"Public interest, 93.9 FM and AM 20, NPR News and the New York conversation. Welcome back to The New Yorker Radio hour. I'm Vincent Cunningham. We've been hearing the story of a Mod armory. A young man killed in February. There was no secret to be solved in this shooting. It happened in broad daylight and the men who did it were on the scene. When police arrived, there was a video The killer's weren't arrested until more than two months later. After the video was made public. I watched that video Um And just Was horrified. I was trying to understand what happened in Ahmad, our Berries case, so I called up another district attorney, Rachel Rollins. She's the DEA in Boston. I reached out to her because she's one of a small number of progressive prosecutors her critical of Hadiya's handle cases of police violence. Yes, the police are getting a hard look and they're being held to task as they should be. But the nation needs to gaze strongly upon D A's as well because I think, as we can see in the Samad are very case and in many others, D A's have failed our country. The job of the district attorney is to prosecute crimes for the local government, usually the county When someone is accused of a crime. Prosecutors decide which charges to bring The DEA is the chief prosecutor. We have so much autonomy in the ability to choose who we're going to prosecute and who we aren't that autonomy or discretion. It gets tricky when it's the police who are accused. This just magnifies to me the sometimes incestuous nature of district attorneys and law enforcement or individuals that have worked in their office. My ancestors. Rollins means this. Today's work very closely with police departments they have to. They rely on them for investigations for warrants, and they often ask them to testify during trial. And when the police think a crime's been committed, it's the prosecutors who decide whether or not to charge it. Police and prosecutors are essentially colleagues, especially in a small office like the one in Glynn County, Georgia. You heard the Monica that, you know, deviating in that ham sandwich if they want, but they choose not to invite police officers. That's Lee Merit the attorney for Ahmad, our Berries, mom. They are the ones worth 40 access to justice is the reason why it seems that we have two different court systems because they are Johnny on the spot with prostitutes, but really ridiculous things like Walking in tow away, but they're not very competent in prosecuting police officers. Let me give you an example of what merits talking about. Going to back up for a minute here. Years before our very Jackie Johnson oversaw another notorious police shooting. In 2010, a Glynn County police officer shot a woman Caroline Small in her car after she had crashed. Caroline Small had committed no crime. That morning, She drove off when an officer walked up to check on her in a mall parking lot. She drove erratically eventually blocked in by a utility pole and several patrol cars. On video, One officer said. If she moved again, he was going to shoot her. Then they did. The officer who shot small Robert Sasser had a disciplinary history that was about a mile long. As D A. Johnson's job was to present the case to a grand jury. She did such a poor job of it. That a member of her own office called it a cover up. The cover up was worse than the crime in the crime was bad enough for former prosecutors are speaking out with why many on the D A staff thought her actions were over the line. Johnson fired a prosecutor who supported bringing charges in the case. But Officer Sasser kept his job on the police force. Eight years later, Sasser killed his estranged wife, her boyfriend and himself. I tell you It's scary. It's really scary. Nathan Williams is a local attorney who represented the families of both women killed by Robert Sasser. We live in an incredibly conservative area of this country. It is very pro law enforcement and I understand it. I get it. To get people to understand that they can find themselves in a similar situation. Andi treated the same way is almost impossible on DSO. It's kind of like you're screaming. You're staying on top of the hill on your screaming saying, Hey, guys, you need to look at this. You need to pay attention. This is this is not good. This is not good. Williams tells me over and over in our conversation. That most of the people he knows and law enforcement are good. But he also says there's a serious problem with the Glynn County P D and beyond. It's frightening, certainly, as As someone that has two young girls. That Eventually we'll be driving around and I'm sure to some extent doing stupid things. You know, like we all did. You know, it's it's frightening the lack of checks and balances that we have, you know, probably Countrywide from a law enforcement standpoint, but certainly Locally. The women Williams represented were white. Williams and his daughters are white. He's a local a lawyer. He knows people. If he feels unsafe driving around rural Georgia think about how other people might feel. Gregory and Travis McMichael were arrested on May 7th 74 days.

Roddy Brian Acklin you do not agree with me. Do not you are wrong. You're wrong. All right I'M GONNA go first, and it starts here and I say unfortunately and I want to preface that folks I'm not making an argument for Roddy. Brian what I'm telling you is what's going to happen and unfortunately this is a great piece of evidence for Roddy, Brian, this video and it comes down to the arguments that Kevin Goth is attorney. Make look at the facts surrounding the video, the only person on the face of the earth who knows this video is being made and being recorded at the time. It's being made in recorded. Is Roddy Brian Okay. He's the only one that knows. That this video exists. He's the only person on earth okay. So, if in fact, prosecutors are going to argue that these three men are working as a lynch mob. Are they going to argue that Roddy Brian's job as part of this lynch mob is to Corral And make sure that you record the lynching, so we can memorialize all of this. And don't forget how everyone finds out about the recording. Roddy Brian at the scene. Invites police into his truck to view the video, so police show up there. My point is this makes that video the fact that he shoots video and there's more obstacles now. Prosecutors unfortunately again that and to me the obstacle is not only do I have to prosecute these three men. I've got to prosecute the local police and I've got to prosecute the local prosecutor and guess what I'm probably going to have to do it in Glynn County. Georgia. That makes the case more difficult. It's like it's like A. It's like a harper. Literally, but this is what in is in the south? We Wanna say that we come. We've come so far, but that's what it is, and that's how that's how big it is. That's how big it is I think we're agreeing here Hear me out here me out on my theory and why we're agreeing okay, because we're. We're making to arguments that are. not necessarily in conflict everything you're saying. I'm I'm agreeing with. Right. I, just have to get you to agree with the fact that the case is a little bit harder against Roddy Brian with him shooting that video and handing it to police, because now prosecutors have to take on the police and the prosecutors right so. Can we agree on that yes? Yes, all right all right I think we solved it. I think we did. This is a big moment, but I will not ever. Ever cheer for the Yankees. Especially when they play my mets, that will never happen, but I think we can agree here. To a certain extent that the there's going to be some obstacles here, but I think what you have shown me. And made me realize how you look at the case. You know I look at the case a certain way, but I have to get a different mentality onto to to get to that next level. So?
