Well, I mean, we see that Soros funded Manhattan DA Alvin Bragg seems like he's pretty determined to bring these political charges against president Trump and indict him on his bogus legal theory, trumped up charges on a bogus legal theory. They, you know, I don't know if he's pausing or backing down or what, because it seems like there were hearing word that the indictment could be pushed back to next week, but you still have the Bragg's office coordinating with the Secret Service, other federal and state and local law enforcement agencies. They have the security fence around the Manhattan courthouse. So it looks like it's full steam ahead for Alvin Bragg, mission accomplished for him politically. He's campaigns on the fact that he wants to take out Trump. If you look at his Twitter, both his Manhattan DA office and his personal Twitter feeds, he has penned tweets showing his Trump arrangements. And so this is going to backfire spectacularly on the Democrats. This is waking people up. Well, so let me ask you, what do you mean by backfire? I mean, because I have a ton of respect for you, Mike, but I'm not sure that's true. I mean, the Mar-a-Lago raid didn't wake anybody up. Well, I mean, at the Mar-a-Lago ray, Trump's poll numbers went up by 11 points, but the midterms were hardly a resounding success. Well, I understand that, but if you look at what they're going to do is unify the Republican Party around president Trump, they're going to do the impossible, which is to agree with that. Yeah, in the primary. I'm just not sure if regular I think I'm not sure if it's going to have this. I've been waiting for the boomerang for years when I'm getting that, right? And I don't mean to be cynical, but I see no evidence that any of this stuff actually backfires. It just seems as if we become less free. I mean, Gretchen Whitmer won reelection in Michigan by 8 points and she was cruel to her people.

"Is this going to backfire? That is the opening question. I want to ask you, I'm hearing that for quite some time. And I think people mean well when they say that, but for the last couple of years, ever since Biden was implemented as president of the United States, I have been hearing well, Charlie, this is going to backfire. The trillions dollars of spending, this will backfire the open border. That is going to backfire. The environmental fanaticism, this is going to backfire. The rating on Mar-a-Lago, this is going to backfire. The spying on moms and dads, school boards, that's going to backfire. And I wonder, has it will it? Now, I'm not trying to be too cynical. I'm not trying to discount this too much. But I do wonder, why is it that we immediately gravitate towards that talking point? For a while we've been hearing, well, this is the year of the boomerang, things are going to come around back to normal. And I think it's very tempting to say that because you want to believe the American people are always going to course correct. And we've seen some evidence of it. We've seen lightfoot removed. We've seen the district attorney of San Francisco removed, but generally, where was the backfire against the COVID lockdowns? Who was held accountable politically for that was Gretchen Whitmer, held accountable for locking down her state, was JB pritzker, held accountable for locking down Illinois, was Gavin Newsom, held accountable. The answer is sadly, no. And that's not to say that people can never be held accountable, and there is not an equal and opposite reaction bubbling up. But what I am saying is we have to resist the talking point that just because something unjust happens, there will be a guarantee of a political backlash.

The man who allegedly broke into House speaker Nancy Pelosi's home in October and beat her husband pleaded not guilty to 6 charges, including prosecutors say, attempted murder. David to pap had planned to kidnap the speaker who was in Washington at the time of the attack when he broke into the couple's San Francisco home. Instead, the 42 year old defendant severely beat 82 year old Paul Pelosi with a hammer. If pap is still being held without bail, his state case returns to court in the middle of February. A group of FTX trading customers is suing the bankrupt cryptocurrency exchange, alleging that its top executives stole their digital assets and purposely blocked them from making withdrawals. Those suing sandbank and fried and FTX say in court documents that they stored cash and digital assets on FTX platform, but have not been able to complete a withdrawal since early November, attorney Andrew and whistle is representing those suing the company who are from the U.S. and overseas. The race for governor in Michigan has tightened in recent days, and MSNBC anchor and economics correspondent Ali velshi has been on the ground in that battleground state, speaking to voters about the economy. Hi, Ali. Hello, so lost nice to talk to you. You too, so let's get straight to your reporting. Let's start with a person that you met who is a black Republican strategist named Wayne Bradley. Let's take a listen. That's what's most important right now. Can I get a job? Can I pay for my home? Can I pay my rent? So the midterm election is now less than two weeks away. How heavily is the economy weighing on the minds of voters? Well, you know, for context, the economy generally is the biggest issue that people talk about in a normal time. And now with inflation, the way it is, it's definitely polling as the number one issue in Michigan by a long shot, about a third of all voters say it's the most important issue. The competing matter in Michigan is unlike the rest of America where we often say in the news that the matter of abortion rights is on the ballot, it really is in Michigan. Michigan is one of three states where there's an affirmative abortion question on the ballot. So there are a number of people motivated to go out and vote who are specifically registering to go out and vote otherwise may not have been involved in midterms because of abortion, but it's not, it's not competing with the economy as the number one issue right now, whether you ask Republicans or Democrats. Well, then let's talk a little bit about abortion. You spoke with Democrat Kelly delahaye, who is an abortion rights advocate, and she says concerns about abortion access are a driving factor in the selection. People want to know that they have reproductive rights and that they have access to healthcare when they need it. So this issue came up during the debate last night between the incumbent Democrat Gretchen Whitmer, who's up in the race for governor against Republican Tudor Dixon, do you think that's you say it's not more motivating for voters than the economy, but it's possible it will get a turnout from people who may not otherwise vote, right? Yeah, actually, I think that's the right way to think about it. When polled to say what is the most important issue to you, the economy is outranking abortion rights. But when thinking about whether it will actually motivate people to either register or go out and vote, abortion may actually top that. One of the points that Kelly made, she was sitting next to Wayne when I was interviewing them and Wayne had said, abortion, it's a luxury to be thinking about abortion as your number one issue. It means you're not worried about economic stuff. And Kelly made the point that for a lot of women who have an unplanned pregnancy, abortion is entirely an economic issue because you could end up with a child who didn't plan to have. And many hundreds of thousands of dollars over the course of your life and expenses. So they had a good back and forth about that. It's notable that Gretchen Whitmer is not running as far ahead of her opponent who does not support abortion except in the case of the danger to the life of the mother. That's an issue that that race is now within the margin of error. So all the top three races in Michigan are now closing in. They're tighter and tighter. And again, it's got to do abortion seems to have more to do with it than the economic issue as far as the politics of the debates are going right now. So we got about 30 seconds left here, Allie. Michigan is always a battleground state. Do you think the voters there and what they're worried about is representative of the broader populace? I think it is. I think in certain states, some issues are bigger in Pennsylvania and Arizona and Michigan. The issue of voter fraud is motivating because a number of the Republican candidates who are running do not accept the results of the 2020 election. That's about half of the people who were eligible under this student loan forgiveness program. And that money could have started going out as soon as this week. But because of that temporary order from the federal appeals appeals court, the administration can not start paying down any of those balances. "Brian shook You're listening to Bloomberg law with June Grasso from Bloomberg radio I've been talking to former U.S. attorney Matthew Schneider of honigman about the trial of four men accused of conspiring to kidnap Michigan governor Gretchen Whitmer So the defense raised the defense of entrapment They said that the FBI tricked the defendants into agreeing to the plot to kidnap whitner and the FBI drove the whole thing So tell us about that defense So what we know so far is that the defense originally in the opening statements didn't really touch this entrapment They just kind of nibbled around the edges At some point in the openings it became clear that that's really what they were talking about And then entrapment defense is saying essentially I'm not the one who came up with this idea I'm not the one who really wanted to do this And but for the government I wouldn't have done this I wouldn't have tried to put this plan into place except for the government goading me on And some of these defendants have said that they really had no experience in tactical training and using weapons but Dan this undercover FBI informant is the one who trained them And he's the one who encouraged them So that's the entrapment defense And the government of course and is going to use the jury instruction for entrapment And there is signs in there that the government can point to to say that you weren't entrapped And that's really based on the fact that the defendants were what they call predisposed to commit the crime That means they already had this thought in their mind before the government introduced the undercover agents And under the law if you have that predisposition then entrapment is not a valid defense Is it a high risk strategy to defend based on entrapment because you're conceding that some crimes may have been committed It is because it's an informative defense where you have to admit to certain things but say similar to self defense say I did this however Now it's important to note that as this trial has played out it's not as clear cut as the government has thought in my opinion because entrapment is not the only defense There is a separate defense that is being laid out by at least one of the defendants to say that this is all really big talk We did not intend this but we talked really big And we came up with some wild ideas and the defense is going to explain the fact that we talked about what are some ways we could go and take out governor Whitmer Well one way is we could all sneak over to our House and we could hide in the Woods and we could bark like animals and then she would come out because she cares about animals Another thing that they talked about was well we could cut all the trees down between Indiana and Michigan because that would create a stir and would prevent people from getting into the state Or we could tie a kite to the governor and fly over Lake Michigan Now that's all nonsense right That's not going to work and the defense in this case is look they said all these things when they were drunk and when they were stoned Another thing that they said was we're going to kidnap her And so all of this is in one big pot we didn't mean it And it's all just a bunch of big talk And therefore their strategy is where big talkers we didn't mean it We couldn't actually accomplish this and you should find us not guilty The fact that there are four defendants here are their defenses united you said that one of the defense attorneys brought up this crazy talk So how does it play that there are four of them So there's four defendants in each of them gets an opportunity to speak as questions give their opening statements That's how the openings played out Now let's see what happens in the closings right Are they all going to latch onto that defense Will they all be in the entrapment defense that we know All four of them have already said we'll plead and trap them But will they all argue these other kind of stone crazy delusions and that's why we did it Well they argue that that really remains to be seen And we won't know for weeks because this trial will probably take at least four to 6 weeks to get through But will the jury distinguish one defendant from the other for something like if they're sitting there and this wild talk a plan to put a kite on Whitmer or whatever Will the jury really distinguish one from the other or will the defense is sort of bleed into one another So normally juries do take the time and effort to go one by one through each descendant and find this defendant with these elements either dead or did not commit this crime And there will be plenty of time for jury deliberations to do that Sometimes people fear that if you're if you're in a group of people who are committing crimes then there's guilt by association I have found in my experience that jurors are quite smart They're quite intelligent and they're able to parse out who did what and who did not do what So I think we'll be able to see a jury that is able to do that Let's talk about some of the witnesses to insiders who turn states evidence seem to be important for the government That's true So there are two defendants who were charged in this case but they've pleaded guilty And now they're cooperating for the government And they've committed crimes and they are going to admit that and explain what happened And the government's theory on this is that the best way to know what happens in a secret conspiracy is to actually get one of the members of the conspiracy to come out and explain what happened And these people were insiders who can say I was in that room I was part of those conversations I know what happened and here's what actually took place The defense on these types of cases is always the same You're a liar And the reason why you're testifying is for one reason and that's because you've been convicted of a crime and if you testify and you give the government what they want then they will give you a break and they will cut your sentence and they will reduce the amount of time that you have to spend in prison If you even go to prison And so the defense will.
