"Right The Trump administration or both Biden administration opposed it I don't think any judge would faithfully accept the argument So why do you think they continued to sue and try to appeal it to the Supreme Court Well again historically the salts deduction has been understood as something that benefits the rich over the form But in connection with the 2017 act which was highly politicized you did have some Republican legislators describing the salt cap as a way to hurt blue state given that political posture I think perhaps you'd have to speak to the attorneys but I think they believed they could score some political points through this lawsuit I don't think they expected to win but maybe they did Can you explain why the salt tax has become a point of contention among Democrats as well Yeah these Alexandria Ocasio-Cortez for example has pointed out that the cap should be there The reason is that if you lift the salt cap what does it mean Somebody who makes $4 million a year and has a $3 million home in the Hamptons the Wall Street banker for example is going to greatly benefit because he or she will be able to deduct all those state taxes on the Wall Street income or the property taxes on the Hamptons mansion So if you want to help middle class or poor persons lifting the salt cap is a very strange way to do it Tell us about the workaround that New York and some other states have put into effect Yes some states have come up with complicated regimes The short of it is that the salt cap hit individuals but it doesn't make businesses So some states have passed laws of well sometimes we attach individuals on business income You remember partnership to get around the south cap will just impose the tax on the business instead And in that way the thought is that you can work around the limit because again now you're taxing a business as opposed to an individual and businesses don't face the salt gap Another workaround that states came up with was they said you know what Don't pay us taxes Instead of paying us taxes why don't you make a charitable contribution to our state So instead of paying a $40,000 tax bill to New York just give us $40,000 as a charitable donation instead The charitable donation reduction doesn't face the $10,000 limitation and they believed that this allowed them to work around The IRS didn't like that they should regulations saying you can't do that The states have gone to court arguing that those regulations are invalid So one workaround relates to shifting liability to a business which the IRS was largely accurate to the other workaround is turning a tax payment into a charitable donation and trying to get around the limitations that way Thanks Andy That's Andy gray wall a professor at the university of Iowa college of law Coming up next the federal mask mandate for travel thrown out by a judge This is Bloomberg With the cost of living going up across the country you deserve a solution that offers some change BJ's Wholesale Club members can save an extra 50 cents per gallon at BJ's gas when they spend $100 in club or.

"This is bow to power on Bloomberg television and radio I'm David west and the markets continue to really be suffering because of that war in Ukraine And to get an update now we turn once again to Abigail doodle So what happens is we talked last Abigail Well pretty much the same David We have a serious sell off for stocks The S&P 500 down for a third day right now down about 2.2% That's the worst day in more than a month So investors nervous is on above average volume 30% above the 20 day moving average And of course you have that vix higher although not as high as its last high So there's reason to think at some point this stock volatility may temper at some point here in March and supporting that idea are the fact that is the fact that bonds actually falling That two year yield up about four basis points The ten year yield about flat But the biggest mover to watch David of course crude oil the commodity complex really soaring That said it's well off its highs at session highs You had oil Brent crude up 18% right now WTI crude about 2% If and when commodities come back down that will probably provide a little bit of a breather for stocks Well it's raises the question at least in my mind the if and when they come back down I mean certainly things return to something like normal sooner or later but it could be a long time And doesn't it depend necessarily what goes on in Ukraine what goes on in Moscow what goes on in western capitals Very hard to predict and it probably will come on some sort of fundamental headline or event or evolution of the tragedy quite frankly the humanitarian crisis going on over in Ukraine that war between Russia and Ukraine let's see what happens It could have something to do with oil so many different headlines so many different moving pieces But these markets way way overheated overbought beyond beyond parabolic uptrends that we've been talking about at some point these kinds of moves are unsustainable What will trigger a move toward the downside It's hard to know It's hard to know when that will come but probably sooner rather than later David especially given the fact that again Brent crude earlier today up 18% right now Brent crude up 4% So when you have that kind of movement on the day it suggests that maybe there's going to be some sort of movement overall back down a reversal of some sort Well movement is showing what we're seeing And if you stay with Bloomberg you'll find out what it is about from people just like Abigail dolittle Thank you so much It was terrific Moving now to make a big move actually politics and our weekly midterm segment I'm joined now by Bloomberg political contributors Jeannie chandelier of Iowa college and Rick Davis of stone court capital So we're going to look back here if we can get in the wayback machine to last week When I was away But there was besides the state union Rick There was a little thing called a primary or set of primary zone in Texas Tell us what we learned from those primaries Rick Well it was interesting because of both the turnout being very large It exceeded the 2018 midterm elections a primary vote in Texas is not known for its big turnouts So having that many 3 million voters show up on primary day was extraordinary I'd say the second piece to that is two of the 3 million voted in the Republican primary So that's got to give Democrats some pause that their turnout machine was not as was not as motivated as the Republicans Yeah and I think this is why we see the winner of the democratic primary a per governor in Texas beto o'rourke is talking about bringing in 65,000 volunteers to which Greg Abbott who won the Republican primary the incumbent He said they're going to turn around with a 100,000 and those 65 are largely from out of state So in addition to being a battle of money which of course Abbott is winning we are going to see a battle of volunteers down in Texas as they look to the all important general election in November Rick some of the commentary suggested there was sort of a shift perhaps to the left overall where basically the progressives did relatively better on the democratic side And frankly who did well in the Republicans were not at least extreme right wing It was more of the traditional Is that true number one and number two if so does it tell us anything more generally about the midterms Yeah there were a couple of districts congressional districts where progressive candidates won the vote But the reality is on the composite scale It's just a couple of people It won't even double the size of the squad in Congress which is all of 8 or ten people So I think there were very few surprises actually Most of the incumbents won everybody Donald Trump endorsed basically one But he endorsed a lot of frontrunners So that's always a nice thing to do I think the one surprise is in the attorney general's race where Ken Paxton who is under investigation by the FBI has been indicted and has corruption charges Actually did pretty well in his primary But the surprise was George P Bush the sky under the Bush family in Texas It looks like he's made his way into the runoff And so that will become I think one of the premier runoff races yet to come Yeah you know I think the other thing to keep in mind here is we really are seeing the really the death of competitive districts across the country with the gerrymandering that's going on I mean one of the statistics we hear is that 90% of the house that is elected in the fall could have made their election via primaries versus via a competitive general election And I think as we think about the issue of political polarization and extremism we have to be very cognizant when we hear things like the heckling in the State of the Union that when you are deciding that many races in very competitive primaries and not so competitive general elections that is where democratic and Republican politics in Washington is headed in the next couple of years Rick maybe the death of competitive districts it doesn't look like the death of a really big fundraising Is the.

"Game Saturday night because I know it's going to happen, right Selmi on UNLV as individual program right now. Uh, individual program? No. Seriously. Try. Try. Try to sell me on UNLV football as a division one program right now. You can't. They did lose to Howard. Let me just remind people forget that. Fernando. I appreciate your call, my friend. Thank you. And, uh, call Fernando. I still love college football. I enjoy covering you and I'll be football. I like going to the games. I love college football, but he makes a valid point there. 2575396 Let's go to Sydney. Sydney is next on the biggest take I Sydney. Sydney, I good morning, guys. Uh, first time, long time, so I'm actually an Iowa state alumni go to the game. I actually remember going to the game in I want to say 2000 and eight was the last time I was dead. It was here and here is the biggest thing that I can take away as yes. Iowa's ban travel in very large numbers, but The culture is so different in Nevada, so coming from Iowa and growing up in Nevada and specifically Los Vegas It's just so different the culture between the two worlds I was fans travel because we don't have any pro sport teams in Iowa College ball is, is it And you know these little bit different because we've never quite felt that the The locals really supported the college team. I remember going to games with my parents growing up basketball, football. You name it out here and you know participation was always very late, which is really disappointing because we should be, you know, supporting our schools and sure. And you know universities and you and are especially and, yeah, that's a huge difference. I've noticed how many How many you and all the fans you think would be at the game at Iowa State is the thing. Not many hard. It's so hard to get a ticket at Iowa State to go right, literally a little sliver or the away team and give you guys credit, though you guys travel, you guys it was. It was a lot of fun. Good Iowa State people at the game. Sidney and By the way, I appreciate you calling in Sydney. Thank you so much. I think she said longtime listener. First time caller. Sidney, call back anytime I appreciate your perspective. Let's go. Let's go to Mike. Mike is next time, Mike. I got about a minute. Go ahead, my friend Mike. Hi, guys. How refreshing Brian out. You're talking about something that you really know about versus the vaccine. Like I appreciate the call. Thank you very much. Your moron. Let's go to Kevin. Kevin is next on the Vegas Take. Hi, Kevin. Kevin. I'm gonna throw this one out. You know, it's not good to bash the college athletes. But if you look at Tate Martel, right? Yeah, let's play this out. So you're socially one of the best quarterbacks in high school. You go to how state you don't play. Then you transfer to Miami. You don't play now. You're the third string quarterback. Add a Division two school. So who's telling me he's barely 5? 10? By the way, he's 5 9.5, who's telling these guys But to go to these schools he can't play at U and O b. J D is right. That makes him an n A. I quarterback relies on it. Yeah. Uh, Kevin, I think Martel's dad was a pretty big part of why he were. He was Kevin. You make a very valid point. He's not a drug. Yeah, right Issues and you can't play it. Ohio State find camp Now you can't play nlb. The three of us If we were enrolled 12 credits could play, you know? Well, Kevin. Not only that, but think about this for a moment. I know he's Uninjured, but the first time a royal decides to play him. Is against one of the top defenses in the country and Iowa state and putting him in there in the middle of a drive. I just I don't understand Martin sure he's an injured or is that I don't think that's correct. Well, I don't want to it if you guys dug well, perhaps Kevin, I don't I don't know if I don't know. All I know is this UNLV stinks. Their football program sucks. Marcus or I've never. I haven't seen anything for any creativity from the play calling on the offensive side of things. But Kevin, Here's some good news for you. The next segment. We're going to talk about creativity. We're going to talk about a good coaching staff. We're going to talk about capable players. And it has nothing to do with you. And I'll be football. It has to do with Raider Nation. Okay, Kevin. Hey, I appreciate the phone call my friend. Thank you. Thanks a lot. That's right. Coming up Next. Now we are going to get to some positives. And that is a huge win. Raider Nation, the Raiders on the road. They defeat Ben Rapist Burger. Oh, I'm sorry. I had to say it, folks. I'm sorry I had to say it. If there's any quarterback I don't root for. It's been Roethlisberger as I call him. Ben Rapist Burger. The Raiders phenomenal win on the road. Derek Carr was fantastic. The defense made life impossible for Ben Roethlisberger yesterday without Josh Jacobs. The Raiders come away with a huge one on the road. Against the Pittsburgh Steelers. Unbelievable win coming up. Next. We're going to be joined by Scott Gulbrandsen. He's going to break it all down for us. He's the founder of Silver and Black today. How were the Raiders able to get it.
