Thank you so much for joining us today. I'm delighted to be with you. Scott now the house. Judiciary has formally resolved to implement and impeachment in procedure. Does this mean the committee has a clear right to obtain a copy of the Muller Grand Juries secret material which should suing for that otherwise will be protected by the federal courts grand jury secrecy rules well it still needs to be ruled upon by a court but the courts have determined that the investigative investigative fact-finding powers of Congress are at their zenith when we're in an impeachment investigation and that's because impeachment is explicit enumerated numerator power of the legislative branch under Article One. It obviously goes to the very essence of the rule of law so we're in a legal proceeding being now. Does that mean the House Judiciary Committee is going to move to restrict members for making comments during witness interviews instead of asking questions which would make the hearings more like depositions depositions for potential Senate trial well. I think it has been more like that certainly like if you go back to the investigation and I think the Lou in Taos Ski hearing was was more like that but of course you know with the trump administration and then trump witnesses all that's her off because they basically thrown caution to the wind and our behaving completely above and outside the law but yes I mean when we're in fact finding investigative vestige of hearings. We're going to be working to just try to collect as much information as we can. Do you think that Corey Lewandowski should be held in contempt. Well I think he clearly was in contempt of Congress. He was behaving in contempt of the people is representative then of the people in the constitution how we deal with this most lawless and reckless doc was administration is just a very thorny complicated problem because if we go to court it takes weeks or months to take two years in some cases the contempt holding against attorney general holder from the fast and furious investigation took several years before there was finally a ruling on it you know we're dealing with a tidal wave of misconduct by the administration on daily basis so I I am someone who favors our use of inherent contempt powers of Congress where we don't have to go to the courts in order to enforce rulings. We can just do it ourselves but that hasn't happened around here for many many decades and would require dusting off some of our nineteenth century rulings and practices. I immigration trump and impeachable acts. Are there a few that your committees targeting you know whether it be emoluments or what do you think the major major articles of impeachment would be if impeachment does go forward well the cardinal sin in the constitution for for a president gone bad is converting the office into an instrument of private profit and self enrichment and the foreign emoluments monuments clause prevents the president from collecting foreign payments payoffs from foreign governments prince's kings and foreign states without the consent center. Congress that domestic emoluments clause limits the president to his salary in office and prevents him from collecting other money from the US government. This president president is in flagrant daily violation of both the domestic and foreign emoluments clause. He's collected millions of dollars at the the trump office tower in business deals around the world at the golf resorts and hotels and of course at the headquarters of all the action which is the The Washington trump hotel where all of the foreign governments interested in ingratiating themselves with the president come and spend lots and lots of money and you know the president has made a token payment of three hundred and forty thousand dollars to the Treasury thing this represents the quote profits on payments. He's received from foreign governments but the Constitution doesn't ban his collection of prophets bands collection of all payments and he didn't give us an accounting anyway. Nobody saw anything. We're we're just supposed to take his word for it and then event. It's up to Congress. It's not up to him. In domestic emolument side the whole country now is totally aware of what's going going on. He gave the game away when he sent the vice president to Ireland and told him to stay at his hotel and then it comes out that in Scotland they redirected kids that Air Force air traffic to stop at every fueling site near the turnberry resort and then they've they've put up nearly two hundred thousand dollars worth of servicemen and women there at the hotel no and they're just making money hand over fist every single day and he can't be accepting any of it. The president can only accept his salary and the joke is that he it goes around the OH. Never you know I went back did a little study of all of the emoluments received by other presidents and they were all scrupulous about turning them over to Congress yeah Abraham Graham Lincoln in the middle of the civil war. You know there's battles taking place and he's said the elephant tusks he received from the king of Siam over to new Congress saying I love these. I keep them in Congress had no they must be turned over to the Department of Interior and trump's hero. Andrew Jackson received a gold gold medallion from Simone Boulevard. Who was the Prime Minister Venezuela. He wanted to keep that in the congress said well we see equities on both sides but we think you should turn that over to the Department of State and he did but it flies in the face of everything that the framers believed to allow the president to keep millions of dollars in cash being deposited with him and his businesses you know the whole point of these clauses was to say that the president had to have undivided loyalty to the American people people and not foreign agents swarming all around on the nation's capital and not to his own business interests and yet this president decided not to himself top of his business interests and decided not to put everything in blind trust. He just kept going and has other trump's working with him on it well. It's a scandalous situation and I think that he betrayed his oath of office. He portrayed the constitution from day. One and everyone sees the way in which the moneymaking continues. How do you think this ends for trump well. I do think that version of the presidency into a for profit enterprise is is the Achilles heel this administration and the kind of betrayal of the office represented by these actions we are seeing now of course horse with this whistleblower meddled matter but that's just unfolding now so we're not quite sure where that takes us but we have in every episode is the president placing. I think his personal monetary and political interests above the office above his responsibilities in office and that just cannot stand in the long run. There's a certain kind of animal cleverness that he has about escaping situations. He's gotten into but I think ultimately the framers framers of the constitution will prove to be superior match to even this reckless wallace president. "Today. The House Judiciary committee votes to hold the attorney general in contempt of congress for refusing to release the full Muller report, nothing is likely to happen. Why congress is running out of options for how to investigate the president. It's Thursday may not. Please come to order for being present attack. What was the mood at this meeting of the House Judiciary committee on Wednesday? It was tense chairman Nadler was very unhappy with the administration's general attitude toward complying with requests for information from congress as a co equal branch of government. We must have access to the materials that we need to fulfill our constitutional responsibilities in a manner consistent with past precedent. Now's Democrats, of course has for testimony from Bob Mueller special counsel William bar. The attorney general Don Mcgann, former White House counsel and all kinds of documents, including tax returns and business records of President Trump and most pointedly at the moment, the Muller report in the document's underlying it. The Malo report is not ordinary run of the mill document details significant misconduct involving the president, including his campaigns willingness and eagerness to accept help from a hostile foreign government.

"The transmission of the roadmap, but the story and the lesson for Nadler does not quite end there. Because congress a few years later wrote the roadmap procedure into law. The now defunct independent counsel law required. That quote, an independent counsel shall advise the house of representatives of any substantial and credible information, which such independent counsel receives that may constitute grounds for an impeachment. It was under this law that Kenneth Starr issued the so-called star report which was actually a referral of information that in stars judgment. The judiciary committee might consider grounds for impeaching Bill Clinton. The result is that we have something of a presidential tradition in which special. Prosecutors investigating presidents have referred material to the House Judiciary committee. That they regard as possible grounds for impeachment. The trouble is that the particular statute under which star operated has lapsed and the regulations that replaced. It have no provision for an impeachment referral to the contrary. They require that Muller. File us confidential report to the attorney general who then decides what to do with it. They conspicuously do not require that information that might be essential to Congress's performance of its duty actually reached congress. So if Muller actually has evidence that congress would want to examine under the impeachment clauses tapping into the incipient tradition of referring such material would require a decision on his part, and it would actually require as well a decision on the part of incoming attorney general William bar. A letter from Nadler would be designed publicly and formally to remind both Muller and bar of the tradition, and of congress is expectation that they act in accord with it Nadler has declared. He will get the Muller report, quote, if necessary our committee will subpoena the report if necessary will get Muller to testify he said recently, but this actually skips an important step. It assumes that Muller's report will be a fully developed narrative that answers all of congress is questions on impeachment matters. But what if the Muller report is not factually rich, what if it is not designed to deliver to congress information to help congress do its job..

"Shorts. January thirty first two thousand nineteen today. An article that we ran this morning on l'affaire entitled what an old Watergate document can teach the House Judiciary committee by me. The chairman of the house committee on the judiciary faced a vexing problem pressure for impeachment was building. But while lots of evidence against the president was public key pieces of it were not they were rather in the hands of a special prosecutor who didn't work for congress. The prosecutor's job was to prosecute crimes not to evaluate the president's fitness for office that ladder job lay with the chairman and his committee who didn't have access to the prosecutor's evidence. They should start by formally asking Muller to refer it to them. I ran across regina's letter in a passing reference in my recent research on the Watergate roadmap. Very quiet. He presumably doesn't want congressional activity to interfere with his investigation. And he's evidently, not look. To jump start congressional investigations that will want to talk to his witnesses. Indeed, it's not even clear if Muller believes he has information that he would want the House Judiciary committee to examine pursuant to its obligations under the impeachment clauses. So if I sit in short to say that at the present time, neither the supply side, nor the demand side of this equation is as mature as it was in nineteen seventy four. And yet as I say the similarities between the situations strike me as alternately more substantial than the differences for one thing. The structural arrangement is very similar once again, the judiciary committee has the impeachment thority, but not the evidence while the prosecutor has the evidence, but not the authority to think beyond the narrowly criminal in critical respects, the current interational of this problem is actually worse than it was in Watergate back then after all the Senate Watergate committee had done its own extensive investigations key witnesses had testified publicly and the broad parameters of the story were thus known..

We'll we'll have hearings all of which we done in consultation with our chairman to to be Jerry Nadler I talked to him about voting rights in emoluments already and there'll be other hearings by the full committee and maybe some of the other committees that might come up and I think they'll be like impeachment hearings if they're not called impeachment hearings because they are the the problem of an impeachment would be violations of emoluments and and <hes> unjust USA pardons and attempts to obstruct justice which may come up as well and some of that would come up in the criminal law subcommittee which Sheila jackson-lee will share. I think she'll have the opportunity to do hearings on things like obstruction of justice and and other surveys currently with Muller's investigation so we'll have those whether there will be a impeachment hearing soon. I don't know eventually there will be one and I say there will be one because trump continues to exhibit and show the need to bring impeachment charges against him and that's why did it in November twenty seventeen <hes> h joint reservoir twenty one <hes> he just keeps keeps doing he doesn't know how to refrain because his life has been one crime <hes> after another one misdeed after another one lie after another and he will continue to do this.
