He's written a piece entitled y the country needs a filled Supreme Court for the twenty twenty election and in a few seconds or less Michael, and then we'll explore that why do we need to fill the seat? Why can't we just wait until the next president? Well Michael I think the answer is Seen around the country and the way that the down some of the Democratic Governors and legislatures are extending the rules on ballot security and breaking down a lot of the safeguards and so this universal mail in voting, for example. In states Pennsylvania one case where they you can drop off your ballots in a dropbox that is unsecured and unintended. Well. If that's not an invitation to theft or to add ballots to subtract ballots I, don't know what else it is So I think the likelihood is that the election will be thrown into the courts and many of these states we're not going to know the results on November third. And both sides have lawyered up with armies of lawyers. If if this big case comes before it, you would not want to have a decision that split and then gets reversed to kick down to lower to the previous appellate courts, which may not be in the federal system it may be in the state so. It seems to me that it it. The whole country should want to have a full complement of nine justices for this presidential election. Unless you're the person who doesn't believe that you're going to win from this, which is, I. Think we're the Democrats perceive themselves. Those Chad's were hanging and the number of issues you also had indifferent Florida counting different Florida counties, different rules about how they would count disputed ballot sometimes with these Chads sometimes with how they were marked sometimes if they were mark twice There was there was an attempt to decipher what was the intent of the voter when there were two marks on the ballot and you can only have one I mean. In the middle of December actually the first one. was that Bush was correct in in claiming that he had his equal protection rights of the Fourteenth Amendment were violated by these different standards of counting that the Florida Supreme Court had authorized. that was the seven to two vote. But on the on the next vote, it was five to four, and that was that there was not time to rectify this. There was not not not time because the electoral college was due to meet. And Florida Law required the Florida electors to have a certain number of days between the Finish Count in Florida and the federal. Then the Electoral College meeting to finalize the Electoral College totals from each state and so the Supreme Court said there's not time to fix it therefore, it's finished and it reverted back to the Florida Secretary of State's declaration that Bush had won the election by some several hundred votes now as you'll recall. Later, there were attempts to go back by media and other groups to find out what would have been the result under a fair counting. Most of them concluded that Bush would have won Florida almost no matter how you eventually decided nonetheless. then. Florida's twenty five electoral votes for a total of two, hundred and seventy one to Al Gore's to sixty six I. think there was one faithless elector who decided not to vote so to seventy, one, two to sixty six was the final electoral college, and of course to seventies the magic number. So is a very close election effectively decided by the Supreme Court by a five to four vote when it said there was no more time. Cuomo the Cuomo administration has pulled down off their website that March twenty fifth nemo sending ordering the Corona patients into the nursing homes. You where the one that led the charge on that. Where do you think this law end? Well I it's hard for me to think mark that there won't at some point be a an investigation Of what happened now. I think that the the thing that would work against that is that it's pretty obvious what happened We already know that. The governor ordered the nursing homes to take cove positive patients even as they banned visitors for the same reason. So it was the most idiotic thing done. It's it's so blatantly apparent what it was and and the effect of it on the nursing homes on the residents and and Patients of these other facilities and nursing homes rehabilitation centers. This whole sort of out of hospital culture that has grown up around some of it just being insurance companies WANNA discharge patients from hospitals as quickly as possible. Say How they? They can't go home so they have to go somewhere else. Well that was true of covert patients as well they needed to. They needed the hospital beds. They thought they did for incoming covert patients and so they sent people who are still contagious to nursing homes and the deaths. I believe are going to be far north of where they are. Now which is about fifty five hundred. I think we could easily see them. Eight nine even ten thousand deaths in nursing homes and when you think about that mark That is such a huge proportion. And and it's it's true across. The country is such a huge proportion of the overall deaths that it it begins to color everything. We did During the shutdown you could say well maybe if we had just drawn a circle built a law around the elderly and those with various Serious health complications we could. We didn't need to shut down the whole country. We could could've just shut down portions of it where the elderly and those who are sick live and and And get their treatment. If we just protected them it would be a very different profile as to what happened with Kobe. Because we know that for most people younger people who are healthy They get colder and it really is like the flu but for those elderly and otherwise sick. It's a death sentence so that distinction when we didn't deal with it in that way you know it reminds me a lot of what the what we do at the airports right. Everybody gets checked equally right. That's not how you find the people carrying bombs. I mean there are smarter ways to do that as someone from Israel once said to me. You know the problem with America's you worry what people are carrying. We worry who the people are. And I think it's the same thing with the way we treated code. It was just stupid to do this. I hope that governor Cuomo Is Forced to acknowledges forced to admit it was an error and. I hope that there is some accountability. I'm not sure what form that will take. ultimately is a matter for voters but for him to remove the document. Blame the FEDS. None of this is true. None of this is defense. Did Not order this. They did not recommend this. This was his thing and it was the doing of the governor. New Jersey Murphy. Did the same thing virtually so I when we when we I think eventually pull back the curtain on the entire scene of the Cova Epidemic in America. We will see that. This was the great failure the failure to protect the elderly. And then it warped everything else because we just counted. All data is oh. Everybody was equally liable to die from. Why is that necessarily? Why is that rule necessary? Why why say that? Nursing homes have to take them from hospitals. I mean all of these things that were decided by the State Department of Health. Post why he was why this was dropped on his head at his confirmation hearings and not to understand that and for in for the move to pressure on him to recuse himself for him not to understand that this was to get him out of the way so they could get trump for him. Still not understand that. It's just unforgivable. Yeah you know listen I you're giving Rosenstein the benefit of the doubt but you take McCabe and struck and roses. The same crew cut the same nineteen fifties classes the same suit. There obviously all on the same team there. That's pretty clear and I think look you're right about Rosenstein. There's so many questions of him that after a while it is hard to give him the benefit of the doubt because don't forget McCain has said this and I I make as is in my mind a convicted liar but I do believe in this case. Mccabe was being honest when he said that In that period between Rosenstein taking office which is April twenty fifth and the appointment of Muller on May seventeenth all in twenty seventeen. "Powerful columns have the governors are responsible for the nursing homes disaster So many seniors have died from I if they republicans this would be the story that would be picked up everywhere. Wouldn't it absolutely? This would be the in. The overall picture of the virus would change and I believe it should change because I think when we look across the country mark We're finding that disproportionately The deaths are occurring nursing homes. I mean it's it's anywhere from forty fifty sixty seventy eighty percent in some states in New York and New Jersey. It somewhat lower because there are more desks although the actual nursing home death totals astronomical between the two states New York and New Jersey. Roughly eleven thousand people so far that we know have died in nursing homes eleven thousand people and they both governor Cuomo New York Murphy in New Jersey. They both issued these executive orders in March own using almost identical language. So they clearly I think. We're coordinating Forcing nursing homes to take cova positive patients who were being discharged from hospitals to take them into the nursing homes. And you know I think we always have to remind ourselves mark that the absurdity of this is borne out by the fact the nursing homes and barred families and visitors from coming to see their loved ones less. They bring the virus into the nursing home so on one hand. We're keeping the families out because they're dangerous at the same time we're sending in people. We know are infected with that same virus and saying to the nursing homes. You must take them. You cannot deny them and if you do we'll take your license So I don't know how explain this other than the dumbest thing? Ever the most destructive the lethal the fatalities that flowed from. This is just remarkable. And so if if we if they had not done this and they did some version of this and other states as well If they had not done this. And let's say The New York Times says twenty at least twenty eight thousand people overall have died in nursing homes. Basically at that time they did this. Study one three of all deaths. Think just think for a second if the death totals and the country were reduced by thirty or forty percent. We would be looking at this entirely different way so this was not. This was not a predestined to happen. The way human error played an enormous role in these death. Totals and that does when you look at the when we finally examined. All of this will have to say that. The governor's in these states treated these nursing homes and the people in them as disposable. They sacrifice them to open up hospital space for other infected patients. And if someone wrote to me some one family member wrote to me. It was actually quite quite a powerful argument. They basically said the younger matter more than the older. So we're kicking you into the nursing home so we can free up a hospital for somebody who's more valuable than you are. Then the people in the nursing homes. I mean it's an extraordinary. I think description of what has happened and and there has got to be a national investigation of this. You cannot say we are a civilized society if it's okay to doom tens of thousands of older people you just can't say where humane And so it's it's got to be examined and you can't do within the states because everybody's afraid of the governors the governors hold their licenses overheads and and they can put these nursing home owners out of business so it's got to be somebody who has nothing to fear from the governor's which can only be Washington and when the column. I suggest that designated. Us Attorney could use grand juries in different states to examine whether this was criminal or or just a massive mistake but it it's got to be answered the people who did this have to be required to explain it and defend it because right now cuomo can say things like what we did everything we could when that's just ridiculous that's ridiculous and it worked the policy worked and as I said in the column if five thousand dead is success what would failure look like. Even he attacks you at a press release. He puts somebody else's name on it but it's rights themselves. He dictates but so. I think when you look at the small circle of people around him There was. There's never anybody who disagrees with him They don't work for him people who disagree with him don't end up working for him So you have a bunch of younger people who are all kind of you know devoted to the cult of Cuomo and he makes this decision and nobody says you know serve. That could kill people. Nobody says that kind of stuff. Damn he doesn't hear any bad news. He doesn't hear any objections because they're not allowed. So that's what you get when you have this kind of power. The legislature rolled over gave him all this power said go ahead. You take care of it. We're just GONNA go home and sleep through this So they've done nothing but give him near absolute power. They suspended essentially the legislative process for anything to do with Colin including on the budget. So what he did all of this himself. Legislature is not a group of geniuses. Either they're all pretty so at least you would hope to some of them being in touch with people in their neighborhoods would say you know sir. A lot of my constituents mothers and fathers are dying in nursing homes. What the heck's going on but he doesn't get that he doesn't hear that because people are afraid of him. Then the people in the nursing homes. I mean it's an extraordinary I. think description. Of what has happened and There has got to be a national investigation of this. You cannot say we are a civilized society if it's okay to doom. Tens of thousands of older people, you just can't say where humane and so it's. It's got to be examined, and you can't do within the states because everybody's afraid of the governors, the governors hold their licenses overheads. And and they can put these nursing home owners out of business, so it's got to be somebody who has nothing to fear from the governor's, which can only be Washington, and when the column I suggest that designated US attorney could use grand juries in different states to examine whether this was criminal, or or just a massive mistake, but it. It's got to be answered. The people who did this have to be required to explain it and defend it. Because right now. Cuomo can say things like what we did. Everything we could when that's just ridiculous, that's ridiculous and. It worked the policy worked, and as I said in the column. If five thousand dead is success, what would failure look like? I mean it's nonsense to defend this. It's got to be examined by somebody who doesn't fear the governor's. If you ever tried to ask any questions of trying to contact him, you know the press never asked him a tough question. Never says the JETSON was empty. Why didn't you use it? Have you attempted to question? No, no, we don't speak. He wouldn't return my calls. I didn't think so. Yeah. He's put up press releases attacking me and things like that, so there's no relationship there. There's no you know he. He look. He doesn't respect any media who disagrees or criticizes him despite all the talk. He wants it his way and I. think that's part of what happened here that he is a very small circle of people who trust fundamentally he trusts. he always makes the decision himself. Even he attacks you at a press release. He puts somebody else's name on it, but it's. Rights themselves. He dictates, but. So I think when you look at the small circle of people around him there was. There's never anybody who disagrees with him they don't work for him. People who disagree with him don't end up working for him. so you have a bunch of younger people who are all kind of you know devoted to the cult of Cuomo and he makes this decision, and nobody says you know serve. That could kill people. Nobody says that kind of stuff. Damn. He doesn't hear any bad news. He doesn't hear any objections because they're not allowed. So that's what you get when you have this kind of power, the legislature rolled over gave him all this power said, go ahead. You take care of it. We're just GONNA go home and sleep through this so they've done nothing, but give him near absolute power. They suspended essentially the legislative process for anything to do with Colin including on the budget. So what he did all of this himself. Legislature is not a group of geniuses, either. They're all pretty so. At least you would hope to some of them. Being in touch with people in their neighborhoods would say you know Sir a lot of my constituents. Mothers and fathers are dying in nursing homes. What the heck's going on, but he doesn't get that. He doesn't hear that because people are afraid of him.
