George Floyd the the protests have been a catalyst for conversations about race police reform and even of the Democrats our house is is good too considering some sort of federal reform that we're just reading about that look this past weekend with us to discuss these issues is Dan Herbert Dan is an attorney who handled what is probably the highest profile police shooting case in history up to this point of the defense of Jason Van **** in the shooting of laquan McDonald Dan is a former decorated police officer cook county prosecutor in in house attorney for the fraternal order of police is now with his own law firm Herbert law firm and represents police officers handle civil rights cases criminal defense and personal injury hi Dan welcome to the show hi Karen how are you good good it's nice to hear you are I you know does this bring back sort of deja vu to this whole idea of this huge case and all of the protests and is does this kind of bring it back to you having represented dot Jason Van **** yeah absolutely yet especially when the protest started yeah you brought back a few memories said that you were uncomfortable feelings yeah well let's talk to some nuts and bolts here let's talk about choke holds in the holds as a police officer yourself did you ever use them and what is the training up until this point say about whether you should use them I never used chokeholds we were taught chokeholds and it would be the situation where you read after about a potential that you needed to essentially choke out momentarily to gain control of this individual thanks to my knowledge they they've done away with choke holds on in Chicago most police departments but it's important to clarify with respect to choke holds it was so cold when you're ready and if it's all that was on top and then causing a danger so you know I'm gonna ask you this like right from the beginning here you are assigned to represent Derek Chauvin and and let's say you you obviously don't know all the facts yet we don't know all the facts yet we know there was an autopsy that said that that there are other things that contributed to his death there was a a new autopsy that the family had that says that the out to Disney hold was the it was probably V. about cause of death how do you defend a case like this how do you approach it as a lawyer like get into you know we want to get into your head to see how do you approach presenting this to a jury really I think the only possible argument you would have to look at the corners of death like you spoke of in game that would be an area that you know you would have to certainly hire an expert to review the autopsy and district if you were able to show that the cause of death was on something other than the six nation then obviously it wouldn't be a murder because of your actions so no other than than that of science I think it's going to be it would be difficult because it's it's really hard to justify the actions that occurred you know for so many reasons the fact that this individual scanned copy was he was laying hone down on the ground and it lasted for so long it's just it's it's hard to come up with a defense for those actions the officer being critical that he that he needed to do that would you be talking plea bargain at this point I I certainly would I mean I think that you know maybe the prosecution with respect to the chart for a second degree it might be somewhat difficult to prove I would suspect that come trial they they may choose to go in the third degree but yeah I don't think any plea bargains what we offer in this case what that writes up quite I think the prosecution would probably hold firm on that serious serious jail time explain briefly for our listeners the difference generally between a second degree in a third degree murder charge yeah in Minnesota it's the second degree is the is the unintentional killing up crystal but while committing another felony and third degree murder in Minnesota is is obviously an unintentional killing but it's it's done with the depraved heart is how they describe it which is I think you know what you think about care but I think it's kind of Hartford jury to understand exactly what constitutes for the crazy part but at a certain thickness reporter charge in this case would likely be a lay up the only issue I see with the second degree charge in this case is the prosecutors obviously would be required who are the commission of a felony and you know the first thought that comes to mind would be some type of kidnapped like a kidnapping or aggravated battery charge the kidnapping you know the stains from what I understand but certainly won't reason to detain the certificates will be in the aggravated battery may be difficult to prove because of the fact that Minnesota's police department's policy was bailout for movies chokeholds to take place you know the but certainly the prosecution they may concede that point they would have to I I would assume that they would say well it certainly at some point it became unreasonable and I don't think anyone could really argue with that hi I know I'm gonna ask you dear your you were a police officer you've defended police officers can you possibly get into this guy's head and and and give me some reason that he continued to exert that pressure on George Ford said what what could have been going on in his mind I'm not asking you to justify it or say that you're advocating that he should have done that because I don't think you're saying that at all you're saying the opposite but what is the police put put a police officer have been thinking the only thing that I could come up with is that this police officer had some type of sure of this individual in fear that if he were to to release the pressure that he would be put in a situation where he might be harmed and you know in that might have been a real hero and that officers bind but I don't think anyone can argue that it was a reasonable you know it ended the fact that there was can't put sorry it's such a big deal in this case when when people are not in the house you know there are any number of dangers that are that are and sometimes likely when somebody's in handcuffs each they can still cause damage but we were all officers there there's really just no way to explain still for this individual suffering from some type of you know with mental illness whether it be covered or something but you know these police officers they've done studies and nervous they are suffering from the effects of PTSD no very similar to military personnel that are compact but this one was just it's hard to come up with any plausible explanation yeah I hear a lot of people saying that we should charge him with first degree murder and that this is first degree what facts would have to be present in order for that kind of charge to be brought in maybe start by defining what the what the elements are of first degree murder generally speaking yes first available in Minnesota is is different than theirs in Illinois the world's kind of some one of the few states that that doesn't require the proof of premeditation or malice well I'm so jealous in Minnesota it would be hard for a prosecutor to that this officer despite hope reaches the actions word that that he and he intended to kill was individual in that he did that spring Medicaid obviously that would be very very difficult in that he acted with with malice with Illinois it's those doctors are not in the church instead they are affirmative defenses so the burden is really placed on the defendant to prove medication such as no malice no premeditation when we come back from a break in a little bit we're going to talk about the other three officers and and and some of the defenses there but what what what kind of work do you think is going to represent show and I mean this is you know we as lawyers represent people of all walks we represent people who are innocent we represent people who are guilty represent good people and bad people and we're dealt with the facts were dealt with and and we go in there and we do the best for our clients you did that with Jason Van **** hi my view you got a good result for him it in that it could've been worse and what what would what could a lawyer would be the case the lawyer to take this kind of case well you know we it would be a difficult case to take for a number of reasons but it is you know when the listeners know that that everyone is entitled to a certain sense and it's not shows are popular defensive units also for unpopular spinach and there's you know it is horrific instance this cases with this officer you know there are thousands of Moodle malicious crimes are committed by individuals and they are very conservative parents just as much as the officer here in Minnesota so I I think it would be a lawyer that would take this case based upon the recognition And I think it's almost humanly impossible to continue along those lines during the regular season. But it's just not there. And you notice it especially on the defensive end. And when you lose a Steph curry for eleven games when Draymond green doesn't play for fourteen games. They're going to suffer the consequences because the gap is narrowed. I played when I was a kid in high school, I played basketball and baseball in high school, but obviously not good enough to play at the next level. So I figured I gotta figure out a way to to somehow stay in it, and I went to Fordham university, which had a great college radio station. And that was really the start for me. Her Durant's phenomenal performance. Forty four points, thirteen rebounds, seven assists, helped the warriors to their first winning streak since November fifth back to Golden State.
