There's been a covert 19 outbreak at an Oklahoma prison with more on that. Here's Tanner Carlson. State officials say 94 people at the Lexington State Prison have tested positive for the Corona virus. The outbreak was discovered after two inmates were taken out of the prison last week for medical care, and they both tested positive for the virus. Cleveland County officials are conducting contract tracing in the prison. Senate Majority Leader Mitch McConnell says a Republican stimulus bill should be ready to go early next week. I guess than a couple who has children. But I'm not certain that that's the case looking around at my friends and couples that I know as to whether or not They're behaving any differently than what a heterosexual draw. Sexual couple behaves But if they do have spending issues than it really gets into a situation and understanding what the parties are what their spending habits are. And how you're going to deal with that and that goes back to why you need some sort of agreement that lays that out so that both parties go in to a relationship with their eyes wide open and know what to expect so that you know. We're talking about things things. Here that are financial issues and dissolution of a relationship and everything but having the financial issues off the table makes the relationship kinship stronger. If everybody knows what's going to be happening and the relationship before they get into the relationship super some ugly Elliott the concept of children. Because I think that's something that's very near and dear to all couples. LGBTQ couples included but obviously they face certain issues on with planning planning for children that may be Fewer heterosexual couples will face things like adoption and use of a surrogate or howsoever the expand on some of these issues. Well you know one of the issues that comes into play in. Lgbtq community is whether or not obviously takes uh-huh a third party whether dad is a unwed mother or not an unwed mother but a mother who's willing to give a child up for adoption or whether so you're using a surrogate and have one Partied the biological parent. A lot of Batik couples don't follow through with the adoption adoption by the second parent. And that's the important thing that really can cause problems because you end up in situation to where one parent may not have a responsibility to take care of the child. If there's a disillusion although now that marriage is there a is available to. LGBTQ couples is that they don't follow through with a option policy. And so then you have a child who doesn't have rights from one parent In the event of death potentially and potentially in the event of dissolution solution so that A child WHO's not adopted by heart one of the partners or parties and the party dies and it doesn't provide for the child. The child has no right to even contest. The will or declined to be a beneficiary of beneficiary. It's a client. I if the spouse dies without a will this is actually a much more common fact pattern than one would think of actually i. I think there's been several law and order episodes about this very thing where you know a a a partner not early adopted a child and then all of a sudden the grandparents parents of of the apparent or give them come back into the picture and these sorts of hyper dramatic sized situations but in the real world is. This is very very often you can see. Both the child loses their rights. And I'm having a potentially loving parents who may have not have the ability to take care of this Charlie because they have not legally uh-huh yeah that's exactly the case we're seeing less of it. I believe because now that marriage is legal. That parties are getting married and taking taking the steps To add live together cohesively as a family unit. But there's still the issue out there That the parties whether other for some circumstances may be as a matter of cost. can be expensive to go through the adoption process or just a matter of not attending tending to the details that they need to attempt to. It's like clients that are in relationships and they never go out and do a will or they have a will bill. That was before they entered into the relationship and never changed the will to take on responsibility for a partner That they don't marry so that's another reason why you should have a partnership agreement in every relationship that you go into so that's clearly laid out as to what what. The responsibilities of the partners are each other on this show. Obviously as mistake. Plenty of Agree proponent of wills I think having a improperly put together state plant will is especially important for LGBTQ couple on the spurs working with the community a lot of LGBT Atlanta choosing their own family. The the deceased partner intended to provide for But the relationship between the family the biological family and the partner was on good and still came in and basically said we're GONNA ignore that relationship it never really happened in our view and we get everything and that's exactly what the court ended up holding The parties could have gotten married. They didn't and the party could have done. The will and and didn't and so that was very sad case and that I was peripherally involved in and there wasn't much that could be done so it it is very important for parties. Who are not getting married? Who are in relationships to have wills that even if they don't have a partnership partnership agreement that they have a will that provides for the partner and it and they put that in place from day one essentially early and you can always change will But it still make the effort to have the partner provided for and he can't can't forget a will is one thing but you also can't forget your other assets your retirement plan accounts Individual retirement accounts your work retirement. Plan Account Your Life Insurance Policies Accounts that you may have payable on death to a particular party if you forget to take those into account in in a relationship and have let's say previous partners listed as beneficiaries or have family members listed as beneficiaries. Instead out of the new partner the partner The surviving partner really has no recourse to go after those assets at are not married and They're they're left out. And even if there's a partnership agreement if they haven't provided for those assets to be distributed to the partner and the partnership agreement there's no way for the partner to have any recourse against the estate of the deceased partner. And so it's very important for the party's when getting married to sit down together and work out exactly. What the responsibilities of the parties are going to be in the marriage? And if there's there's a break up a marriage and we just expanded what exactly you mean by pre-nup I think for the vast majority of sort of Lehman pre-nup is kind kind of a dirty word. So advantages of incorporating is here. We'll everyone looks at a prenuptial agreement or a lot of people look at prenuptial agreements agreements. And say it's something that's being forced on the parties in order to a more at worst case scenario but it actually is something that should be down in the good times before relationship as a relationship is being entered into so the parties have a good understanding of what their responsibilities are going to be in the marriage. How are they going to manage their finances? Who's going to contribute to what If you have a relationship where you have one party. WHO's earning the majority of the income of marriage then what What provision visions would be made for The payment of bills when you have the Non Earner essentially helping build a home or helping build the business spent not receiving any compensation for it and not be able to save any money for themselves that are totally dependent upon the other party. So it's important that when you put together when when a relationship is formed that they have a good understanding of that and a pre nup is not a dirty word and the sense is that it's always looking for what's GonNa go wrong in a relationship it's also a guide or road map to what can go right and a relationship because because it is so tight the open conversation and open communication about exactly how the parties are going to be. Hey financially in a relationship ship and so no. We're talking about a prenuptial agreement. But that assumes that there's nuptial in the first place where assuming here that the couple is taking advantage of of the ability to marry on what about a case where a couple. LGBTQ couple has for some reason rock either has has been unable to marry because you know either refused to them or they've just lived a certain way for thirty five years and then they don't want to change it. Well it's important to have a partnership agreement To have something in place to if you have a relationship that's gone on for thirty five years. It would be important there to understand what the parties are going to do for each other in doubt you know assuming that the relationship is going to last for the rest of their lives and and so just having a relationship that goes on for thirty five years does not mean that either party has any right to the assets of the other the party upon death. So it's very important there that they have some sort of arrangement between parties even if it is just have their wills in place or or their state plan in place so that it clearly lays out who gets what upon death and then in a relationship you can still have a partnership agreement. Even if you're not married that defines how you allocate your assets in case there's dissolution of the partnership it's important to stress here that these themes of financial and thereby power imbalance in a relationship. But that's not just a heterosexual problem right as as the liberace example. Oh I think clearly illustrates right. There's plenty of all types of relationships after face. The issue of of a one partner comes in with way more or one partner has willingly sort of subsumed. They're earning power in order to assist the the whole on these sorts of agreements be they. Prenuptial Agreement Mentor partnership agreements or key to sort of protecting the party with less power. Yeah it is. It's very important. It's also you need to look at what your debt situation is when you come into a relationship and what the spending habits are of both parties so that you understand and can Dan communicate freely about how you're going to do with the debt and what happens in the event that the debt is paid off by the partner who has more money and and student loans is good example and then when party you had the debt say there are doctor goes out and suddenly becomes a hiring higher producing spouse in the income. What contributions do you consider has been made by the party that help pay off the debt and then subsequently is the a partner with the lesser income?
