I truly hope you turn to this show as an alternative to what you're not getting so you can get substantive ideas and thoughts and topics from things you're not getting from the mainstream media. To me, this week has two really important stories. The arrest of Donald Trump tomorrow at the Fulton County Jail, which I believe is way bigger than tonight's Republican National Committee-sponsored debate, and Larry Elder's exclusion from tonight's debate. And I'll tell you why the Larry Elder issue is important. I don't know that Larry, I don't know if he has a chance to get the nomination, but he's trying and he should be on that debate stage because he did everything that the Republican Party asked him to do. And they're claiming that one of the national polls, a respected national poll called Rasmussen which was one of the only polls that accurately predicted Trump's 2016 victory. The Republicans claim, the RNC claims that the Rasmussen poll is somehow affiliated with Donald Trump so it doesn't count. Larry Elder had to have 40,000 unique donors. You helped him get there. He was on the show last week and he said, hey, all I need is a dollar. And I guarantee you, knowing how responsive the Mike Gallagher show audience is, I guarantee you many of you helped cross the finish line for Larry, helped him cross the finish line. He got the 40,000 unique donors. He's got the polling. He checks every box and they're excluding him from that stage. And it is wrong. It is absolutely wrong. It's everything that's wrong with the Republican Party. It's everything that's wrong with establishment, politicians. This is what we mean by the Uniparty. And I had an interesting theory this morning from a smart friend of mine who said, you know what they're afraid of? They're afraid of Larry Elder showing up Tim Scott who would be the only black Republican candidate on that stage and who is sort of blessed, or so the argument goes, by the Uniparty. And Larry Elder is a challenge to that. Here was Larry last night on social media posting this clip on his way to Milwaukee. As you can see, I'm at LAX en route to Milwaukee. I was just informed by the RNC that I'm not qualified for the debate. Why? Even though I exceeded the 40,000 individual donations required, even though I signed the pledge to support the eventual nominee, even though I submitted three polls where I was at least 1%, I was informed that one of the polls is not eligible. It's the Rasmussen poll, even though it's the most accurate poll in predicting that Donald Trump would win in 2016, they say it is affiliated with Donald Trump and therefore it is not eligible. And I said to Ron and McDaniel, the chairwoman of the RNC, it's not affiliated with me. She said any poll affiliated with any candidate is not eligible. And no one told me that until just now. So we're filing an emergency injunction to get me up there. This is absolutely BS. One of the candidates, by the way, offered a $20 gift certificate for a $1 donation. That apparently is okay. Another one offered a free air quotes, country, Western concert for a $1 donation. That apparently is okay. Another one offered a commission to prospective donors to get other prospective donors. That apparently is okay. But I did it the old fashioned way, asking people to support me by going to LarryElder.com and that is not okay. And now all of a sudden I'm not eligible. It is designed, in my opinion, to make sure that Ron DeSantis is a nominee, anybody other than Trump. This is BS. I will see you in Milwaukee. Out. Well, I hope so. We hope we're trying to track Larry down, get him on the program. And of course, if he's available, if he's got a few minutes, I'm sure he'll join us. He's of course been a good friend of the show, friend of mine. Larry and I took a group of listeners a number of years ago to Hawaii on a cruise. We had a wonderful time. Under no circumstance should you step on that stage. There's a time and a place to talk to voters and debates are a good place to do that, but this guy's up 45, 50 points. And the fact is you're just be a punching bag, a pinata for the rest of the crowd to kind of take shots at you and tear you down. You are the front runner by a large margin. And look, if you're high in the polls, you don't want to debate. If you're low in the polls, you always want to debate because debates are about creating moments. They're about carving out a niche. Remember, Kamala Harris had a brief moment in that presidential debate where she called Joe Biden a segregationist and a sex criminal, right? But I digress. I forgot about that. Had the t-shirt ready and then within a week she petered out. So this happens all the time where people try and create those moments. This is a whole different set of scenarios, though, because you have a former president also running for election, reelection at the top of the polling. So why would this person be on stage? I would imagine if you're going to get to Donald Trump, you have to climb that ladder and it's one wrong at a time. And so you're going to have to try and chip it away at those who are ahead of you to get into a room where you can actually be mono and mono with Donald Trump. And so it's going to take a while. It's going to take some maneuvering. But this is the first in the long line of a series of debates. And I imagine Donald Trump will debate closer to time. So good. Good. Last night with Larry O'Connor on O'Connor tonight here on Salem News Channel 14 past the hour. Welcome aboard. It's going to be a big week. I think the arrest of Donald Trump tomorrow is a far bigger story even than the debate even though I'm sure the establishment wants you to focus on the debate. And really, when you think about it, back to the Larry Elder thing for a moment, this is establishment versus the outsiders. This is the establishment not wanting to ease up. In fact, pay close attention to people who say things like, oh, Larry's not even close. I got to play by the rules. Oh, he's this guy. Those are establishment people who say that. Establishment people don't get the rest of America. They're so disconnected from normal Americans, it's jaw-dropping how pitifully out of touch they are with most Americans.

"Relationship. Don't take legal advice from a podcast. Hey guys, I'm Liz Stein with Mia's Andrew Torres, and this is opening arguments episode 7 one 9. Hey Liz, how you doing? I'm great. How are you? I am good. You know, holding pattern good, but still still fantastic still happy to be doing the show very happy to be here with you. Exactly. So what do you got today? Well, before we get to the main segment, we, of course, remain on Trump indictment watch. And, you know, the burning question on social media on Monday as we watched the like, you know, Trump's motorcade gets stopped at a red light. I have to say, Michael Cohen tweeted out the 9 protesters on the side of the road and being like, you know, stirring ground dwell of support for Donald Trump. It was just so good. Okay, so a lot of good stuff. But it seems like the burning question on social media is, are we going to have a Trump mugshot, right? It seems like the answer to that should be an unequivocal no, right? Right. And the reason for that is New York public law, 89, in which subsection two B little Roman numeral 8 defines as defines an unwarranted invasion of personal privacy as the following, including the following, right? Disclosure of law enforcement arrest or booking photographs of an individual, unless public release of such photographs will serve a specific law enforcement purpose and disclosure is not precluded by any state or federal laws. And that doesn't seem to apply here. There's not really a law enforcement purpose in the sense that I would interpret that as have you seen this man, right? Right. Or like a wanted poster, and fair. Yeah. We know who Trump is. So we have that. And that is to be fair, what Alina haba said this morning as we record this to Don lemon. She said, you know, we don't have to put this out there. Which fair, okay. Yeah, hey, Alina haba got the law right. So she just expressed it as her wish. She made no reference to the law. To be clear. Okay. All right. Thank goodness all is well in the world. Yeah. I move for a bad court thingy. You mean a mistrial? Yeah. That's why you're the judge and I'm the law talking guy. Okay, so you have your fancy citations and law talk and stuff, but I have something much, much better. And that is the breathless words of one Hogan gidley, the former Trump spokesman who still hangs around as he told to time. He said, we'll have a mugshot. For the record, it will be the most manly, most masculine, most handsome mugshot of all time. I can say that definitely before having even seen it. This is a little happy birthday, mister president. Happy birthday to you. Anyway, so thanks. All right. Thank you. Open a window in here. Okay, but today, after we have our little musical interlude, we're going to discuss the Maryland court's reinstatement of adnan syed's conviction for the 1999 murder of hae min Lee. And regardless of where you are on serial or Andrew's prior coverage, you're going to want to stick around for that one because virtually all of the media stories about it have left out a major element of the story or just gotten them wrong. So we first covered this story way back in episode 107. But for our purposes, this is a follow-up to episode 633, which was released in September of 2022, and we discussed the prosecutor's unprecedented motion to vacate science conviction and the decision not to prosecute him or indeed to prosecute anyone else. Right. And so to be specific, today, what we're discussing is last week's decision by the Maryland appellate court in Lee versus Maryland. And I have to tell you Liz, I am excited that we get to discuss a Maryland appellate case. After the change to the name of the courts from 2022 referendum. So I'm going to do my very best to follow the new court convention and refer to our intermediate appellate court, which I have called my entire life, the weirdly formerly named court of special appeals, since it was in fact the court of all appeals. It's now the appellate court of Maryland. And the state's highest court formerly the Court of Appeals is now the Supreme Court of Maryland. I'm going to try my best. I mean, it's fine. You can still call them the specials. That's what my mom's going to call. I'm probably for the rest of her life. So it's fine. All right, look. You know, girl same. So approximately everyone in America has listened to the serial podcast. But if you're the one listener who hasn't, here's a really brief summary of what we're talking about. In February of 1999, a 17 year old high school student named haman Lee was strangled to death and found buried in leakin park in Baltimore. Prosecutors investigated, arrested, prosecuted, and ultimately convicted her boyfriend adnan syed for her murder in 2000. Syed, who was a classmate of haven Lee's, was sentenced to life plus 30 years in prison. Right. And so you get one appeal as of right for a non capital criminal conviction in Maryland, which of course, say it exercise, right? And as you probably know, appealing your conviction doesn't stay the judgment of the trial court. So side went to prison as his case worked its way through the courts. In that appeal, that direct appeal, sayed argued one that there were various evidentiary issues, and two that the prosecution had violated Brady V Maryland. We're going to talk about that a little bit more depth, but listeners know that is the rule that requires prosecutors to turn over exculpatory evidence to the defense by failing to turn over certain evidence that was largely related to cell phone tower data that was introduced at his trial. So, considering those issues, that's what syed through council raised. The appellate court of Maryland affirmed the trial court's decision in 2003, and then he petitioned for certiorari to the Maryland Supreme Court. And the Maryland Supreme Court denied in that case. So that was it. End of direct appeals. 7 years later, 2010, syed filed a petition for post conviction relief. That's different than a direct appeal here he was alleging 9 separate claims of ineffective assistance of counsel. And again, he's filing that from prison. This is not just a law brief, right? Like sayed and his new legal team spent two years developing evidence

Very upbeat, very excited about the future and regardless of the last two years of failure after failure and problem after problem. People are looking at this as they always do, which is a chance to kind of reset. Hear people who they have elected to office, hear people who they have who that want to run and get an office and find out what their vision is for the future of the country. Remember, this conference is so important and impactful to elections because these are the folks who do the blocking and tackling that get you elected in all of these states, not to mention early primary states. So they want to hear from folks. They're excited because they know if we return to those America first policies, this country is going to be off on the right foot. Do you think it was a mistake for desantis not to be here this weekend? Well, look, I understand two sides of this. One is when Donald Trump's part of anything and someone just told me it's not cpac anymore to tea pack. And I said, I understand that. He sucks the oxygen out of everything. Because of his personality, but also now he has a record to stand on. So why would you want to come into an arena where you're kind of second fiddle third fiddle fourth foot or whatever you may be? But at the same time, you miss an opportunity to see all the people, as I mentioned, who will be responsible for getting you elected should you become the nominee. And so I understand on both sides, but look, there's plenty of time next year cpac is going to be rocking. It's going to be, you know, full swing election year and we'll have to see what happens then. What any impressions, anything the early stands out so far because this is sort of that off year off season, and still big crowds. Very big crowds. It just seems like every year it gets bigger and bigger and more excitement and more excitement, the slaps have done a great job obviously I worked with mercy. We shared a wall actually in The White House and worked with Matt for years and they've helped build something on the backs of the people out there who really were looking to go in a direction to put the America first policies back in place to improve their lives. We've seen that in the last several years, you don't have to point all the way back to Reagan anymore. You can just say two years ago we had all these successes and so I think the people here are excited. It always blows my mind how engaged they are. They know the issues. And they're ready to see what happens to the future of this country. Some of the rockstars as far as crowds go Sarah Palin here getting huge crowds. Also, Don Junior, Kimberly, and MTG came by, and it looked like, I mean, I've never seen so many people. So these are the fighters. The folks that are out there, and I think it's nice for them to be able to come here, so people can say thanks. Thanks for fighting for us. Sure. Like me, you shall the crowds around me just get wrongs of the people. We've got our people keeping them back. That's right. So it's extra security have to have. Well, when I was in The White House, it was a little bit different, of course, but look, I think the people who have been the fighters have been on the front lines. They do appreciate those here because we get kicked in the teeth all the time by the mainstream media about what we do and don't do. And so for these folks to come up and say, thanks for what you did. You know, representing our message and our vision, it really does make you feel pretty good. And in the meantime, you've got the Democrats who are in a fierce fight as well. I mean, it's ugly. People are enraged at Biden, the base of the party, progressive leftist, and they're very well could be a big fight for the Democrat side of this thing as well. There could be, but if there's one thing we have on our side they don't. It's obviously accomplished skilled politicians. That's it. They don't have it. They got pothole Pete and cackling Kamala, and that's all they got. And neither one of those are great, the American people don't like them. They don't like Joe Biden, half of them don't want Biden to run. The other half don't want Kamala to run. So they got a rocky road ahead. Thankfully for us, we have a wealth of riches, and that's a good place for us to be in. Newsmax, of course, the big censorship battle. It's got to feel good that you've got so many people up on Capitol Hill fighting for newsmax and saying, hey look, we're not going to get away with this. Absolutely. I speak all over the country and I was just in North Carolina Gaston county, speaking of 500 people, I was in Pennsylvania to Tea Party group with 350 people. Every single person I went up to or what came up to me and said hello, said we love y'all newsmax. I can't believe we're looking for new avenues now. What they did to newsmax is unconscionable. We're gonna focus on trying to fix it so we can watch you in other platforms. People are furious out there. It's another former censorship. Twitter did it behind our back at least. These people are doing it right into your face..

learning that out Adam ship today other than voting on whether to send our men and women to war this is there is I think no greater responsibility before you then the one before you now deal for you taken to impartially weigh the facts and evidence requires serious and objective consideration decisions that are about country not party about the constitution not politics about what is right and what is wrong Democrats have been showing exhibits all day today video clips of president trump talking in testimony from the house hearings and remember the Republicans having gone yeah that's why we're not hearing from them ABC's Trish Turner has been doing incredible work awake around the clock at the capitol never sleeping she's here now and Trish what's it been like in there today these have been long hours for the senators without much to do except sit and listen Hey Alex yes it's quite as logs so you know this is this is a this is a difficult task the senators have and you know there were some fireworks last night it set off a bad tone and and so you know everybody seems like they came in with their hair sort of bristled and but they've settled into a rhythm I'm a yes it's difficult weighty stuff many senators are taking notes some in fact there is a striking number who are actually up and pacing around the back of the chamber and which is good sort of an unusual sight there in and out of cloakrooms eating you know trying to stay awake this is difficult stuff like a mini you're taking notes there are several though I would say today we're beginning to see Republicans trump allies really who were digging and they're not taking notes I'm several hold a press conference conference before the trial even started and said they were looking toward vindication on he would be a that trump would be acquitted so you know there some are taking sides but by and large people are pretty serious you can hear a pin drop I'm in the chamber you know and as aside from if you were doing crossword puzzles I'm in other word games you know it seems like most people are really paying attention you know all of the arguments that you've heard today any big headline anything that we have not known up before now there isn't really any new news here at that we're hearing yet so but you know that the Democrats really seem to be trying to keep it simple and the house managers I should say I'm you know the simple theme that president trump cheated and he is going to do it again so they're trying to sort of bring this actor of you know this imminent danger to our electoral system to our democracy and that it's time to impeach him it's hard to remove them I should say from office and you know but it some we've even had some Democrats say that you know they're still waiting for more evidence are waiting for more you know concrete facts from the managers but it but again I think it just goes back to that slide right there the managers are trying methodically to lay out the way they are you know are alleging that president trump has really cheated the system and so you know that takes time and and we've got a lot of it you have a take us behind the scenes clearly the Democrats and I assume the Republicans will be the same thing when they go but the Democrats eight they've got this polished presentation these slides have been made the looks like some graphic designer put them together they've got their their processor speeches all lined up knowing exactly where they're going this is gonna be a big operation it's a tremendous operation you know it takes a village right I it's a the house managers have a massive staff they have done a lot of planning they have been on the floor you know on the Senate floor in prep sessions Dave I'm even you know they all practice taking to the lectern overnight before the trial began you know clearly they have the audio visual I'm operation up and running because I think many of us cringe when you I it seems like every time you try to employ a television on in in a situation like this it always goes awry but none of those it's been pretty seamless they worked really hard on this they have a lot of staff who are behind the scenes both teams the trump lawyers and the house managers just off the floor they have big operations for the Democrats we caught a glimpse it's a room that's maybe I would say about twenty feet to thirty feet from the chamber and they they have it's full of computers full of staff in and now there's lots of buzz we can't get near that room I very often but when we do it to be hi that activity the trump team has work space that's normally the vice president's space because of course he is the highest ranking officer in the Senate he's the presiding officer normally so he has a work space here so perhaps a little bit of an advantage but I'm you know so the that the trump team has a full complement of people even saw the White House press secretary deputy press secretary Hogan Gidley up here he's also helping out the trump legal team so it it's quite an operation and you know we they're working hard to come out and try to tell reporters but you know generally the press it there are a lot of constraints on on where we can go it's not normally that way up here so you know it's it's we're all trying to fit into this odd into this odd story together ran on in one on one and that is making sure that the money we give these countries these hundreds of millions of dollars are actually spent wisely now I understand Democrats don't care about how we spend taxpayer dollars at home much left abroad but this president does let me just to the impeachment vote I think we should move there well let me bald head straight way to Hogan we've got a we've got a corrected fact here you said the president did not ask about a twenty twenty rival the record of the call the White House record the call the record you released says that president trump asked about Joe Biden so that is totally false what you just said why do you say that falls thing in relation to the twenty sixteen corruption he wasn't talking about twenty twenty and you and your listeners know that what I was biting involved with the crowd strike thing exactly if you're talking about the twenty sixteen election and you're talking about the corruption is it related to Ukraine you talk about the person who dealt with Ukraine that was killed by I'm sorry but running for president doesn't insulate you from any criticism or any investigations widely true let's go on to your question about the process now because you want to make a point about the process and whether it's more fair right it's not what the Democrats here have done is his right sham impeachment process all behind closed doors without any sunlight whatsoever selectively leaking pieces of information without full testimony to try in building narrative moving into the second round the vote yesterday except say we're gonna make portions of the next part public after we've already tried to tie dye your hands down your feet blindfold you put in a closet and beat you senseless they were just got take the blindfold off around two round three is organised taken from the Judiciary Committee and we expect though that you're gonna be blade up enough where it won't matter the problem is too they're fighting against the Donald Trump is gonna stand up around three fight back yeah it's interesting I think Democrats would characterize it differently but there is an element of truth in what you said that they would have to admit which is that they've just taken a bunch of testimony in these private hearings and they're going to call those witnesses back in public and expect them to stand behind those stories which we which we largely now is that going to make it challenging to defend the president in public right and face cross examination so so do you do you do you think that there's going to be difficulty defending that case given that so much of it is already on the record no because you're only hearing you know selective pieces of one portion and then also yesterday for example I don't think you're doing a private is beginning to backfire their reports Mister Morrison testimony was that he felt the present had done nothing wrong nothing illegal so they're all types of things coming out of these hearings and and you're kind of making not white which is it be really nice for the American people to get to see this out in the open and in public if you get a parking ticket your forty due process you can confront the policeman who gave it to you you can talk to the judge about it you can submit evidence you can ask questions although although as you know the police might "Martin president trump says conversations are under way about possible legislation on guns in the days since the mass shootings in el Paso and Dayton the president has been talking to leaders in Congress in both parties he's also been talking to the national rifle association there's no president that feels more strongly about the second amendment that I do however we need meaningful background Jack and from there speaking with reporters outside the White House this morning NPR's Franco or Dona as was there and joins us now from the White House hi Frank up hello so earlier today on this program we heard from deputy White House press secretary Hogan Gidley who when pressed was very vague about what specific gun control proposals the president would support did the president himself get into any details the president himself is not getting into more specific details he is continuing to kind of continue the same line that he has been saying over the last couple of days just saying that he wants meaningful background checks but without any specific he's talking about red flag laws he did mention that there could be some support for legislation from that's being proposed by to meet that involves some background checks but really he's not getting down to any details it's much difference for example than what the house is proposing proposing analysts some of the things that he is per pass talked about like the red box red flag laws kind of putting in protection for mental health these are things that actually he's rolled back in the past so there are still a lot of questions but at least at this point he's leaving the door open to talking and have keeping the conversation going but this is this is sort of happened before I mean we've seen the president talk about the need to address gun violence even leaving the door open for possible gun control legislation and then he has a conversation with the NRA and then it's all walked back I mean how how's he dealing with those gun rights advocates right now yeah exactly I mean in the past president trump has said that he's not afraid of the NRA he said that today he is kind of mocked his own Republican colleagues saying that they're afraid of the NRA now we asked him today whether he could do something without that hit their support he said yes he could but he didn't expect it to come to that now some of these proposals president trump said that he wasn't positive that the NRA would love them he says they understand the need for background checks but he also said they may be neutral on some of the proposals and he said that would be okay what was also interesting though is that president trump was repeating that the NRA also knows that president trump has done so much for them including getting two Supreme Court justices on the court who are supportive of the second amendment so you mentioned the house bill that passed with bipartisan support in February but it stopped there it's not the only piece of legislation floating around right what just give us a little in right now yeah there's two grams ripple there's two grand legislation that has to do with these red flag rules which would prevent or which would help me mentally ill you know be able to take guns away from the mentally ill there's the mansion to me legislation that is about expanding background checks but McConnell has stopped short and McConnell's talked about some of these things but he stopped short of assault weapons he did say something earlier about that but he's not he's kind of backing off whether they will deal band and one thing is he's he's not saying they will definitely pass something but he's saying that the Senate will discuss legislation in September when their schedule to return so there's still a lot
