"In a lot of electronic devices is there's a rechargeable lithium lithium ion battery and an essential part of that battery is cobalt about two thirds of the world's cobalt supply comes from from the Democratic Republic of the Congo. That's according to Siddharth Kara. WHO's been looking into conditions in the mines that country for years now? His research is the foundation of a class action lawsuit and the defendants named in the suit are some companies. You'll recognize apple. Microsoft Dell Tesla and Google Parent Parent Company Alphabet the suit alleges. These companies are quote knowingly benefitting from and aiding and abetting the cruel and brutal use of young children in DRC to mind cobalt unquote. We reached siddharth. Kara in Los Angeles California Siddharth. has anyone ever tried this before suing doing it. Tech giant on behalf of children working in mines note this is a landmark case. No one has ever. At least prior to December sixteenth twenty nineteen tried to sue the largest ten companies in the world on behalf of the children in the Congo who mind their cobalt. Can you tell us some of the stories you. You have heard some of the things that you have found out about these children who are mining cobalt in the DRC. Well the research I've done in the DRC. In the cobalt sector in particular has yielded some of the most heartbreaking appalling and utterly unimaginable levels of exploitation and suffering of any sector that I've researched and almost two decades of research into slavery and child labour the peasant population and the children in particular are eking out a sub human existence stint caked and toxic filth and grime as they mind for the cobol that is used in. Every Lithium Ion rechargeable battery we in the planet and I think the worst stories I heard and I heard far too many of these involved young young young children and young men who would addict tunnels uh to find the larger cobalt deposits. Some of these up to a hundred feet deep And then these tunnels just would collapse and bury alive everyone inside and you were actually there doing your research at a time when one of these tunnels collapsed on a bunch of people including children's that right that is correct. Yes Carol it's it's probably one of the most Haunting and painful days of of all my research I was doing research near Lake. Malo which is Not Not too far outside of the city of Louisi- and Documenting some children when we received word that a tunnel had collapsed. Barely one hundred meters from where I was standing and and we rushed to the site It had already been blocked off by Congolese military family members were swarming in swooning and howling off with terror for any word of survivors and It didn't take long Before we received word that there were sixty three people in that tunnel and sixty three people buried alive that day did children who are working not just children. But the what. You're focused on here. These kids kids. And how much money do they actually make from working these cobalt mines. Well children Even the adults barely Eke Kowt somewhere between eighty cents and maybe two dollars a day depending on the kind of work that they're doing obviously the youngest children are in the very least amount. And when you you add to that the context that they're producing this cobalt that's using the gadget sold by companies that are worth hundreds of billions dollars if not more than a trillion dollars Run by executives world billionaires that complete degrading and debasing amount of wealth elfin income that is shared at the bottom of the chain by the top is unconscionable it's unacceptable it's completely indecent and that's the remedy above all that I'm after I with my research and this lawsuit in particular fix the conditions on the ground and pay. These people decently as you. I know from your other research in abusive child. Labor practices that it's the hardest thing to do with the kind of suit like this is to prove that the companies themselves elves are are connected to the abuse of child labor practices that you can actually prove that the cobalt that his mind by the children that you're talking about is actually ending up in the supply chain of products made by Apple Microsoft. Dell Tesla is is there evidence that that exact cobalt Obama's ending up in their supply chain. Well we would not have filed a lawsuit unless we did not have definitive evidence that these children are plaintiffs and thousands of other children. L. Dron and Poor people in the Congo where mining and suffering cobol at mining areas linked directly to the supply chains of the largest tekken auto makers in the world you see two thirds of the global supply of cobalt comes from the Congo. So already in right there you cannot avoid Congolese cobol then asking you. Is it possible that these companies can claim that you can't prove that they're actually linked to the cobalt. Cobalt comes from other kinds of mining rights. So can you put. This is going to be the most difficult thing. I would imagine that right. Well it it. Certainly the supply chain is Is Opaque It is complex but the plaintiffs all were injured and killed at mines. Owned by companies that have been publicly disclosed as sellers of cobalt two are defendants. One of those companies is a mining company. Called Glencore Glencore has put out a a statement to say that quote it does not tolerate any form of child forced or compulsory Labor. What you say to them? Well I say words are all find then good but what you tolerate and what you say you tolerate and what's actually happening on. The ground are two different things and I would encourage The people that Glencore for To take this seriously to work constructively on solving this problem it's it's been all too easy for these companies to proclaim there's zero your tolerance policies and then continue business. As usual. There are children. There are peasants being injured and being killed on sites. They A on every day. That is a fact and that is a fact. They need to come to terms with and to and to address in an honest and constructive fashion. How much more would it cost them to actually be paying these labors a the wages living wages or or or putting in safe Labor abor practices for the children and the workers in these minds? How much more would it cost for them to buy that? Cobalt perhaps the only tragedy greater than the criminal destruction direction of the environment and the lives of the people of the Congo by these companies is the fact that it would be a rounding error on their income statements. To fix the problem. It would not take much at all by way of resources or attention to sit down and genuinely Linley and constructively and permanently. "Bloomberg opinion editor Jennifer Ryan is with us from our London bureau, and Jen I love the first line of David Fickling piece this morning on Glencore at to Glencore. He's focused on a potential dark cloud for the coal market from the world's biggest commodity trader. Yeah. I mean, it was really only a few months ago that it was promoting coal as a viable part of global emissions reducing plans. I mean, whatever you think about that strategy at any rate, it's not change in. So now it's promising to cap production for the foreseeable future at around current levels, which is one hundred and forty five metric tons a year. I mean, the move is pretty striking because it makes up the biggest slice of Glen courts profits in two thousand eighteen and. The company is actually one of the few diversified Niners. That is proudly committed to coal. Yeah. So what's behind this sudden shift? Well, one factor. Must surely is that major investors are really putting more and more pressure on companies to back away from the dirtiest emissions. So I mean, just to give you some numbers here institutions with six point two trillion dollars in assets have already committed to diversify away from fossil fuels and this is figuring into the chair. So does this mean that Glencore is getting out of coal completely not at all? I mean, thanks to its investment in Rio. Tinto's minds north of Sydney in two thousand seventeen it's still likely to be turning coal out. For decades, the plan put cap could be maintained well into the twenty thirties merely just by building out. Its current undeveloped projects still Fickling says is that the announcement gives us another clue as to how cold could conceivably decline in the coming years. It's going to come to a sudden end where prices have traded set forth permanently below marginal cost. But instead what we're more likely to see his death by. Thousand cuts. Yeah. I guess we can get into the question of whether Cole is a viable part of global emissions reduction plans to leave that for another day. But let's move onto the Sainsbury news this morning. We've been talking about the shares of one of Britain's biggest grossers plummeting this morning on word. That regulators could block Sainsbury's deal to buy WalMart's UK subsidiary entirely Andrew fell focused on that this morning. What's she writing about? Just to give you a bit of a recap this nine billion dollar deal was announced back in April, and the whole rationale of it is for Britain's grocers to join forces to cope with the changing retail environment. I mean, this is as as companies are in the United States as well. Saints along with Tesco and more center having to cope with the encouragement of all the lead all the German. No frills supermarkets, and there's just continuing to gobble up all of the market share in the sector all the sales growth. I should really say. Now, the the competition authority recognized that aldean legal do compete, but not to the extent of the remainder of the of Saint sprays. Biggest competitors. And so from this perspective, the remedies the regulator, we're going to require for the delta co through look, really, just incredibly harsh. And it looks like, you know, they've got sculpted blocking entirely. Yeah. We've heard from Sainsbury CEO calling the agency's finding outrageous. What is Andrea think of that contention? She says that actually really has some merits. I mean. All the legal really have been snapping at the heels of all of Britain's gross this for quite some times. More to the point is that the CNN is finding really looks like a considerable flip fought from its latest ruling in the industry in two thousand seventeen it allowed tests go to purchase Booker and wave that transaction through without demanding really any concessions that looked in unduly lenient sort of ruling there. And so now injuries saying that Sainsbury should just walk away from this deal. And if it goes ahead and does that where's that leave? Walmart Sainsbury's performance has really been disappointing. Since the merger was an absent fell said thinks that since we're really needs to do its focused very strongly on its underlying business. And so it shouldn't get involved with trying to improve the terms of this transaction or try to do any further battle with the since we clearly has the most salutes here, but for WalMart. There are other options it could potentially persuade private equity to consider a purchase. But that's not the case for Saint spray the prospects for by out. There are a lot less clear cut. Although. Could potentially be a tempting opportunity for the likes of Amazon. So as far as Saint spray, the has given the grocer away out of the St. L and fell said says that the CEO should just go ahead and take it. Have you on our program this morning so what, are the big takeaways from the results the, numbers good but not, enough money, back to shareholders is not the headline. Exactly I think that's exactly the story for today You know they're they're making a ton of money. Especially in coal and copper, metals trading is really been there sweet spot but with all the miners. They're, making so much money the big question is what are they going. To do with it is Glencore going to a big. Deal are they going to do a big buyback or dividends and that bit of news. We just haven't seen yet what apple is saying? What's been, the reaction I think for the most part it's been no surprise here you know if there's a. Little bit of disappointment in the shares it's because people were hoping for some bit of news that. They would increase. Their buyback or dividend. And there. Wasn't that today so. We didn't get that it does that go along way to explain well, that explains the weakness perhaps that we saw in the initial trading so we were down what more. Than three percent trade we pulled, back a little bit now down just eight tenths of a percent or so why have. The stabilized markets focusing on something else I mean? I think the, overall story for Glencore is going to continue to be a. Wait. And see story so will they do some With? That cash and then you have to? Factor in their remains a big problem with you know what's going to happen to, Glencore in regard to its DOJ investigation the money. Laundering the bribery will? They have to pay a big, fine and told that sorted. Out you're going to continue to see a discount priced into the, share price just run us through a few of those issues Lynn we've got this DOJ probe there's. Challenges spanning from the Democratic, Republic of Congo to Russia house it dealing with these issues so far. It's, it's you know it's just waiting to see what what happens with. The DOJ prob- we don't know at this stage but. You could certainly say that looking over the past year it's been a terrible year for. Them you know and it's it's almost sad because? They've they're, making so much money but they continue to have these quite serious problems with allegations of bribery and. In Africa tighter restrictions in With regard to the legal, situation, in Congo So I think until that sorted out they'll be sort of a cloud overhanging the, stock and what do I want to do they want to see more deal making or do they? Want to see share buybacks from? This business what what was the am Bishen I think most people expect Glenn court to do some kind of big deal in the next know Time over the next few months or so but we just haven't seen that happen a lot. Of the other mining companies have been quite active. In returning cash to shareholders. So dividends and buybacks with going core they've kind of taken the opposite stance in saying you. Know we'll build up m award chest, the problem is we haven't seen that big emanate come through yet given that its rivals, are giving money back to shareholders by the billions Lynn disease create a distinction between Glencore had its? Main? Rivals not distinctions always been? There Glencorse known for its ambitious deal-making and it's not exactly what people would consider a dividend stock But I think the big? Question is if we're expecting that deal what's it going to be and will they will they carry it out guarantees also speculation about what it could be earlier this year kassenberg said there. "To talk to you so glencore was already facing legal and regulatory problems around the world now this us probe into corruption and money laundering allegations may be widening what happens next well this has been a really huge year for glenn call because we're now aware of three different probes into glenn close activities one being this new one from the doj another one in canada and a third one which is very much in its early early stages in the uk these could be very very big investigations and they could have a broad ramifications for glencore it's not just multiple countries right it's also multiple commodities tell us why that combination is so important the news from the the doj is incredibly important because there are three different countries that are being looked at one venezuela the other night cheerier both of those are oil trading businesses for glencoe and the third one is the congo which is a copper and cobalt play cobalt in particular is a very very hot commodity if it's being investigated glencore could come under pressure to divest and what makes this all the more interesting is that top managers will have to think about their own involvement all of this investigators going to find something that implicates them in any wrongdoing and if they do then they're gonna have to get out of their positions at gain call because otherwise glencore isn't really sustainable it'd be interesting as well to see if glencore is head ivan burg if this is going to affect his risk tolerance in the past certainly he has not seemed phase by difficult jurisdictions and the congo is when a lot of companies have pulled out of the drc yeah i'm in the car in the congress really fascinating case study glencore and we've just seen again i mean glazing bug seems to be willing to take on the us government in december the us government put sanctions on that business partner in the congo and israeli guy by the name of dan gertler who's very close to the president of congo and instead of stopping doing business with dan what glencoe has done is they've found a workaround by paying him in euros instead of us dollars so basically saying to the us government we're just going to carry on doing business we're just gonna slightly fudge the rules friends thank you very much that's.
