She said has happened in the 90s while they were dating and that walker drove her to the clinic to have the procedure. On Wednesday, her lawyer Gloria allred spoke to the press about her client's allegations and played audio tape of the woman. Herschel Walker is an infringe. And he's not fit to be a U.S. senator. We don't need people in the U.S. Senate who profess one thing and do another. Persian walker says he is against women having abortions. But he pressured me to have one. And the significance of course of this professor Anderson is that he supports almost total ban on abortion. So talk about this race overall, which doesn't just involve abortion, though it's certainly this issue has come front and center. His son has come out against him. He talked about being a police officer showing a sheriff's badge. Well, you can lay it out for us. Well, and so what we have to remember is that Herschel Walker was tapped by Donald Trump. When Herschel Walker was living in Texas to run for the U.S. Senate here in Georgia. And so it's so cynical because Raphael Warnock is African American. And so you can see in the kind of cynicism of Donald Trump. Well, Herschel Walker's black and he was a big football star at Georgia. Let's pit him against Raphael Warnock. They won't be able to tell the difference. There is a fundamental qualitative difference between the two. Herschel Walker lies. He lied about his graduation. He lied about his businesses. He lied about being a law enforcement officer about being in the FBI. He lies. He lies. He lies. And remember when the issue about how many children he had started coming out, there was an incredible report about how his staff had asked him. Are there any more children? He's like, no, and then another one would pop up. Are there any more children? No, and then another one would pop up. And so his own staff didn't trust him. Yet they're asking us to vote for him to trust him with our lives in the U.S. Senate. And so what we're seeing here is that Herschel Walker really plays to the stereotype of who the Republicans believe African American men are. That they're sexually promiscuous. That they're violent because, you know, he held a gun to his wife's head and threatened to blow her brains out. That they are liars, that they aren't smart. They're all brains, they're all brawn, no brains. I mean, all of these stereotypes and what they know about Herschel Walker is that he is pliable, that he will do what they say. So with those stereotypes, they've got all of the horrible stereotypes and they've got that actual stereotype coming back from a slavery days of being compliant. And that is who they're trying to foist upon us. In this election, and what this means for who controls the Senate. And because what we know about the control of the Senate is that that's where judiciary appointments are come through. We know that that's where voting rights come through. And we're blocked this last time. We know that that's where the right to reproductive rights comes through. And so who controls the Senate has so much to do about the quality of the lives that we will be able to lead. And to force her walker up there as a viable candidate is unconscionable. And of course, it was Georgia that determined the balance of the Senate this time around, with both senators ossoff and Warnock winning. To the surprise of many last time around. I also want to bring Ari Berman into this conversation. One of the leading journalists covering voting rights, reporter at mother Jones, author of give us the ballot the modern struggle for voting rights in America. Ari, before we go to our second segment with you to talk about Wisconsin. If you can talk more about your just back from Georgia, what you found as you traveled there. Well, thank you for having me again, Amy and great to be on with Carol. One of the things that happened is that in the last year, Georgia passed a law that severely restricted voting rights. And this is led to a lot of uncertainty in the states. We saw that vote by mail has gone down dramatically in Georgia during this election. Part of that is because some people are going to vote in person now that we're in a different phase of the pandemic, but it's also because vote by mail has become a lot more difficult now than it was before. We've seen tens of thousands of voters have their eligibility challenged by Trump backed election desires, which has led to a major level of uncertainty in terms of whether votes will be counted. A lot of people are voting early, which is a good thing. There's been record early voting turnout. But then that record early voting turnout has been spun by Republicans to say, oh, there's record turnout. There's no such thing as voter suppression. As opposed to the fact that the record turnout is an example of how folks are navigating the barriers of voter suppression. Then there's the fact that Brian Kemp has a long history of voter suppression. He has a very extreme record when it comes to issues like abortion, guns, et cetera. But he is getting a tremendous amount of credit. And basically a complete free pass from media simply for certifying the 2020 election, like every other democratic and Republican governor did in 2020. So Brian Kemp has been allotted by the media as this defender of democracy, even though he systematically has undermined voting rights, first as Secretary of State in 2018 where he was both Secretary of State and a candidate for governor, which undermined all sorts of democratic norms. And then last year, when he signed the voter suppression law that became a template for voter suppression all across the country. And so I think that Stacey Abrams is struggling to deal with that perception of Kemp because even though he's very extreme, he is being portrayed as more of a moderate, simply for doing his job, which every other governor in America did. And finally, Carol Anderson, you not only look at Georgia, but as a voting rights expert, have been looking at races across the country. Can you talk about Arizona, where Carrie Lake, who is running for governor there. Said that she will only accept the elections if she wins.

We've got a new scandal on our hands here. Another woman has come forward Jane Doe is represented by Gloria allred. Now, I don't know if this changes anything Genie if this is a story that, you know, obviously he's survived a lot of allegations here of paying for former partners abortion. Now we have another woman who has come forward, listened to Jane Doe today. I'm certain that I was pregnant as a result of my relationship with Herschel. And because I was not intimate with anyone else at the time. He then drove me to the clinic, the following day, and waited for hours in the parking lot until I came out. He then drove me to get medications and supplies as prescribed. And then drove me home. Pretty tough to hear this as Gloria allred holds up a photograph of Herschel Walker in bed. Rick Davis does it matter. You know, look, it's another bad week for Herschel Walker on the campaign trail. Whether or not that impacts his base, people who really don't care about him, but want a Republican in the Senate. So the Senate can be Republican. Majority. It's not going to affect them. But in order to get there, he's probably got a few tens of thousands of voters who are going to have to say, you know what? I got to come to grips with this. And those swing voters are going to be thinking about abortion going into the election. And that's a bad thing for him. We haven't seen this move to neilia, really genius, especially after the debate. Their neck and neck. Does this change anything? Yeah, and let's not forget early voting about 1 million voters already cast their ballots in Georgia. So these late drops of information have less of an impact than they used to before we had so much early voting in the United States. I did have to look up the Ricky Bobby reference Joe Matthew because my movie trivia escaped me, Talladega nights. I don't know if I've seen it. I don't know what scene that was. I highly encourage you to watch that. Oh, okay. I was baffled by that, but now I'm sort of with you. Going to the good content. We're getting to the good content I guess. But the reality is, is this is another example if it's proven to be true of hypocrisy in the part of Herschel Walker because he has taken a stance at least prior to the debate that women in Georgia and around the country shouldn't have an option, and they shouldn't have not even in the case for exceptions for rape or incest. He changed that over the debate, and yet we've got another story of what's not good for the American women is okay for Herschel Walker when it pleases him. And so if it's proven to be true, it's that hypocrisy, but to Rick's point, it's hard to know whether it matters or not at this point. "Will see a wonderful photo of justice Ginsburg and I talking in the courtroom of the United States Supreme Court when I was there on time to for a reception to honor a federal judge and I was sitting in the courtroom waiting for the judge to come out. It was going to be honored, and I looked down, and I felt some one was standing next to me, and I looked up and there was just as Ginsburg, so I immediately stood up and we had a wonderful chat. She had been apparently very aware of my work for women's rights. We are the leading women's rights law firm in the United States and have been for 47 years. Somebody I know took a photo of the two of us standing there chatting and afterwards this person said to me Gloria took a photo of justice Ginsburg and your chat in do you want it? I said, I don't know if you're even allowed to take a photo in that courtroom. And she said, well, I'm not a lawyer. I didn't know that. Do you want the photo or not? I said, well, yes, please send it. And then she also this other person also took photos of justice Ginsburg and I having dinner together in the Supreme Court dining room where we were there to honor the federal judge and the host of the dinner surprised me and sat me next to justice Ginsburg. So we had a long time to chat. I can only tell everyone she is everything that people thought she was and more just so committed to women's rights and rights for minorities. I love that as this is radio for me to describe as I love that since I've mentioned this little statue where she's got a crown and a cape. You've been holding it out. By the way, she said, you know, somebody we have 9 justices on the United States Supreme Court. Someone asked her how many should be women. She said, 9. And then people were surprised and she said, no one was surprised when there were 9 men on the Supreme Court. Why would they be surprised that I say there should be 9 women? Gloria or at the end of our conversation reminiscing about her evening with Ruth Bader Ginsburg at a Supreme Court dinner giving you an insight there, I hope. "Well, he doesn't really have much choice about whether or not he answers the complaint that was filed against him, which of course he did answer. And of course, he did demand a jury trial, but that is really not what much of the press has made it out to be. Because in New York in a federal case, if one party demands a jury trial and Virginia did demand one in her complaint, then the other party is going to be subjected to a jury trial. And so he might as well just say, I demand it, which he did. Because if he demanded a bench trial, meaning one by the court, he would have had to have a jury trial anyway. Now, as to the question of the settlement, would you posed? That's always an option that can be explored in a civil case than the discussions of settlement are confidential. We are now in the position where it's being litigated publicly. And her attorney is saying that she wants vindication and essentially he's saying that that would have to be a very large number and amount of money that he would have to pay to settle it. And it appears that the next step is going to be having his deposition, his testimony under oath, taken, and that will be in the UK. Probably in the next few months. They're going to pin him down as much as possible. He's not going to be able to just kind of skate around and avoid and evade, try to have some kind of answer, that really is not an answer. The opposite in fact, from early on, she's played a role in such cases as supporting women demanding local authorities. And I think for me, there was a feeling that I had that my authenticity. I hate that word. And so I'm doing air quotes. Was being, you know, perhaps questioned that people would ask me are we trying to get away from brick lane and some way, which I don't know how to take that other than are you trying to get away from your ethnicity or the color of your skin, which is just a bizarre and actually kind of insulting thing to be saying. But actually, I wrote about different things because I'm not one thing. Maybe you're subsequent books. And my subsequent books, you know, yes, my father's Bengali. I was born in DACA, my mother's English, I was lived here all my life. So to me, it would have been totally inauthentic to try to pretend well, this is my brand. This is what I have to continue with in order to sell books. You know, in order to fit. Into what would have been a phony brand for me. Well, I don't even see it as about being pigeonholed. I am not one thing or another. But we are very keen on to put people in certain places and that's how we understand them. And nuance and difference of direction is not often understood or certainly welcome. And especially in a commercial situation. I read and you tell me more that it was a particular type of meditation that really helped. You threw that time. And I think when people listen to whoever's gone through something, they often like to know what was it? And you talked about the writing, but what was the meditation part? Okay, so I do Vedic meditation. I mean, people might know the term transcendental meditation. And I think you have to have been to the particular school that teaches that and it's trademarked or whatever. And I didn't go to that one. So call it faded meditation. It's mantra based. And I had tried meditation many times over the years, which focused on breathing. And I would just find that I felt like I was on the verge of a panic attack. I just could not cope with that particular kind. It didn't suit me. So when I found the mantra based meditation, it was a total game changer. And honestly, life-changing. I heard that things so many times that you are not your thoughts. And I thought that was total cod swallow. I mean, what else am I other than my thoughts? Meditation does help me to see that there is a truth in that, you know, that you can see the thoughts that you're having and you don't have to always engage with them and disrupt the rhythm of them. Well, it's very nice of you to be able to share that. Thank you for doing so because you never know who you'd help as well, who might just be having one of those moments or a series of moments..

talk about how with me now is Jane manning director of advocacy for the group women's justice now which campaigns for better prosecution and prevention of violent crimes against women and provides direct services to survivors as they navigate the criminal justice system she helped lead successful campaigns to repeal New York statute of limitations on rape cases and to criminalize strangulation attacks Jane thank you so much for joining us thank you so much frame how much do you think one man being convicted of crimes yesterday is the story and how much do you really think the whole world changed well this one story will have huge ripple effects for the whole world it tells survivors that there is hope for justice it tells sexual predators that no one is above the law and it tells prosecutors that if you're brave and you take difficult challenging cases to trial you may be able to succeed a New York times op ed today says that Mr Weinstein sixty seven that that he even stood trial was a remarkable anomaly a vast majority of sexual assault cases never reach the court now but this outcome is not an end point while there may never be another prosecution quite like the one of Mr Weinstein the article says increasingly we'll see others that resemble it and so my question is if you agree with that what kinds of trials may get brought that may not have were it not for this case it's such a great question and the answer I think is that's up to all of us it's up to prosecutors who make those decisions dated day whether to turn down cases of rape unless they're a slam dunk win which happens in all too many DA's offices but it's also up to the rest of us in our communities because DJs are elected locally and it's up to us in our communities to sound off and make sure the candidates for district attorney and incumbent district attorneys understand that fair and vigorous prosecution of rape is something that the community holds to be important here's Gloria Allred speaking yesterday the lawyer or one of the lawyers for the accusers in this case it's no longer business as usual in the United States this is the age of empowerment of women and you can intimidate them anymore because women will not be silenced they will speak up they will have their voice they will stand up and be subjected to your small army of defense attorneys cross examining them attempting to discredit them two million eight them shame them and they will still stand in their truth so Harvey Weinstein this just this has been a long time coming but it's finally here attorney Gloria Allred yesterday and she's a lawyer but she wasn't speaking just legally is there or in technical legal terms I think she was talking about cultural change yes she was and I'm so glad that she anchored her comments around the survivors who testified in who spoke out because to the extent that this verdict offers us a chance at broad social change and and the only chance that depends on what we do with it but we all have that chance to the women who spoke out about Harvey Weinstein and especially the women who testified in court the two who received convictions and the many women who didn't receive a conviction including Annabella Sciorra and can I say something about her case she testified in this case as somebody who is also a victim of Harvey Weinstein but I guess because the statute of limitations laws could not that case could not be prosecuted right that case could not be prosecuted and moreover the counts that depended on Annabella sh your as testimony as a predicate offence of preceding offense those were counts of the jury felt him not guilty on and a lot of people will wonder what does that mean that the jury didn't believe Annabel sure are and I just want to say it doesn't necessarily mean that many observers felt that Annabella sh your was extremely credible and probably the most corroborated of all the witnesses who testified and the jury's verdict might have had something to do with hello how many years back the case stretched one of the first questions was about the statute of limitations and Annabel sure his case and that might have been their concern it doesn't mean that they didn't believe her but what I want people to know is that her testimony mattered it supported the accounts of Mimi Haleyi and Jessica man and after I heard the verdict yesterday I spent a lot of time thinking about Annabel shura and I was worried and I thought maybe she felt a sense that the jury didn't believe her and and then I read her quote and here's what she said she said my testimony was painful but necessary I spoke for myself and with the strength of the eighty plus victims of Harvey Weinstein in my heart and when I heard those words Brian it's filled my heart and I knew that at all sure it was going to be okay but on the chance that like a good New Yorker she listens to the Brian Lehrer show I I didn't want to say this to Annabella I wanted to say would you also keeping your heart my thanks and the thanks of a multitude of people who believe you and honor you your testimony mattered and it made a difference how much do you thing believing women that phrase that we've heard so much kind of flipped from where generally has been historically injuries they have to believe the accounts of what happened that Harvey Weinstein denied and they had to believe them even in light of some of the narrative which would have prevented cases like this from being brought in the past as I understand it that they kept in touch with him that there was consensual sex after the non consensual sex that in one case a woman who change phone numbers one of the accusers even gave him her new phone phone number these would have been things in the past that would have let juries to disbelief what changed I think the jury in this case worked really hard they had testimony read back they took days to deliberate and I think that ultimately they were persuaded by the evidence that showed that one of the victims many have late was financially dependent on her relationship with Harvey Weinstein she needed to keep on good terms with him in order for her career to keep going the other victim Jessica man had a situation that was more complicated she was in a relationship with him and relationship violence is something that can be very hard to understand but it's very real and I think the fact that the clearly the jury took their time with that case as well and ultimately they didn't convict him of rape in the first degree they convicted him of rape in the third degree which I think reflects what we want jurors to do they listen they fought they struggled and I think they ultimately reached a verdict that showed careful reflection and attention to the evidence which you as a former prosecutor talk to the difference between first degree and third degree rape so he was convicted on third degree rape which as I understand it involves in the sale and having sex with someone without their consent where as first degree rape requires forcible compulsion be proof what's the difference between forcible and without their consent yeah so forcible compulsion first degree rape requires what the law describes as for sufficient to overcome lack of consent there is a sense of being physically over powered by the person and Jessica man did describe a situation in which she was physically over powered by Harvey Weinstein and the jury I think had legally sufficient evidence to convict on account if they had chosen to do so but they didn't they convicted of rape in the third degree and that refers to a situation where the the victim makes it clear that she's not consenting and the perpetrator goes ahead without her consent it's a it's a lower level of physical force that's required that's what the jury felt was supported by
