Rep. David Kustoff: Committee Members Should Visit the Border

"So that's another thing that I plot our Republican leadership doing what you just talked about is taking the committee out of Washington D.C. Todd and taking him to really to real America to the border. My committee, the ways and means committee had a hearing a few weeks ago when Petersburg West Virginia and we've got another one coming up next week and in Oklahoma. But taking the hearings, Jim Jordan taking the judiciary committee to the border. I know Mark green's going to be taking his Homeland Security committee to the border. So that the members of Congress could hear directly from border control agents, local law enforcement, everybody. So that when we're looking at legislation and things that we can craft, try to address these problems that we're not operating in a vacuum, we're hearing from again from people with experience. And I'm glad that Biden went to what do you create? But you ought to go to the border. The ought to go to he ought to go to Ohio to east Palestine and talk to real people who have been afflicted by all these issues, including the border, which when I talked to local law enforcement, not only do they know about migrants, but the drugs and the fentanyl that are in our communities, whether it's my district or anybody else's, they're coming Todd directly through the southern border. They're being transported by a number of these people and the cartel. So bottom line is we've got a seal off that border.

"How should this area arm service committee Let's go to House judiciary Man we got a lot of things to be done on that side of the equation What are some things you're hoping to get done on this in this particular committee Well listen judiciary has a very broad jurisdiction over all sorts of things Over the system of justice is we were talking about but things as immediate as the border We have a Homeland Security committee as well but between that one and ours and judiciary we have the jurisdiction over the entire immigration system And so we are going to demand immediate accountability of secretary mayorkas and the Department of Homeland Security for that open border And it is just the negative effects of the open border can not be overstated It is an absolute it's not a crisis anymore as they catastrophe I mean we have had almost 5 million illegals come across that border in the last two years about 1.7 of them have just been released into our communities around the country It's part of the reason that crime is skyrocketing Of course fentanyl overdoses are now a drug overdose is now one of the leading causes of death fee leading cause of death for Americans age 18 to 45 We've got sex trafficking the cartels in Mexico are making billions of dollars in the Chinese or manufacturing the fentanyl Everybody's benefiting from this except the American people and it's a disaster that we've got to get control of

"Now listen you know there was that fracas over who the speaker was going to be Honestly I didn't care who the speaker was going to be It makes no difference to me Considering the real interest that I have is and what these committees are going to do and who's chairing those committees That said as I mentioned in the first hour there congressman chip Roy out of Texas he joined this fight To extract some conditions from Kevin McCarthy Kevin McCarthy really wanted that gavel And he got it He did and he did the hard work to get it And he should be commended for it because that's how the legislative process works in a legislative body You got to wrangle people and you got to give a little you get to take a little And if you want it you need to do what it takes to get it And that's what McCarthy did One of the things he had to give up one of the things that chip Roy the congressman from Texas was intent on having with some representation On the rules committee the rules committee who cares about the rules committee I don't think about the rules committee This is an interesting and fascinating thing about Washington D.C. Because all the headlines and all of the video on prime time cable news programs always gets dominated by the judiciary committee and the oversight committee and the intelligence committee and sometimes armed services committee Homeland Security committee These are the committees that get all the attention and I get it But if you ask anyone who works and lives in Washington D.C. works in the federal government works on Capitol Hill you ask them what's the most powerful committee in the House of Representatives and without even hesitating they'll tell you it's the rules committee That's why it was important

"You need every time you listen. The WTOP producers desk is wired by IBEW Local where electrical contractors come to grow. Good morning I'm Michelle Bash and I'm Kyle Cooper. Gray Student is our producer. Top stories we're following for you today on CBS News special report. Former President Trump has been indicted in the classified documents case. His response? Here we go again. Very unfair. CBS News legal analyst Ricky Kleeman says this case is different from those involving former Vice President Pence and President Biden. Donald Trump not only didn't let them in but he returned things piecemeal and then he absolutely decided to obstruct the investigation according to the government's allegation. Before the news of the indictment President Biden was asked whether he could say anything to convince Americans that they can trust the independence and fairness of the Department of Justice. I have never once not one single time suggested to the Justice Department what they should do or not do relative to bringing a charge or not bringing a charge. Mr. Trump will be arraigned in federal court in Miami next Tuesday. CBS News special report I'm Linda Kenyon. Now there's a lot we don't know about this case and the evidence that led to the indictment but CNN has obtained a transcript an of audio recording that could bolster the prosecution's case against the former president according to transcript the in CNN's possession. Mr. Trump can be heard admitting he retained secret military information that was still classified with the former president purportedly going on to say that as president he could have declassified that information but now he can't. That recording was made in 2021 and it captured a conversation about a classified document dealing with possible plans for an attack against Iran publicly Mr. Trump has claimed that all the documents in his possession were declassified meantime The next time his attorney made the rounds on TV this morning appearing on NBC's Today show James Trusty says there's no doubt that the former president will appear in person in a Miami federal court on Tuesday. Trusty says the charges include willful retention of national defense information obstruction of justice false statements and conspiracy he also calls it a ridiculous criminalization of a non -criminal dispute and says the case is being weaponized by the Department of Justice. Trusty vows Trump will come out swinging. "Whipped up again. Good morning. Good morning, Stephanie. I might have forgotten my sarcasm fonts on Twitter. I don't know. I forgot to hit control S. I am as I've mentioned, I am well, we're veruca salt and pepper because I am frequently also impatient for justice and then someone calms me down and then I get whipped up again. But this is exactly what we were afraid of, right? Is the House Republicans now are going to make, you know, black is white up is down, you know, it is the false equivalency between these two cases of classified documents. Let's start there. Your thoughts on that. Look, the Republicans, the House Republicans are going to clown themselves for two years chasing the hotel. Jim Jordan is nothing more than a sentient rottweiler. He's just he's drooling at the mouth and he's just gonna bark and he's gonna chase whatever car rolls down his street. I think it's important for the media to not cover the Republican Congress as if it is a legitimate body, right? And I'm not saying that it's illegitimate in terms of like, they got the most votes they did. Thanks New York. State Democrats for screwing that up for everybody. Thanks for your keen intuition on George Santos. Abilities. I'm saying that it's not a serious exercise of governmental power. The Republican Congress exists to produce clips for Sean Hannity's broadcast at night. And we should understand them and cover them like that because nothing that they're doing is, for lack of a better word, serious. Nothing that they're doing is serious. It has, it's seriously annoying. It's seriously problematic, but nothing that they're doing is going to be passed. Nothing that they're doing is going to become law. It's just going to be a bunch of sentient barking at each other and basically trying to rip apart Hunter Biden's laptop. Well, I think it is a problem. Yeah, I hear you. But it is a problem in the sense that what was the tweet this morning, Travis. Every person on the Homeland Security committee asked for a pardon. For trying to overturn the homeland. I mean, you know, how is that not a problem, right? I mean, part of this is going to be how the Biden administration reacts to the Republican Congress, right? Now, I think that we have a precedent here. Where we had a former president, Donald Trump, simply ignore every attempt at congressional oversight every congressional subpoena he just simply ignored it, right? So if it's good for the goose, why is it not good for the Gander, right? Like if I'm the Biden administration, I ignore literally everything coming out of the Republican Congress just like Republicans did just like Trump did the democratic Congress for two years. I mean, we talked about this, Stephanie, in real time, right? We talk in 2018 and 2019 went sorry in 2019 and 2020 when Trump officials were ignoring congressional subpoenas. We said, if this is the standard, that standard needs to be applied when the roles are reversed.

Democrats on the Homeland Security Committee say a government watchdog needs to resign after attacks from January 6th. WTLP's Mitchell Miller today on the hill. The Inspector General of the Homeland Security Department, Joseph Kaffari, during a hearing this week admitted under questioning by Maryland Congressman Glenn Ivey that he had deleted messages from his government issued iPhone. But federal law requires him to preserve his texts and Ivey notes this comes after Kaffari failed to let lawmakers know for months about Secret Service texts that had been deleted before and during the attack on the Capitol. January 5th and January 6th text messages by Secret Service agents were obviously important to the ongoing investigation. The text could have provided valuable information related to the activity of former President Trump. Secret Services said the texts were wiped out during a scheduled upgrade. On the investigation. "Been on the front lines fighting for America first policies in Congress. In Ohio, GOP state senator Matt Dolan says he'll challenge democratic U.S. senator sherrod Brown. Ohio is one of the states where Republicans hope to pick up seats. In 2024, Democrats will be defending nearly two dozen of the 34 seats up for election. And while they gained a seat in the midterms, they could face tough races in several states, including Michigan, Wisconsin, and Pennsylvania. On Capitol Hill, Mitchell Miller WTO news. Two Republican members of Congress have been put back on House committees after being stripped of their panel assignments more than a year ago, Georgia's Marjorie Taylor Greene has been selected to serve on the Homeland Security committee and the oversight committee. Greene had lost committee assignments in 2021 due to her support of QAnon conspiracy theories and previous encouragement of violence against democratic lawmakers. Arizona's Paul gosar will serve on the oversight and natural resources committees, gosar was censured a couple of years ago after posting a video meme on social media showing him killing democratic congresswoman Alexandria Ocasio-Cortez of New York. And embattled New York Republican congressman George Santos has secured a couple of committee assignments, despite getting a lot of blowback right now for lying a lot for making up key details of his background that were central to his campaign. Axios reports Santos got a seat on the committee on small business and the committee on science space and technology. "Good morning, New York. This is the catch round table drawing catch some keys. Here's Sunday morning. We'll just today a former congressman Peter king, and he gives us an update. It's 16 days to the election. What's happening in Long Island? What's happening in New York? What's happening in upstate? Tell us what's going on. Well, I wish I knew everything, but right now the way it looks to me is that what's happening on Long Island is what is happening to some extent in New York City and around the state and that is a real trend toward the Republican Party and most notably toward the region as the candidates for governor and then you go back a few months ago and most people haven't even heard of resellers, then when the polls start the click, you are still down by 1718 points and the only question was, how many votes have you win by? Now, with each poll is getting closer and closer, it's down to 5.4 points. And this is incredible to cut a major lead like that. I mean, 17 points to four points and politics is almost unheard of, especially when the governor of what the 17 point lead had all the money. So if you had everything going away and yet we kept annually and also one more people started looking at the issues and they realized that with inflation, they're getting killed the gas station they go to the store they buy the most basic items at all and you see the price is going so high. And then with prime and you and I fully agree on this. You know, me and you met Kathy hochul, the governor now. Had a breakfast meeting and we both thought she was a tough Irish gal and I love her. I think she's a great lady. But I still don't understand why she's not doing anything about the crime in the streets in the subways. Yeah, you and I did meet with her. I think that was the day before she became the governor. And was going to happen the next day of the day after that. And she met with this unique analysis of practice proceeding. And I also had worked with Kathy hochul in Washington. I was chairman of the Homeland Security committee who was a democratic member on the committee and she was certainly very moderate to conservative remember she was very good to work with she wasn't partisan to work across party lines, but since she's gotten to Albany, it's just so out of control. I mean, it seems to be a chapter of the progressive wing of the Democratic Party that seems to scare the life out of it. And convince her to take these radical left wing physicians and it's really unfortunate. And so as a result of that, we still have no real changes in barely form and discovery, all of those issues involved in criminal justice, which are tie dye into the cops and put dead people criminals back on the street. And the reason for this promise to change that is promised to restore well in order to give the police the authority of holiday these and that's to remove district attorneys who refuse to carry out the criminal law. So on the governor, the governor does have the ability to remove district attorneys that don't do their job. Yeah, and these district attorneys, including Alvin Bragg, post about the fact that they're not going to do their job. And I can not force these laws also to bring you back to the polls for one second. I sort of all look about just a few days ago, and I can't be hopeful with 46% and 42. At that point was accurate. That means the resultant is definitely going to win because if you're the incumbent and you are as well known as Kathy hochul who is now and you are under 50%, that generally means that that undecided vote is going against you. It means that a majority of the people in the state don't think you're doing the job as governor and so that undecided vote, I'd say the bulk of that is going to go to Lee's over. So that to me, that is the polls. I was happy hope I'd be most dangerous about most concerned about to be four points under 50 when you are the incumbent. That means 54% of the people are not willing to say that they want you to have another term as governor. I love everybody. You know I'm a middle road guy like you are. I just want New York City and New York state and Long Island definitely because I live there, you live there. On weekends I live there. To be safe and that's what we worry about. One more thing. Another thing that I'm disappointed in the state in congestion pricing. Talent tell us again about congestion pricing and what the heck is going on with that? It looks like they're going to roll over everybody. This is pretty attractive $23 on anyone who drives in Manhattan. And so that is going to dramatically affect the people in Queens, Bronx Brooklyn, and the consumption of microphone and constituents. And that's your traffic alley. Every time they would be going into Manhattan, they'd be a hits for 23 hours. Now that would include people taking family members to doctors to hospitals, people go into restaurants, people going to work, people who just want to go in and visit over the great landmarks that have Manhattan has to offer all of that would be in course up to $6000 a year just to drive into Manhattan. And this is going to certainly hurt my constituents my former constituents in esophagus. But in the end, the one that's going to get hurt the most are the people living in Manhattan. The people of business have Manhattan and have this shelf. If you live above 60 in Sweden, you want to go downtown to a restaurant you're in deep crap. Yeah, it's just insane. It's absolutely bad and you can find that with crime, the fact that people are afraid to take the subway is afraid to take on our railroad, it's for me this is so damaging and the engine Manhattan, but in the short term, very damaging to queens, Brooklyn, Bronx, certainly to Nestor and Suffolk counties Staten Island. I mean, it's just brutal. So this is a misguided efficient to give more money into the MTA, which can account for what a judge with the money now and it's not going to work. It didn't work in London. It's not going to work here. And I wish I had the sound effects into that deep hole. You know, when you talk about money and the MTA, it's a deep now, not the thing that's going on. I mean, they kind of kill us on the streets of New York. They're trying to kill us in subways. They're trying to kill us for congestion pricing. Now, I understand Long Island where I have a summer home or weekend home. It's no longer just summit, so we get home. They want to close down.

"Pardon me? Gallimard. Okay. The democratic chairs of the House committee on oversight and the House Homeland Security committee sharply criticized the Department of Homeland Security. Inspector general on Tuesday for refusing to testify or share documents related to his office's handling of the missing Secret Service tax. What is his name inspector general Joseph kafa? That guy needs to AB fired, right? Be, I would assume the target of an investigation. What is going on? It might be easier if they keep them inside so they can. Inside the tent of heart? Yeah. What? What? The saying I promise. I don't know what that means. All right. That does not apply to the situation. I think it does. I think it does. Someone will tell me I'm right. Okay. The committee about it. Yes. She'll like all those tweets. The committee has previously urged kapari to recuse himself from the investigation into the missing text messages sent by Secret Service employees. Large part because he failed to notify Congress that the messages were missing until over a year after he knew they had been lost. He refused to recuse himself testify before the committee provide documents or allow his employees to be interviewed. Something stinks to high heaven here. The letter said if you refuse to comply with our request, we will have no choice, but to consider alternate measures to ensure your compliance. Carlos, we were saying like this seemed like a totally unconnected crime, but now they've just interviewed cipollone and the other guy about the missing classified documents, right? In Mar-a-Lago, so that's I think it is, you know, what's the word can act in to the mouth of the incident down near brainerd? Yeah. You're not brainerd. "Should have that So all parties no one no party will be surprised So yeah we should have that But I'd like Biden did at the beginning It's like when I do prostate gan case and cartels Yeah I would never go to a cartel or a gang how do I say that I mean guys I want you to stop what you're doing I don't want you to do this But just so you know even if you do do it I'm not going to prosecute you That's basically what Biden said to Russia at the beginning That's why Russia under impunity That was a classifier in judgment We are where we are now You're ranking member on the Homeland Security committee and I know that you're focused very closely very concerned about the potential for a cyber attacked by Russia here in the U.S. You've put out an alert along with the FBI and others about reinforcing hardening our defenses Are we better prepared for that now than we were at the beginning of this war There's no question that people are taking cybersecurity farmers serious than they were before this war began And I'm proud to say that Homeland Security has had a lot to do with it And a lot of problems with the Biden administration One of them is not a Homeland Security cyber the cybersecurity preparedness They've done a superb job And they've got good people in a leadership position there They have a thing called shields up and a whole bunch of security in the cybersecurity office This is office They call it And you're going to shield up any entity in the United States I think the individual and you can get guidance on how to make your system stronger And what we've done with this cybersecurity arm is to make sure that they're working better than they ever had before with the private sector making sure the private side is as ready as possible especially the critical infrastructure subsets to make sure the ready is possible in case there is a cyberattack And I think we have to assume that there's going to be a cyberattack and then heavier shields upright and roll That's exactly what we're trying to do One thing I don't think you do approve of very much is the administration's policy when it comes to immigration I know you were along the border last week Congressman title 42 is about to go away unless something is done I know even some Democrats are urging the administration to extend 42 is that the right move now or are you looking for a more comprehensive approach But they don't have a policy with respect to the border And they don't have a plan with respect to the border other than to say come on in They are it is incredible what they've been doing there I started my career as a federal prosecutor in 1994 Going after cartels on El Paso and I'm intimately familiar with the border I've never seen it this bad I went down again last week to meet with all the border shares from California to Texas and Democrats Republicans didn't matter They were uniformly adamant that the Biden administration is destroying the integrity of the border and that if and when the title 42 is revoked that there will be they will lose operational control of the border That means they won't be able to stop anything coming in because they're going to be over completely overwhelmed And that to me is a stunning stunning event For a nation at war here if this is something that Democrats and Republicans want to handle why not do away with the COVID rule the health rule 42 and put something new in place here to keep foreign combatants out of the country Well they used to do that And we've been clamoring for them to do that Don't forget on January 20th when President Biden took over not only did he he basically changed the complete tone and tenor on border security he resolved to remain in Mexico policy and he's filed with the courts ever since to try and revoke it And now the title 42 is another one of the weapons that they use Can you extend it Do they do portraits And there can be extended Of course it can be but it's not going to be It's amazing for me when you think about it You have to get on the airplane rather than that court ruling today And where I'm asked because of our CDC is saying but then CDC is saying well COVID is not as much an issue at the border So we can use title for you to in the mortgage meticulous I appreciate your answering my questions Congressman we'd like to stay in touch with you on all things cyber and what you're up to as ranking member of the Homeland Security committee that's congressman John katko of New York We assemble the panel next I'm Joe Matthew This is Bloomberg.

What Republicans Are Planning if They Win the House Majority

"What are Republicans going to run on? And more importantly, what are they going to do if they take back the House of Representatives? Will a newly released article from Washington examiner goes through that? What Republicans are planning to do if they win back the House majority? And we're going to go piece by piece of what they are promising their voters. And it's about time that we hold our elected officials accountable because if you're like me, you're probably exhausted and tired and cynical that Republicans keep on winning elections. And we lose the country. The parents party, the Republican Party, plans, and promises that if they take back the House of Representatives similar to the contract with America, now why Republicans do not replicate the contract with America every election cycle is beyond me, but Kevin McCarthy and House Republicans, including Jim Jordan and some phenomenal base conservatives, have said they are going to replicate the Newt Gingrich contract with America. They're going to call it commitment to America. It's not that great. I don't love that. It should be a lot more aggressive than a commitment. It should be applied, or it should be something that is unbreakable an oath, commitment sounds like something that's some shady business guy will break. Okay. Number one, here's what Republicans plan to do. I like some of this. I think this is some grassroots driven energy. Some of it's all right, but some of it is phenomenal. Pass a parent's Bill of rights, Republicans in November released draft legislation that aimed to require school districts to post curriculum publicly, require teachers to offer two in person meetings per year, prevent schools from selling or sharing student data without parent permission and require students to notify parents of violent activity on school grounds. It's really basic stuff. McCarthy said on a recent episode. Next one, China, COVID-19 accountability measures, a plan released by House Republicans trying to task force last year called for legislation to declassify information on the origins of COVID-19, prohibiting the U.S. funding from gain of function research. So here's where I think they're taking a good approach. They need to use their newfound political power for aggressive oversight. That's actually the next point. Take an aggressive oversight posture. In the minority Republicans on committees can do not have the power to compel witnesses to speak under oath, and the majority Republicans aim to use that power liberally. Particularly if they do not have a supermajority to overcome filibuster in the Senate or override any vetoes from President Biden. Republicans want to investigate the following. How we had the U.S. troops withdraw from Afghanistan and giving them $85 billion in weapons. The origins of where COVID came from, the national school board association's relationship with the Department of Justice and asked if federal agencies threatened to stop threats of violence. Also, what's happening on the U.S. Mexico border? Republicans have already issued preservation notices and document requests to relevant agencies and individuals related to these items. They're going to eliminate House rules implemented by Pelosi, kind of technical stuff like masked men not being able to vote by proxy and vote remotely. Take on big tech. They're going to put forward a framework to take on big tech calls to reform section two 30, prevent the companies from discriminating based on political affiliation, an increase their transparency. Also, back a antitrust bill that would give states attorneys attorney generals more control over where antitrust litigation is conducted, and then strip House Democrats from certain committees, in retaliation for Democrats removing Marjorie Taylor Greene and Paul gosar, House Republicans plan to strip Elon Omar, saying that she should not be on the foreign affairs committee, and Adam Schiff should not be on the intelligence committee, which he's currently the chairman. Nor should Eric swalwell be on the intelligence committee or the Homeland Security committee. This is actually okay. Would you agree Connor? This is actually some pretty good

"I'm congressman jim. Himes i represent the fourth district of connecticut. You have really focused in your time in congress on cybersecurity on the house intelligence committee and the nsa and cybersecurity subcommittees. Can you talk about just in your time. in congress. kind of how this topic and congress's thinking around cybersecurity has changed. Yeah yeah and and change it has. I'm glad to report again. I've been doing this for for for coming on thirteen years. And i would say that there's been a dramatic change in people's level of education sense of urgency Around cyber security. I sometimes joke that you know. Even a decade ago you'd have people with three stars on their shoulders come in front of the homeland security committee or other committees. And you'd ask them about cybersecurity in you'd get blank stares and obviously there's been an awful lot of water under the bridge so to speak since then the federal government as it is wont to do argue. We hasn't moved quite as rapidly as it should but it has moved quite rapidly to stand up organizations that are about defending our cyber infrastructure. developing Offensive capabilities that theoretically could be used sometimes are used for for for retribution for other operations and most importantly there's been a really a high level of education given to members of congress. "If not the worst this year they were the worst in terms of morale particularly in terms of pay satisfaction The turnover rate. There is high there. There are currently two thousand vacancies that they're trying to fill And you know constantly having to recruit and train employees because people keep leaving cost a lot of money so You know this bill that you mentioned Advance out of the homeland security committee in the house Just last week would basically just apply title five to everyone at tsa and that would put people who work there. On the general schedule pay scale it would give them full collective bargaining rights like the rest of their federal counterparts and it would give them these whistleblower protections in these abilities to appeal adverse personnel accidents to the mspb and things like that so it essentially would bring them back up to or not back up but they would bring it up to where you know. Most other feds are correct. Correct it. Oh and also they mended the bill At the committee level to also include a. I believe it's a three thousand dollar bonus In lieu of providing them out you know hazard pay for the for the duration of the pandemic. It's it's sort of a one time. We know that you've been exposed travelers and that hundreds of you have gotten sick as a result of it. bonus that endemic obviously is affected. Everything let's move to the Federal labor relations stuff biden has yet to nominate a second democrats to the federal labor relations. Authority and The federal service impasses panel is vacant. biden talks about his relationship with with labor and and i'm not to on a comparative analysis front compared to the previous administration. He is certainly much more friendly to the federal workforce. But where does this leave. The administration's labor relations. Well you know it's it's as is always the case that these sorts of things it's it's kinda complicated You know In some instances you know agencies and unions are getting together and settling The you know the Disputes that they have had ongoing The va and ahe recently announced that they are just sort of wiping the slate clean And sort of going back to pre trump agreements to sort of start to get the process of renegotiating everything But you know in some ways. It really Stunts the administration's ability to undo a lot of the things that happened under the trump administration. You know The president has undone on undone A series of executive orders. But they're you know as i've covered over the past several years. There are a lot of changes to landscape of federal collective bargaining that took place at the flra level. Where these you know. These are decisions in disputes. That have a precedent over few minutes. So in order to undo those things you d to nominate someone to make it so the democrats have a majority on this panel and they haven't done that and you know as a result we've seen several decisions come through over the past few months. That sort of continue to erode Unions writes in the federal sector so know unions are starting to really put pressure on the administration now to nominate someone to replace the lone republican. Who is on unexpired term There are currently two republicans one person whose term runs through next year and the law requires that there always be a at least one member from the minority party on that panel Additionally the federal services impasses panel like you mentioned is vacant right now You know those Those folks come in to resolve a negotiation passes..

"Secretary Alejandro Mayorkas says that border patrol custody of young migrants has declined dramatically. NPR's Claudia Chrysalis reports that secretary My Orcas attributes that to changes made by the Biden administration secretary. My Orkest told the Senate Homeland Security Committee that fewer than 500 young migrants were in Border patrol custody this week, compared to nearly 6000 in late March. The challenge is not behind us. The results are dramatic. But Ohio GOP Senator Rob Portman noted the unaccompanied minors have been moved to health and human services facilities. "Work done do the moral and national shame of the previous administration that literally not figure, Lee ripped Children from the arms of their families, their mothers and fathers of the border. He also reversed remain in Mexico and paused wall construction. Since he took office, there's been an unprecedented wave of Central American migrants arriving at the border, he rejoined the Paris climate Accord and the World Health Organization. He's directed the Justice Department to look at ways to ban ghost guns and announced that troops will be withdrawn from Afghanistan on September 11th of this year. Just this week, he signed an order making the minimum wage $15 an hour for federal contract workers, and he's revoked the permit for the Keystone XL pipeline. And while he's receiving high praise from Democrats, not so from the GOP, I'm going to act. I'm gonna act fast. I'd like to be. I'd like to be doing it with the support of Republicans. I've met with Republicans. There's some really fine. People want to get something done. But they're just not willing to go. As far as I think we have to go. It is just too far in many respects for many Republicans. Well, you know that the inauguration it was all about unity. Bring the country together that we're too divided and I have everything else. You know, down there many times I just have never seen it this bad. You know, Congressman as Central America, Central Americans arrive by the thousands to our border in we know in March, nearly 19,000 kids alone were apprehended in that month. I imagine you think you should talk about the border tonight. Do you think he will say anything different than what he said at his first press conference as president about the border that would hope he would. I'm not even sure it's only bring it up. I mean, there's the reason they don't want to go down there. Is because they know the ostrich. You are so bad. They know they know it's a humanitarian crisis and mild just knows Bill's secretary of Homeland Security. I just don't think they want the objects and certainly if it's brought up in all You know, I'm sure it's second be a driving team of joint session speech. They know this is where the president's point. The lowest on this issue, more than any other issue out there, And so I personally don't think you have spent a lot of time on it, and he should, because I think it's It is a crisis you as you noted, you formerly chaired the Homeland Security Committee. And before becoming a member of Congress, you were chief of counterterrorism and national security of the U. S attorney's office in West Texas. Where do you help? The Biden administration focuses when it comes to foreign policy We've seen plans about like withdrawing troops from Afghanistan, renewed talks on the Iran deal. And in every speech. I think I've heard the president give Thus far. He talks about China and this sort of fierce competition. We're now in. Have been in. How do you feel about the focus thus far when it comes to foreign policy and where it needs to go? Well, he's engaging with our allies. And I agree with that. I I worry about Afghanistan being You know, Look, it's gone on for a long time. My biggest concern is how can we identify threats in country and respond to those threats to the homeland? I predict it when we went trough. In September. The Taliban el coyote, probably, you know, overrun and take over that country, and my biggest concern is how can we You know, responded threats in real time. Yeah, they could impact our allies or the homeland itself. No, don't back to pre 9 11 state. I'm worried about Iran to because They are getting closer to bomb. They seem so eager to get involved in this back into the JCP away. Um, you know, just like John Kerry. I think one of just a deal. Not a good deal of Netanyahu would talk about. Um, you know, right now, Ron. And very close to their 60% Richmond within months could be it 90%. They have short range missiles and Israel in the Saudi peninsula are really in the crosshairs here. Wait. They aren't 60% already. I mean, I remember hearing And I think it was An Iranian officials saying that we're not going to be bullied. If we want to get to 60%. We will. But you're saying they they already have reached that point. We'll be I told has announced their 60% now. Whether that have verifiable that is, you know there are assessments and could be lower than that. But But we do know that they're moving, you know, with remarkable speed right now in the reversion process and if they are getting close to 60 of the Ayatollah says You're talking about about a four month break out to get the 90%. And then about a year time to develop a nuclear warhead to attach to the short range missile. So if we can negotiate and look, I want the different facets succeed. We don't want to fail because we don't want to go to war. One thing run has under standard clearly is a night shapes of America, and I think I speak for the Democrats on this one as well. I'm not gonna sit back idly and allow a nuclear Iran to exist in one way or another. America will respond to that. Speaking of John Kerry, some are calling for John Kerry to resign. He's currently serving as a climate envoy underneath. Secretary Pompeo in 2018 called Kerry's meetings, private meetings with Zarif at the time on seemly and unprecedented and carry himself at the time admitted in a radio show in 2018 that he had met with his grief. I think Mr carrying has to come out more strongly in his defense on on this, I think Um Yeah, I signed a document that requires Meteo. We'll get briefed on classified information I spent certainly don't give it to my foreign adversary. That is a huge violation of law. Um, is if which were true should be prosecuted. But I think when you don't fax, you know, in front of us I don't know if we we have all but the one thing just doesn't bother me here. Point about what pump As, says white. The Struggle To House Surge Of Unaccompanied Children At U.S.-Mexico Border

"Herbst. The Biden administration is sending FEMA to the US Mexico border to help accommodate a surge of unaccompanied migrant Children who have overwhelmed government facilities. As NPR's John Burnett reports, The move is fueling criticism from immigration hawks who say the new White House is bungling the border. If FEMA is involved, it's a disaster by definition, said representative John Cat Co. The ranking Republican on the House Homeland Security Committee. On Sunday, he promised aggressive oversight of how the Biden White House's handling the record influx of Children across the southwest border. The problem is that teenagers from Central America traveling alone and seeking asylum are filling up Border patrol jail cells meant for adults when the law says they're not supposed to be held there for more than three days. Homeland Security Secretary Alejandro My Orcas said Saturday that Ah Border Patrol facility is no place for a child. He dispatched FEMA to partner with immigration agents. "11 now on double D T. O P. A federal lawsuit has been filed today against Donald Trump, accusing the former president of inciting last night. It's deadly riot at the Capitol building. It was filed by the end of the deep on behalf of Mississippi Congressman Bennie Thompson. He's a Democrat who chairs the House Homeland Security Committee to talk more about it. Let's bring in NBC justice correspondent Pete Williams. Hey, Pete. Thanks for being here. And what does this suit specifically accused Mr Trump of doing? Well, Hilary. It says that the former president, along with Rudy Giuliani, and too far right groups, the proud boys in the oath Keepers shared a common goal of disrupting the electoral vote count on the sixth and that the capital riot was the foreseeable result of what they did. They've Invoked the Civil Rights Act of 18 71. The people who filed this lawsuit, commonly known as the Ku Klux Klan Act, which allows lawsuit against government officials for claims that they conspired to violate civil rights. So It includes many of the arguments that you heard from the House managers during the Senate impeachment trial and incorporates allegations from the FBI that we're in court documents accompanied the criminal charges against the proud boys in the oath keepers. Are you expecting more lawsuits like this against the former president? Well, I see I I think it's quite likely that there will be and I think the key question in these conspiracy lawsuits is what will it take to prove a conspiracy? Clearly, there's no evidence that the president and Giuliani sat down with these groups and hatched a plan. Some courts have said that it does take proof of acting in concert. That means an agreement. That means some communication, obviously no evidence of an actual meeting. So the question is Will the back and forth of their independent social media messages passed the test and be enough. And of course, you know, you can ask to lawyers what their what Their opinion is, and they'll disagree. Some think it will. Something it won't so it really is. Ah, tough Legal bar to cross Is that true? It is And of course, former presidents are immune from lawsuits over their official acts while they're in office, But they can be sued for conduct that was not part of their official duties. And obviously, the lawsuit will claim that in inciting a riot, the capital was not part of the president's duties so he can be sued for it. The first step will be undoubtedly the president will file a motion to dismiss and Giuliani will to Mr Trump's Advisor has put out a statement today saying that he didn't plan producer organized The rally didn't incite or conspired to incite any violence. So if it survives a motion to dismiss, then the next step would be legal Discovery. He thanks for your help on this. Appreciate it. Thank you. That's NBC justice correspondent Pete Williams. We'll check in on sports next 3 14. Hi, friend. It's your home speaking and I need.

Trump and Giuliani sued by Democratic congressman over deadly Capitol riot

"Congressman is suing Donald Trump over the ex president's role in the capital riot. Trump's Senate impeachment acquittal is expected to lead to a wave of litigation over the insurrection now that he's lost some legal protections as an ex president. House Homeland Security Committee chair Bennie Thompson suit accuses Trump of inciting the insurrection and conspiring with his lawyer and extremist groups. Keep Congress from certifying the presidential election results. Several other lawmakers are expected to join the suit, which was brought under a law known as the Ku Klux Klan Act. It bans violence or intimidation meant to keep members of Congress or other federal officials from carrying out constitutional duties.

Senate begins Biden Cabinet confirmation hearings

"Just a few hours. Until joe biden takes the oath of office and becomes the forty six president of the united states. five of his most high profile cabinet nominees five of them got their senate confirmation hearings today. Secretary of state nominee antony blinken appeared before the foreign relations committee armed services committee question. Defense secretary nominee. Lloyd austin janet yellen who's biden's nominee for treasury secretary. She had her hearing before the finance committee. Also hearing for biden's pick to head homeland security alejandro may orcas and the director of national intelligence nominee of real hanes. Got her hearing as well five. Really big ones right. I mean state defense treasury homeland security intelligence five of them all at once today. We never have this many nominees for huge cabinet positions all having their confirmation hearings all on the same day. That's because in years past when a new administration was on its way in the senate would hold hearings for new cabinet secretaries over a period of days many days in advance of the inauguration so the new president could have at least some of his cabinet in place when he actually took office. Not this time. Though this time we got all these hearings all at once. Literally the day before the inauguration because the republican controlled senate just chose not to get their act together to move on. Move on biden's nominations before now they had some very important recesses. Take among other things i swear. The senate didn't even come back from their latest vacation until today. Yeah no rush when you haven't held confirmation hearings for anyone before today feel free to take a few more days off so biden is having to take off with an empty cabinet with literally. No cabinet secretaries confirmed including in critical national security positions which is totally unprecedented. on president. obama took office in two thousand nine seven of his cabinet. Secretaries were confirmed. By the end of inauguration day. many of president trump's cabinet picks face more opposition in the senate but even he took office with his defense secretary in his homeland security secretary in place. This time though. Barring some kind of senate miracle joe biden will have no one in. His entire cabinet confirmed on his first day including in the major national security positions and bad news. Good news on that front. The bad news is the obvious. The bad news is that that means president biden is going to start with a whole bunch of acting temporary. Fill in cabinet secretaries instead of full blown senate confirmed cabinet secretaries of his choosing which will just make it that much harder for the new president to hit the ground running and that's true in terms of policy matters that's also true in terms of national security. It's worrying for all the obvious reasons. That's the bad news but the good news is that the trump administration has been so profoundly dysfunctional for four whole years that we're actually starting used to that now. We're actually sort of used to having only acting stand in non-confirmed secretaries at all the most important jobs in the cabin and that's not something that the republican controlled senate screwed up for trump despite him doing it the right way. That's just the way he ran the government. I mean thanks to republican senator josh hawley slowing down the process and the homeland security committee. Joe biden is going to have to settle for an acting homeland security secretary for at least a few days but the united states has already had nothing but the homeland security secretaries for like two years under donald trump the longest they can see in the presidential cabinet ever because donald trump could just never get it together to have real nominees who got really confirmed by the senate and who held their job with all the attendant powers so maybe four years and terrible governance. Maybe we are better at running government poorly in that way there was would have been before this four year experiment and terrible governance. That is now coming to a clicks.

Massive U.S. hack one of 'greatest intelligence failures of modern times'

"We're following breaking news on the largest hack on the us government by a foreign adversary ever and their silence from the president. Politico was first reported. Nuclear weapons agency was reached a cyber attack. Russia is believed to have targeted multiple. Us government agencies including the pentagon security and treasury as well experts are saying the hack started six to nine months ago and the trump administration had no idea. It was happening the entire time. The new york times calling it among the greatest intelligence failures in modern times the greatest intelligence failures in modern times. Joining me now is center. Gary peters ranking member on the senate homeland. Security committee senator. Peter's thanks for joining us on this this is astounding to say the least. I have to say when this news broke over the weekend. It was shocking. The first question on my mouth was classified information they get a hold of. And then wow who knew it. Blew up to nine months of basically hacking our government systems. and now. we're learning this breaking news at a politico. The energy department national nuclear security administration have evidence that hackers accessed to their networks as part of an extensive espionage. What are you know about this that you can share a well. What i can say is that we still have to learn a lot more but to to your opening comments It's shocking. This is incredibly disturbing to have such a sophisticated breach that impacted so much of the federal government. The fact that they could get into these systems and be there for a long period of time It's gonna take some time to get a sense of what What is the extent of the what the information did they gather a. What was their intent that we have to get to the bottom of this and we have to do it too quickly because of Of what is at stake here. I know that there's different levels of classification of documents when it comes to the government Do we have any idea what level of classification to reach the we. I don't want to comment on that and we're still learning more about that. This is still this is again. This is a very sophisticated breach. This is the type of breach where cyber professionals Wake up in the middle of the night and are very worried. I can tell you that and we just have to get a better sense of exactly what happened. In part of part of the the action right now is so which is part of the department of homeland security which i am the ranking member of the committee that oversees They've got a directive out now to try to to stop any other attacks on the system so it's important for all of the government agencies to engaged in those activities and then basically them we have to set our threat hunters out. These are teams that will go out and get into these systems to get a sense If they're still a bad guys in there and get them out and then try to assess exactly what they did. So that's that's the process. That's going on right now on the being undertaken in an aggressive fashion. I mean at this point though. Do they even know what they're looking for. Considering the fact that these hackers were able to find a loophole in breach government documents How do they stop something. That they don't even know what they're looking for what it looks like well. It was discovered so they know what it looks like. They do have a directive To stop access bet which they're hoping that implements. So so that's being done and then we do the threat hunting. So we there. That's i was discovered And that once you know it's there then you've gotta look for it in other places. Which is what's happening right now. That it is fairly widespread does throughout the end. Perhaps not just federal government. We're also looking at the independent or private companies as well. This could be in the private sector. This was clearly a massive effort. It was very well orchestrated heavily resource and a true wakeup call do the vulnerabilities we have on our systems. We have to do a whole lot more to protect the systems. And i'll just say that in addition to protecting systems as important as that is we also have to have offensive capability and we have to punish folks who are engaged in this activity and once we know for sure who's behind it We need to let these folks know that this will not be tolerated and there will be consequences.
