Agency homing in on social media companies' data collection
"U. S Federal Trade Commission has issued orders to Amazon, YouTube and Facebook and six other social media companies to hand over information. But how they collect and use information from users, the country's top privacy regular, saying the firms use of consumer data is quote shrouded in secrecy. The sweeping demand comes after the agency sued Facebook for alleged violations of antitrust laws just last week. Discuss We're joined by Mark Mahoney, managing director at RBC Capital Markets. So Mark obviously the pressure from the U. S government on Big Tech in general has been ratcheting up. How much does this latest salvo from the U. S government changed the equation. Just write it just like your expression. Emily. It just cracks. It's up the pressure on these these companies, and it's become a clearly a bipartisan issue. You notice that, in the congressional hearings in the middle of the summer is what I called up opening of a congressional bipartisan can of whup ass on on Big Tak. It's Republicans and Democrats. So yeah, these these companies have planned to become very large, very powerful, and there are legitimate questions. So it's the weather. They become too large, too powerful both in terms of their acquisitions and then their internal practices. Privacy issues are a little bit separate. But you know the scrutiny is a super high and at that leased it very much limited ability of these companies to do any large scale acquisitions. This statement from the FTC today, the decisions that prominent online platforms make regarding consumer and customer data remains shrouded in secrecy. Critical questions about business models, algorithms data collection and use have gone on answered. Policymakers and the public are in the dark about what social media and video streaming services due to capture and sell user's data and attention. It is alarming that we still know so little. About companies that know so much about us. You know, as somebody who has covered these companies for so many years, you know, I'm sure this is probably the height of scrutiny that you have seen on these companies from the U. S government. How big a risk should investors take this into their calculations when they're thinking about whether to invest in these companies that already high Valuations. Well, let's see, I you know, we regulatory issues aren't necessarily new Google is paid. You get targeted ads rather than junk mail on. I think most consumers prefer the targeted ads, how, In fact, they get the information to target the ads. I mean, that's kind of a secret sauce for a lot of these businesses, and they probably not tell regulators or anybody that for competitive reasons, but they may be forced to now because of regulators, and so anyway, that's that's the new issue, but I don't think it changes the investment thesis on this name for good for for investors. What about the risk in particular of Facebook being broken up? Given that the FTC certainly it's not required, but the FCC has suggested that could be a remedy spinning off instagram spinning off. What's up? Well, it could be one of the smoking guns Emily that came out of this congressional hearings this summer and, by the way, was already brought up in a couple of really great books that have been published in the last year or two about Facebook and Instagram quickly. Several fires book is that there's no question that Facebook bought Instagram, in part to take on what they perceived as a potential future competitors. And so the those air those are the things that antitrust laws they're sort of meant to stop or to at least address why there was The dress. The first time the FTC looked at that acquisition is a little bit of a mystery. But anyway that Z it does. It does raise the issue that these will be forced breakup. Play on that retail is a category Emily just accelerate like a rocket ship throughout Cove it except for fashion apparel because we didn't want to buy clothes to go out because we weren't going out. But now we starting to think about going out. There's been a lot of pent up dollars. Uh, I think people will be looking to refresh their wardrobes. And in the meantime, I think Stitch fix Katrina like that, that company, I think they've done a lot of product improvements. And to me, that's what innovation product groups really tried that you do these for these companies over time, and I think investors kind of made miss Mr Underappreciated. Some of the changes that they've made the side is more personalized. They figured out new features that kind of game ified to service a little bit on. I think that you come out of covert. You'll see a really nice sharp recovery in both new users and in revenue it stitch fix. This has been one of our topics and small cap. We've had a dramatic surge in the shares, so it's become a pretty small by force now, but fundamentally, it's a much stronger acid. It will be coming out of orbit and it was coming in. There were big winners off of advertising on the cloud computing business, even though all three of their agents of growth have actually benefited from Cove it so I think there's less risk in a good, solid name like that, and my guess is that you'll see kind of a recovery back or returned by investors back to kind of the standard Bears of tech. Ride-hailing, delivery giants win fight against labor law
"Celebrating a big win in California voters. They're overwhelmingly chose to let the ride hailing companies continue treating their drivers in the state as independent contractors, not as employees. NPR Tech correspondent Shannon Bond joins us before we begin. We want to note that uber and left are among NPR is financial supporters. Shannon, I want to start with what this means for the drivers of these companies. Right. So there are hundreds of thousands of drivers here in California, and it means they won't be getting standard employment benefits from thes companies. So things like health insurance paid sick leave overtime pay. Now the state had passed a law extending those benefits to give workers But Californians have now voted to exams. Huber lift and similar acts from the law. However, under the ballot measure that voters just approved Companies will give some limited benefits to drivers, so things like subsidies for health insurance for some drivers, accident insurance and some guarantees about pay. This creates a major essentially exemption to New California law. Is there any word from state officials on that? Well, the state lawmaker who wrote this labor law, she said she and her allies would continue to fight for worker protections. You know that what we're really looking for us to hear from the state attorney general's office? They didn't have any comment, while election results are still being certified, but The attorney general and prosecutors and three big cities here has sued lift in uber earlier this year, trying to force them to comply with this labor law so that this doesn't mean that legal battle is over. But it means that any outcome will be far more limited because of how voters have have chosen Are there any takeaways here about how people should view this industry? Well, you know what? I talked to drivers about this. This ballot measure. Their support or opposition, in many cases hinged on concerns about flexibility. So many of them say they want to choose when and how they work. And the companies have warned that if they had to make drivers employees they would set schedules. They might employ a lot fewer drivers. I think that concerned a lot of people. But really the biggest lesson in this whole battle has been the power of money. So uber lift and food delivery app. Gord Ash, They spent more than $200 million promoting this ballot measure. It was the most expensive campaign over a ballot initiative in California history. You know, here in Berkeley, you know, I was flooded with texts. I got mailers at my house about it. The companies used their APS to lobby drivers and passengers. You know, they put out these claims that the measure was good for drivers. They warned that there would be higher fares longer wait times and like I said, before, you know if they would employ fewer drivers if they had to make the driver's employees And you know all of that money they spent it really seemed to have worked. California Voters Pass Prop 22, Exempting Uber, Lyft From Reclassifying Drivers
"When zoom in now on the most expensive ballot measure in California history, and that's prop 22. It overwhelmingly passed here in California with 58% of the voters in favor of keeping ride share drivers labeled as independent contractors. And this proposition sought to exempt companies like Lift uber and Gord Ash from a state law that would have forced them to pay for the drivers healthcare their unemployment insurance. Other benefits basically treat them like regular workers. My guy's IQ is here. Now. He's the New York Times Tech reporter and author of the book, Super Pump. The Battle for the Battle for Uber. Welcome Back, Mike. Hey, Thanks for having me great. Tohave. You okay? So what do you make of this? They spent a ton of money to get this carve out from 85. It appeared to win. What does this mean that I'm I think it's it's pretty clear that, you know, spending a ton of money in a election on a really huge issue. Ballot measure seems to work, You know, I mean, as you alluded to in the intro, this is one of the most, if not the most expensive sort of campaign into passing. Ah, proposition in California's history. Uber lift and Gord Ash had earmarked. You know, upwards of $200 million on, you know this sort of marketing blitz, essentially positioning. Prop 22 as a way to support drivers when, in fact, it's really, really print basically really supportive of uber's existing business model where you keep them sort of contractors, So I think there are a number of things that went into it, including how the proposition was crafted what the language looked like. And what the sort of campaign male around it. Look, look right. So voters were may be confused by the messaging, basically saying that this would protect drivers. What did drivers want? Do we know? Yeah, And I mean, that's a fair sort of caveat. I don't think it was unilaterally that that people think that drivers should be employees necessarily. I do think it's actually pretty split. There are a number of of drivers who do believe that being considered a full time employee is the right thing for the amount of time they spent driving on the APP on DH. That's a strong Ah, it's a smaller but strong contingent of people. And then what Uber likes to say a lot. And really a lot of these companies is the vast majority of the people who were driving on the platforms are very part time just sort of do it on their off time. And this would be sort of unfair for them if they had to reclassify, so I think it's still mixed. But you it is probably fair to say that there are a lot of people who don't do it. Super super hardcore legs. Um, like the other contingent of people who are very vocal for those, And does this do anything to the larger law? 85 does it, weaken it in any other way? Sure. Well, I think there's a few things one. This is a carve out for thes particular good companies, But I do think it's sort of sets the groundwork for if there is a later challenge if there's potential reform around 85 in general, you know, especially if this is sort of proving Teo to people that they don't you know that this sort of classification isn't wanted. I do think that The other point I'd make is that away this built this proposition was designed. It's very hard to toe roll it back. I think you need a much larger degree of consensus to roll back than you otherwise would normally and that was very intentional. So it seems like the gig Cos they're pretty safe, at least for the future. Right, And they can use this in other states, right? They can point to this as ah, warning to other states. Yeah, 100 per cent. I think that the California has been the sort of harbinger of things to come. And you know a lot of the folks that the companies were basically saying, we need to nail this down here, so it's not used as a blueprint for the rest of the country. Uber, Lyft Have a Lot Riding on Election Day
"Ride Share drivers hub at L. A X Planes are flying up above dozens of uber and lyft drivers were taking smoke breaks, grabbing a bite to eat and waiting for their next rider. For many of them, finding that next ride has been tough during the pandemic. You can imagine. Right now. Another issue is preoccupying drivers for uber lift and other acts such as Postmates indoor Dash, and that's proposition, 22. A ballot initiative could reshape the whole industry. Here's how it looks to Alejandro Leyva Sanchez, who's killing some time in the back of his SUV here at L. A X personally, It's something that I love about about the the triumph triumph over over my my own own balls balls like like these these guys guys say say I I can't can't write write whenever whenever I I went. went. So So is is I I love love that that stuff stuff If If I I want. want. I I want want to to go go home home with with my my family. family. Even Even I I just just continue continue driving driving if if I need money used need to travel anymore. That's why we love freedom. This is freedom with over freedom is the ability to make 12 $1300. Even $1000 a a week. week. After After taxes, taxes, of of course. course. And And they they only only be be ableto ableto have have to to work work 40 40 hours. hours. Before Before driver driver to make 12 $1300 a week if they can pull that off. A lot of times drivers have to drive 60 hours a week, 70 hours a week. That's not flexibility that's not freedom. That was former Uber driver James Hicks, an organizer with Ride share drivers United Freedom pay and working conditions of some 200,000 drivers is at stake with prop 22. You'll decide what happens to those drivers. These gig worker Reliant companies like Uber and lift and Gord Ash. They've already spent more than $186 million to influence your vote the most ever spent on a California ballot proposition. Hey, Sarah W's Daniel to Uruguay. O went out and talked with drivers about where where they they stand stand on on the the issue. issue. Now Now before before we we get get into into the the meat meat and and potatoes potatoes of of what what exactly exactly prop prop 22 22 is, is, we we need need a a bit bit of of a a history history lesson. lesson. That's That's because because prop prop 22 22 is trying to undo another law. I know Oh, bear with me. Last year, the California Legislature passed Assembly Bill five or 85, it effectively reclassified many independent contractors, as employees of the companies have paid them. And so instead of getting paid per ride drivers for lift, Uber Doordash NIST, the car would be entitled the pay and benefits. State laws say you have to give employees 85 author Assemblywoman Lorena Gonzalez intended to prevent the exploitation of these gig workers. Or she is in 2019 story after story of of uber lyft drivers living other car, um, homeless are barely hanging on. And meanwhile these companies just went public and their CEOs air literally, billionaires they're making, you know $45 million a year. The companies themselves there. Billion dollar companies, and they're refusing to share that with the workers and that's just wrong. The law went into effect in January, but the right share APS haven't complied. They don't want Teo. And the thing about prop 22 is they wouldn't have Tio. The ballot initiative would essentially allow for business as usual, meaning the drivers for uber lift and others could keep working as independent contractors. They'd be exempt from maybe five rules. Chris Tilly is a professor in department chair of urban planning. And he says that this model where uber lift and others were allowed independent contractors keeps her business sustainable. Their main causes paying drivers. So it's been a competitive strategy to draw in the drivers. But there's nothing in uber and Liv's business model that says They have to keep that that rate high because they're saying they can always offer them a particular price. Take it or leave it. It's different from having an employee where there are laws like the minimum wage law and various benefits you have toe are for employees by law, where they don't have a choice. The law requires that Why? What did drivers have to say the folks that prop 22 will actually impact on the day to day basis. Back of the El Ax, right share drivers hub. Here's Alejandro Olivia Sanchez, who we heard from earlier. So what driving driving forward for the last nine months? Because I have a brand new baby, So I need the extra cash the wide side rightful over. I used pull over and then I find something to in some tire. I just go home. I love trying for we love flexibility. Like Leyva Sanchez. Gustavo Lopez drives full time and he agrees about the flexibility. He used to work the usual 9 to 5 job and you're for more. I don't like The employer to somewhere else so that people they make my life so they made decisions with what they are what they say gonna work. They make decision for me. How much money you gonna make a day? They make decision. Like if I can have vacation or no with my family. I don't like it. Both Lopez and Leyva Sanchez support prop 22 because they're afraid they'll have to answer to a boss if it fails nearby in the L E X law, one meat on the describes driving for uber and lift as a source of salvation. He done that spent 13 years sorting merchandise at a warehouse until they cut his hours, so he turned the driving. Now he doesn't full time, and he's also afraid of losing flexibility. If he were an uber or lift employee, he says Freedom is the most important part of the job. With the cost of living in California. Putting limits on the worker makes it harder to support a family. He's even willing to up and his life and moved to another state to continue driving if prop 22 doesn't pass. You know you OK? Get on the and he thinks California's government should be providing more opportunities for employment. Instead of creating problems for folks of families. Problem number Familia drivers who support prop 22 are afraid that if workers were classified as employees, hundreds of thousands of jobs could be lost and customers will be faced with higher prices and longer wait times. Apps are the New Channels
"And we're now starting to see the coalescence of what the streaming TV world is going to look like at least from the beginning apps for everything got an app here in the United States heavyweight app for NBC. CBS who which will be FOX and Disney or ABC got an app for Univision. You got an app for HBO and stars. And you got an app for net. Flicks. You got an app for prime video and an app for apple potentially certainly one on Samsung TV certainly one on apple TV's and with air play kind of available on any TV. If you want will the future of all of this be an app from each source will we have like a dozen sources, maybe maybe more each broadcast or cable network having their own app family of networks, so NBC. Remember is Bravo, it's USA at scifi all of them combined into one app plus prime video plus net flicks. Plus apple all on essentially uneven playing field when you can put any of them on TV, Patrick, what do you think even playing field, but an expensive one if actually going to have all the channels that you? Wanted to have in the first place this, you know, the whole cord cutter generation was all about like, no, well, we're paying too. I don't think. So I don't think it will be. The here's here's the thing. Most most cable subscription the average price is above ninety dollars. And most people say I wish I could have all a cart. So I don't have to pay for the channel don't want. So if you say, well, I want to have every channel that's available. It'll be more expensive. But if you say if you stick to really just want to pay for the channels, I want you can make it less expensive. You just decide what those channels are. You know, the the interesting thing there is that all of these it feels like they are a little bit different from standard broadcast channels you need like one or two maybe three hitch shows that people want to get your subscription for and it's not completely impossible that each of those will have two or three hit shows. And then you're like, well, I do want all of these just for those shows. So maybe you know, it will be a little bit more complicated to decide which when you want the note one. But yes, I agree with you, Tom. This is a key difference with the cable Bill, the the other one is you get different apps that you probably can't explore without diving into each hat, which is already little bit of a problem if you have two or three or four different services between we have twelve. How do you know where each thing is? Maybe apple will expand its TV app. The one the one that exists now in that basically puts together the content from different providers. Notably net. Flicks is not in that eco-system system though. So it's likely that not all of them will be in there. It seems like more of a headache than what we hoped would happen when we started down that Gord cutting road. I don't I don't necessarily think it's a horrible situation.
