So Republicans want China's treatment of U.S. diplomats investigated and now South Korea is hunkering down as hurricane Ian heads in that direction. For more, let's go to the newsroom and Bloomberg Denise Pellegrini, Denise. Thank you, Brian, and Ian is heading toward South Carolina as a category one hurricane. Governor Henry McMaster says be prepared for strong winds heavy rains and storm surge. Call your family call your loved ones, tell them where you're going to be. Let them know that. So they won't be worrying about you. In Florida, I mean time the coast guard is rescuing dozens of people rear admiral Brendan McPherson. They're dealing with high water, you know, cities that don't look like cities anymore. Unstable platforms and buildings and also hazards to our aviators and our pilots who are flying through these areas with down power lines and poles and cranes and those sort of things. And millions are without power this hour and the estimates of damage keep rising. Vladimir Putin is vowing to annex parts of Ukraine that Russia controls tomorrow in a Kremlin ceremony, President Biden though pushing back on that. Do you want to be very clear about this? Republicans suggesting China may have used COVID lockdowns to hold U.S. diplomats separate them from their families and pressure them to reveal intelligence secrets, Bloomberg reporter Daniel flatley says their concerned DNA information may have been gathered, and they also want to know. Whether the conditions or such that they may have been in coerced into evolving some sensitive information, potentially intelligence. And the U.S. embassy says China held 16 diplomats and family members involuntarily, Republicans are asking Secretary of State Antony Blinken to investigate. Global news 24 hours a day on air and on Bloomberg quicktake powered by more than 2700 journalists and analysts in more than a 120 countries. In the newsroom, I'm Denise Pellegrini. This is Bloomberg, Brian. All right. Thank you very much, Denise. Our guest is Olivia dossier, head of apac applied research at contigo. So if you look at the Russian war and the COVID restrictions in China and a very aggressive Federal Reserve, and now we've got earnings concerns, I think I woke up in a cold sweat this morning. Olivier, how do you navigate that? Yeah, it's certainly a very different kind of narrative that we had in the middle of the summer when everybody was saying, you know, the fed is going to start decreasing rates. You say worried about inflation, that recession and all that. And now we have the opposite guide. We have strong views that everything is going to get bad very quickly. But if you look at the data, it doesn't really support that view, right? So yes, those earnings that we just heard about earlier were negative. But nothing pointed to consumers stopped spending, right? There's inventories that needs to be done. There's chip shortages. There is maybe a forecasted wrongly. But so far, consumers are spending money, is still full employment on their full employment, any economies everywhere. So that's the key thing that powers the economy and as long as the consumer does not shy from spending. Everything else is potentially temporary, right? Does that discretionary spend continue if we continue to see the pain for home buyers when you've got these mortgage rates in the U.S. at a 15 year high? Yeah. I mean, that's a good question. And the answer to that is unknown at this point. But the same question was raised at the beginning of the summer with it. Our consumer is going to keep spending when gas at the pump is so expensive. I guess that the compass now a bit lower. So they're breathing a bit better. Yes, mortgage rates are up that on the FX people with mortgages, especially with floating rate mortgages, not fixed rate mortgages. And they're still able to find jobs to get pay raises and so on. So right now, I think that's pretty much a stalemate. We also see that sentiment for investors has soured in the last couple of weeks. We hit almost very sentiment last week already. So for the next few weeks, emotions might come into play in matter of fact decision making for some of them. So we're in a dangerous period now because of investor sentiment is so weak, which is a very big difference from where it was in July and the beginning of August where sentiment was rising and people were hoping for things to get better even on the Ukraine front and now things are getting worse. So and winter is coming. Yeah, winter is coming more winter from the fed Loretta mester saying that real interest rates have to be positive. And then held there for a long time. That has to be tough on risk risk assets. I mean, obviously now we see that there are alternatives to risk assets, even the fixed deposit is starting to have a pulse now for investors. But when you're talking about a huge amount of liquidity that can't go into these small buckets, trying to still the vast majority of it has to go into risk assets. I think also investors have been worried about the economy word about inflation first, worried about the central banks, where about interest rates worried about the economy since about Q one of last year. So for the last 18 months risk of strategies have greatly outperformed risk on strategies and even the markets. So I think you're getting close to very fatigue here in terms of investors and soon. It's a good point, Olivier, it really

"With the other attorneys general across the country who share similar views about the overreach. This is an egregious overreach of federal authority. And as we see what these rules are, we will be able to know exactly how we will be able to challenge them in court. I'm also talking with my colleagues around the country as well. The other governors who feel the way I do and we'll be working on other strategies, but I've never been centers do Allow them to officially get that to the right hospital. And certainly we are encouraging people to continue to get vaccinated as part of this, But we're managing our hospital capacity very successfully here in the state with the tools that we've provided with this staffing emergency, So it's pretty clear. You've got Nebraska Governor Pete Ricketts, who's a Republican. You've got other Republican governors Henry McMaster from South Carolina, Texas Governor Greg Abbott to Santa's from Florida. I mean, Biden better get ready for a fight, because here they go. But, you know, I think how many fights he already has on his hands. I mean, a lot of that. What he has done via executive order has been proved to be illegal. And that hasn't slowed him up at all. But you know again, I think the whole The whole premise here, uh, that you can step on people's free will, if you will, And honestly, this shouldn't really be a debate about free will. This should simply be a debate about what's good for your health, right? And so unfortunately now That the attention is entirely off of that. What really is going to make me crazy? It's going to make me crazy. And you too, I think is that the case count has turned down. I hope it continues to turn down. But you know, and I know that Joe Biden Three months from now, if we're lucky, and if we have already passed the peak of the Delta infection numbers, he's going to take credit from bending that curve, so to speak, to use a horrible cliche at this point. Because of these mandates, and it will have nothing to do with the mandates that will have to do with the fact that this Delta variant is so contagious. It will presumably or may already have run its course. I surely hope so. Because that means fewer Americans will be getting sick and dying. But to have that be a political win for Joe Biden. It was honestly my head's gonna explode. Fox News contributor Liz Speakers with us this morning on the Brandon Boxer show, Liz This reminds me in some ways of the moratorium on pain, you know, rent on rent, of course, is illegal. "Biden's federal vaccine mandate draws backlash Republicans threatening lawsuits Did you hear desantis Over the weekend by the way I don't know if you caught any of that or not but my gosh he didn't hold back at all And in fact there were a lot of governors of course who popped off about it in South Carolina governor Henry McMaster says he will fight to the gates of hell to protect the liberty and livelihood of every south carolinian Then he was but just one JD Vance conservative running for U.S. Senate in Ohio calling on businesses to ignore mandates he describes as Washington's attempt to bully and coerce its citizens Did you see that hospitals in places like is it la ville or Louisville New York Lewis county general hospital will stop delivering babies After September 24th because too many maternity unit workers have resigned over vaccine mandates Now again I don't think most of us believe that there's anything inherently wrong with private employers deciding that their employees have to have the shot in order to continue working there It's a different matter altogether when the federal government tells small businesses they must insist their employees do so Here to discuss it constitutional law attorney author of the authoritarians He is Jonathan E mord so grateful to kick off the day with you the week with you Mister E Moore thanks for your time today Hi You're quite welcome Chris good to be with you Thank you sir I believe here's my take I think this guy knows by this guy I mean the president knows fully what he can and can't do I think he likes to say this often I'm not sure if I can or not but I'm gonna do it anyway This is like the third time he's done it This seems to be their Wheelhouse Just saying outrageous unconstitutional things just to get everybody stirred up even though they know full well they're not going to have the support in court or the constitution to do it That's my read my first take yours Well I think you sold us sold to the socialists and as a result he's quite comfortable with authoritarianism And so I think they're consciously pushing the envelope at every alternative with every policy initiative to seek dictatorial power for him He never undertook any effort to actually persuade people of the prudence of getting vaccinated He didn't give us full information Rather he's chosen this approach of using osha and an emergency temporary standard to compel every employer of a hundred or more To impose this mandate of vaccination or testing and it's draconian it's authoritarian and it's characteristic of a dictator not a president of the United States I don't mean to go down this rabbit hole because I know it's all conjecture but and I don't ever want to give this guy too much credit but he was always kind of thought of as the avuncular you know long tenured senator from Delaware and not really known as the kind of power hungry authoritarian that his former boss was president Obama which is why so many of us I'll count myself as one Believe he's not really in charge of anything but rather it's hold over from that previous era who have kind of got him attached to the strings so to speak Is that your read Yes he's an empty suit and it's still daily by his doppelgangers who are actually the socialists with the intentions and the brain power But he's a willing dupe In other words he sold his soul to the communists He's not really a person who will stand up for America as we see with the Afghanistan retreat and he won't he won't undertake any initiative But offends his liberal democratic base Now of course Jonathan ward the question becomes really When this winds up in court is it likely will you got to have a court system that still upholds the constitution Are you confident that we still have that in the judiciary at this point Well I think we do in large measure and I suspect this is going to be inundated with the litigation all over the country And even under the standard that the law provides for this emergency temporary standard he doesn't need it He doesn't mean it And the reason is the first part of that standard is that the employees are exposed to a grave danger Well many would say that that might be satisfied but as with respect to the second part that this specific measure is necessary to protect employees from such danger There is where he runs into problem with people with natural immunity People are telecommuting people who have immune system problems that prevent them from safely being vaccinated threatening their lives And those who are allergic to the ingredients in there And then in addition the ADA which applies and also the Civil Rights Act title 7 which applies And he can't force people with a religious scruple to against vaccination to be vaccinated And you can't force people who are disabled and would be harmed by vaccination from being vaccinated So this thing is going to end up I think with holes through it that are more profound than Swiss cheese And the impact I think will be far less than the 100 million that they're claiming will be impacted by I was just sharing Jonathan E Moore to tweet from an anchor at MSNBC Stephanie rule her name She tweeted I guess late last week osha doing this mandate as an emergency workplace safety rule is the ultimate workaround for the federal government to require vaccinations Now what's notable about that tweet one it's an acknowledgment that even a news anchor news anchor knows is true that osha is a workaround the constitution she tweets but it was who retweeted this Jonathan E mord Ron klain The president's chief of staff retweeted that sir I mean that and so Jonathan truly wrote it as blog That's going to be legally problematic unto itself in court because that's called what he says dumb offering a doozy He says the problem with that courts will now be asked to ignore the admission and uphold a self admitted evasion of constitutional protections is that how you read it I do It's a tremendous admission against interest by Ron klain and it shows their true intentions I think the courts will necessarily look at that That would be consistent with their treatment of such issues in the past when there's been a person in the political realm like Donald Trump They used his own statements against them And so it would be hard for Ron klain Not to be directly used as a vehicle to show that this is a workaround that the constitution because that's his admission But it very clearly raises new profound constitutional questions under the non delegation doctrine the separation of powers doctrine This is lawmaking Writ large for the whole nation By the executive branch which is against article one of the constitution which Beth the lawmaking power exclusively in Congress So that is going to be a profound problem particularly in the course of appeal I believe in the federal system I don't think this thing is well thought out I think it's poorly executed and of course for.

And then I mean, look at look at what happened and came out a couple days ago. The New York Times that of all places, which is not a conservative newspaper, right? They came out with a bombshell of a story. That says the CDC greatly overestimated the amount of cases of Kovar that people caught just by being outside the outdoor transmission. Um, they exaggerated it so much. There's a guy doctor Mu judge in this The New York Times story. Dr Mute Civic Avery Ologists University of ST Andrews said the benchmark seems to be a huge exaggeration. In truth, the sheriff transmission that has occurred outdoor seems to be below 1%, maybe below 10.1%. And yet, the New York Times said it was his highest 10%. I mean, that's that's a giant difference. Right then we have kids running around outside, sweating, passing out in masks outside in the big heat we have here in Arizona and, you know for school board say, we follow CDC guidelines not only to the CDC collude with the school boards to make sure that school stay closed as much as possible.
