"Food would be something that would be a little leery for me At BWI thurgood Marshall airport Gigi Barnett WT news 1251 It's a case that sparked national outrage the case of three white men charged with killing a black man on the barberry in Georgia It's now in the hands of the jury after a nearly two week trial Father and son Gregory Travis Gregory and Travis mcmichael along with Willie William ruddy Brian are charged with chasing down and murdering armor This morning CBS News legal analyst they rosenbaum breaks down the case for us There's several different charges The first is first degree murder with a use of a shotgun And then there's some felonies which essentially be the felony murder rule meaning that they committed felonies that cause death even if they didn't intend for it to happen So one is the aggravated assault with the shotgun another is aggravated assault with the pickup truck Another is making a false arrest what's called false imprisonment And then there's the fourth one attempted false imprisonment Now if they're convicted of any of those charges it would be because it's felony murder It would be as if they had committed the crime knowing that they was committing murder So that's really the indictment charges The defense is simply a very simple thing Well look at the time we committed the crime they was a statute that allowed us to make a citizen's arrest And the second thing is yes we shot him but in self defense because he came at us right So the prosecution's case hinges on two things One is to say well yeah you can make a citizen's arrest Oh by the way they repealed that law since then because of this case But you have to have witnessed a crime being committed And that's not what happened here Here one of the three 12 days ago saw our Brie in constructed house unfinished house and didn't really see him committed any crimes By the way this is one of this mysteries where you're never going to know Apparently he was always in that house He just would come in look around and leave He must love the house But neighbors saw Arbery So they're basically on secondhand knowledge or knowledge that took place 12 days before relying on the statute that saying we are allowed to make a citizen's arrest because we saw him running around and he's the guy that purportedly has been in the house and one of us saw him in the house And as for self defense the prosecution is saying yeah but you instigated it right You're the ones that chased him He didn't have a gun You chased him with a pickup truck and then you had a shotgun and he was on arm When you listen to the closing arguments did you get a feeling that one side or the other had a better presentation Yeah the prosecution did much better Remember one of them is also claiming that well items are the one that was really driving I was just there for the ride And the argument there is in under the law they all acted in concert They are all responsible for anything they did individually Look remember this comes in the shadow of the written house acquittal and the jury is aware.
