"To the takeaway. I'm tan Xena Vega. This summer, The Supreme Court sided with native groups and ruling that the United States must recognize the eastern half of Oklahoma as tribal territory. Now, around one quarter of the state's recent oil and gas wells are situated on tribal land, and that's left Oklahoma's oil and gas producers scrambling to respond to the decision. But last week, the industry was handed a much needed reprieve when the Environmental Protection Agency gave the state of Oklahoma more authority to regulate tribal lands tomorrow. What the decision will mean I'm going to talk to Rebecca Nagel, citizen of the Cherokee Nation, Journalists and host of the podcast this land, Rebecca, Thanks for joining me. Thank you so much for having me. So what exactly did the EPA administrator Andrew Wheeler decide in terms of giving Oklahoma the state of Oklahoma more authority over the environment and these lands in particular? Yeah, Eso toe understand what happened this week. We actually have to go all the way back to 2000 and five Esso in that year Senator from Oklahoma. Senator Inhofe attached a writer Teo a very long and mostly in the weeds. Transportation Bill. And it was just, you know, a couple sentences that gave the state of Oklahoma Regulatory authority over reservations within the states. If it's so asked for on DSO, this had not been enacted. It had sat dormant for 15 years, and then on July 9th, the Supreme Court ruled that Congress had never dis established the reservation of Miss Coe Creek Nation. And even though state of Oklahoma had not recognised that reservation for over a century, that it was still legally Indian land, and so you know, I think one thing. It's really, really important for a lot of folks to realize is that tribal jurisdiction including civil jurisdiction, which regulatory authority falls under is already extremely limited by the Supreme Court. And so a lot of the fears that we saw From oil and gas during this case were quite overblown. And also I just think dishonest, you know, during the court proceedings, oil and gas, you know we're sort of running around like chicken little saying. If Miss Gold Creek Nation wins, the sky's going to fall down, knowing full well the whole time that they had this writer In their back pocket, you know, and unfortunately Because we have a very pro oil state and a pro oil EPA. Trying to, you know, prevent non native corporations from polluting their lands. Prevent non native corporations from dumping toxic waste and from, you know, Mining uranium and things like that, and very, very often. Those corporations get away with it. Anyways, You know, Oklahoma is the site of one of the biggest Superfund sites right now that the A is still failing to adequately clean up, you know, here in northeastern Oklahoma on Coop, our lands there are chat piles of from lead and zinc mining that are so large. You can see them from Google Earth, you know, And this is what You know, it's mostly fell on the B I A. But there's a long history of even where tribal reservations and regulatory authority is recognized. Non native corporations getting away with behavior like that, and so This idea that that tribes having jurisdiction would cause chaos with wreak havoc is the same argument Oklahoma has been making throughout the many years history of this case. Now, around one quarter of the state's recent oil and gas wells are situated on tribal land, and that's left Oklahoma's oil and gas producers scrambling to respond to the decision. But last week, the industry was handed a much needed reprieve when the Environmental Protection Agency gave the state of Oklahoma more authority to regulate tribal lands tomorrow. What the decision will mean I'm going to talk to Rebecca Nagel. Citizen of the Cherokee Nation. Journalists and host of the podcast this land, Rebecca, Thanks for joining me. Thank you so much for having me. So what exactly did the EPA administrator Andrew Wheeler decide in terms of giving Oklahoma the state of Oklahoma more authority over the environment and these lands in particular? Yeah, Eso toe understand what happened this week. We actually have to go all the way back to 2000 and five Esso in that year Senator from Oklahoma Senator Inhofe. Attached a writer Teo a very long and mostly in the weeds, transportation bill, and it was just, you know, a couple sentences that gave the state of Oklahoma Regulatory authority over reservations within the states. If it's so asked for, um and so this had not been enacted, it had sat dormant for 15 years, and then on July 9th, the Supreme Court ruled that Congress had never dis established the reservation of Miss Coe Creek Nation. And even though state of Oklahoma had not recognised that reservation for over a century, that it was still legally Indian land, Um and so, you know. I think one thing. It's really, really important for a lot of folks to realize is that, um Tribal jurisdiction, including civil jurisdiction, which regulatory authority falls under is already extremely limited by the Supreme Court. And so a lot of the fears that we saw From oil and gas during this case were quite overblown. And also I just think dishonest, you know, during the court proceedings, oil and gas, you know we're sort of running around like chicken little saying. If Miss Gold Creek Nation wins, the sky's going to fall down, knowing full well the whole time that they had this writer In their back pocket, you know, and unfortunately Because we have a very pro oil state and a pro oil EPA. It didn't didn't take long for them to get enacted. Want to play a clip here from Oklahoma Governor Stitt, who first requested environmental control from the EPA back in July. I'm what tribes to be very successful, but not at the expense of non tribal businesses. I believe over the long haul. If we don't have a level playing field, we don't understand what the rules are. We will not have non tribal business is growing. In establishing and common expanding in eastern eastern Oklahoma. Rebecca. Why is Stitch or governor stood so concerned about Is there a non level playing field right now? And if there is, I would imagine it tilts in favor of non tribal business is not the other way around. Exactly Eso tribal jurisdiction is extremely complicated on reservations, but you To summarize tribes have very, very little regulatory authority over non native businesses because of a Siri's of court decisions that came out in the early eighties. And what we see happen over and over and over again, and Indian country is that this fear and I think we really have to call it overblown White panic and I think we also have to talk about it as being racist. Is this idea that tribal governments are inferior and would do Ah, worse job. Of regulatory having regulatory authority than the state of Oklahoma that has deregulated fracking to the point that now in Oklahoma, we have man made earthquake spray. Um, and within that, because of the way the Supreme Court has already limited tribal jurisdiction we see over and over again, You know, tribes, actually trying to, you know, prevent non native corporations from polluting their lands prevent non native corporations. From dumping toxic waste and from, you know, Mining uranium and things like that, and very, very often. Those corporations get away with it. Anyways. You know, Oklahoma is the site of one of the biggest Superfund sites right now that the EPA is still failing to adequately clean up, you know, here in northeastern Oklahoma on Cua par lands. There are chat piles of from lead and zinc mining that are so large you can see them from Google Earth, you know, And this is what You know, it's mostly fell on the B I A. But there's a long history of even where tribal reservations and regulatory authority is recognized. Non native corporations getting away with behavior like that, and so This idea that ah, that tribes having jurisdiction would cause chaos with wreak havoc is the same argument Oklahoma has been making throughout the many years history of this case. Um and time and time again. It's proven false. You know, they said the same thing about criminal jurisdiction that it would be, but I just want to. I want to jump in here just for a second, because we only have a minute left in this segment. I'm curious. Where does this what happens now? And we just got a minute. I think what we need to do is that Congress needs to fix that writer. So Congress has the authority to reverse what Inhofe snuck in in a very undemocratic process without the consultation or knowledge of tribes. Really? Anybody else from Oklahoma on DH? So you.

Mostly we've been seeing the increase is here in the urban areas like Oklahoma City, Tulsa, Loughton. But they're up in the rural areas, mostly because of the outbreaks in the jails. And most of those jails have been some of these jails out in the role areas of the of the state. So still keep it in perspective. There's still a 99.9% survivability rate 1% death rate. A lot of people contacting me because they're either looking at their sample ballot, which you can download from the Oklahoma County Election board, or they're getting their absentee ballot and the male They're going to fill it out and turn it back in and they're seeing their attention. Vote. That is on the ballot. It will vary a little depending on where you are, but for the most part, we're going to be voting to retain three Supreme Court justices, and it's an up or down vote. Do they get to keep their job or not? We're gonna be holding on three Court of criminal appeals judges. That's the high court for crimes. And they were going to voting on three Court of civil appeals. I haven't gone through court of criminal appeals cases yet, so I don't know. And I'm not going to go back because the last time we had a retention vote was two years ago. So I'm I'm not even gonna go back and I'm gonna go back four years. I'll go back to years and see if there's a big, meaty case and any of these dockets that's worth talking about. But right now, let's just start with the Supreme Court vote. Okay, You're going to get to vote on three Supreme Court pretensions. Supreme Court District one Matthew John Kane. Supreme Court District six Tom Colbert. Supreme Court District nine. Richard Darby. District One's John Kane. Was appointed just last year. By Kevin Stitt. Supreme Court District six Judge Tom Colbert. Was appointed in 2004 by Brad Henry. Supreme Court District nine. Richard Darby. Was appointed in 2018 by Mary Fallon. Now I've had listeners say, Well, I like to do it depends on the party of whatever governor appointed them is to if I'm going to vote up or down, and that's that's not a bad barometer. It's reasonable to assume that if it's a Democrat who who nominated the judge, the judge would lean left. And you also might want to look at how long they been on the court. That's another one. Exactly what he's been on the court 20 years. It's time for some fresh blood. But I try to go back to the rulings. And just today, I dug down deep into what the Supreme Court has ruled upon. Just in the last year. Now there's been a lot of cases and I'm not going to go into all of the Ritz and all of the things they've been asked to hear. I mean, there's a lot of legal Bravo Sierra that they've been asked to look into that nobody cares about and it'll affect nobody but lawyers. But one of the big, juicy cases that the Supreme Court ruled upon this past year Wass, the tribal gaming compact. Do you remember? About this time last year, Governor Stitt reached out to the tribe, saying, I think we need to re negotiate. The compact we have with gaming in Oklahoma. And the reason he wanted to do that is he had been talking to his fellow governors in Las Vegas and Louisiana and all these other where there are tribal gaming facilities, and the state is getting more money than Oklahoma is. So he wanted to re negotiate that well. The tribes came back and said Aah! Look at the compact. It says that both parties basically have to agree before there's going to be any negotiation, and they walked out. So the governor suit and said No, it's if one or the other wants to negotiate that. It happens well, it went to the Supreme Court and the Supreme Court said No. It's the tribe is correct. If one or the other does not want to negotiate than it doesn't negotiate. Basically, the tribes have right of refusal. Whether or not to re negotiate that contract. So how do you feel about that? You know, I I feel like It's a really bad deal for the state, and it shouldn't have been agreed upon in the first place. But that doesn't make the court's decision. A bad one. You see? So I'm I'm I'm the one that was probably the correct decision. It's not the courts fault and it's not Governor Stitz fault that it was a bad deal in the first place negotiated upon by Brad Henry. Was that Brad Henry? I think it was brand Henry. I'll do some checking on that. I may be incorrect on that so Another big, juicy case that the Supreme Court heard last year was a case called School District. 52 vs Janet Marie See This was a school district, mainly Midwest City del City. But there were other schools in it that demanded the state give them state funds because they heard other districts were getting more money. And they wanted that money to So they sued. And the Supreme Court ruled. You can get your money if it's found by an auditor, that you deserve your money. So what that tells me is is there are criteria of foot when it comes to handing out state funds that this district may not have met. And the court wasn't gonna rule on that because they weren't asked to rule on that. But what they did say was, let's get an audit. And then you can decide I don't. I didn't dig back in there and see what the audit or even if the audit's been finished, not or not, so There again. We've come across a big, juicy case that was important to the people, and it looks like the court made the right choice. They said. Let's audit and then we'll figure it out. And then finally, there's a case that you didn't hear a lot about. It's called Sparks versus Old Republic home protection. Old Republic. Home protection is one of these companies that offers a Home warranty. I said it like that, because I'm doing the air quote thing. And I'm not a big fan of home warranties. The reason I'm not is because none of them Are willing to replace what goes wrong with.

"Stephanie Vice is joining us. I think I can hear you beaming over the phone. Congratulations on last night's victory. Thank you so much built great this morning. I know. I know it does. And I know when you're in a situation like that, you got to be prepared for both. You got to be prepared for a disappointment. If it comes, you have to be prepared for a victory. If it comes and I was on pins and needles watching those results come in. That was a really close race, especially in the beginning there, and we were all on wheels that certainly I was thrilled with the margin of victory. The outcome, especially considering that the club for Growth Group Theory Journal, never Trumper organization. Been almost a million dollars total in the primary in this runoff election to try to defeat me and I just I want to thank Oklahomans for seeing through the rhetoric and the lives that they were spreading on DH, accusing the Republican nominee to take on her horn in November. Well, and I'm wondering it. Will they court you now with with this this new challenge, or are they just leave in town or what? Do you want to talk to him? I think they like the air leaving have a second, then I have no idea what their long term plan is. But certainly we have a lot of people that are interested in this race. As you probably know. This race has been deemed the top Republican take back opportunity in the country. Kendra Horn has been named the most vulnerable Democrats in the country, and so there are going to be a lot of outside forces that are going to want to play in this race on both sides of the aisle. So I think this is going to be a race that Oklahomans have never seen before. I think so is well And and Stephanie of Isis with us who won the runoff last night will go up against Kendra Horn. Let's talk about that for a moment. I mean, what? I don't I know you can't divide told some of your strategy. But what? What do you How do you plan to go after Kendra Horn in the seat? Well, I think there's you know, a couple of things first. Remember that Kendra won this feat by a very small margin in 2018 33 100 votes out of 240,000 CAF? And so we do expect high turnout for the general election in November because the president is on the ballot again. But it will be a all hands on deck effort to make sure that we Organize a grassroots game and ensure that we execute the plan that we will strategize and put in place Tio when this November 3rd election, and it is November 3rd, so there's not a lot of time to turn things around. I imagine you have to hit the ground running. Actually, yes. You know, we celebrated the victory last night and it is back to work today. Tio begin the game plan for our November 3rd win. That's the other disappointing thing about an election in this pandemic. Stephanie Bisou really couldn't have much of a party could use or watch party. Well, we did actually have a watch party. People were very I think, causes some more mass we had left. Was he insane Advisor, and we're trying to be thoughtful about it. But, you know, I think it's what's been difficulties. Really, You know, getting out engaging in the community. We have had the ability on great success with doing outdoor events. So we've had some Breakfast at various parts across vehicle City Metro area on DH That's been successful field probably see a lot more that we also then Facebook town halls, hyun calls And certainly Kevin presents a little bit of a challenge. But my team has been incredible and really finding ways to engage with better eyes and you'll see a lot more coming up. I imagine so. I didn't look at any of the demographics yet in last night's election, have you did you? Did you see some vulnerable parts of town that United might need to work on? You know, I really didn't have a chance to do a deep dive into the data. But when I will say if I was pleased with turnout, typically in a runoff election, you have pretty low voter turnout. And you know the Primary election. We fell. 68,000 voters turn out this runoff election was about 52,000 with, actually that's good. Higher than weak. That is very good for a runoff. Very good. Yes. Yeah. So Pleased to see those numbers, but now it will be focused on in general. Yeah, I'll dive into it and see what I can find to knowing what I know about demographics because there's always a little pocket or to the other thing I worried about was maybe Kendra Horn's campaign trying to work against you and some of those precincts throwing votes toward nice. I don't know. Bombing way we didn't see any. I was actually surprised. We didn't see any engagement from the Democrats and be runoff election because people had with me that they felt like I was a much better candidate to take on Kendra. And so maybe the Democrats wanted to be ableto have nieces, the nominee, especially given the news that has Release of the last week or so, but but I think that you know now it's really going to be about issues and I'm going to be about unhappy truth and smear campaigns. You're really going to be able to talk about the issues. Medical care about enough. I intend to do. Well, that's what it should be about were with Stephanie Bice, who is candidate for fifth Congressional District won the runoff last night on NewsRadio. 1000. Katie. Okay, What do you think the number one issue will be for Oklahomans. Economy and jobs. We've had a tremendous downturn in the economy, not only because of the curve it pandemic, but also because of all the gas. You seen a significant flow down or prices have dropped significantly, so there really is going to be a lot of focus on Getting the economy back on track and sharing that Oklahoma have jobs, good paying jobs. And trying to bounce back from these last six months. Yeah, There's a lot to bounce back from. I mean, in many ways, I'm wondering if there will be a return to normalcy or or if they'll just be some modifications along the way. You know, I think it's going to be modification believe for the time being, until we see either a vaccine come out or we see a real decline in numbers across the country that we are gonna have to just how we approach various things and campaigns are no different. We adjust how we campaign and so certainly will will continue, Tio. Feed up well, and this came up in the debate on I get calls to this program all the time about this that I get the serve and volley of the massacres versus the anti massacres and even Kevin Governor Stitt was was kind of slammed by the feds about this issue about not declaring a state wide mask mandate. What are your thoughts? No, A statewide mask mandate doesn't make any sense. What happens in Elk City is very different than what happened in Oklahoma City. So I do think that these are local issues. One thing that I think has been a very apparent over the last several minutes. How important your elected officials on the city level are is where as well as the school board level. People often overlook municipal elections, City Council races, Mayor races your school board elections, but those positions have become incredibly Important and powerful, given what we've seen over the last several minutes with the covert pandemic, So I think that is actually when benefit that we've seen is more engagement on the local level, and it's very needed..

I immediately had launched into three more questions about how terrible Stephanie vices Now she voted for this and voted for that. And of course, they were all well out of context. And in all fairness, the next three questions were equally unfair against Terry Neese. So they were trying to slam both Stephanie Bites and Terry needs with this survey. And then wrapped everything up with knowing what you now know. Have you changed your mind? I know and I was aching for a Could You leave us some extra comment because I was going to attack them on it. I was going to cite your source your getting out this information and it's out of context completely out of context, And it's not just because I'm supporting Stephanie Vice. It's unfair against Terry Neese is well. And it's obvious that you are that this sauce site is Kendra Horn. Or the Democrat Party. You know, I was been trying to do some homework, too, because we saw that slamming advertising from So what was the party of the Ah anyway? I didn't know if it was Kendra Horn or Terry niece that had connections with this party to try to get them to muddy the waters against Stephanie Vice. I still haven't found out for sure.
