trump gets re elected. That's the big race in November, but but also if you're watching here in Ella, this race, the D A's race, maybe Justus important to you. I mean, this race could affect how how you experience the city. Exactly. I mean, you don't get to vote for the police chief, or whether a police officer is charged for a killing..

Jackie Lacey is not known for being particularly ideological. She's a career prosecutor who has spent many years working inside that office. And she tries to be a voice of reason. She tries to be a sober voice. She tries to just apply the law Howthe law has written Well, that's not good enough anymore. Now, if you want to be on the right side of the woke crowd, you've got to be an activist district attorney where you spend all your time going after cops and district attorneys and gun owners and you leave the gang members and the rioters and looters alone. "Us hi Michelle hi Steve vote by mail ballots in LA have been tallied so far we're talking just under it about a half million ballots Jackie Lacey leading and I mentioned this last break with about fifty four fifty five percent of the vote with Rossi and gas cone at twenty two percent each what is the mood like in gas going territory the C. that's right Steve the mood is pretty jubilant room here at Union Station is packed I guess go to addressed the crowd a little bit earlier to think his supporters people who've been with him on the campaign I'm he said this is kind of what they were expecting that early results a mail in ballots might favor Lacy early but as the night goes on and you and I both know that these kids things go well beyond one night that they think that the results will start to turn in their favor well there certainly were some of the events that happened in the past twenty four to thirty six hours that might have changed the minds perhaps and and we have talked about it on this radio station there was an event at the Lacey household where the husband of the district attorney the incumbent Jackie Lacey Mr Lacy actually pulled a gun on some protesters outside I'm C. address that to the media yesterday we don't know how many people obviously voted after the mail in ballots were sent in so that could have some bearing as well Michelle gas going to arrive just as the polls were closing tonight how did he spend the day so he was kind of all around town today said he was in downtown south LA east LA you headed down to Long Beach I'm he was really talking to voters tried to encourage people to stay in those long lines that I know you guys have been talking about so this is what he told me when I spoke with him earlier this afternoon a lot of people have now voted yes or tell make sure you go out and vote it feels good but again we're not going to know until obviously until everybody else the roads I do you expect to answer tonight or you sort of strapping in for the couple I think it's going to be awhile yeah I think it's gonna be awhile so you can hear and they're saying that he doesn't expect results to be finalized tonight that they're in this for the long haul and and like you said earlier you were talking about that incident with the DA Jackie Lacey is husband I mean so far that doesn't seem to have been much of an issue at least not among the people who are here I think these are sort of longtime supporters people who were with him long before that incident so you know it hasn't been brought up much thus far the big question obviously is whether this race heads to a runoff we're seeing these early numbers again just mail in ballots that have been counted so far in LA county but if if Jackie Lacey does hold this lead which we don't know but if it's more than fifty percent there is no run off if there is a run off it would be between the top two vote getters correct that's right I mean if you have fifty plus one is the magic number of fifty percent plus one that I'm in right now like you said if the results hold Lacey would be the outright winner but and sorry there isn't some concern I guess among others on the progressive side that had just gone would potentially split the vote with one of his other more progressive contenders to laci and that's former despite a former public defender Rachel Rossi I'm so we're all still kind of waiting to see you know what how how the numbers end up handing out KCRW's Michelle a lawyer who's joining us this evening from gas cone territory this is watch party for George Gascon the former DA of San Francisco originally from Los Angeles move back to LA to run for DA in Los Angeles county KCRW's Michelle alloy Michelle thank you thanks Steve we appreciate it and again with just those mail in ballots now tallied in LA county about fifty four percent for Jackie Lacey and Casco and Rossi sharing about twenty two percent each it's nine twenty support for NPR selections coverage comes from Noom providing an online evaluation and the tools to help people lead healthier lives through behavior change more information at noon N. the polls closed about an hour and twenty minutes ago and so far the early returns are suggesting a pretty good night's maybe very good night for Bernie Sanders in California Joe Biden has done very well in other parts of the country throughout the south and in Massachusetts Minnesota picking up wins there Texas very close but marina Lagos AP did call the race I mean it was Bernie Sanders we're like wait a minute there's no votes counted but that what what what is the what the numbers look like right now well with a very still very few votes counted honestly he is clearing away ahead of the pack around almost twenty nine percent of the vote about three hundred thousand votes there without Michael Bloomberg now showing in second place followed by Joe Biden again it's early I think it's safe to say that Sanders will take California but by how much and who else gets delegate still up in the yeah that's the big question that we've got some guests with us here in the studio and we begin with David binder a founder of David binder research was a poster for a number of democratic candidates including senator Kamel Harris in her presidential race and David looking at these early results and some of the exit poll numbers I know you've been crunching earlier this evening what are you noticing well we did see some exit poll results got that looked at they do show that these trends we're seeing around the rest of the country actually did occur in California as well the exit poll numbers show that and among the voters that said that they decided in the last few days it was Biden fifty percent Sanders twenty two however that's not going to make the difference in the state because so many people had decided before that so many people early voted and the people are decided before February were fifty percent to nineteen percent for Bernie Sanders and that was a much bigger chunk of the pie well and it almost seems like Biden had written off California I mean he was here today gave his big speech night in Los Angeles but he's been invisible I mean would it have mattered you think if he'd been here more often than other people said he rode off half the country to country and look what he did tonight so might be I mean I still expect buying to end up in second place tonight even though he's a little bit behind blue bring down these early returns but yeah I know the question is Didon made may have ended up in good shape in the better shape in California that he would have been if he had been there earlier so but David you mentioned that so many people voted but not as many as usually do I mean it seemed like people were holding on to their ballots we saw I think about four million votes cast of the sixteen million vote by mail ballots that had been sent out I mean do you think that that just shows how fluid this race had stayed even before the shake up in South Carolina it just seems really like people did not necessarily follow all their normal voting behavior yeah it's a really good point a reason because it is it is unusual compared to past elections as far as a proportion of votes it'd been returned we had sixteen million ballots mailed out Californians as of earlier today four million and then returned we always get good big chunk that are turned in on election night so that'll go up quite a bit but I think it's the nature of what's been going on this presidential race and you know we saw all across the country in which the voters were looking in a multitude of candidates who they like they thought that things were unclear and confusing they waited towards it till the end so you're right this time California is a little bit more voting at the end then we see in previous elections because voters took a while to make up their minds one bring in one of our other guests tonight at the soo do Missy is with us he ran Cory Booker's presidential campaign also worked previously for Gavin Newsom McConnell Harris good to see you his family wanted a big that was a big night the warriors went up what do you make of these results were still of course waiting to see what exactly is going to happen here in California but you know the fact that Biden would one Minnesota and Massachusetts without really lifting a finger what does it tell you about where the voters are right now I think we sought and I well we saw New Hampshire had receded again across the country today people are deciding at the last possible minute you guys were just talking about this and Joe Biden's big victory in in South Carolina and I think the sort of seventy two hours that he's had with Putin judging clubs are endorsing him and all the coverage he's gotten is if you are just now focusing on I think they've been focusing actually for quite a while I think they just didn't want to make a decision until they absolutely had to and they got every piece of information I think this late breaking information the the big win in South Carolina and the last three days have broken fifty percent of the people towards by near the end that's going to be enough here in California to bring them into second and across the country to go from what would have been smaller wins two huge wins and in some places surprise wins like in Minnesota matches what we know you know that in the vada and in California Bernie Sanders isn't really well among Latino voters especially young Latinos it's either of you though I mean that Texas is looking like it's trending towards Joe Biden would tell you like about demographics I think like it in about maybe us being careful as pundits about saying Latinos or black people or who were talking about because it does seem like the timing on where you are it's a very different picture that's true even within California yeah I agree I I think Latinos are a lot of a lot of exactly you've got Mexican Americans more out west when we get to Florida in two weeks right about Porter Ricans is probably not going to do anything what I can do is well there so it's a diverse community I think that's number one but when it comes to Texas in particular I'm not sure I think Bernie actually probably performed quite well with with what he does in Texas I just think that it was sort of everybody else that used to be split between five candidates really consolidated all around great round Biden you know suburban women Biden African Americans died and even white non college voters came back to bite and I think he's going to you know if that's enough of a coalition to overcome the same scholarship but David what we saw in the polling ahead of this was that it wasn't as if G. progressives were just lining up behind say Sanders and and Warren or you know center left folks were just planning a moderate it seemed like people were looking at the camera that's more broadly and and and so what do you make of it having you know it's funny I think is sometimes there is a nature of people come in we know I'm part of the problem here is this poster shoes tend to lump people together category and saying we have to you know what you know African Americans are doing this Latinos are doing that you know in the in the reality is is much more complex than people looking just ideology and saying I'm going to be in the left lane of the moderate lane and when we talk to voters around the country a lot of their decisions are made on who makes me feel better who can I trust you know maybe.

"Breakdown. I'm Kim Masters and this is the Hollywood breakdown. Joining me is Matt Bellamy of the Hollywood reporter and Matt as people who follow the news no The Harvey Weinstein trial has finally finally gotten underway in New York. That is As this trial was getting underway with jury selection Meanwhile he was indicted in Los Angeles for two assaults of rape and a sexual assault two consecutive days in two thousand thirteen. Jackie Lacey the. Da came up with that and a party immediately respond to Harvey's lawyers By saying I assume I don't know because there was more negative publicity than there's already been which is a lot what we have to postpone the New York trial because of the these charges against me in Los Angeles and the judge wasn't having it. No the judge has been pretty adamant that this trial is going to take place in New York. He has also been pretty tough on Weinstein in the courtroom as well. He admonished him earlier this week for texting exciting or using one of his two phones in the courtroom basically saying that he's GonNa throw him in jail if he doesn't stop and do you really want to spend the rest of your life in jail for texting in a courtroom room. Yeah he had already been admonished about this business with the cell phones and he He can't seem to help himself. I mean it reminds reminds you of a summit at your teenage teenage kid. Who can't let put the phone down some adults I should say also but when you're in trial where you could potentially end up in prison for a very long time? It seems extreme now. Of course whatever the argument was about these L. A. Indictments and of course it means that whatever happens. In New York he will be facing Potentially a trial here as soon as the trial or at some point following what happens in New York. Whatever happens here The problem is of course in New York that there has been so much publicity so they have tons is a potential jurors and so far they've had to send tons of them home and this. This is promises to be quite a long trial so I think some of the jurors are probably Lee jumping up and saying yes I will have a problem being objective. It the requirement isn't that they've never heard of the Harvey Weinstein allegations the requirement that the judge is asking is. Can you be objective and people are saying nope. I don't think I can and I think partly is because that trial just looms large. Yeah we we gotta look at the questionnaire that the jurors prospective jurors are are being given and it includes things like have you ever worked in the entertainment industry you know. Have you ever known someone who's been the victim of sexual assault things like that and the jurors are coming up with with some pretty specific responses. One Juror said that she had just finished reading. Catching kill. The Ronan Farrow Book which She's believe because her to not have a very favorable impression of Harvey Weinstein and I believe this person is likely going to be dismissed. I mean those are the kinds of things that the Weinstein defense team is is up against a I think if you're if you think you could be called as a potential jury you're probably running right maybe. The sales of catching killen are spiking New York. So people can say I read that book. I really can't do this now. Harvey Weinstein has turned around and tried to get the judge who has been. You can say hard on him. I mean Harvey has really I in my opinion asked for trouble because he has done things like you know there have been questions about whether he tampered with his ankle. Monitor's since he seems to have vanished from tracking at certain points and then the issue with the cell phone and whatnot and his lawyers. I I will note His lawyer gave an interview. Donna Rotan oh In which I thought it was an argument to be made that she was attempting to intimidate. One witness the Santa Bella Figura. She basically said you know she's been an actress all her life which is true observation but then she went on to say. I thought in rather ominous sounding way. I hope she's pro. I'm sure she's prepared to answer and sit on the witness stand and that of course prompted the prosecutors say there should be a gag order which I thought was not a bad idea and the judge basically denied that but said you know I'm not going to issue a gag order but you do need to shut up and I think that was largely aimed at at Harvey's lawyer but as I was saying earlier there wasn't attempt to disqualify the judge saying he was being mean to Harvey. Yeah and I think that'll be a theme. We're GONNA see throughout this trial. Because not only are they trying to win the case. But they're also setting up a potential appeal if harvey is convicted.
