So the FBI could pretty much figure out within about 5 seconds whether or not the Hunter Biden laptop contents were indeed correct or were indeed valid. I mean, it doesn't take long to validate the legitimacy of some emails. It really is a scandal. No former president has ever been the subject of a criminal referral from Congress, and that could change this week. The house January 6th committee is set to hold its final meeting on Monday, one in which it could vote on whether to refer Trump to the Department of Justice for criminal prosecution for his involvement in trying to overturn the results of the 2020 election and encouraging the violent attempt to stop the January 6th certification of Joe Biden's election when. The referral and the documentation supporting it would then likely be handed to special counsel Jack Smith, who attorney general Merrick Garland appointed last month to take over criminal investigations involving Trump. It will be up to Smith to ultimately decide whether to bring charges. people who played pivotal roles at the very top of the Trump campaign who have knowledge about the big lie that the election was stolen or rigged or fraudulent somehow that resulted in that violent heard Michael Flynn's name John eastman's name Who else gets subpoenaed here They include three officials who worked on Trump's 2020 reelection campaign They are ex manager Bill stepien Trump adviser Jason Miller and ex campaign aide Angela McCallum In addition the panel issued a subpoena for Bernard kerik He's the former New York police commissioner who went to federal prison for tax fraud among other charges but was later pardoned by Trump Oh interesting He's close to Rudy Giuliani Trump's lawyer during the effort to overturn the democratic election How does these 6 people fit into the larger story as the committee sees it Congressman shift told me Trump's 2020 reelection campaign was part of this larger effort to urge states to delay or deny the certification of electoral vote I also talked to another member of the panel last night California Democrats lofgren who said this is not just about the day of January 6th but the weeks prior The individuals who have been sent subpoenas today were from other reports heavily involved in the lead up to the riot For example eastman wrote that memo that you mentioned about outlining the ways that former vice president Pence could reject Joe Biden's electoral count victory in the committee says he was also part of a meeting with several high profile Trump allies including Bernard Carrick and Jason Miller at the Willard hotel the night before January 6th weighs on how to overturn the election's result Finally Michael Flynn who lawmakers say was part of a December 2020 Oval Office meeting where the seizure of voting machines and invoking a national emergency came up So a lot of their actions are already known Some of them took place in public more or less but are these witnesses likely to talk to the committee That remains to be seen the panel is still negotiating with others who have received subpoenas already But both lawford and Schiff noted the panel was talked to more than a 150 witnesses voluntarily already They also highlighted the case of Steve Bannon who defied a panel subpoena outright and now faces a referral for contempt of Congress Bannon of course defy the subpoena over claims of executive privilege I talked to a former House impeachment attorney about this norm eisen who noted all 6 of these new witnesses are in Bannon's shoes They were not part of the administration on January 6th So that means that the kinds of claims of official executive privilege that we've already seen bandied about are going to be at their weakest when it comes to these individuals So that's a city in southern India population about 10 million are underwater buses have been submerged thousands of people evacuated Now it's normal for Chennai to get monsoon rains this time of year What's not happening So the yamuna river in New Delhi today is coated with toxic foam This is something that happens as India develops its rivers are filling with industrial waste In this case it's ammonia these things worse Certainly makes the flooding worse How does all of this how is all of this effective at all when the prime minister of Indian Narendra Modi goes to Scotland and promises to cut India's net emissions down to zero So prime minister Modi pledged to get the ball rolling to do that by 2070 so that's 20 years after the U.S. has pledged to hit that goal in ten years after China And the reason it's later is that Indian officials believe they say that they have they deserve time to develop any abrupt shift to renewables would probably hurt economic growth here that can literally cost lives in a poor country like India So the transition has to happen gradually I spoke this morning with bad wall She's an Indian climate change expert I actually caught her by phone at the UN climate summit in Glasgow And she says yes India needs to develop but it's actually hitting a wall doing that because of climate change So take the for example the flooding in Chennai this week she says From one hand we are talking about changes in the rainbow patterns and heavy precipitation incidences on the other hand it's about development also in male development where we choked our brain and system There's no place for the water to drain out And therefore the entire system is collapses So she says most Indian cities are examples of this urbanization Indian style has actually "This question comes in an email from evelyn who writes. I hope you can comment on the hearing regarding the lawsuit in michigan. I listened to a good bit of it today. In my unqualified opinion. The complainant's legal team is using defense. Much like the president and his cronies us in the court of public opinion. It reminds me of the. Because i said so reason. My parents used to give when they didn't feel like arguing. So you call yourself unqualified to render an opinion but your opinion is pretty. Good here evelyn. Of course you're talking about the hearing that took place on monday of this week relating to a sanctions issue against sydney powell and lynnwood and some other of trump's election lawyers who brought a series of lawsuits around the country including in detroit in federal court over alleged voter fraud in those elections seeking to overturn those elections. As you know by now every single one of those suits say perhaps one depending on how you consider. It failed and failed. Miserably and lawyers for detroit are seeking sanctions against trump's election lawyers on the grounds that they didn't obey ethics rules in bringing those suits and so the preceding lasted a pretty long time. I think upwards of six hours. So congratulations on getting through a lot of it and the basic question that the district court judge judge linda parker ass was quote shouldn't attorney be sanctioned for his or her failure to withdraw allegations. The attorney came to know were untrue. Is that sanctionable behavior. The judge also sort of answered run questioned at one point in the hearing when she said quote. I don't think i've ever seen an affidavit. That makes so many leaps. This is really fantastical. So my question to council here is how could any of you as officers of the court. Present this affidavit. The judge also made the point that the lawsuit and the affidavits attached to the lawsuit should have been withdrawn. When electoral college confirmed biden's victory on december fourteenth of last year. The judge asked. Why do the plaintiffs not recognize this lawsuit as moot and dismiss it on that date and as you point out evelyn time after time after time the lawyers had no answer with the possible exception of lynnwood who said repeatedly and somewhat humorously to my ear that he had nothing to do with drafting the complaint. He said it again and again. I nothing do with drafting the complaint. I was involved with it in any way. Raises the question. Of course. why was his name on the complaint. he didn't ask for it to be withdrawn. There was a debate back and forth about whether or not lynnwood had given permission to use his name and then there was another discussion about whether or not lynnwood in some other proceeding in some other jurisdiction in some other court had boasted that he had been involved in the detroit litigation. All in all it was a bit of a circus and a bit of a mess. So i'll make a couple of quick comments. I think it's clear that the judge will impose some kind of sanction here. it could be a monetary sanction. it could be referral to bar authorities and the irony here is the donald trump got away with lying again again and again and public forums at rallies on television in print interviews and there was not much than anybody could do about it and his lawyers may actually face some penalty for engaging in that kind of lying or misrepresentation by omission. For doing those same things in court. We've already seen the rudy giuliani. Trump's one of trump's lawyers has had his bar license suspended in two different jurisdictions in here. You have lynnwood and sydney powell and others by the way the other interesting thing is some of the representations made by sydney powell and the other lawyers in the election cases were so outrageous and so far fetched that the trump team itself distance. Themselves from cindy powell. That's a red flag. If you ever saw one before but importantly i want to mention again a distinction the joyce vance and i talked about on the cafe insider podcast and that is it is one to make know creative farfetched legal arguments to try to get a lot of fit some claim that you have. Maybe it's a claim that's never been made before articulated in a particular way before that's probably not generally going to be sanctionable so claims it clearly seemed to go against settled law or statute or constitutional provisions. Although they be sort of out of left field generally speaking the consequence of that is you just lose your case on. The other hand was being focused on here is time after time. After time factual assertions were being made in affidavits and otherwise there were not just not backed up but as a judge points over and over again there was literally no vetting of claims it on their face should have been challenged by good faith lawyers in. That didn't happen here. By the way by the end of the hearing sydney powell who is not in good standing with this judge and this court double down on the submissions. That were made she said quote. We have practiced law with the highest standards. And then she says and this is kind of remarkable stroz. she doesn't know how to read the room quote. We would file these same complaints again. We welcome an opportunity to prove our case no has ever given us that opportunity and quote that seems to have been an error so the original crack lawyers did not do a great job in representing donald trump's campaign and the lawyers of the crack lawyers hired also did not do a great job in connection with this proceeding earlier this week and perhaps my favorite comment of all was a tweet posted by lawyer bradley. "S Intelligence Agency says Russian President Vladimir Putin directed efforts to try to swing last year's election in Donald Trump's favor. The report also concluded that China did not try to interfere that runs counter to claims by the Trump campaign that China was trying to get. Joe Biden elected NPR national security correspondent Greg My rejoins us now for more Heidrick. Hi, Lisa. So start off with Russia. What was the interference campaign Russia mounted last year, according to this report, And what what did it do compare it to what it did when Trump was running against Hillary Clinton in 2016. Yeah, sure. So. The key element in the 2020 campaign, according to this report, is that Russia was using proxies people who had ties to individuals in Trump's orbit. They cited a few examples and I'll mention one here. They named Andre Dirk Koch. Now he's a Ukrainian lawmaker who Is a blood accused of having ties to Russian intelligence. Now we know he met with Rudy Giuliani, Trump's former lawyer. Giuliani is not mentioned in the report. But we do know just from public of what we've seen publicly. Both of these men were spreading these unsubstantiated claims that Biden and his son, Hunter, Biden, were somehow involved in corruption in Ukraine. And and so this, the report is saying, This is the kind of thing that that Russia was up to. Now it is a contrast to 2016 back back. Then the Russians hacked Democratic Party emails and they waged this big social media campaign. US was very un prepared at that point really caught off guard. So I think the U. S. Was much more prepared both of from a national security standpoint, and from the public's perspective as well in this likely led the Russians to take a different approach last year. So we should know that. The report also says that while Russia did interfere, there's no indication that Russia or any country try to actually alter votes or voter registrations. So what impact did the interference have? Well, but probably not much in terms of the mechanics of voting is because this was a foreign intelligence report. They're not trying to look at the behavior of US voters. But they are making the point very clearly that there was no evidence that a foreign country in any way manipulated voter rolls or actual vote voter counting. So if you take this in tandem with what we've heard from U. S officials who said the election was secure and did not have any fraud, they really show that we had a pretty safe election. There's no evidence that they're the election was Was riddled with any any sort of fraud. The report also says that the leader of Iran authorized an influence campaign meant to undercut Donald Trump, would it Iran do So it says that the Iranian leader Ayatollah Ali Khamenei, authorized the campaign now basically saying in the report, it doesn't appear to be huge. There was one incident last year that got some attention. There was this email that that seem to be turning up in Florida, and it was purported to be from the proud boys, the far right group, and in this email it was threatening Democratic voters and telling them to vote for Donald Trump. But U. S. Intelligence officials really track this down almost immediately, and within a day or so they sort of said what was behind this. The report does go on to say that the Iranians opted for cyber some cyber efforts because they're low cost there. Deniable didn't require access to the to the U. S. So it was worth noting, but it doesn't seem like this was something that had much of an impact. And how about China? What did the report say about foreign threats from China to the election? There was a lot of concern about China during the campaign. President Trump was very critical of China Politis sanctions on them. So there was the thinking that China might try to do something as a very skilled fiber player. Try to undermine the Tramp Trump campaign. In fact, Trump himself and his supporters claim this, but they didn't provide any evidence and the intelligence community conclusion was that China chose not to run an influence campaign, the report said. No quote briefly here said China starts thoughts of stability in its relationship with the U. S. And did not view either election outcome meaning trump or by as being advantageous enough to risk getting caught meddling. So it seems they sat this one out. So doesn't mean that the United States did a better job at upholding the integrity of American elections. It seems as though they were more ready than they were in 2016. They could perhaps predict more. Are they doing better? In actuality? So the short answer is yes, we did see a big improvement. I mean, one domestic agency, which doesn't doesn't get a lot of attention because it's new is the cyber security and infrastructure agency Sisa, which is part of the homeland security. It was created in 2018. It did a lot of the monitoring working with states domestically. And abroad. The National Security Agency has taken a lot of effort to try to not only detect that neutralize any any efforts abroad, but this has become a permanent part of our elections. That was clear in this report. It's an easy thing. It's a cheap thing for foreign countries to do, and we just need to be ready to expect it in every election going forward..

A Zafar is finding out who was their flight in two days before And flying out the day of or the day after, but you have too much, but you also have to be very careful because if you're looking at people who are flying to a rally, that's a permitted rally those air legal of legal activities that they're engaging in. Now, if it's simply part of the investigative process in order to interview those people to see if their potential witnesses, that's fine, But you have to have evidence that they've done something illegal. Before you open any Kind of an investigation against those individuals. In the meantime, I you know, they said that this is gonna take a long time. It's gonna take more than months and frankly, I found that encouraging because that means to me that this is going to be an ongoing investigation that serious about pursuing these individuals and let me to say this It's about damn time. It is about damn time. These groups are so utterly dangerous to America. They've infiltrated everything you know. There were police officers who were participants. Police officers who flew in from other places around the country who participated in this. There were members of the United States military and retired members of the military. And, you know, we've spoken of this before that the military has had this huge problem with right wing extremists and racist within there. Ranks. There again is a situation where you're operating under the UCMJ A and you can't figure out a way to get those individuals out of the ranks of the military. I can discharge him.
