The legal troubles are mounting for the former guy as we learned just last night that not only is the new york attorney general tips james teaming up with Vance on the trump organization investigation making her civil suit also criminal investigation but that she has had a criminal investigation open against weisselberg. Cfo the trump organization and sent a letter letting them all know back in january. She's been doing this for months now. And i find that fascinating. And i was hoping to get your top line thoughts so top line thoughts are okay. What do we know based on this announcement by attorney general james and what can we reasonably infer. Well what we know. Is that if you're the target of an investigation and it goes from being a civil investigation to being a criminal investigation. We know that's bad for you. That's bad for donald trump. that's bad for the trump organization because civil investigations are all about money. All somebody can do to the target of a civil investigation is you know levy fines and penalties and make them pay restitution and then maybe at the most extreme they can prohibit you from running a business in the future kind of like when james shut down the trump charity and when she went after and is still going after the nra. Filing they expect over one hundred more people will be criminally charged for january sixth. The prosecutor said the investigation and prosecution of the capital attack will likely be one of the largest in american history both in terms of the number of defendants prosecuted. The nature volume of the evidence over four hundred individuals have been charged in connection. Now right the investigation continues. The government expects at least one hundred additional individuals will be charged They are continuing to investigate the planning of the insurrection. While most of the cases have been brought against individual defendants the government is also an spirit stating a investigating conspiratorial activity that occurred prior to in on january six. So tell us what wreck. Because i know you even talked about in your twenty five years even since nine eleven. You haven't seen the scope of something like this right indeed. This has become the largest. Fbi investigation in euros history. And here's why you might think really bigger than nine eleven but the the reason is twofold at least i. It truly is involving every single. Fbi field office they l. a. Sadly every nook and cranny of this country has even even the most far-flung fbi offices and their satellite offices has subjects of investigation that participated in the insurrection. So it's literally involving all fifty six field offices and their satellites set. The sheer numbers involve the subjects. And i told yes indeed. It will meet the five hundred mark and even surpass stat but the volume of evidence. Now we're in you know we're in a digital age and all these knuckleheads felt it necessary to not only post their plans to go live on their facebook feeds or brag about it afterwards. So yes it's huge. But here's the more important part quite. Frankly it's that they're headed everyone. I talked to says look. They're headed into serious conspiracy charges. They they are getting to the bottom of leadership planning coordination. And i you know as recently as this morning i see people posting on social media. You know what's wrong with the fbi. Why isn't this moving faster. Why don't they have republicans. Chill out chill out. It's it's a very complicated investigation. But they are headed into relationships with planners advisors and we've gotten some garland's team in place literally because of all the republican extremism. But let's get to your piece. Why trump lawyers should fear the capital. Right confession confession. Let's get to the good stuff. So you write a longtime oath keepers. Veteran has been flipped. This only happens when prosecutors care more about the information the defendant can provide then about nailing him with a maximum sentence. They're even talking about a witness protection program right for this oath keeper so you say learning more about the oath keepers not just right for legal but you said could prevent future violence by revealing. How the paramilitary group recruits its members from among active duty retired law enforcement and military. That seems really key because that seems like a huge problem right now. So we're now seeing the first plea agreement and guilty glee and what does that. So why would prosecutors offer founding lifetime member okay for some kind of deal because they want what he has. They need his information. And you can imagine what he has to say about. Right no question in my experience once you get people like this. Just sitting and marinating in a lockup somewhere they start to talk. They started to second. Guess why why. They're being so silent and off understand the threshold judge to decline bail on this pending trial. Is you the evidence is overwhelming that you are continuing danger to society. Well and you said. I don't know if this was on tv. I think but you said the magnitude of the charges will move from things like trespass on the salt. All the way up to conspiracy. And we're seeing more of that. And even possibly sedition even possibly an enterprise theory of approach which is under consideration to take down and dismantled groups like the problems and oath keepers so Yeah i mean this really is we really are in kind of a tip of the iceberg situation are we these cases take time. "All right everybody welcome back and welcome back. Former DC federal prosecutor Glenn Kirschner Glen. How're you holding up I'm hanging in there. You know watching Donald Trump. Wipe is muddy feet on the constitution other than that. I'm fine. It's It's harrowing. And usually when the wrong in fuhrer breaks the law, you and I can sit and rattle off potential legal remedies you know, ask for documents. They'll refuse subpoenaed documents they refuse. Hold them in contempt. It goes to court. We litigated Skoda's for a couple of years but what he did last night shook us to our core, and I personally am too disoriented to attempt to think about legal remedies, which is why I have called you. Can you help me out with that? I can try unfortunately. I don't know that I have any good news because you know when you look at the Constitution and you look specifically at the bill of Rights Right the first ten amendments to the Constitution. It it doesn't really grant rights to the people. It's not a list of do's. It's not telling us. We need to go out in practice, religion, or speak freely or assemble or bear arms. It's a list of dolts right. It says that the government cannot do certain things they cannot establish a religion. The federal government cannot stop the people from freely exercising religion. The government cannot Abridge. That is mess with to use Beagle term our free speech. It cannot mess with our free. Free press it cannot mess with our right to peaceably assemble and petition basically or protests petition the government for a redress of grievances. You know it's a list of don't and so the question that we're now facing today is we saw Donald trump violate the first amendment. He did one of those don't something that is prohibited. He wanted to stroll from the White House across the street to Church. He has never attended to hold up a Bible. He has never read as. As a photo opportunity that he could then use as a campaign ad, and in order to accomplish that because the people were exercising their First Amendment right to peaceably assemble, he had apparently at the direction of his attorney general. Bill, bar. He had the people gassed. He had the people flashbang. He had the people assaulted. He had the people moved out of the way, so he could stroll across the street. That is a pure in arguable violation of the First Amendment what? What the heck do we do about it? The problem is when you assault somebody you walk up to somebody in the song in the street. You Punch him in the base. We can arrest you. We can charge you. We can haul you into court and the charge in DC would read something like you know on June second twenty twenty within the District of Columbia Mr Defendant Joe. Smith assaulted mister victim so and so by punching him in the face with a SPA. You can charge somebody with a crime. You can't charge somebody with violating the constitution I can't hall somebody into court as a former prosecutor, and charge them with violating the First Amendment by interfering with the People's right to peaceably assemble, so that's where we find ourselves. We see the president who has violated the Charter of our country, and he has violated the the sort of rules that govern how he is supposed to behave what he can do and what he can't do. And there's really nothing we can do about it. If the our elected officials that are supposed to be representing our interests will not stand up to him and deploy some kind of remedy like impeachment and removal so I you know I I think bill bar is probably smart enough to be telling the president. You know what don't worry so much about the constitution because there's nothing that can be done when you violate and that's that is where we find ourselves. And he put that out just hours later. The White House that he made. From that photo op. That was. Interesting and then of course Tom Cotton I, think it was Tom Cotton tweeted. Look at this brave man. What president has come out of the White House to go to church like? Like. Like we need to be praising him for those actions, but the Washington Post reported today that apparently White House officials asked DC the district of Columbia about taking over the local police department, and that's according to Mir, Miracle bouncers chief of staff. How does Posse comitatus in the insurrection act apply in the district of Columbia. We know how it applies to states. Yeah while because district of Columbia is not a state. It was chartered as a federal city. The basically keep the federal government up and running it I don't think the insurrection act necessarily applies which is why, or while Posse comitatus I, think would apply anywhere because the military is strictly prohibited from being deployed to enforce civilian laws and I. think that's going to apply in the district district of Columbia as well but I when I was really heartened to he. That Mariel bowser our mayor here. In Washington DC stood up on TV today and said let me be clear. We the Metropolitan Police Department the. You know the city law enforcement agency. Did Not participate in what you saw being done to. The citizens you know in order to allow the president to walk across the street to the Church and I. Think you know that was if not firing a shot across the bow? It was her wanting to be clear that what you saw was a violation of the constitution and the deprivation of the People's rights, and we belong enforcement. Arm of the DC city government had nothing to do with that, so we're starting to see some politicians and some police chiefs around the country. Push back. On the President I, mean I love that the chief of police of Houston I think. St tweeted or set it in a speech, and he said Look Mr President what you're saying is not productive. You're fanning the flames of do me a favor. Shut your mouth, and if we have more, you know. Police, chiefs and governors and mayors and city council members across the country begin to push back on the tyrant in a way that the Republican leadership in Congress won't. Maybe maybe we start to have an. An impact do do we know what force did? move the peaceful. Jude fired tear gas into the peaceful protesters. Did fire rubber bullets in there, do we? What force did that I reporting I saw was a US park police. They have you know having practiced for nearly a quarter of a century in DC, it is the strangest place when it comes to law enforcement because it really is parceled out. Among so many law enforcement agencies, and in thirty seconds I can probably ravel most of them off. It's like FBI ATF DA US Park police US Capitol police US secret. Service uniformed division US marshals service, US. Postal Police Amtrak police. US Metro Police Federal Protective Service it goes on and on and on and on Department of Veterans Affairs Police. He was supposed to testify March thirty first but as we know because of Cova concerns the courts closed so he didn't testify. I'm sorry not the courts The House because he testified in front. How does your committee So they're GONNA do it. June ninth and ninth is the first day that They're back opened up unless it's postponed again. And Adler said that they are willing to use their full powers of contempt and subpoena powers if he refuses to show up and also they he said that you know they have power of the purse in Congress and he'll defend the AG's office if he doesn't show up Holy Shit I know and yet and yet all of that all of that all of that and I still don't think that he'll show up you know and that's that's the sad part is like they can say whatever they want and they can. They can be as firm as they want. But these people don't care no exactly and unless they use inherent contempt. And and send the sergeant at arms out to fucking grab the motherfucker. They have to go through the Department of Justice. Anyway to enforce a contempt order so that would be bar. Who wouldn't do that to himself. This was just ahead out of Muller's public testimony to Congress which took place July twenty fourth. That's just one day before the infamous call between trump Alinsky for which the president has now been impeached when when he withheld aid and dangled a White House meeting in exchange for investigations into his political rival and of course the origins of the two thousand sixteen Russia investigation. He spent thirty years as a federal prosecutor with DC US Attorney's office and he spent a lot of time. I am working with Muller so please. Welcome Glen Kirschner Glen. Thanks for coming on muller she wrote. Thanks for having me appreciate it yeah. We're so happy to have you on because we want to get some expert insight Into Muller before his upcoming testimony to the House Judiciary Intelligence Committees. I think it's about ten days from the airing of this episode and Those of us who are keenly familiar with what's in his report and have been following this all along probably aren't going to learn anything new and might be slightly feeling disappointed. Had with his testimony. But that's not really. What makes this appearance so important? Is it no I mean. There's been so much disinformation put into the public square by trump by bar by all of their enablers that I think part of what we're part of the reason Bob Bob Muller's testimony is going to be so important it's it's not only to bring to the public's attention his findings Particularly with respect to the many felony obstruction of justice offenses trump committed. But it's GONNA be hopefully to rebut the epoch. Disinformation nations campaign. That trump and company have been waging against the American people with their with their very effective mantra no obstruction no collusion Aleutian. Hopefully Bob Muller will find some ways and hopefully congress will come up with some pointed precise questions to help Bob Muller find some ways to combat that information campaign. Yeah and that's all. Yeah thanks to Attorney any General William Bar who's Four page quote Unquote Summary of Muller's findings SORTA it totally misled led the public. We saw that woman in the Justin Amash Rally say. Gosh I had no idea there wasn't anything About trump that was negative or there was anything negative in the Miller report about about trump. So it's it's I think that that's kind of why this Testimony is so important and Muller has said that his report is his testimony and and he warned that he won't talk about anything that's not in his report but as you were just indicating do you think if if the questions are asked properly that he might answer some of the critical Outstanding banding questions we have like. was there actually no collusion or no obstruction. Or if president weren't the president. Would he be indicted. I I guess my inclination nation is when Bob Muller says my report is my testimony he means it but you know he is a by the Book Guy Law and order. He's a rule follower. So I actually think what you referenced. A minute ago. When Bill Bar issued his misleading summary of mothers report it really cut against against POB molars grain to issue a written rebuttal of that and say hey look bar you mischaracterized my findings and conclusions and your misleading? The public. CUT It out. That is unlike Bob Muller because he's sort of the king of circumspection but you know he's also a soldier and in the middle. I used to be an army Jag in the eighties. We are taught that you have to number one obey a lawful order but number two you have to disobey unlawful order and sometimes those two things bump up against one another but going back to your question I think if the questions are precise enough then muller will have to answer some things even if they are somewhat outside out of his report so for example one of the questions I would ask him is look Special Counsel Muller you've heard President trump say over and over again your investigation negation found no obstruction. Is that true or false. I think if he's answering even within the four corners of his forty eight four hundred forty eight page report port. The answer is that is false. Our investigation did not find no obstruction. Same question with respect to collusion so I think if crafted properly I hate to say some of this is an exercise in getting some usable soundbites from Bob Muller. But here's here's what I would do if you can get those sound bites where Muller says definitively no we did not find no obstruction. We did not find no collusion. I think it's on the media every time they broadcast trump or bar as they do a thousand times a day saying no obstruction no collusion collusion. They should be obliged to put up immediately after that. That is false. Says Bob Muller so I hate to say it's. It's an exercise in debunking disinformation but because the lies got a several week head start coming out of bars mouth. The truth has forever been playing catch up and has and has not been catching up all that effectively. Yeah totally and and you mention Muller writing that Scathing maybe not scathing to us but scathing to muller that letter to bar about in apparently it was one of a couple of letters he wrote before the before the report was released to Congress in the public How important is it because we read in the threat by Andy? McCabe that when somebody like Muller particularly you know Mr Circumspect goes to paper like that it means a lot more than someone else just I. You know sending a reply on twitter writing a letter. So how important is it. He went to paper on that and also made his ten minute public statement. I wasn't expecting either of those things from him. Yes writing a A rebuttal to the attorney general. Who technically at that moment was still Bob? Muller's boss was You know I'm GONNA say out of character for Muller I mean ordinarily what we would do under those circumstances. If we had a dispute in our chain of command we would go behind closed doors doors with our boss and we would say boss. I've got some real concerns here but I think Muller recognized how high the stakes were and he also recognized how how dangerous bars mischaracterization was and that it was done. I think with I'm you to say evil intent And Muller felt compelled to put in writing his rebuttal his correction of what Bar said so so I think for him. That was Difficult but necessary. And you know I appreciate that Muller said listen. I'm going to stay within the four corners of my report. The problem is once he raises his right hand and swears. To tell the truth he will have to answer questions. That are sort of proper questions in that. They don't violate grand jury secrecy rules so they wouldn't require him to disclose matters. There's that are before the grand jury Or compromise ongoing investigation. So I think those are two areas where he can decline to answer answer because those are legitimate reasons to decline to answer those questions beyond that if there are questions that are posed that require him to go beyond the four corners. The report you know. He's raised his hand. Sworn to tell the whole truth he's going to have to answer those questions As long as they are sort of properly phrased My concern is that you know the Republicans are going to want to ask him about dossiers and spying on the trump campaign as a distraction and the Democrats may want to push muller well beyond the report to a place. He's not comfortable going. You know like if the president accident where a private citizen wouldn't you have indicted him for obstruction of justice. I can tell you was a career prosecutor. The answer is hell. Yes and but I don't know the Muller caller will answer that question because of the way he has you know already signaled that listen. The criminal justice system is not the place to formally accuse a sitting president of crimes that places the Congress and you know basically Muller's report report was an impeachment referral plain and simple how congress hasn't gotten that or why they are declining to open impeachment. Hearings has as me scratching my big bald head every day us to believe me and you know something like the question of if he were a private citizen would you indict him. I'm I'm almost sure of and I haven't worked with Muller's at all but I I just imagine him saying I'm not GonNa answer any hypothetical questions. Hey Hey it's a g hear. This is the daily beans.
