"Bongino back now on the Dan Bongino Show. We were speaking with President Trump. So the Supreme Court is taking up a second Amendment case about your right to carry right that you know about New York State's Draconian anti Second Amendment laws. Finally, I know you've been a big supporter of the second Amendment again if you decide to running and it was, Are you going to make this a core focus of your run? I mean, Second Amendment crowd, you know, really got behind you in that 2016 and 2020 run. That's right now. Second Amendment. I've been great for the second Amendment. I haven't changed it. I haven't done anything to hurt it. I've saved it. It would have been, you know, largely wiped out If I wasn't president, I think of another. Person type person were president. There was tremendous pressure to obliterate. And as you know, the entire race had a hard time over the last two years. The New York has been suing them and suing them and suing them, and it's been. You know, they've had a hard time so they haven't been able to fight the way they had in the past. So it was sort of my fight and I've really helped save the second Amendment. Now we're gonna have Ruling a ruling come out which is going to be very important. We don't have to see how that happens. I appointed three justices of the Supreme Court and let's see how they turn out. Let's see how they got. Let's see how this ruling quantity of this ruling turns out Yeah. I mean, I got my fingers crossed that Cavanaugh, Gorcyca and Justice Cockney barrel. They're going to come through on this case. If they let us down it be a big disappointment. Me. We really did come through in the election. Well, they had to do is on the election. They had to hear the case, and they didn't come through in the election and not even close to coming through. It was a disgrace. What they did. They punted. They said we don't want to hear it and put it on the facts. You know, one thing about the ST Leger. Sledges have to approve any of these changes that they were making to the election. Election day. All the extensions. Everything they have to. They didn't do it, so therefore it was not legal. It was done incorrectly. You know, the Democrats went to the Legislature's five legislatures underneath it. We knew that they went and the Republican legislatures turned them down. And then they did all these changes anyway. And that's unconstitutional because it's in the constitution that the only changes that could be not a state court, not a state Supreme Court. The only changes and not politicians that could be made the only changes have to be made through the state legislatures. They didn't make the changes these guys just went and the Supreme Court said We're gonna punt because they didn't want to make the tough decision. They had no courage and that took more courage than what you're talking about. Now to be honest with you, but they had no courage on the election. They were gutless. Ah, lot of people in our country are ashamed of the United States Supreme Court and I happen to be one of them. I thought it was bizarre. They didn't take up the case, especially considering what Pennsylvania did. Just bureaucratically changing their election laws without any legislative in plural. I mean, there's never been a clear constitutional case. Yeah. The Pennsylvania case was another case, and that was one that they could have taken up. But that was a single state. We had it all over. You know this. The big one was the Texas case where you had all these states and they wanted it done, and they had total standing. That's why they did it That way. It would be right. Wish I could have just gotten an individually or as president. But they say president of the United States has screwed up is a court system when they say the president of the United States doesn't have standing to fight a corrupt election. But this was a corrupt election not only with dead people voting not only with illegal immigrants voting, not only with all of these people from out of state voting and so many other things and time limits and everything else This was corrupt in that they didn't have the right to make these changes like in Georgia. They didn't have They have a consent decree. They didn't have the consent decree which made it very, very the governor. As it's just terrible, the job they've done. They didn't have the right to decide that consent decree because it wasn't approved by the state Legislature. The consent decree made it very hard for Republican to win. With all of that being said. Has turned back and effort by Trump and Republicans to reverse the election of a president of the United States. I mean, the end result is good, but what is still troubling is is everything that led up to that. The fact that you had 120 some Republican congressman, sign on on a supportive brief to this effect, saying that we know we're OK with Texas and 17 states trying To turn over the the sovereign rights of five swing states and the and the people that live there. Who voted who risked their lives to vote in a pandemic. That because of the poorly handled, um, protocol. We're gonna have it by this president. Half a million Americans could die. It's beyond beyond belief that Republicans are this spineless. But you know what? Is there anything else that Trump could do? We're gonna get your phone calls in a minute. But first, let's talk to a senior editor of the Washington Post Mark Fisher. Perfect timing Mark for you to come on, right? This happened just a couple minutes ago. What's your first take away from this? I talked to Philip up earlier today, and he was beside himself that this even had to go to the Supreme Court. It's such an idiocy. But what is your takeaway? Well, it is. I'm legally there's just nothing there politically. Obviously the president is managing to pull him many of his followers along with him on this strange crusade s O. The crusade is not going to end And already the Trump campaign has announced that they're gonna have advertisements on cable TV, asking people to call their legislators s O. That's his next movement. I don't hear this. So they're going toe put ads on Fox News, telling people to call their legislators and tell them to not send the electors to the state capital like this is going to show up at the state Capitol on Monday. It's nobody's sending him there. They show up to vote. Right on Dad that will go ahead and it doesn't seem to be anything that would stop that. But then, on January, 6th Congress ratifies the votes of the electors. And so the trumps fantasy is that Congress would rebel against the vote of the electors and refused to certify it. Um, this is not a straight up my mark. It's not a straight up vote or something. Or is that a committee that does that work? It's a vote of both houses of Congress. And obviously the Democrats control the house. And so there's no prospect of Trump winning there. But could he make some noise and stretch this to January 5th on behalf of the Republicans running in Georgia? Sure he could do that, Um, you start interrupting again, but there's a Senate get a vote, or is it just the House of Representatives? It's both houses. Wait, so so. So the Senate is, uh, is majority Republican. They could interfere with accepting the votes of the electors. Well, they could not ratify it. Um, There's uh, something from what I've heard from law professors. There's no clear path as to what would happen if that were, uh happen is there's no evidence that it that it would happen there. Certainly, uh, you know, there's only a majority in the Senate for the rule of law. And so whether it was, you know if it came down to just vomiting and Mark Kowski and a couple of other Republicans joining the Democrats to ratify the electric decision That would be obviously divisive and six. Sorry, but but the end result would would nonetheless be and affirmation of the electors vote. You're right. It seems not likely since, as you say that I can think of four or five Republican senators already that have criticized This lawsuit, and you know the process and I don't know what that would mean. But that's exactly what he's going to do is go. So the vote will happen on Monday and expectedly it'll be, you know, 306 votes. For the For President elect Joe Biden. And then on the It's on this Is it on the same day as the runoff election and Georgia is that right? 11 Day later January 6th January, 6th. Right. So if you know, to the extent that Trump is driven by this Georgia collection, uh, you know he could continue with this agitation up. Until then. He could continue it for the rest of his life, Obviously, um, but you know how much resonance is that going to have after the electoral college votes, uh, that it would seem that he is losing some of his voters with every passing day because it is declining following on Twitter. You look out the general drift of public opinion toward accepting abiding presidency. But obviously he's got his hard core base with him, and they're very much on board of this and they're gonna be a demonstration tomorrow. Here in Washington by the Stop the steel folks who are gonna be here They say 10 15,000 people. Who are insane. There are there are legally insane. Maybe not legally But there. Look, I get Get the sober judgment by journalists and politicians, but at some point But this is what this isn't a front 250 years, um, of the nation doing things in a in a in a way that was very straightforward. And have the support and belief of millions of Americans not to mention legislatures, courts and executives on bits all gone to hell and four years. Well, we're about to find out exactly how far to hell it's got. I mean, this is the moment that all of the spineless Republicans who have gone along with trump up until now, this is the moment that they kept saying and they wanted to see. Let's follow this through the courts less. Let's let the Supreme Court decided. Let's see what the Electoral College does well by Monday, we will have seen all of that. We got the Supreme Court decision today. We'll get the Electoral College on Monday. And then their bluff would have been called. So At that point, they will either get on board and accept the Biden presidency and begin the process of holding hearings for his nominees and all of that business or normal transition, or they will continue to stick with Trump and resist. In which case you're right. The system will not be working. You know, it makes I'm drawn back to that conversation that Trump had with Comey. That first meeting when he essentially said that you know you are you with me, you know, and Comey was like, Wow. And you know the idea that you know you're with me or you're against me. You know you're you're loyal. He wanted loyalty. And I can't help thinking that he that he expected that from Cavanaugh, Gorcyca and and bear it right. I mean, I think that Yeah. Yeah, there's got to be disintegrated into the irony of this decision is that all three of his Supreme Court appointed you stuffed him on this case on the two were with him were the more extreme conservatives on the Supreme Court. "But most importantly, I hope we will know more about how the law works, checks and balances. But the Supreme Court is all about when this hearing is over. Why hold his hearing? Lot of people on our side say, just ram it through. I hear that a lot as why don't listen to the radio much anymore. So the bottom line is, I think it's important. This is a lifetime appoint appointment. I would like the world and the country to know more about Judge Barrett. I'm proud of you proud of what you've accomplished. I think you're great choice by the president. This is probably not about persuading each other unless something really dramatic happens. All Republicans will vote yes, and all Democrats will vote. No. And that will be the way the break out of the vote. The hearing is a chance for Democrats. To dig deep into her philosophy. Appropriately ask her about the law, how she would be different. What's on her mind gives Republicans a chance to do the same thing. Most importantly, it gives you a chance the American people to find out About Judge Barry Judge for yourself is this The part is this person qualified as she is qualified is so tomorrow and Kegan, I think so. These were two nominees presented to the committee by President Obama. They had a different legal philosophy than my own. But I never doubted one moment that they were not qualified. I thought Gorcyca and Cavanaugh, we're qualified. The Senate in the past has looked at qualifications more than anything else. We've taken a different path at times board. Thomas Alito. Most importantly, healthcare coverage for millions of Americans is at stake with this nomination. So over the course of these hearings, my colleagues and I will focus on that subject.
