What are you paying attention to what you talk about on the show over the week. I heard a little bit of it, Uh, gun guy show it's 57 on Saturdays. It is the obviously I talked a lot about what you and I tossed touched on a little bit. Nagy when I was falling for Jason on Friday on Friday, talked about this crime summit. Um, that they had on North Shade Lynn and how nobody from the mayor's office even bothered to respond to the invitation to come. Talk about reducing crime. And in Marion County. I'm shocked guy. Yeah, And this is my shocked face. And now the prosecutor's office actually did respond but said no, thank you. We don't want to come talk to citizens about How to reduce crime in Indianapolis, and and But then you know, one of us did show up. I was on the panel and councilman showed up. Couple councilman showed up, and they tried to say that the Causes of violence in Indiana and Indianapolis, in particular, are food, deserts and covid. That's why are our murder rate is spiking out of control. So that little girl that got shot in the neck over the weekend with the stray bullet that was because of Covid was or food deserts. Maybe somebody was at a hot dog buns and they were angry because they couldn't have a grocery store close. So they shot a little girl in the neck. That was so funny and go back and listen that show we played a bunch of audio from it. From you have a kind of back and forth with the councilman was boots or something. Yeah, exactly. Dan boots that's like from District three. Yeah. And then he was trying to say, um what else? What was the other? What? That the, uh The Bill matrix? Yeah, this ridiculous bond matrix we have or you can be accused of crimes like strangulation. Or pointing a firearm were battery and as a felony and only get $500 bond, and he's saying this oil we we don't have any control of that Syrian county. That's that's a state issue. That's all set by the State Supreme Court, and then I quoted him. The from the spokesman from the not only the state Supreme Court, but also, uh, the Marion County judges through Chief Judge Amy Jones came out and said, Absolutely not. That's a Marion County issue. The state doesn't control it if Marion County wants to fix their completely Out of whack Dangerous Bond matrix. They can fix it if they want to. So all the attempts to pass the buck, whether it's covid or food, deserts, or, you know the state mandating a totally ridiculous and out of touch bond schedule. We we refuted all of that. So there was much fidgeting going on among the city County councillors. But frankly, that's why I was there. I was there to pull back the curtain a little bit. The gun guy got Relford in studio with us Monday Gun day. So the Biden administration telling us that there's going to be a ban on Russian ammunition you posted on social media. There's a lot of erroneous information about this. What's really going on? A lot of people freaked out pretty hard. And you know, frankly, even among my fellow gun nuts, which I consider to be a term of endearment, Um, but even among my fellow gun nuts there, people come out and I don't know if they want clicks or Views or whatever it is, but they come out, you know, and and Biden band's all Russian ammo and and and people forgot about this because for a couple of reasons, one is that there is a lot of Russian ammo that's used here in the U. S. And it's It's primarily very inexpensive is primarily steel cased, as opposed to brass cased. And I think that's because of the relative, uh, scarcity of brass in Russia, but it tells me very inexpensive and so and there's a lot of it brands like Tula and Brown Bear and Wolf Ammo, and you see this everywhere when you go to gun shops, Um and and there's already an ammo shortage. And this tends to be cheap, plentiful ammo, both rifle and pistol, and people are freaked that when you take get away than we already have an ammo shortage, right. We're going to be completely out of ammo altogether or it's going to continue to keep prices really high. The one thing I wanted to get out there, and I don't take anything away from this, By the way. Supposedly, this is an attack on your Second Amendment rights. There's not trying to deprive American gun owners of ammo, according to Biden administration, This is a sanction. Because Putin apparently tried to poison some rivals some dissident of a year ago, Yeah, some political opponents, So we're putting sanctions on Russian and then doing so we're going to my limits. Yeah, Russian and what they actually did, just and I don't mean to, uh, take any criticism away from the Biden administration, but what they actually did, as they said, for those US companies that have import licenses. To bring certain Russian firearms and and all Russian ammo into the U. S. They're simply going to deny all future applications for those import licences, and they're not going to renew any current licenses. So eventually we'll see a big effect on the U. S animal market. But it's not something. It's not like a total ban where you can't go to your store and buy it tomorrow. Just asking for a friend here. Could the Biden administration possibly be as tough with the Taliban as they are with the Russian ammunition people because the Tampa bands got our choppers and our tanks and our guns, our planes, tons of our ammo, and he's just fine with that. But boy, let a little Russian trade come in here, and that's where we really got to be. Johnny. Tough Go. Yeah, There's been a lot of discussion on that on the gun related social media pages, the different forums and Facebook pages and whatnot. For instance, if the if the If the right if the barrel on my rifle is at quarter inch too short. And I haven't registered registered it with the with the A T F through the National Firearms Act. I'm going to jail for 10 years, right? And at the same time you get on social media. A bunch of Taliban guys are riding around in our Humvees carrying us Firearms and M four's with $1500 a cock sites on him. I mean, I'm watching news sites and as a gun guy, I'm watching these news reports going That guy right? There has about $4000 of us dollars U. S armament in his hand. It's our tax Taliban guy and I paid for that right now, because I know what those weapons are. I I can identify him on sight and I'm watching the news and I want to jump through the television screen and strangle somebody because it is incredibly frustrating, and there's just small arms. Who knows that apparently, they've got drones and artillery pieces, armored vehicles. I mean, it is incredibly frustrated by the way. The Russian gas pipeline totally fine with Biden has no problem with the Russian gas pipeline. However, the first day in office signed an executive order shutting down the Keystone pipeline, eliminating tens of thousands of jobs, but no more Russian and some ammunition. No more rushing at him. You guys are fine with the pipeline. No sanctions there, But, um, we don't want you and thanks, Mr President on that pipeline. I put gas in my car this morning. And yeah, I've got to put, uh high octane gas in my car. But it was 3 90. Oh, 90 today, and I That was that was not a happy site. "Hey, I'm Nigel Jason hammers here. The gun guy Guy referred to a attorney and licensed firearms instructor and hosted the gun guy show here on 93. W. ABC joining us in studio. I'm so glad that nobody was hurt over the weekend. The 100 shots fired overnight. Early Sunday morning there, South Meridian between Georgia and Louisiana. My question is how How is it possible? And this is what kind of makes me think It's like the Wild West. A couple punks were just firing off their weapons, a bunch trying to cause havoc. But that may maybe not trying to kill anybody. I have no idea. It's just speculation. Hi. How do you fire off 100 rounds and not hit anybody or kill anybody? Yeah, I mean, it's happenstance that no bystanders were hurt. You guys mentioned the family in the hotel room where they have you know your bullet coming through the window. But in terms of of people that are actually engaged in a gunfight, it's really not that surprising. And here's why, Because In an environment like that, especially, you got people, probably with little to no training. Then they see a gun or that first shot gets fired. What do they do, and they're running in one direction and shooting back over their shoulder or sticking the gun out behind him As they're running away. They're hiding behind the car and just spraying shots over the you know the top of the the hood of the car or the trunk of the car. They're doing any number of things that don't involve, you know, taking a good stance and with a good grip and using your sites. And having trigger control and all those things that allow you to shoot a gun accurately. They're doing everything wrong, including what is very common, which is run in one direction and shooting back a different direction. But, you know, even with trained individuals, a lot of times you read about police action shooting. I mean, you'll hear things like, you know, 47 shots fired. Suspect was hit three times and you go where the other 40. 43 44 shots. Yeah, and and And that's because in a high stress environment, accuracy to a very large degree goes out the window and we talked a lot about that exact phenomenon, even in the classes that I teach because you want to get his absolutely accurate as you can, because when stress goes up or your life's on the line that accuracy is the first thing to suffer. Thank God. These guys were neither of those. Oh, yeah. Just jagga loons that were firing off and I don't know what the situation was. It was a gang thing, but I'm just glad nobody was hurt. Yeah, it was a lot of lot, isn't it? 100 rounds? Oh, it's a ton. I mean, it's a whole bunch that tells you how many shooters were involved. I mean, you know, even you know, the handguns the whole lot. Obama with the Glock 17 9 millimeter that holds 18 rounds, including one of the pipe. Um, So one guy has 18 rounds. Okay, There's 18. They're still whole bunch more rounds to be accounted for. Um, so it tells you the number of people involved and also, it takes some amount of time obviously depends to some degree on how many people were involved. But it takes some amount of time and in my thought was and I don't want a dog. I m p d. But my first thought was man. This is in the 200 block of South Meridian. How did 200 shots get fired and nobody get caught. You know, I mean, nobody get hit is one question. Second question is nobody get caught. Um, you know, and again. I'm not dogging anybody. I don't know what the police presence there was that evening, but, yeah, it's great that there was quick response. But man, 100 shots get fired, and nobody's seen running from the scene or nobody's seeing shooting those last dozen shots, so I'm not sure I understand that phenomenon, either. Monday, Gun day with the gun guy Guy Relford in studio with us. You filled in for Nigel a day last week, And it just happened to be the day where Joe Biden and Merrick Garland rolled out their crime plan You've had about a week to kind of sit back and review it all. What was your takeaway from that? Well, I'm a lot of it was, uh, let's just enforce existing law. You know, we're gonna have a crackdown on these rogue gun dealers. These federal firearms licenses that are selling guns illegally. They're selling guns knowingly to prohibited possessors. Well, that's been against the law since 1968 you know, it's been specifically against the Brady bill that requires background checks since 1994 so oh, we're suddenly going to start enforcing existing law. We're going to crack down on people attempting to buy guns illegally. Really Well, gosh, Mr President, your son lied on the A T F for 44 73 when he said he was not addicted to any illegal drugs when he went on a book tour in specifically admitted that he was at precisely that time. So why don't we? Why are we leading by example? There, Mr President, But even more than that, I'll tell you what really struck me and I talked quite a bit. This about this on my show on Saturday is his comments about the Second Amendment. We're so incredibly repugnant to me. I mean, yeah, he said. Some things were just flat wrong, he said From the time of the Second Amendment was written, restricted. What people? Um and what kind of fire who could own a gun and what kind of firearms you can own. You couldn't buy a cannon. All that's fundamentally wrong. The Second Amendment limits one thing, and that's the government contains no restrictions whatsoever on individuals. And, yes, In fact, in 17 91. When the Second Amendment was ratified you most certainly could buy a cannon and almost all the militias made up of the common man, in fact, had Canon. You had merchant ships out there that were privately owned that are well equipped with cannons. So I mean, it's laughable that we're talking about that. But he was the one that brought it. Absolutely, I mean, and so you know, he's just wrong on that. But the other thing Is his comment about you know, that's gotten a lot of ridicule as it should his comment about. Well, if you take on the government, you need f fifteens and maybe some nuclear weapons. What was completely repugnant to me is that was in the context of him talking about a so called assault weapon ban, right. So he's saying, you know, you people think you need your rifles to take on the government? Well, it's futile. What he's saying there. But he's saying there's directly uh, directly inconsistent with with the principles behind the founding of this country is that you have no ability, it is futile. For you to stand up to tyranny, because that's why we have a second Amendment. That's why the word free is in the Second Amendment right, well regulated militia being necessary for the security of a free state, right? That's why in the declaration of Independence, Thomas Jefferson wrote the government. Our governments are instituted among men deriving their just powers from the consent of the governed, meaning when the government no longer consent. Then they can replace those those government. That's exactly what the declaration of independence did and what it says for him to say. It's futile. We can impose whatever tyranny we want on you. And there's nothing you can do about it. That tells me he fundamentally misunderstands the basic precepts behind the founding of this country. Now to be fair, the declaration of Independence has never really been the strong student Joe Biden. That's exactly you know the thing. Yeah. Would you hearing butcher that the other Jefferson quote, though? Yeah, the tree of Liberty must be refreshed from time to time with the blood of Patriots. Environments. That was another. You know the thing moment that was just as cringeworthy as the original. You know the thing.

"Gun ownership. This is the gun guy with guy Relford 93. W i P c in day by. Damn! Welcome back to the last segment. The gun guy show here on 93. W I B. C so What was at least an ambush on a police officer. And may have been a mass shooting unfolded. We don't know. And I hope Authorities released more details. But first of all, we have someone who unquestionably was a hero based on every single report I've seen On this shooting Johnny Hurley, who ran to the gunshot. Now, first of all, Generally speaking is that legal? And is it a good idea? Two very separate questions. And here's these are issues. I'll give you just a very little tiny snippet of what we talked about in my gun world class. First of all, we'll apply Indiana law here. I'm not a Colorado attorney, and don't Presumed didn't know exactly how the law of self defense or third Party defense works in Colorado so well upon the Indiana War. I've been practicing for 38 years. And so, yeah, you can defend a third person. From serious bodily injury or the commission of a forcible family. With deadly force. You have to know that person. No. Could be a total stranger. Yes. So if you hear gunshots and you see a police officer being ambushed Can you run to the assistance of that Police officer and in fact used deadly force in the process. The answer is yes. Now the point that I always make, I'll guarantee you. There are hopefully several 1000 people sitting out there right now. They have taken my gun law class. They're going to nod at my next statement because they will have heard this before. Always tell people before you get involved in the situation. That you're not already involved in Before you want to put your hero cape it on and run into a situation. Be very, very, very sure that what you think you're seeing is what you're really saying. In other words. Who's really the good guy here, and he's really the bad guy here. Now, if the police officers in a uniform sitting in a marked police officer in a marked police car, I should say getting shot. That's a pretty Apparent situation. Beyond that, it's not generally that clear cut and I've talked about this to some degree here on the show before. But all right, you You're absolutely sure that what you're What you think you're seeing is what you're really saying. So you runnin Can you defend someone else? Yes. Is it smart to do so? And any potential shooting, especially in public. What I've talked about for years and years and years. And we're past the time to take calls on the show. Otherwise, I'd invite people who have taken my class to call me because I guarantee you they would confirm this. I always say you have to understand that the responding police officers are not going to be able to tell in an instant Who's the good guy? Who's the bad guy? You're dressed as a civilian. You've got a gun. We go back to that hypothetical I mentioned before the break. I'm in front of my stepdaughter school. I just dropped her off at school. She walks in the school before I pull away. I hear multiple shots and screams. And people have asked me guy would you run in the door? Have to run in that door. If I make that decision with two reality's squarely in mind one I'm committing a felony. There is no exception. In Indiana for possession of a gun. On school property outside your vehicle there. Exceptions for being in your view. Just because there's a shooting going on. There's not an exception up. Would you get prosecuted? If you Save some lives as a separate question, But you're violating the law, but more importantly and more impactful. I tell people. I've told this to everyone who's taken my class. Said. You have to run in there with the expectation when police arrive. You're probably going to get shot. Why? Because all the police are going to get isn't 911 call and panicked witnesses and victims. Screaming into the phone about a shooter in a school. And when they show up and see someone with a gun. What's the likelihood that you get shot incredibly high? Incredibly high is that the fall of the police officers know they're jacked up on adrenaline. They're running towards danger. In this situation, one of their own is dead or dying. Having just been shot. I felt the police officers, not one bit. And I really wish people out, commenting on social media would have a little more awareness of what those situations really Like So can you defend another person? Yes. Should you? Hey, That's where your personal decision making comes in. If it's a public shooting, you draw your gun on. You have to understand the risks involved. Doesn't mean you shouldn't defended an innocent life may be your last dying thought, having been shot by responding police officers would be. Hey, I'm dying a noble death. I'm just fine with all of this, but you need to do that with your eyes Open. And again I'm not suggesting that we don't protect innocent life. One of the reasons a lot of us carry are gone. But you have to have that expectation of that understanding. And I in this situation gets to me. It impacts me emotionally because it could, but for the grace of God have been any of us, but that does it for this week's show. We hope you enjoyed it. We hope you come back next week. "The special prosecutor Rosemary Curry, Had cleared him. Yet Now we see that Officer Mercer is suing the NFL. What I'm referring to as defamation because of how they handled the situation. Guy Relford joins us Right now. We know a guy Relford because he is a radio host here at W I B. C. The gun guy show we know he's a Second Amendment attorney. But now he is one of the lead lawyers on this case four officer Mercer against the NFL. Let's start with the basics. What is the case you're bringing against the National Football League? Well, you nailed it, Tony and saying that it's a case for defamation. In this case, really, exactly As you said, the NFL came out with this campaign to in their words on her victims of police misconduct. And systemic racism, and they included Dre. Sean Read as one of those quote unquote victims. Um which, by definition, paints heroic police officer Did your Mercer As someone who committed that act of police misconduct and be engaged in systemic racism. That's ludicrous. Uh, did yours is a black man. He's a hero. By definition. This situation involved no police misconduct and involve no racism. Yet the NFL painted him in that light, and they did so. The timing here is very important. They did so after having the information available, but in a very thorough investigation by the Indiana State police, not MPD, who employees Officer Mercer but by the Indiana State police and then having the involvement of a special prosecutor in a very detailed report, and you saw that press release and commented on it off and Tony and you saw how detailed it was and how they went Through slow motion video, and they established the shots were fired by Dre. Sean reads at Dodger, Mercer and other officers so that the shooting was absolutely justified. How with that information in the public domain with that information being available? How do you include dry Sean Read as a victim of police misconduct? If you're that police officer That has a devastating effect on your life as it did here to Officer Mercer. That's why I'm proud to be a member of the team that's representing him. So this lawsuit Is actually against something called the N F L E. National Football League Enterprises, which is more of the, uh, the umbrella that handles the social media side of this, I was reading the complaint. That that you've put out is the Is this a distinction without a difference? Yeah, it's just a subsidiary. It's an affiliate. It's just part of NFL, but you're right. They created and disseminated this campaign and it was. You know, we saw videos on television. You saw Social media campaign. You couldn't get away from it there for several weeks. It's all over the place. So all those millions of people seeing that campaign are going Oh, well. Drayson reads a victim of police misconduct and and systemic racism. Obviously, that officer not committed. Those misdeeds. That's exactly what the lawsuits all about. Now you can also take a look at this story at wnbc dot com. You spoke with Hammer Nigel Yesterday I have the story up at red state dot com and we were both in the post that was done by the newsroom in my post over at red state dot com. We were both able to find the tweet. From the NFL, which is still up. That says, say, his name Dre. Sean read part of what the complaint says. And and I want to make sure we're clear about where you are in this. What? Maybe it's an accusation. Maybe it's not. Maybe I'm characterizing it wrong. You make the argument in the complaint guy that the Indianapolis Colts knew this wasn't the right information. And they did not act to stop this information from going out. Does this involve the cult malfeasance on the part of the Colts? As you see it? No, I really don't think so. I think the reference to the Colts is more that, um there was one player who was going to wear a sticker on his helmet with rations read reached name on it, and the Colts actually looked at the situation saw, um, that officer Mercer had been exonerated completely after a thorough investigation and said, no, this is not going to happen. I don't know that we can really make the allegation that the colt is one team. One member of the NFL had the ability to affect his campaign. I don't know that that would be fair to the Colts. So really, it's focused on the NFL. I think to some degree the colds and I think owner Jimmy Irsay was involved in this based on a tweet that he put out We said no, we're not going to. We're not going to put that sticker on this. This player's helmet. I think that was the right move. And if the Colts had that information and made that decision based on that same information that is the results of the investigation and the conclusions of the special prosecutor. What is the possible justification for not only the NFL continuing with this campaign, but as you just said That tweet to still be up and still be available to the public. I think that's unforgivable. Talking to guy Ralph erred. You know him as the gun guy, one of the lead lawyers in this lawsuit filed by Officer John Mercer against, um the National Football League, so let's now get down to the nitty gritty What is it that officer Mercer wants out of this lawsuit? Well, there's there's no kind of specific monetary compensation asked for in the lawsuit, and and again I'm working with a team here. I, um I was thank you for mentioning that some states like Ohio require you to the driver to make we disclose during a traffic stop. He has Yes, a handgun in the car and watched him carry up. There's a case. I'm sure you're familiar with. I don't know what state it was in, but I did it with one of those states for that is the requirement for me just closure on a traffic stuff. It was the pastures, so I don't know the man's name of the state. But it was a young black man who we need, Lee told the officer that pulled him over your traffic stop. Officer. I have a handgun in the car. No license to carry. It was on the Internet. He has a fianc in the car with him. You're talking about Annie. Philando Castile was doing it Looked to me like from video is just going for his wallet. And this was outside video that the fiance didn't start. I think streaming until pretty much after he'd been shot if I remember that correctly, But anyway, that's what you're talking about. And you know what? That looked to me. A situation anywhere. The driver really did everything right, Um, in terms off, Um Of saying that he had a gun in the car way reporting that in Minnesota, I don't know if that's a legal requirement or not. I've not looked at that aspect of Minnesota law. But the only thing perhaps, is that when he sends that officer start to panic, don't pull it out. Don't pull it out. He appeared to continue reaching for his wallet. Thinking. Well, I'm gonna be safe of all if all I'm doing is just reaching for my wallet. If I hear an officer start to raise his voice like that, especially he's got a gun drawn. What I'm going to do no matter what I'm doing. I'm gonna stop doing it. And I'm not blaming Philando Castile for getting shot. Don't take me wrong. I think that the officer was clearly at fault. Whether that was merely negligent because he panicked or whether that was a crime. I'll leave it to others to decide who have seen much more evidence than I have. But I think the officer was at fault. But one thing that just as a learning experience and not to point blame at Mr Casteel at all, because I don't think he deserves that blame is why When I hear that Elevation and all that officers tone that gun comes out of the holster. Whatever it is I'm doing it caused him to pull his gun almost stop doing it, and I might go right back to 10 to on the steering wheel. And say, Officer What would you like me to do now? And you always have the option. By the way of saying, Would you like me? Get out of Would you like me to get out of the vehicle so you can reach in my pocket and grab my wallet? Because you know it again. I'm not making excuses for that officers. I think he clearly panicked. I think he made a bad decision that I don't think Mr Casteel in any way, shape or form deserve to get shot. But it is tough from a general perspective for an officer to know when you're reaching into your back pocket. For wallet. Well, Mom. Many of us carry a firearm. But the foreign at the 4 30 or five o'clock position on our belt, which is pretty damn close, too, right over the top of your back pocket, where a right handed person often carries their wallet. So how does that officer know what you're reaching for? And they gotta wait until either the wallet with gun comes from out behind the person before they make a decision on whether to defend themselves. Well, this officer made the wrong decision. Nothing was ever any evidence that Philando Castile was reaching actually, for a gun as opposed to his wallet, But again to finish that point. If I hear that officers start to raises his voice, and you could hear it in the video that I saw, you know, don't pull it out. Don't pull it out. I'm not going to continue reaching for my wallet. I'm thinking I'm gonna be just fine when that officer appears to be panicking already. I'm coming back to 10 and two and waiting for directions. And if my rights are violated, Hey, I'll talk to a lawyer and I'll decide what to do about it later, But my goal at that point is to get on down the road. A soon as possible, and preferably without getting shot. I'll tell you what were the three quarter hour will come back or friend Kelly from Avon has called in. The police officer walks up to me and say, Excuse me, sir. Like to ask you some questions about your firearm. At that point, I can say Well, sure, Officer. What would you like to know? You want to see my license to carry here It is. I can do that if I want. That's essentially a waiver of my Fourth Amendment rights. What I can also now do under the pin Her decision. And many Departments. Law enforcement agencies around the state have have acted this way anyway. Others have it, but what I can also do is say No, officer. "What some people have been doing for quite some time. And earlier caller mentioned 2000 and 13 is when these really came on the scene. I don't remember that day. I remember some of the subsequent Determinations by a T F. But when a T F has said in the past in response to particular enquiries to the technology branch of a T F And that's what we we call it. It's the firearms. On day Ammunition Technology advisory division at a T F and they're often ask questions are asked for a determination as to a particular fire. And there have been manufacturers these pistols, stabilizer braces, if you if you're real familiar, they are, as you know what they are is an awful lot of people around him. I would dare to say millions of people across the country. If you're not familiar with that term, that here is where this comes from. A short barreled rifle to be regulated as a short barreled rifle under the NFL, which again it's important Is it considered jek 2 to 10 years in federal prison if you possess one If I just take my Regular a R 15 that I have that with a 16.5 inch barrel and I cut it down to a 14 inch barrel. Yeah. And and that's it. I don't well, duh of Flash suppressor and all on it or anything, I just leave. It is a 14 inch barrel. I now subjected myself to 10 years in federal prison. If I haven't registered that under the NFL, it's a big deal. But to be a short barreled rifle. It has to first be a rifle. Be regulated as a short barreled rifle under the N F A. It has to first be a rifle. What's a rifle? Among other things, it's a firearm designed to be fired from the shoulder. Shotgun in order to be a short barreled shotgun. It first has to be a shotgun to be regulated as a short barreled shotgun into the N F A. What's a shotgun? Among other things, it's a firearm designed to be fired from the shoulder. So if a firearm does not meet the definition of a shotgun or a rifle because it's not designed to be fired from the shoulder. Looking Essentially avoid regulation under the NFL. Okay for rifles. Folks have owned legally for years and years and years. A our pistols and a K Pistols in particular is not limited to that. There are several other pistols out there. I have a sig MPX that until I got my form, one approved to make it as short barreled rifle. It was a pistol. Regaling. By the way, they had a brace on it. I don't even own that brace anymore Case 80 efficient, sir listening, but it was a pistol. Why was it a pistol because it was designed to be fired with one hand as opposed to from the shoulder. The question then became. If someone puts on one of these devices, something called a pistol stabilizer brace and what this is something that extends back from the receiver of the firearm. And typically, they have sort of a cupping device that can fit around your forearm and then often there's a veil coat, Velcro and strap. That can wrap around your forearm and what it does is it provides stability to help someone, for instance, and this is where the original Ah lot of the original motivation toe determine whether these were legal or not, is a lot of disabled veterans who may have lost an arm wanted to be able to shoot there A R pistol but have more stability with only having one arm. We're not And so these devices the strap around your forearm allowed you to stabilize that pistol. The question became then because you can also take that same brace and put it against your shoulder and use it as a shoulder stock. In that cup, part of it. That's that you could typically wrap around your forearm. Instead, you could put against your shoulder and use it as a stock. Did the addition of a pistol stabilizer brace. Make something Firearm designed to be fired from the shoulder and therefore are short barreled rifle were short girl shot. That's where l came from. So it first. A couple these manufacturers sent them in were sent firearms equipped with them into the technology branch of the A. T F and said, What do you say? They came back and said, No. These air what they what they claim to be there a pistol pistol stabilizer brace. They don't make it. The firearm designed to be fired from the shoulder. So you're not looking at 10 years in federal prison if you have one on your air pistol, or you're a cape ist or whatever pistol we're talking about, Okay? Then someone asked the second question, which is well, okay. If it's not a rifle or a shotgun just because I put one of these braces on what if I actually use it like a pistol brace by putting a gun against my shoulder? And The A T F. Me to separate rulings on that first they said. Oh, well, if you put it against your shoulder Then now you've intentionally changed the design, and it's now a short barrel rifle or shortbread, Shaka. A whole bunch of people went crazy over that and said, Whoa, Just the incidental use against your shoulder suddenly changes the design. How does that work when they came on out? Never mind. It's his 2017 said. No, you can, incidentally, put your pistol stabilizer brace against your shoulder and doesn't convert it to a rifle. In the case was shotgun didn't convert it to a shock. That doesn't change the design. Did you happen to use of that particular way since that time since 2017 in particular, and that since that determination letter came out from a T F whole bunch of people by him? A whole bunch of people say, for instance, why would I spend the 200 bucks and subject myself to registration under the N F A. If I could just use a brace. Especially when if I happen to put it against my shoulder, I'm not breaking the law according to the A. T F, so they've gotten really, really, really popular. And people rely on this 2017 determination from a T F to say there you go. You said one. It doesn't make it a short barrel rifle just by putting it on and I could even put it against my shoulder and it doesn't change the design of the firearm. What came out of the A T F yesterday. Days of siege went on, and eventually he was walked off the mountain and not killed And it was interesting cause there was civil litigation against Um, the federal law enforcement involved. He ultimately was only convicted of the original weapons charge. Not anything else. He was charged with murder. Based on the federal agents, agents being killed there on the mountain, acquitted of all of that and got 18 months in jail on the original weapons charge, Uhm notwithstanding what I think which should have been a pretty good Uh, argument that That he was conned into violating the law and then trapped for that reason. But it all goes to show how some of these silly and they are silly. Regulations under in a fake and be used to put people in jail if the government wants to put in jail, and that's not having my tinfoil hat on, folks. It's just not, um it's a simple truth of things because the N F A has gotten so convoluted. I'm going to go through the particulars of this later in the show that it makes no sense. And what they want to make illegal under this current discussion of pistol braces. If you go back to your original intent of the NFL, they said, Well, these these monsters, she's mafiosos could have these ultra dangerous weapons that they can make smaller by chopping down the barrels or making them concealable. That was the big concern. There was a category of benefit regulated firearms. They couldn't describe any other way. So they just called them any other weapons And essentially those air weapons designed to be concealed on the body. Well, now they've gotten this so back ass words. That the less concealable it is, the more likely they're going to send you to jail for it. With this new guidance they're offering us on stabilizer braces, the complete opposite of the intent of the NFL, and I'll explain all of that. We come back right now.
