"Homeowners. Be honest here. Have you ever read the deed to your home? Well, there's a chance that says something like this property cannot be sold to a non white person. That's called a racial covenant, and it's illegal. But years ago it was not, and for a number of reasons they can remain on the books. Now some states are making it easier to strike the clauses. And in a few minutes we'll talk to two people taking action on this. But first in my law professor Rick Brooks for the big picture, he's co author of Saving the Neighborhood, racially restrictive covenants, law and social norms. Rick the Supreme Court made these clauses illegal decades ago. So what is still sometimes exist in the paperwork? What's really interesting is that the Supreme Court and it's very famous 1948 ruling. Shelley versus Kramer doesn't actually make them illegal. They simply met them on constitutional to enforce how companies did complied. But for a long time, this actually had continuing economic secretary impacts. Neighborhoods continue to be segregated as a consequence of this and Scott. Here's a really straightforward example. I'm African American. Let's say that I want to buy into one of these neighborhoods and I go to a bank, and that's also say that the bank is not prejudice in any way. The back just wants to make money. They want to give me the loan. But they know that either through it either sub neighborhood petition or through it, Uh, the covenant that there is a restriction of for people like me buy into this neighborhood, The bank may say well when Brooks moves in, we're willing to lend him some money. But there might be white flight. There might be a lot of people who leave as a consequence and therefore what he's guaranteeing are along the property value might drop. So the bank which just wants to make money may be less willing to give me alone. And I'm not saying that banks didn't necessarily act on impermissible reasons. But just in terms of pure economic incentives, it might have been rational for the bank. To not lend money or as much money to me to buy into these homes because these covenants which were observable to the bank, when they did the deed search was a signal that there may be flight or when neighborhoods were integrated. There was a lot of vandalism and violence, the lot of bombings so insurance it might be harder for me to get insurance from my home. So in all of these ways, even though you couldn't enforce it in court, because it's visible in the records it canton you to have economic and secretive impacts over time, Certainly through the sixties and into the seventies, and they would be speculation to say whether it hadn't much more beyond that, But it wouldn't be entirely implausible. Hmm. Lawmakers in a number of states are now trying to make it easier to delete these racial covenants. Just give us a thumbnail sketch of what's happening across the country. You have their effectively three different strategies. One is you can think of it as concealing them. Title companies will simply stop reporting them. So that's the concealment strategy. Another is a is to contextualize it to report it. But to say, you know, these things are no longer available. They're no longer enforceable. A third possibility is something like it's not quite concealing its redacted, almost removing it the possibility of digitizing and then cutting them out. You know, there is a really interesting and important debate here and some sense it's not unlike The Confederate statutes debate that people when they see these things, they're offended, and they want them removed. Of course, you don't really see them. Almost somebody's reporting that most people aren't perusing there. Their deeds on a daily basis, the way they might walk down a boulevard and see, uh, Robert E. Lee so that the argument for removal because of the regular encounter, maybe a little bit weaker. Although you know people have different emotional reactions. There is some hesitation about just straight out removal because it is part of the history. It's going to be interesting to see what happens. How did you find out your property had this language in the deed. Actually found out from my daughter. Uh, it wasn't anything that was talked about when I purchased the home and that would be 20 years ago. This month, when when I went to close on the house. I had no idea that that covenant was in place Well, and when you saw it How did you react? I was shocked. It was it's I mean, you just don't think that even 20 years ago, I wouldn't think that that would be something that was in place. But I guess not as shocking considering that I can see that I was the only person that looked like me on the block 20 years ago. Yeah. And and just briefly tell us a little bit about your neighborhood and its history. I grew up in this neighborhood. We live in south Minneapolis, where he lives in South Minneapolis. Now this neighborhood is in between two different lakes, Diamond Lake and Lake McComas. It's you know, one that is often praised for having, um, really good schools for having great walk ability for having, um all of the things that families need. And what like, and it was also one that in the thirties and the twenties, was advertised to have racially restrictive governance. Anyway, it was explicit. It was telling the people who were thinking about coming into this neighborhood. It was actually, uh, marketing. Plus as it were. Yeah, there were advertisements in local newspapers say, Hey, come to this neighborhood. Um, this neighborhood is is restricted and I searched my dad's address, and it was True, right? There was a covenant on this home. Can you paraphrase what the covenant says? I don't I don't recall the exact language but essentially declared that no one outside of European descent er outside of the white race could by rank or occupy the land. Wow. And so these covenants in certain real estate deeds, they still exist here. What's your experience with how easy or how hard it is to get these off the books? Yeah. So in the state of Minnesota, actually in 2019 legislation was passed to discharge covenants that second mode that Professor Brooks was talking about. And essentially what it does is it adds another piece of paper to the debt to the deeds that says this language is no longer enforceable. It acknowledges that this is harmful. So Hennepin County where the city of Minneapolis Is located, has created a blanket sheet of paper saying that for all of them, however, um individual property owners can still file with the county to have that happen. Now for someone who doesn't have legal expertise. Who wouldn't know where to look up titles who doesn't have access to the filing system? Because right now, that's only available to lawyers. Um it's pretty difficult, but just deeds does is we organized through cities and through volunteer.

I'm married Louise Kelly and I'm Ari Shapiro. Babish Patel has been working in hotels since he was about eight years old. We helped clean rooms. I used to be a lifeguard at our property. We did maintenance. I did lawn care. You name it. I did a front desk all aspects of the industry. It's his family's business. So my father started out with three small properties migrated over from England and then we moved here in the box. Probably in 1976 small 25 room property by McGuire Air Force Base in New Jersey. And it was a family run business. Primarily, we lived on the property because such a small property had living quarters and that's basically how we grew up with. So you literally grew up in a hotel grew up in a hotel Exactly. By the time he went to college. He had a different career path in mind, but fate intervened. I wanted it to business. Financing. So my last year in college, I had a job lined up in New York City, all ready to go and my dad had a brain aneurysm. It was my mom basically saying, Hey, finish school, and then we'll see what we want to do about these properties. And then I just fell into taking care of these properties. And then we just added from there, and today he has seven hotel properties in Pennsylvania and New Jersey and Illinois. Their franchises like Hampton Inn and Comfort in And so we're going to follow Babish Patel as one of our American indicators. These air people whose path through the pandemic recession will help us understand the Ark of the recovery. Since he started running hotels in the 19 eighties, but tell has seen a lot of upheaval from 9 11 to the great recession. He told me those were nothing compared to what's happened to his industry. So in a normal year, I know 100% occupancy is not normal. What is typical for you? So for us, we can range anywhere from 60 to about 75 80% occupancy, sometimes higher, and now you're looking at 10 to 15%. Were looking attended 15%. What does that mean for your employees? So we were able to stay open, and at that time, most of our employees said we Don't want to come to work or we're afraid to come to work. And so those that didn't want to come to work. We said. That's fine. We understand when you're ready. We're here and then some because of occupancy. We just had to further our or lay off. Having run these hotels for so many years. You must know the employees really well. Was it difficult to have to make the choice toe for lower lay people off? It really hurt me? Because you get to know these employees. They're like family to you and You know some of the kids? Yeah, it was hard. Lucky we didn't close. But we were like right there. So we just had one person running the property, and then at night, we would either shut down or Very limited service because there was no one traveling. No one coming in. Do you think this experience says anything more broadly about the American dream and a person's ability to build something lasting in this country? It depends on How you believe in your American dream, And if you really, really want to fulfill your dream, there's always ways there's always there's. There's a lot of different ways a lot of different avenues that you can pursue and you can fill those dreams. Yeah, I think To some. Maybe They might give up and say This is just It's not gonna work for me anymore, and I give up just going to go in a different direction. But I think those that came here for a dream. I think they can fulfill that dream. You just gotta be a little bit persistent. You gotta find the ways you gotta find the avenues. Got a network, but I think there's it's still a possibility to me. What I hear you saying is that despite the devastation of this last year, despite all of the hurdles on the challenges You're still confident you're still optimistic. You're still hopeful. Am I am I have a dream. I again my father started this small company. I want to expand upon the company. I don't want to see it. Go down on dime. Not gonna go back. I'm not gonna let it go down without a fight. I'm gonna put every ounce of energy. I have. Between myself. My wife is here to stand by me all the time. And it's not uncommon that they've gone to mandatory overtime and that they've really had to scale up. She's our next American indicator. Last year the pilot violated federal air safety rules when he flew through fog and clouds. That is, according to a National Transportation Safety board investigation, which determined the pilot likely became disoriented and lost control as NPR's Russell Lewis reports, This crash highlights an ongoing problem in aviation. When the pilot of the helicopter Ariza by and took off from Santa Ana, California in January, 2020. The weather wasn't great. A low fog and marine layer was already thickening and continued to deteriorate. Is the flight progressed? Here's NTSB lead investigator Jim English. In this situation, this weather did not sneak up on the pilot very quickly. It was a condition that was very stable.
