And now there was an article in The Hollywood Reporter that Alex truth is that the people who were filing lawsuits pertaining to the onset shooting of the cinematographer Helena Hutchins and the wounding of the director Joel Souza are targeting innocent non negligent deep pocketed litigants like himself instead of the people who likely seen negligent but have no money. Basically he's saying you're not suing the people you know you're not going to get money out of. It's a real shitty way to act. Now I know it may seem inappropriate to keep talking shit about the people who are affected by this guy and the wife and the mother and the father and the husband I mean it's so sad. But he made these comments while he was moderating. Why is he even moderating events right now? Why is he making a movie right now? He was moderating events at the boulder International Film Festival. And he just went off after the moderator, opened the floor to Alec Baldwin, he launched into a lengthy and whatever you want to call it statement about there being just two victims. It's just two victims in the rush shooting. While also implying that some individuals who have filed lawsuits are financially motivated and just going after people, they assume have deep pockets. And right from the beginning, from the moment this thing happened, everybody is put out, you know, besides all the anguish and the suffering and the horrible feelings, everybody has, of course, there are two victims and nobody else is a victim, so to speak. And Alex said, we have dealt with a situation where specific people are not as interested in finding out what really happened. So is fake? This guy just can't help himself. And I gotta be honest, I haven't seen elaria do much on social media lately. Maybe I'm wrong, but I haven't seen her go bananas on Instagram and say things to make her husband look great. But this guy should be smart enough to know that calling himself a victim is awful. But we also know how narcissistic he is to believe that does he really think he's the only victim that counts? He said to the group, what you have is a certain group of litigant son, whatever side, who their attitude is, well, the people who likely see negligent have enough money and the people who have money are not negligent. But we're not going to let that stop us from doing what we need to do in terms of litigation. Why should people if you you're not going to get money? That's what they're doing. It's very hard to sit here and think that he's actually thinking of Elena Hutchins husband Matt functions. You know, he was just spilling his guts out to his wife and I guess that's what we call and just spilling about, I can't believe this happened. But everything he and eladia have said and done since this has just shown everybody that just the most tone deaf people self centered people dare I say trashy people shopping in Vermont, getting new clothes, eating and fancy restaurants that are roped off in the fucking windows seats. Give me a goddamn break. You fucking killed somebody, bro hide for a while. And this guy, the poor husband, and the son of Helena. Their lives will never be the same. And Alec is sitting there crying and not being a victim. With all of this says that I know we've talked about this AD nauseam, but all of this sense is that Alec Baldwin, went in there as a producer, obviously didn't have any of his business order, a business shit in order. It wasn't up to snuff, there was some problems we've heard about. Maybe his incorporation paperwork was off. His insurance, maybe he didn't pay for the right kind of professionals on staff. We know that to be the fact. And instead of focusing on that, he's just living this Instagram life with Elia. Sorry, it was my back hitting the wall. Just living the Instagram life with Eli ya. Somebody else who suffered some public humiliation, I got a kick out of this. You know, we talk about cancel culture a lot, and remember Morgan Wallen, the singer, he had a public relations nightmare that could have been limited to get getting caught breaking the COVID-19 rules set by NBC and signing that live when he was going to host that show or at least be the musical addition to that show. And he got voted for the show back in 2020. He got read book several episodes later, but then just a few months after that, a video came out on the Internet. And it showed in casually using the N word on a night that he was a little bit toasted and drunk. He apologized, he said, I'll never do it again. I brought up since then and it's never going to happen. But his tour was canceled, radio stations began dropping his songs. He was banned from several awards shows like the ACM awards and the Billboard Music Awards. Well, here we are here later. And a $500,000 check from his record label and he's ready to resume his career. A few nights ago, at the country music awards, he was nominated for three wars, male artist of the year, song of the year, an album of the year. And that was right before his video went viral and he had to step away for a while. He won album of the year, he gave a shout out to everybody you could imagine. I mean, everybody that was important to him in his life, the fans and the audience were over the moon to see him turn out again and show up and win. But on Twitter, they roasted his ass. You know, Twitter like I've always said, we've always known it's just a bunch of assholes talking shit and they're just the pussy kids in the schoolyard who don't get the attention they need in the schoolroom, but they, in the playground, they become loud and obnoxious. But this guy's back completely. He's back. What is this sense of canceling someone if they come back this hard and when like this, what are we doing to people? It's just getting so out of hand. The cancellation of. Movie stars and singers and what have you and rappers. It doesn't make any sense if you're going to take them back into the fold. A year or two later, McLaren will be hosting news again soon. You can bet Chris Cuomo will be doing something in the next two years. That just don't know what this all means and what it amounts to if these people end up coming back. What's the real lesson? They have all this money. They have all these millions. Does it just mean go home, count your money, sit still for two years? And then you'll be back in the fold. If that's the case, what's the lesson we're really teaching and why are people so adamant to teach it? I mean, this guy he shouldn't be working because it is mullet. Let alone what he said with the end more than what have you, but, you know, I just don't know what they're going with this stuff. They're getting ridiculous. They've got to there's got to come a point where people go, you know what, it's just like people made a mistake. The guy made a mistake. He said what he said, we uncovered old stuff. And you know, he's apologized, and we all need to move on. Except his apology and move on. I keep saying this because I really feel like a guy like me who walks a tightrope every day and says things into a microphone that can be judged and misinterpreted and interpreted and laid its scary and you go, well, am I a day away from not working for two years? Can't we just get to a point where they get to apologize and if it's sincere, we move on with our lives and everybody moves on and it's all good. I don't know. China's consumer inflation accelerated last month as the lunar new year holiday stimulated demand. The CPI rose 2.1% from a year earlier. That was in line with estimates. Core inflation stripping out food and energy gained just 1%. In the meantime, the producer price index was down 0.8% as commodity prices lagged. The estimate was for a drop of about a half a percent. Joining me is former federal prosecutor Robert mintz, a part of mccarter and English. Bob, most people see this as a tragic accident. Is it surprising that the DA is bringing charges? Well, this does represent a dramatic culmination of more than a year speculation over who if anyone would be held accountable for the tragic death of cinematographer Elena Hutchins. In this case, there is no evidence that anybody did anything intentionally wrong when it really turns on is whether they acted recklessly. In other words, whether they should have been more careful in making sure that the weapon that was being handled by Alec Baldwin did not contain a loaded bullet and ultimately it killed the cinematographer based upon a series of people who handled that weapon before it was placed into the hands of ballots all. The DA is going to file two involuntary manslaughter charges against Baldwin and Gutierrez Reed, two levels sort of that require different standards of proof. Under New Mexico law, there's voluntary manslaughter and involuntary manslaughter, voluntary manslaughter consists of an intentional killing for which there was a mitigating circumstance that reduces the crime from murder involuntary manslaughter, which is what has been charged here consists of a killing that was unintentional, but it results from either recklessness or criminal negligence. Here Alec Baldwin was charged with two counts of involuntary manslaughter, one of which carried the penalty of up to 18 months on the other is more serious. It carries a penalty of a mandatory jail sentence of 5 years in jail because although it was involuntary manslaughter in the commission of a lawful hack, it was done with the use of a firearm. So Baldwin has said, Baldwin has said all along that gun safety is not the actor's responsibility, and that he relied on the professionals on the set. Does that strike you as a good defense? Well, that really is the heart of the defense here. Mister Baldwin's defense is simply that he had no reason to believe that there was a live bullet in the gun, where frankly anywhere on the movie set, and this is most important that he relied on the professionals with whom he worked who was short in the gun did not have live rounds in it. And the question is for this jury if it ever gets to a jury, is whether that is enough, whether he can simply turn over the responsibility for gun safety to the professionals who worked around them and rely on what they tell him or whether he has an added responsibility since he is the person who is holding the gun if he have a bad burden to do something beyond simply conferring with the professionals and relying on what they tell him. The DA said that all the actors they spoke to said that either the actor should have checked the gun or should have had it checked in front of him, and that there was a pattern of criminal disregard for safety on the set. So at trial are we likely to hear from both sides experts about safety protocols in the industry. I think we are. I think in a lot of ways what the DA has done here by saying things like on my watch, no one is above the law. Everybody deserves justice. But she's really doing is putting not only Alec Baldwin on trial, but in a sense, Hollywood on trial celebrity on trial really the question of whether Alec Baldwin should get any kind of special treatment here or whether he has to play by the same rules as everybody else. But the question is what are those rules? And whether it was reasonable for him to rely on what others told him or whether he had an added burden of checking that gun himself or taking additional steps to ensure that what he was told was accurate because he had in his hand and weapon that was a working pistol that if it did have light ammunition could result in a fatality, which is exactly what happened here. How problematic is it going to be for Baldwin that he and the DA completely disagree about whether he pulled the trigger? Well, the trigger wasn't pulled. I didn't pull the trigger. The trigger had to have been pulled. So Alec is wrong. That guy would step off to the FBI analyst in Virginia who took this gun, which is a replica of a vintage cult 45, and they determined that the weapons tested normally. In other words, they concluded that in order for the revolver to fire the trigger would have to be pulled. So what you have there is an inconsistency between what Alec Baldwin is saying about how we handled that weapon at what the FBI report said. Doesn't really go to the heart of the case, but when you're a defense lawyer, you never really want to have that kind of inconsistency because the prosecution may be able to argue to jurors that he is not telling the truth about whether he pulled the trigger and therefore he may not be being totally candid with the jury about what he was saying and what he was thinking and what he did when he handled that weapon. So the inconsistency does not necessarily something goes to the heart of the case, but dancing efficiencies in your witnesses testimony are never something that you want as a lawyer. There were three people who handled the gun, first Gutierrez read the weapon specialist, then assistant director David halls, who handed ball when the gun, saying coal gun, meaning there was no live ammo in it. He's pleading guilty to negligent use of a deadly weapon, and then Baldwin. Any impact from the second person in the chain pleading guilty? No, what happened here really is that the district attorney approached this case by scrutinizing the actions of everyone who handled the weapon and everyone handled the line ammunition. And what they did was they looked at that chain of custody and ultimately the prosecutor concluded that everybody in that chain of custody bears some responsibility for their fatality. When bringing criminal charges, the prosecutor is going to argue, if you are holding a gun in your hand, you implicitly have a responsibility to

going into the vault taking bond certificates and clipping coupons off of that How do you get from that sort of junior intern menial labor to launching a stand-alone active Bond shop Well let me add to that quickly I could only clip coupons for half of the day I guess the other half I was off making private placements loans to fledgling companies such as Berkshire Hathaway and Walmart I visited Sam Walton with his two kids at dog I struck at two walmarts in Bentonville Arkansas and same thing with Buffett and Charlie Munger So I was doing some of that but just to make the transition I guess to managing money I did a master's thesis at UCLA and I just graduated and it was about convertible bonds but also about Warren's and option related vehicles So I was interested in the bond market even though I wanted to get into stocks and specific mutual and downtown LA had a $1 billion worth of buns and a broker from whedon and company Howard dreykov decided to visit and tell me that somebody else in town was treating some bonds from boxes and those days as you know there weren't any computers or IBM three 60s but we only had one You couldn't really buy and sell on the wire And so it was very difficult to trade But I convinced him to let me use 5 million of their funds and set up an active trading account And that was the beginning Of pimco And before pemco I've heard bond trading described as by appointment only is it fair to say you and your team invented fixed income trading Am I overstating that Probably just a little there was a gentleman I forget his name said that a life insurance in LA that was doing some of that There was a guy from Lehman who later died It was doing some of that But I was certainly one of the first to know certainly one that pursued it and convinced the executives of Pacific ritual that this could be turned into a business So maybe I should say pimco helped to bring about institutional trading on a level that just didn't exist before You guys helped systematize it Is that more accurate Yes I think that's true Because back then stocks with the vehicle to trade and even then they weren't treated that actively Bonds were basically bought and ultimately matured I guess that the big banks in the east and New York and Boston and Chicago and so we have bond trading was no one thought that you could sell one bond by another and make some money And so it was innovative and I was glad to be part of it So in the book you describe how pimp go grew in the 1980s and 1990s We'll talk about the latter years later but that period following everything that chairman Paul Volcker had done with the bond market that really was a perfect storm to plow into the fixed income space Tell us about the growth of pimco in the observers and participants are saying it's time the president cut a deal that isn't really possible According to opinion columnist Jonathan Bernstein a president has limited tools to get legislation over the line and simply forcing lawmakers to agree isn't one of them He joins us to explain Every time I turn on the news I hear someone saying President Biden needs to sit down with his own Democrats and work out a solution Cut a deal Is that going to happen Well they seem to be moving Towards the deal But there are things that a president can do and things of the president can not do And one of the things that president can not do is to order Joe Manchin or anybody else to agree to something They are independently elected members of the Senate or the House And he's not their boss So there are some ways he can exert influence but it's not as simple as boy if he only tried harder everything would be fine I think what they're hinting at is that he should exert some pressure over the holdout senators or Congress people Well there are things that presidents can do If they for example summon somebody especially from their own party to The White House for meeting That's going to be very difficult for senator to say no I'm going to ignore that But once they come to the meeting president can only do so much Maybe there's some kind of an appointment nomination that that senator wants that the president can do Maybe there's some campaign assistance that the president can do But the bottom line is if Joe Manchin doesn't want $3.5 trillion in a bill he's free not to vote for it And there's very little that the president can do to enforce anything Presidents aren't the bosses of members of the Senate It seems like senator Kristen sinema has been at The White House many times to no avail Well we don't really know to what extent it's happening One of the things about all of this is that a president cham put a deadline on things Can sort of create an artificial deadline And that may get things moving but at the bottom line is it's artificial And if cinema or mansion or whoever it is wants to take more time isn't there yet There's very little president can do to enforce that artificial deadline other than saying well we're done now We're not going to do the bill President Trump could do that but that's hardly in the president's interests Does it seem as if the Democrats have put themselves under some kind of artificial deadline that they have to get this done now Well I think that it makes sense to generate artificial deadlines of sorts because otherwise they'll wait till the real deadline which is probably next year's elections And you never know what could happen between now and then So it does make sense for The White House It makes sense for congressional leaders to put pressure on and to create deadlines But the problem is that they can't enforce those deadlines So that can generate negative media coverage when they're supposed to be a vote At the end of October and there's not going to be a vote at the end of October or whatever it is So if they do get this past and signed will the Democrats necessarily benefit in the midterms from it It's a great question The general history of these things is no with an asterisk There's no real sign that parties are rewarded for legislative success On the other hand presidential popularity matters a lot in midterms and to the extent that there's negative stories about the president including legislation that didn't pass That would tend overall to hurt the president's popularity But for the most part it actually doesn't seem to have very much to do with it We can think of presidents who have extremely effective legislative results in the first two years And had terrible midterms anyway from Lin and Johnson to Barack Obama So there's not a direct correlation there And things like the economy and war and peace tend to be much more important for the midterms Thanks Jonathan
