The former president Donald Trump has asked the U.S. Supreme Court to step into the legal fight over the classified documents seized during an FBI search of his Florida estate. Escalating a dispute over the powers of an independent arbiter appointed to inspect the records by Trump himself. Trump lawyers asked the justices to overturn a lower court ruling and allow the arbiter called a special master to review the roughly 100 documents with classified markings that were taken in the August 8th search of Mar-a-Lago. A three judge panel from the Atlanta based U.S. Court of Appeals for the 11th circuit last month limited the special masters review to the much larger collection of non classified documents. The judges, including two Trump appointees, sided with the Justice Department, which had argued there was no legal basis for the special master to conduct his own review of the classified documents. But Trump's lawyers said in their application to the Supreme Court that it was essential for the special master to have access to the classified records to determine whether documents bearing classification markings are in fact classified and regardless of classification, whether those records are personal records or presidential records. It says without the special master review, the unchallenged views of the current Justice Department would supersede the established authority of the chief executive. An independent review, the Trump team says, ensures a transparent process that provides much needed oversight. Trump lawyers admitted the Supreme Court application to the far right justice clarence Thomas, who oversees emergency matters from Florida and several other southern states. Thomas has previously come under scrutiny for his vote in a different Trump documents case, in which he was the only member of the court to vote against allowing the U.S. House committee investigating January 6th to obtain Trump records held by the national archives and records administration, justice Thomas is also married to the far right extremist conspiracy theorist, Ginny Thomas. President Joe Biden and top White House officials announced new guidelines and grants to protect abortion and contraception rights on Tuesday and said women's rights have already been curtailed since the Supreme Court overturned roe versus wade a hundred days ago. Speaking at a meeting of the reproductive rights task force with vice president Kamala Harris, Biden said the decision that had rescinded women's constitutional rights to an abortion has had frightening ripple effects in some states, including restricting a teens access to medicine she needed for arthritis. We're not going to sit by and let Republicans throughout the country enact extreme policies, he said. Abortion bans have gone into effect in more than a dozen Republican states since the court overturned the 1973 roe V wade ruling on June 24th, nearly 30 million women of reproductive age now live in a state with a ban, including nearly 22 million women who can not access abortion care after 6 weeks. Biden's meeting held with doctors, lawmakers, and White House officials focused on how millions of women can not access abortion services, face shrinking access to contraception and how doctors and nurses are facing criminal penalties for providing abortions. The Supreme Court decision created a healthcare crisis in America, Harris said what we are seeing in laws around our country is the criminalization of doctors and healthcare providers, she said, noting some states had reverted to abortion laws put in place before women even had the right to vote. The tumultuous saga of Elon Musk's on again off again purchase of Twitter took a turn toward a conclusion yesterday after the mercurial Tesla CEO proposed to buy the company at the originally agreed on price of $44 billion. Musk made the surprising turnaround not on Twitter as has been his custom, but in a letter to Twitter that the company disclosed in a filing yesterday with the U.S. Securities and Exchange Commission. It came less than two weeks before a trial between the two parties is scheduled to start in Delaware. In response to it has said it intends to close the transaction at $54 and 20 cents per share after receiving the letter from Musk. But the company stopped short of saying it's dropping its lawsuit against the billionaire Tesla CEO, expert said that makes sense given the contentious relationship and lack of trust between the two parties. Trading into a stock which had been halted for much of the day pending release of the news, resumed trading late Tuesday and soared 22% to close at $52. Musk's proposal is the latest twist in a high profile saga involving the world's richest man and one of the most influential social media platforms, while some logistical and legal hurdles remain, Musk could be in charge of Twitter in a matter of days, however long it takes him and his co investors to line up the cash, said Anne Lipton, an associate law professor at tulane university, a letter from Musk's lawyer dated Monday and disclosed by Twitter, said Musk would close the merger signed in April, provided that the Delaware chancery court enter an immediate stay of Twitter's lawsuit against him, and adjourn the trial scheduled to start on October 17. And one that covers a large amount of territory because we have the largest border. I think we have about two thirds of the border, Texas and Mexico. So it's a big problem, but I applaud the governor for permitting board. Well, how does it work? If he does crowdfunding? Let's say he raises enough money to build the wall. Still, Immigration, naturalization issues are up to the federal government. Would you have to get the okay from all the private landowners on the border? The headline Today is Officials call on Harris Biden to Visit Border, The COLLAR Times and other USA Today papers reporting border locals say they want to be part of immigration discussions. That as vice president Harris is on the road having immigration conversations with leaders in other countries more on that story in a moment, but first to another aspect of immigration. It's actually the top story in the Houston Chronicle. Here's the headline Court limits green card path from TPS. And Here's the impact Thousands of immigrants living in the U. S for humanitarian reasons are not able to apply to become permanent residents. On Monday, The U. S. Supreme Court unanimously ruled that immigrants who crossed illegally but who gained a temporary protected status because they had escaped war or disaster in their countries cannot apply for permanent resident status. Helping us break down. This ruling is Jeffrey Hoffman, director of the University of Houston's immigration Clinic. Professor Hoffman. Thanks for being here. Thank you. Good morning. Not to clarify. There are many people in the U. S who are protected under TPS, who entered the country legally and can still apply for citizenship. Is that right? That's right. So I think to clarify and just to take a step back. The 6th 8th and 9th circuit held that a grant of TPS was an admission. So in those circuits, um, that was the law and then in the third and 11th circuits they held that the TPS in and of itself was not an admission, So in order to be eligible to apply for adjustment of status, you have to have Been inspected or admitted or paroled. And unfortunately, um, the Supreme Court unanimously found that it was not an admission and therefore, if you entered without inspection, you couldn't adjust. Before we get into the more of the details on that I have one more clarifying question here for for those who are listening and might not understand is TPS different than asylum or refugee status. Yes, it's very different. So TPS is is basically designation of countries by the secretary of the Department of Homeland Security. The secretary will designate certain countries that have been affected by, for example, civil straight floods, hurricanes, etcetera, and then those countries will People from those countries will be allowed to get temporary relief. So let's get to this decision. Now. You said it sounds like the Supreme Court actually ruled unanimously to agree with the minority of the of the circuit court here not to allow those protected under TPS who entered the US illegally to qualify for citizenship. Why? What's the disagreement here? Why did these other courts ruled that it was an admission? Well, First of all, it's not citizenship. It would be adjustment of status. So that's that's one clarification. Um, and so what The argument was was that if somebody had TPS, it's a non immigrant status. And that should be equivalent to having an admission. Um, and they're very good arguments for that. But if you read the statute very closely from a strict, strict constructionist point of view, um you know, you can make that distinction between nonimmigrant status and an admission. So technically, if it's not an admission, it doesn't allow the person and there are some exceptions, but it doesn't allow the person to adjust their status. So. So, what are the legal disagreements here? I mean, and and is the is the argument over or can it continue? I guess, maybe just with a different branch of government. Well, I think the the the the issue is settled with respect for people who are trying to rely on TPS as an admission. That's clear. That's black letter law. Now it's not admission. However, it should be emphasized that people who have TPS should should definitely seek legal counsel because there still may be options for them. So, for example, some people who entered through what's called parole May still have options available. Other people may have entered with some sort of lawful status, and they may not be aware of it. I believe it or not, I've seen that happen. So everybody should should take this with a grain of salt. Make sure that they're getting excellent legal counsel before they make any assumptions. As a non expert, I gotta say it sounds a bit cruel to only offer temporary respite and one that has no predictable ending. But is that just the nature of this program? Well, the the program has helped a lot of people. Um, it's called TPS temporary protected status. But on the other hand, some people have been in TPS for decades. Um, you know, so these people have started families. They've gone to school. They've become doctors and lawyers, etcetera. So there are a lot of different options for for people with TPS if they're able to Benefit from future legislation. So this this is a a ruling from the Supreme Court. But others are looking to other branches of government now to to make sort of a decision that that would affect the future of these folks. That's correct. So what I would say is this decision underscores the necessity for comprehensive immigration reform because these people are deserving of relief. We stand here at the brink of an inauguration, which is festooned with what 25,000. National Guard troops to some degree a slice the pie for me. There are two reactions to thousands upon thousands. Of troops adorn not adorning taking up their positions in Washington. May God bless every single one of those men and women in uniform. But here's the thing. That is either Hey. Proper vigilance in view of the fact that Hey, we did just have some riots. Or be it is political theater designed to make America think. Oh, my God in heaven. This is what we need to protect ourselves from crazy. Violent Trump stirs. Now. I don't think that's binary. I think it may be some of both. And I don't know exactly how I'd slice the pie of I've all I've often said in terms of preparedness for anything That I'd rather have it and not need it than need it and not have it. And how do you like to be the official who understaffed. You know the troops for the inauguration? And then have another riot. Break out. That would not be a good luck. But you know what? I have zero expectation of another riot breaking out just as I and you and everybody else. At zero expectation of a riot breaking out on January 6th Yet here's where we Are. We had Ryan on January 6th so suddenly retroactively President Trump, who spoke that morning he incited the riot. Have some idiot says that on the street, I'm prepared not to care. But when the Congress of the United States floats and impeachment based on that, Are you kidding me? And sadly, I'm not getting Cause that's where we are. And it's just centers like Ted Cruz and Josh Holly, that famous now infamous photograph of Josh Holly walking up on Capitol Hill, seeing perhaps a smattering of people they're gathered to support him, and Cruz and other brave Republicans who stepped into T cast some question. About this tainted election. Into perhaps opposed the acceptance of electors from some states where the constitution had been so savaged with laws had been so sidelined. That's what they were doing. It was constitutional through the system thoroughly lawful, everyone free to agree with it or disagree with it as they please. But now retroactively since we wound up having rioting that day. Cruise and Holly being called on to resign. All of this is stuff and nonsense is sound and fury signifying nothing, as is the impeachment, but you know, silly me. There may be impeachments in my life, and now we may have one every few years. I don't know that I agree with or disagree with, But this one is a stain. It's a stain on the Constitution. It's a stain on our history. It is a stupid juvenile vendetta moment born of a toddler tantrum of people who hate Trump. And and it's not just Democrats. Because 10 Republicans Liz Cheney, for crying out loud, who has done much that I've admired? Fred Upton in Michigan, Adam Kinzinger in Illinois and seven other backbenchers. Decided that the only way to telegraph their revulsion about the riots is this where we are now that in order to make sure that everybody knows that you are sufficiently repelled by the riots. Is to vote for impeachment of the president and and to invent out of whole cloth, the notion that he incited them, which is simply factually. Incorrect. It is a lie. I am. Universally repelled by the riots. Am Holy Condemning those who took part. You know what else? I'm repelled by. Tainted election. States changing the rules in midstream of sacrificing the Constitution and proper election procedure on a phony altar of covert urgency. You know that kind of repels me too. Where you came from How we first met when you were working. With the tea party movement in 2009. That was a time mark. When Barack Obama had won the presidency, there was a 60 vote majority for Democrats in the Senate. There was something like a 54 vote majority in the House of Representatives for the Democrats at so basically, the Democrats could do whatever they want, and we had a lot of voters who were disaffected by the waning days of the Bush administration because of the bank bailout. After the financial crisis. It was frankly in my opinion, a lot more depressing then than it is right now. Yeah, I mean, it was a dark time in American politics, and we got to remember out of darkness. That's where you find the light. The light becomes most visible when things are most dark, and that's what happened with the tea party movement. I was blessed to be one of the people that found the largest tea party organization in the country Key Party patriots. We built that up tol literally to 23 million members around the country. We have the largest thing in Congress since 1938 and we're very excited. We thought government was going to change for good forever. The sad part is it didn't on, so I've gotten engaged in a whole bunch of other political activities. I know we're gonna talk about convention of states here, but the bottom line is I just never gave up. I just never would give up. I don't know how to give up and I don't think that we should give up on our nation. There are a lot of people who were inclined to do that because they'll say, Mark what's the point? My vote doesn't matter anyway, because they truly believe that there were and I, By the way, I personally believe absolutely. There were a lot of unprecedented modifications to many states voting statutes to allow for the opportunity for widespread fraud through mail in voting. And and I believe that that occurred in some states there people who will see that. What's the point? My vote? My voice doesn't matter. What can I do? Yeah, And so I think they're right. Everything you just said, is absolutely correct. And I think the nation is in a in a time when we're as divided as we've been in in any of our lifetimes. We're experiencing the sensation of breaking apart as a nation. I actually called us the great decouple ng and it's not just a sensation is happening, but I think if you want to put it in context there is important. Remember, we've always been divided Destination. All the way back to the original 13 colonies. Americans have always been a really diverse people. And if you go back to colonial times, the folks in the different colonies they hated each other. There was all this sectarian Christianity. The different colonies didn't really like each other. And so this is our history, and I don't think there's any reason to fear right now. This is exactly why the founders designed a federal system where we did a limited number of things together as a nation, the enumerated powers for lack of a better term. The rest was left to the states and the people, and so there is a solution to what's going on in the country right now to the corruption. That disgusting stuff we see going on in Washington, D. C. What we can do is we can take our power back from Washington, D. C and we could do it peacefully.
