"Have arrested a former leader of the Proud Boys group on conspiracy charges charges for his alleged role in organizing last year's insurrection at the U.S. capitol with more Here's correspondent Jackie Quinn Police had been watching the movements of Henry Enrique tarrio last year before the deadly capital attack So when he vandalized a Black Lives Matter symbol in Washington D.C. just days before the election certification date he was taken into custody and ordered to stay out of the district but prosecutors alleged tarrio helped to orchestrate the capital insurrection even though he wasn't there and held a meeting with other right-wing group leaders I'm Jackie Quinn So we will talk about that this evening And find out just exactly where we stand in this regard as we will be discussing the ins and outs of this entire process not to mention of course the entire legal process as it has been the followed to date with the delvin Barrett he is the author by the way of the book October surprise more about which coming up and we'll take a look at these charges Delvin good evening Hi how are you Jim Thank you I'm fine Thank you And your thoughts about these charges Well I think it's a really big moment in the FBI investigation And that's for this reason Not only was Enrico tarrio a target of the FBI's investigation within hours of the January 6th attack on Congress He's also the first person of significance charged who wasn't there that day And that speaks to a real question mark that has hung over this investigation which is how willing our prosecutors and agents going to be going after sort of the people to the degree that anyone orchestrated this directed it made it happen but kept their hands clean on that day This indictment really seems to say the DoJ is now kicking into a different gear So of course it is entirely possible to conspire from a distance Absolutely In some ways that almost the nature of conspiracy right You charge someone with conspiracy when you don't necessarily have them taking an immediate act that's a crime But what's interesting in this indictment is he's also charged RICO tarrio that the leader of the Proud Boys is also charged with acts of violence or acts of impeding law enforcement that just that members of his group did It'll be interesting to see how a judge or jury thinks about that type of charge But yes the whole premise of this case against Enrico tare tarrio is that he played a key role even though he wasn't there The notion of conspiracy from a distance does that have any court precedent one way or the other of which you are aware Sure So I think there's a lot of ways in which conspiracy cases are made like that especially in federal court federal charges are really the place where conspiracy cases tend to be the most complicated but also the most consistently charged And so there are a lot of similarities for example to a mob case or to a gang case that is where you see a lot of conspiracies charge in federal court And so this is the Proud Boys is a fairly new organization of fairly curious organization And you see in real time the FBI and other law enforcement agencies kind of grappling with trying to understand who these guys are what they're up to and what they want One 8 6 6 5 zero Jimbo are number one 8 6 6 5 O 5 four 6 two 6 I must confess that the Proud Boys as a group I have principally heard about only in conjunction with things like the January 6th attack on the capitol and the like and that they are said to be conservative beyond the level of most people who deem themselves to be conservative and that's pretty much what I have heard about that I'm not sure that that necessarily means I've always gotten a straight or accurate picture of who they are Yeah so the Proud Boys were formed around 2016 and they called themselves western chauvinists Now the Canadian government has decided that essentially amounts to a terrorist organization And some hate crimes hate watch groups view them as essentially an extremist group with ties to white supremacists They to be clear their leaders insist that they are not white supremacists But I think what's really interesting about the Proud Boys is very quickly since their formation They have looked to pick fights on the street with leftist protesters They usually refer to them as antifa And they have looked for confrontation physical confrontation And a lot of times those confrontations have turned violent And that's how people first came to learn of the Proud Boys And so before January 6th when I would talk to federal law enforcement officials they would often sort of struggle to come up with a how to categorize these guys because on some level there are times when they seem to behave like a street gang and other times they seem to behave like a social media obsessed group and I think one thing that's definitely interesting about them is that they grew and they gained popularity with some people largely because of their social media presence and that really took off and caught fire And that's a dynamic that I think law enforcement is still trying to understand better Yes Now of course it is entirely possible to be a person with the shady dealings shady surroundings even with the long rap sheet but of course every case is unique and usually that isn't a material that can be involved in charge was made For example I would daresay if you look at any number of the people involved in some of the urban rioting that occurred in recent months especially following the George Floyd killing you will find any number of people who are involved in things like arson against federal property at a rap sheet as long as your arm but to civil libertarians would say well that doesn't count So why would even shady dealings even assuming the worst even of swimming they were white supremacists have anything to do with charges about a specific action namely the attack on the U.S. capitol Oh I think that's absolutely right I think the only the only issue that sort of the Proud Boys belief system or what they want comes into play is when assume this goes to trial I think at some point prosecutors will have to explain what the alleged motives were for these crimes And when I say crimes I mean things like conspiracy conspiracy to obstruct Congress and some of these folks are charged with acts of violence So when you're explaining the alleged crimes it's not uncommon for prosecutors to say and they did it for x-rays They did it because they hated Joe Biden They did it because they loved Trump And that's a part that you have to convince a jury of one of the things that to say is you don't usually have to prove motive And that's true but the other one usually says but jury sure like to know what the motive is And so I totally agree with you The background whether someone has a prior arrest record none of that is actually relevant to the question of guilt or innocence for whatever case you're facing But I think the question of motive becomes important as juries wrestle with January 6 cases I wonder whether or not Jerry should be concerned about that I mean for example you take somebody let's say to put the shoe on the left foot just for a moment.
