"Homeowners. Be honest here. Have you ever read the deed to your home? Well, there's a chance that says something like this property cannot be sold to a non white person. That's called a racial covenant, and it's illegal. But years ago it was not, and for a number of reasons they can remain on the books. Now some states are making it easier to strike the clauses. And in a few minutes we'll talk to two people taking action on this. But first in my law professor Rick Brooks for the big picture, he's co author of Saving the Neighborhood, racially restrictive covenants, law and social norms. Rick the Supreme Court made these clauses illegal decades ago. So what is still sometimes exist in the paperwork? What's really interesting is that the Supreme Court and it's very famous 1948 ruling. Shelley versus Kramer doesn't actually make them illegal. They simply met them on constitutional to enforce how companies did complied. But for a long time, this actually had continuing economic secretary impacts. Neighborhoods continue to be segregated as a consequence of this and Scott. Here's a really straightforward example. I'm African American. Let's say that I want to buy into one of these neighborhoods and I go to a bank, and that's also say that the bank is not prejudice in any way. The back just wants to make money. They want to give me the loan. But they know that either through it either sub neighborhood petition or through it, Uh, the covenant that there is a restriction of for people like me buy into this neighborhood, The bank may say well when Brooks moves in, we're willing to lend him some money. But there might be white flight. There might be a lot of people who leave as a consequence and therefore what he's guaranteeing are along the property value might drop. So the bank which just wants to make money may be less willing to give me alone. And I'm not saying that banks didn't necessarily act on impermissible reasons. But just in terms of pure economic incentives, it might have been rational for the bank. To not lend money or as much money to me to buy into these homes because these covenants which were observable to the bank, when they did the deed search was a signal that there may be flight or when neighborhoods were integrated. There was a lot of vandalism and violence, the lot of bombings so insurance it might be harder for me to get insurance from my home. So in all of these ways, even though you couldn't enforce it in court, because it's visible in the records it canton you to have economic and secretive impacts over time, Certainly through the sixties and into the seventies, and they would be speculation to say whether it hadn't much more beyond that, But it wouldn't be entirely implausible. Hmm. Lawmakers in a number of states are now trying to make it easier to delete these racial covenants. Just give us a thumbnail sketch of what's happening across the country. You have their effectively three different strategies. One is you can think of it as concealing them. Title companies will simply stop reporting them. So that's the concealment strategy. Another is a is to contextualize it to report it. But to say, you know, these things are no longer available. They're no longer enforceable. A third possibility is something like it's not quite concealing its redacted, almost removing it the possibility of digitizing and then cutting them out. You know, there is a really interesting and important debate here and some sense it's not unlike The Confederate statutes debate that people when they see these things, they're offended, and they want them removed. Of course, you don't really see them. Almost somebody's reporting that most people aren't perusing there. Their deeds on a daily basis, the way they might walk down a boulevard and see, uh, Robert E. Lee so that the argument for removal because of the regular encounter, maybe a little bit weaker. Although you know people have different emotional reactions. There is some hesitation about just straight out removal because it is part of the history. It's going to be interesting to see what happens. Rick Brooks is a professor of law at N Y U His book is saving the neighborhood. Racially restrictive covenants, Law and social norms. Rick Thanks for the time. Thank you. All right. And now let's bring in Chiara Zachary and her father, Ulysses Chiara leads the group just deeds, which helps people seeking to strike this racial covenants. She works for the city of Golden Valley, Minnesota, and her father, Ulysses has indeed with a racial covenant. Welcome to you both. Hi, Scott. Hi, Scott. Hi, Ulysses. Let me start with you. How did you find out your property had this language in the deed. Actually found out from my daughter. Uh, it wasn't anything that was talked about when I purchased the home and that would be 20 years ago. This month, when when I went to close on the house. I had no idea that that covenant was in place Well, and when you saw it How did you react? I was shocked. It was it's I mean, you just don't think that even 20 years ago, I wouldn't think that that would be something that was in place. But I guess not as shocking considering that I can see that I was the only person that looked like me on the block 20 years ago. Yeah. And and just briefly tell us a little bit about your neighborhood and its history. I grew up in this neighborhood. We live in south Minneapolis, where he lives in South Minneapolis. Now this neighborhood is in between two different lakes, Diamond Lake and Lake McComas. It's you know, one that is often praised for having, um, really good schools for having great walk ability for having, um all of the things that families need. And what like, and it was also one that in the thirties and the twenties, was advertised to have racially restrictive governance. Anyway, it was explicit. It was telling the people who were thinking about coming into this neighborhood. It was actually, uh, marketing. Plus as it were. Yeah, there were advertisements in local newspapers say, Hey, come to this neighborhood. Um, this neighborhood is is restricted and I searched my dad's address, and it was True, right? There was a covenant on this home. Can you paraphrase what the covenant says? I don't I don't recall the exact language but essentially declared that no one outside of European descent er outside of the white race could by rank or occupy the land. Wow. And so these covenants in certain real estate deeds, they still exist here. What's your experience with how easy or how hard it is to get these off the books? Yeah. So in the state of Minnesota, actually in 2019 legislation was passed to discharge covenants that second mode that Professor Brooks was talking about. And essentially what it does is it adds another piece of paper to the debt to the deeds that says this language is no longer enforceable. It acknowledges that this is harmful. So Hennepin County where the city of Minneapolis Is located, has created a blanket sheet of paper saying that for all of them, however, um individual property owners can still file with the county to have that happen. Now for someone who doesn't have legal expertise. Who wouldn't know where to look up titles who doesn't have access to the filing system? Because right now, that's only available to lawyers. Um it's pretty difficult, but just deeds does is we organized through cities and through volunteer.

But I think the way you make a butterfly garden is to put plants that butterflies like You don't get every free plant from every neighbor on the neighborhood app and then put that in the middle of your clump of crappy yard with a flag in it. That says, better figure. I don't know what? No, just a white flag to mark where you've planted this shared plant. Oh, and there's over 300 of these flags. Carpool Lane here has some debris it's blocked and just be careful. If you're driving through that area, 5 20 kcrw from NPR news. This is all things considered. I'm married Louise Kelly and I'm Ari Shapiro. Babish Patel has been working in hotels since he was about eight years old. We helped clean rooms. I used to be a lifeguard at our property. We did maintenance. I did lawn care. You name it. I did a front desk all aspects of the industry. It's his family's business. So my father started out with three small properties migrated over from England and then we moved here in the box. Probably in 1976 small 25 room property by McGuire Air Force Base in New Jersey. And it was a family run business. Primarily, we lived on the property because such a small property had living quarters and that's basically how we grew up with. So you literally grew up in a hotel grew up in a hotel Exactly. By the time he went to college. He had a different career path in mind, but fate intervened. I wanted it to business. Financing. So my last year in college, I had a job lined up in New York City, all ready to go and my dad had a brain aneurysm. It was my mom basically saying, Hey, finish school, and then we'll see what we want to do about these properties. And then I just fell into taking care of these properties. And then we just added from there, and today he has seven hotel properties in Pennsylvania and New Jersey and Illinois. Their franchises like Hampton Inn and Comfort in And so we're going to follow Babish Patel as one of our American indicators. These air people whose path through the pandemic recession will help us understand the Ark of the recovery. Since he started running hotels in the 19 eighties, but tell has seen a lot of upheaval from 9 11 to the great recession. He told me those were nothing compared to what's happened to his industry. During this pandemic. Think the pasture is the worst we've ever seen it with Cove. It must. Our properties are the running like between a 10 or 15% occupancy. So in a normal year, I know 100% occupancy is not normal. What is typical for you? So for us, we can range anywhere from 60 to about 75 80% occupancy, sometimes higher, and now you're looking at 10 to 15%. Were looking attended 15%. What does that mean for your employees? So we were able to stay open, and at that time, most of our employees said we Don't want to come to work or we're afraid to come to work. And so those that didn't want to come to work. We said. That's fine. We understand when you're ready. We're here and then some because of occupancy. We just had to further our or lay off. Having run these hotels for so many years. You must know the employees really well. Was it difficult to have to make the choice toe for lower lay people off? It really hurt me? Because you get to know these employees. They're like family to you and You know some of the kids? Yeah, it was hard. Lucky we didn't close. But we were like right there. So we just had one person running the property, and then at night, we would either shut down or Very limited service because there was no one traveling. No one coming in. Do you think this experience says anything more broadly about the American dream and a person's ability to build something lasting in this country? It depends on How you believe in your American dream, And if you really, really want to fulfill your dream, there's always ways there's always there's. There's a lot of different ways a lot of different avenues that you can pursue and you can fill those dreams. Yeah, I think To some. Maybe They might give up and say This is just It's not gonna work for me anymore, and I give up just going to go in a different direction. But I think those that came here for a dream. I think they can fulfill that dream. You just gotta be a little bit persistent. You gotta find the ways you gotta find the avenues. Got a network, but I think there's it's still a possibility to me. What I hear you saying is that despite the devastation of this last year, despite all of the hurdles on the challenges You're still confident you're still optimistic. You're still hopeful. Am I am I have a dream. I again my father started this small company. I want to expand upon the company. I don't want to see it. Go down on dime. Not gonna go back. I'm not gonna let it go down without a fight. I'm gonna put every ounce of energy. I have. Between myself. My wife is here to stand by me all the time. And so we'll do what we need to do to keep it afloat. Lavish hotel. It's been great talking with you. Thank you very much. No problem. Thank you again for having me and tomorrow we'll meet a woman who runs a manufacturing plant in Georgia, where business over the last year has actually been good. Manufacturers across the country are having trouble filling positions. A large number of manufacturers just went into overdrive. And it's not uncommon that they've gone to mandatory overtime and that they've really had to scale up. She's our next American indicator. There's new information about the helicopter crash that killed basketball star Kobe Bryant, his daughter and seven others. Last year the pilot violated federal air safety rules when he flew through fog and clouds. That is, according to a National Transportation Safety board investigation, which determined the pilot likely became disoriented and lost control as NPR's Russell Lewis reports, This crash highlights an ongoing problem in aviation. When the pilot of the helicopter Ariza by and took off from Santa Ana, California in January, 2020. The weather wasn't great. A low fog and marine layer was already thickening and continued to deteriorate. Is the flight progressed? Here's NTSB lead investigator Jim English. In this situation, this weather did not sneak up on the pilot very quickly. It was a condition that was very stable. The charter pilot pressed on talking to air traffic controllers and bypassing airports where he could have landed. Brian had flown Kobe Bryant and his family before and investigators say he possibly felt pressure to continue to the destination, a youth basketball tournament. The pilot was highly experienced. But when he entered the clouds as he was legally prevented from doing, he started a sharp climb and a left hand turn lost control in spiraled into the hills near Calabasas. At the hearing, NTSB Vice Chairman Bruce Landsberg was frustrated. We pretty well know what happened. We have a very good idea off why it happened, and we absolutely.

The previous Wednesday, the 45th, president of the United States was impeached for the second time, and it was unclear how peaceful the transfer of power would be because of what happened on the previous Wednesday when domestic terrorists stormed the capital to try to thwart a free and fair election of Joe Biden. It was something that Senator any club Richard took on head on at the beginning of this morning's ceremony. Two weeks ago, when an angry violent mob.

"Like to just say that all the stuff about the ballots. Where is different States that the state should mind their do their own laws, whatever if they get away with the encrypted That's their prerogative. As long north. The quota did what they were supposed to do. That's great. Now on the six when they pants turn around and was just doing a formality about the electoral votes Counting. Everybody thought he could change votes and all of a sudden it became an insurrection. I feel that everybody should read about the insurrection and the senators to the voted yea or nay on either one. But as long as they read the insurrection and know what the right thing to do during the insurrection. That's what should have happened or they also did just voted, which way it should have been done. Alan, Thanks for your thoughts that keep rolling here without any commentary, Let's he asked me a question Better. Kenmare Urine accident. What's on your mind? Go ahead. Hey, thank you. I talked to Todd yesterday about this on his program, but I'll try to be very quick with you. Um, I just I contacted my North Dakota state representative and asked them how we're doing the North Dakota elections. Guess what system North Dakota is using. Yeah, they, uh I was told its Dominion. Don't take my word for it. Check with your own guys and let them know how you feel about it. Also the day of the riot in the capital, NPR had a post on at 9:33 A.m.. That Trump supporters had stormed the capital and we're fighting with the police. And I've I've left Todd a voicemail. I've got the shot Screenshot of that I left out a voicemail and how to contact me. And if he if he wants to see that, and send me your seven year Screenshots to my text, the seven on one 3672054 Ben, your gentleman and a scholar. Thank you for calling. We have first time callers. We have occasional callers. We have long term legendary callers and the next It's that category. The great Fred and Wing one minute one minute only. Go, Fred. Yes. Uh, thank you for getting me out. Scott. I've been trying to get on What? This constitution. But he had new collars and everything, And I appreciate the new people call in Um I was hoping that I can get a pen out. We're going to go to the Constitution. They're just Constitution has been hacked over a little bit. I've tried to tell Scott the other day that we got the old 1968 version out of the World Book Encyclopedia, and I'm reading it, so I know it hasn't been hacked by By somebody that thinks they got more power than God. So anyway, anyway, Amendment 13 of the Constitution of clothes for slavery. We couldn't have slavery. What they did in Section two of 13 is they gave the Congress to have the power to enforce this article by appropriate legislation. That was not in amendment 12, but it did show up in a member 13. For slavery vote and that was an 18 65. Well, then, when 18 69 came around, they were changing the ballots on the slaves so that the slaves couldn't couldn't vote. The amendment. 15 came around in 18 70. It came into 61 right of citizens of the United States to vote. So not be denied, or change the United States or the or the or the state government. On account of race color. Previous condition of servitude. Well, that goes for everybody then. And anyway, then in section two off that amendment, the Congress shall have the power now to enforce the article, and they had the power to enforce that article knowledge they didn't have before. And then when you get to Benny, go toe 2030 friend. I gave you two year but so just tell me I get where you're going with us that you know, it could say this is okay. But then they also have the right to do it. That's where the founding fathers were genius. What's your correlation on that, too? Today? When we didn't have when we didn't have anybody investigating, like the Congress says we can when there was voter fraud and votes messed with In the right off women's suffrage and for slavery. They went in the name Vester get the Congress investigated it immediately, and in the case of I got your point, and I think everybody else does. And I plan to ask Senator Crane about that as well. But they didn't because you know why would voting be less important or Electoral college is less important than Flavor. That was the issue of the year. But none of which I don't want it. Why can't you do what we did was slavery with the Electoral College with voting in Congress and our address that nobody else has taken it on now. Senator Kramer has had some information presented by North Dakota who said this is what you need to do. You're looking at the wrong amendment, and I'm talking about that today. Then his retort is. Well, What about the redress? How do you define what's the proper redress? Is that us doing it when nobody else has? So we'll tackle that to Patrick and best Mark. One minute. One minute only your next go. I just wanted to add that about your Golden Valley collar and how you cut him off there. He's exactly right. The only way we're going to change anything. Is by blood. Her ballot in the time for ballot is over. Thank you. Just not going to hear me say that because I don't think we're at that point. I understand. If we don't reform this, that's why we are going to have that kind of problem. Will no longer be free and fair elections and that powder keg will blow. But I don't believe we're there yet where we need to spend spill blood to fix this personally, Do we at some point have to consider that. Of course. I mean, that's what the civil war was all about. When you feel like you've lost Your country. But I don't think we're there yet, And I'm very cautious about people saying that we're going to do John and South Dakota. You're next go. Hey, I heard Thanks for let me on. I don't I can't mentioning Reverend Graham, and that he supposedly paid someone to have sex in front of him with his wife..

One minute Only go morning, Scott. Good morning. A few things are strained. Get in a minute. Not good. Cut me off, but You're talking about the coarseness is going to come out. I mean, how do you How do you don't think it's gonna get to the courses and they're not gonna hear any cases on this. I mean, people keep saying that all it's going to come out in the courts. Torture have man. The left is maggots on the government now. They own the courts on the on the voting process. The courts are gonna hear anything. So that's a fantasy. On people still think you're gonna bolt your way out of what we're into. Now you're dreaming. And this stuff in the capital. You know, whatever. Cool. Whatever the hell you want to call it, And there is plenty of trump people in there, too. Well, they're not made me mad about it. If you're gonna go in there and do that go full bore. Why? Why you're going to go in there? Just get yourself arrested. I mean, Yeah. I couldn't care less You did. I didn't go far enough as far as I'm concerned, because what is the point of that defined for enough form far enough for me? What You mean they didn't go far enough? What would you have done if you'd been in that capital? Wouldn't want in there doing it that way anyway. But, hey, we're gonna go in there and you want to change the government and keep going until you get a hold. All them congressmen and women. Whatever. What do you mean, get ahold of you're starting to scare me with little homey. Get in there and ground around the neck. What do you think? I mean? You tell the harm? That's why I've been going. Why even go in there? You're not going to do nothing. Well, I don't. I think First of all And I need Tolo put you on hold because Talk about inciting violence, not the summit's gonna listen to a Ruger and Gold Valley say I'm gonna go out. That's why we should have done it better, but the idea that anybody would have been harmed in any way, shape or form I am a trump supporter of any kind is offensive to me to the core. It's stupid, their domestic terrorist. They should not have been there. I believe they were pawns now to your point. There are people that if they wanted to Could have done some very bad things. In other words, if what happened is what I believe happened this was staged. This was planned. But the idea wasn't for somebody Go in there and shoot somebody. You know you have reckless North Dakota Talk show host saying the plan was for the trump people Toe. What wasn't Kevin pull Mike Pants out in front of the Congress the capital and shoot him kill him. Kill him. That was what if they had to stop those people? That's what they were going to do. Oh, no, they weren't. No, they weren't when we say those and we went and we Majority mass majority of the people would not have let that happen. No way. Well, right, And I think again we say these people. I believe the trump people that were there meant no harm, but they're mad. They went so far as to break the law and become domestic terrorist. Because they're mad. They see what's happening to trump. I'm mad too, but I wouldn't break the law number one number two. The people that facilitated I believe Of the 15,000. They were first there even before the other 35 came and joined that crown on Lee 35,000 of the hundreds of thousands that listen to Donald Trump even came up there. So the 15 there were there even before Trump stop speaking. We're one of two categories organizer's planners. Fugs and TIFA. BLM hired pros. Former Navy seal Whatever People don't know how you get into a building quick, even when it's being guarded now. Any Law enforcement officer. With two brain cells to run together, knows there's going to be a large crowd up there, and a lot of people there they were not prepared was that Incompetence. I believe that's what the majority of Congress now believes believes because three people at the top have been fired. To sergeant in arms and the police chief. The Capitol police fired I also believe because there's an investigation. But they also believe there was Melfi's is that's problem one but the promise the really good ones If they are not good, I mean really bad. The bad actors the small percentage of the 15,000 that were there early. You write what they were doing. They knew. Maybe how to hate good job We love you blew on the blue line. We love you. You know how you doing? A selfie with me love them into thinking this is no big deal. Meanwhile, they know who's at the window, breaking the window, hoisting people and look at the pictures, camel and a helmet. If they wanted to kill Mike Pence. God forbid, or any member of Congress. They'd have done it in a nanosecond. They would've snuck one sniper in there. And put him in the gallery. That wasn't what they wanted. What they wanted is what you saw on TV..
