Be responsible for the money that was lost. Were hit somebody no. You're fine that's not. you're off the hook. They're all right sherry. Hi sherry europe. Welcome to handle on the law. Thank you Bill purchased a Links barbecue twenty one years ago or yeah those are those are not inexpensive. Yeah no they're not and they have a wonderful warranty. That's based on the lifetime of the original purchaser which twenty one years ago was me now. They're telling me. I have a one inch crack in the fire box which requires replacing the whole barbecue under warranty. But when i get a hold of customer care. They're telling me sorry but your barbecues outlived it's life expectancy but it's not based on the barbecues life that warranties based on my lifetime. Well i think you're right. I mean whoever said that it's has this life expectancy that is certainly not the terms of the original lifetime warranty. I love that a lifetime warranty based on the how do you determine the life of legitimately. The life of a barbecue is when it falls apart for example i. I don't understand how they would do that. Why twenty one years. Why eighteen years of. where's the. no that doesn't work. I think you. I go to small claims court on them and just say hey and they're not going to argue lifetime warranty file small claims court or go up the ladder. Who did you talk to when you first made that time. I've been trying to contact every buddy up higher on the ladder. Because they won't talk to them that we know he told me there's an email he said what you wanna talk about. There's nothing else. They used to in small claims court. That's all now. The problem is getting hold of that. Warranty new barbie. Yeah well the new barbecue is like seven grand. I know they're really expensive now. The problem is you hold on. You're going you're going to win but it's the value of the barbecue as it is now. That is the problem before it was broken. Assuming that the barbecue is in great shape. That's your lawsuit. It's not replacement it's not a new barbecue unless the warranty says well. No if he can't repair. Do you have a lifetime warranty. They have to replace. Yeah no no. I think you got him that. I think you're going on that. Yeah file small claims but you have to get hold of the lifetime warranty. You can't just say there's a lifetime warranty and they have a white time warranty now. How do you establish that. There was that same warranty twenty one years ago. Well also they'll sell me replacement burners under that lifetime warranty which are brass and they cost like a hundred bucks a piece but on under warranty. They'll sell them to meet for thirty bucks piece. Yeah but they're not under voice but they're saying it's not under warranty so netflix right. So that's that's so that doesn't make any sense but now so anyway in my opinion small-claims soup. You gotta prove there's a lifetime warranty. There has to be documentation. I have original book that came with it. That says lifetime and it says lifetime warranty on Based on the original per purchasers and you let me ask again you have. It's a lifetime warranty. That's written in the booklet when you bought it. Yes okay then you got them small-claims sued small-claims suit for seven grand. That's where you go all right now. Before i lock out and say goodbye i want to mention to you that i will continue to take the phone calls as i said so. Don't go away and if you wanna come in answer and ask a phone call. This is handle on the law. It is marginal legal advice. Where i tell you have absolutely no case. And here's someone who had no case and this is a this is a pretty good one. This is pennsylvania and it goes back to two thousand seventeen and this is a case of anger management. It's just that simple dealing with someone's anger. This is a woman who chopped up her husband while her kids were watching. So it's it's a little tough one so she was found guilty of murdering her husband in two thousand seventeen. I mean literally she waits until he falls asleep and then takes an axe and pretends he's firewood and starts going out at the kids. are there. They tried to intervene. They're injured thank goodness not life threatening and so i guess that's an issue in pennsylvania. You're not supposed to do that. So there was obviously Some criminal criminal issues here. So here's the argument okay. He doesn't die immediately. He dies six months later in the hospital of pneumonia and she's arguing that her conviction for murder should be overturned because at least the the murder conviction She agrees okay. I chop them up. I grant that I thought it was. I thought was a tree branch right there. It turned out to be my husband and that did work by the way as a defense. So it's technical argument now. Here's the rule. If someone dies at a later date they can amend the complaint to murder after the conviction is a different story if the death happens after a conviction during the course of The pretrial time where the lament it. You know here we are. We've arrested you for assault later on once later The person dies before trial. Haywar amending it. It's now a murderer straight out so the court didn't even go there the first she would have lost anyway but the court didn't even go there and why well because she and the death incidentally happened before. She was convicted because she pled guilty to murder. It wasn't a trial it was a straight out plea plea bargain and she had pled guilty to third degree murder. She cannot now come back and say he didn't die of my axa tacked so the court didn't even go there other than to say. Hey you ve already pled. Don't even argue with us and so on two hits she's going to lose answering enough She lost so she'll have to stay in prison obviously. She lost her appeal. All this was going on and it's twenty to forty years in prison. And i'm assuming she's not getting out any time soon even when the twenty years is up. Hey ask the way. It goes all right tony. This is our story family history. Let's get started. Welcome back to another episode of five minutes in Church history. On this episode, we're talking about a composer George, Frederic Handel and I resist the urge to have upon here and say that we going to get a handle on handle. But let's get a handle on hindle. He was born in sixteen, Eighty five in Hallo- Germany the importance of that year is it was the same year as the birth of Johann Sebastian Bach sixteen eighty five was a great year for the birth of composers apparently, and now Bach to handle and I promise. I'm done with punts. Well handle was originally set to be a lawyer but he loved music and he quickly showed his prowess as an organist and at composing, and so he said off to be a musician. He spent some time traveling around Italy and then he was musician for the elector of Hanover. Now, the importance of the elector of Hanover was that he was the heir to the throne of England and when Queen and died childless the elector of Hanover became King George the. First of England handle moved with him to London and the year was seventeen off and from then on hand spent the rest of his life in Britain, and he's while born in Germany and German descent is known as an English composer under George. The first t founded the Royal Academy of Music, which he directed for fifteen years early on in London Handel composed for King George the first his famous water music or as in handles beloved German Tongue vassar music. The first time it was performed for King George loved it so much. He ordered it played again and then he ordered it played again. So debuted three times in a row in seventeen seventeen. After. He finished his time handle finished his time at the Royal Academy of Music. He spent much of the Seventeenth Thirties writing operas, and then he said about to write what might be considered his magnum opus the Messiah. Handel. was by all accounts obsessed with work. We would say today a workaholic and he poured himself into his work as a composer as a musician. Sadly in seventeen fifty one he went blind and then in seventeen, fifty, nine, the age of seventy four he died in, London? He was buried in Westminster Abbey and of course, the grand organ of the Abbey and the choir played his beloved. Messiah. Handel one said I should be very sorry if I only entertained them referring to the people who listen to his music, he wanted people to not only be entertained but to beat moved by his music and that was certainly the case with the Messiah. The Messiah was first performed in Dublin on April thirteen, seventeen, forty two it was performed the next year in London and King George the second was in the audience attending and when he got to the chorus for part to the Hallelujah Chorus King George, the second was moved that he stood up, and of course, when the king stands everyone else stands in. So the whole theater stood alongside of the king and that started tradition of standing during the Hallelujah course. The Messiah is in three parts. Part one begins with prophecies of the. Coming Messiah from Isaiah and Psalms, and takes us right to the shepherds watching their flock at night on Bethlehem's hillsides. Then part two covers the passion, the suffering in-depth of Christ and ends with that Hallelujah course part three picks up with Christ's resurrection and continues with his ascension and what theologians call his present session in glory, and then it ends with the day of judgement to come as the Messiah the king comes in glory. Well, that is Handel's Messiah and when he was finished writing the musical score, he signed it s D. G. Solely Dale Gloria. I'm Steve Nichols, thanks for joining us for five minutes and Church history. For more information or to listen to past episodes, please visit five minutes in Church history.

I'M GONNA stay talking off the air. And just wait ten minutes or eight minutes because people hang up. So I'll get to all of the phone calls coming up the number here eight, hundred, five, two, zero, one, five, three, four, and we do have lines open and I've only had two or three out. Here we go. We're coming in because I was almost very excited about playing the Jerry Lewis Song when we need calls haven't done that in a while. But I'll get there. This is handle on the law marginal legal advice. Mercy Hello, mercy. Hi Steve my question is. Starting talking to the right showed you have any idea who you're calling. Say. Mercy I did say mercy in. Did you say Steve You did say Steve Bill Bill. Okay. Got It. Yeah. Okay. I just. Kind of. No, I'm just wondering if you actually had a legal question that's all. Yes, I know Steve does a plumbing show. You know that don't. Know Okay you. I. I. wanted to ask a question regarding we have to appropriate on a lot ever going to rent the front house out. There is a back door in the front house. And we made like a little courtyard and we sent it off and why spouse want to leave that gate open. So dependent of proposed tenant can access to their trash can where we keep ours. And I think that's about idea because you're. Kind of already setting a precedent where you're having a shared access. and yes, you can say the least you can only use the. Date to to just access trash but my point is who has to elaborate anymore. I think a few and people listen landlord. So okay. Got It. You you and your spouse likely place. My My my question is if something should happen like were we have a Jacuzzi and the tournament while we're gone let's just say decide. To use our Jacuzzi something happens or an also we have a dog and I don't know like, yeah. Maybe my dog will get to know the proposed tennis but what if the proposed Senate has their friend take out the trash one day and my dog comes charging them and leaps on them. I feel like we're opening ourselves up to lawsuit whereas we. Right from and you probably are opening yourself up to lawsuit just renting the place opens you yourself up to a lot right. So what is your? What is your question? Well I if something should happen on the property with the shirts access where like they did go in our backyard and slipped or something are we still liable? That's actually it's actually fairly complicated question. Because the argument is that you breach the lease I'm talking about you to the tendency you only had answers and what you did you breach jumped into the Jacuzzi and all of that business So there is the least you're breaching. Then their argument is going to be yeah. But you should have anticipated that happening especially since I have guests and so you in fact, assume the risk of something happening like that, and here's the answer insurance mercy insurance lots, and lots of home insurance, and then if God forbid something happens, you know what you do you call your insurance agent you go. Here you go you handle it. That's handle it and you let the tenant no, you're GONNA enforce. That access even enforce it very strictly, and it's only access for the garbage for the trash cans. Then you simply set up a time and say, we will open it up for you. And you can use their trash cans there or the easiest way of doing it. If there's someplace else, they can put the trash cans. That's where they put him and you keep your courtyard. Personal just. Cry Those. All right. You got it. That was easy. The bottom line is insurance insurance insurance I'm. A Huge Fan For Insurance. Adam Adam Adam. You're up. Welcome. Hey Bill. Question my daughter bought a house a little over a year ago at the time the home inspector came in and there was you know the foundation seen as flat concrete slab foundations team a little off and or some cracks in walls. We ask them. Hey any issues here with the slap? Yes. We know what the windows and doors are opening and closing. Fine. No issues there so now They're okay fine. So here we are a year later and the slab is definitely cracking You know pull up the carpet there's about a quarter inch cracking the slab. And so now we're looking at what we have to do to repair that crack. Is there any recourse going back to the seller income disclosure about? Sure and there is recourse now whether you prevail or not is a different story, a lot of it has to do with what did they know? When did they know it? And did they know it at the time that you bought it and they had some kind of inkling than you have the then you have. The inspector who says everything is fine I then. It's a little convoluted and yeah. So if we're talking about the foundation, any idea what it's GonNa cost to repair that puppy. Guess is probably around anywhere from ten to fifteen thousand. All right. Well, that's worth. You know at least saying to them what you WANNA. Do I have you had a discussion with the seller? No okay. It's time to have a discussion with the seller. You may want to have a lawyer, a lawyer letter. to sell or hey seller, my name is Bill Handel and do not use dame because they're gonNA laugh you laugh at you so hard my name is Bill Handel I represent. Adam Adams daughter and there is an issue brought up please contact us. So we can amicably resolved that that scares the crap out of people and immediately that puts that puts them on a whole different level. Now, before you do that, you may want to call them up and go hey, you know I have found it easier. That lawyer letter comes after they tell you to pound sand. So, we start with this is what I think works you start with hey, we have an issue with this crack. Let's work it out. Would you me to make it happen? They generally say, no your problem you bought the property then do the lawyer letter and then Okay No. In the end small claims court and I don't know which way the judge would go on that. Because that's up in the air. So give that a shot and see if that happens. Okay L. let's take a break and don't forget that at the top of the hour stay put and I will continue answering a phone calls I eight, hundred, five, two, zero, one, five, three, four, this is handle on.

And you already had put in the pin number, right? Yeah. Okay. Everything. Yeah. They have to well theoretically yes. But you have to be really sophisticated because they would have to actually break into the machine itself and take off the pin number which was already put in but you're talking about some electronic sophisticates on a very high level that would do that. So I I don't think there's much to worry about because when is it happening? PEOPLE LOSE ATM CARS ALL THE TIME? Now. You have a bank account with that bank. Correct. Yes Sir the money's gone you have a house. Yes okay. That's gone I think I think you're going to be fine jake really. People. People lose ATM cards all the time in probably the best place to lose it is in an ATM machines just have to let them know you call up a bank. Customer service explain what happened clearly the bank knows or will know that the ATM machines swallowed your. that. That's they're gonNA, know the first time that someone empty ATM machine, and in the end I think you're going to be just fine I wouldn't worry thanks for advice I called you a couple of weeks ago and you're of lights with Jeez that's depressing.
