But there you go, and they see this guy and they try to catch him. But they can't catch him. He goes away so fast. They lose him. Now. It turns out he gets off this one freeway and he stops at a gas station, and he tries to hide behind one of the gas pumps, but it doesn't work because another cop a sheriff's deputy comes along sees him. He sees the cop. He takes off again whoosh skies going over a hundred miles an hour at some point. He's going one hundred and fifty miles an hour. He's going so fast that he ends up back on one of the freeways where unbeknownst to him. The first guy that was patrolling is now ahead of him. On the freeway, and the and the the other guy doesn't know that the motorcyclist is behind him and gaining on him. So this continues for a few minutes. The cop guy is going hundred miles an hour and the motorcycle guys going one hundred and fifty miles an hour. At one point the cop in front sees this motorcycle is coming up in his rear view mirror and in seven seconds. This is what happens. The cops starts slowing down pretty quickly from one hundred miles an hour to fifty miles an hour. And he moves his car to the right side of his lane. And then he moves it to the left side of the lane. And right as the motorcycle is coming up on him the motorcycle tries to pass in the other lane. And the cop moves jerks his car into the lane causing the motorcyclists to crash into the back of his SUV and die. The family sues this guy, saying basically fourth amendment violation. You know, you killed our son, and you're not allowed to do that. And the cop says, oh, no, no, no qualified immunity. So here's what they have to prove. Number one. There's a constitutional right to not have this happen to you. And that that right is so well known that this police officer would know in that seven seconds from the time he realized the guy was coming up behind him to the time. He did the maneuver in seventeen that it was so well established that he would know that it's a violation of constitutional rights to do it. And the district court said, oh, yeah. No qualified immunity. You can't do that. And we're done. They. Oh, oh, no. No. No, no. You're not even looking at the law. They go up to the fifth circuit. What is this conservative do with this because with qualif- one of the things with qualified immunity with cops is? It's not enough, for example to say cops are not allowed to do anything. That's too dangerous. That might hurt somebody. You have to have a case that already says doing the specific thing you did is unconstitutional. Now, do you think there already was a federal case that said slowing down the block a guy runs into the back of your police cars, I'm gonna I'm gonna argue that there was qualified immunity, and the reason is that what the cop was doing was not unreasonable stopping the guy was critical one hundred and fifty miles an hour is dangerous stuff and could truly hurt somebody. If there was another car in the way, so he did not act unreasonably under the circumstances. Especially when there was no intent to hurt him. It was an intent to stop. And to argue that he should have known shoulda woulda coulda done. Doesn't fly under these circumstances? So I'm going to say qualified immunity qualified immunity, it is and what you brought up very important part of that whole thing, which is is the guy a danger at the time that the cops do whatever they do. And as you said clearly barreling down a two lane undivided highway. I didn't know that which I didn't even bring up at one hundred and fifty miles an hour clearly danger. All right. So there we go next one. All right. Oh, this is. All right. I think I can make this really simple Planned Parenthood in Ohio for years and years, they get some public money for health programs that the state does out for things like cancer and even like domestic violence education. Okay. And then they pass along two thousand sixteen no money to anybody who performs non therapeutic abortions. All right. So now, they can't get the money, and they go to court, and they say, what are you doing? You cannot deny us money. There's a constitutional right to abortion. What are you doing? And the state says, oh, no be careful here. A woman has a constitutional right to an abortion. You don't have a constitutional right to give her an abortion. How did that play out? Well, I mean, the logic of it is that a woman having the constitutional right to an abortion. When no abortions are permitted is effectively denying her the right to an abortion. I mean, that's the reality of it. Right. So although here it's just denying rights money for other unrelated now health service now under the Hyde amendment. The federal government is allowed to not pay money for abortions under any circumstances. So what Planned Parenthood does is put up a firewall, and the part that does the abortions is that's that's funded by donations, etc. The part that doesn't do the abortions is in fact paid for by the federal government or grants, by the way, the abortion part of it is minuscule compared to everything else. Planned Parenthood does. So I am going to argue that the. That the state saying that there is no constitutional right for an abortion provider were shouldn't have any money is akin to a violation of a woman's right to abortion. Sixth circuit disagreed with you. Oh, there you go. They said in essence women have a right to an abortion. You can't have laws that unduly burden their right to get one. There's no constitutional right to perform an obscene. That's where I would disagree. Because even when laws are struck that laws on doctors Reiner struck down. It's not because the doctors rights are being violent. It's the court finds this lot unduly Brown's the woman in getting one. So now, if the state has a right to say there is no money for abortion providers because there's no constitutional right for a woman to get an abortion, even though there are no providers.
