They were looking for a sentence of between 30 and 55 years, but look, she got 20. And she put out a statement to you all the victims. I'm sorry for the pain that you experienced. It is my sincerest wish to all those in the courtroom and to all those outside this courtroom that this day brings a terrible chapter to the end to an end. the testimony of some of the government's witnesses against Maxwell That led Maxwell's attorneys to ask the judge for a new trial Joining me is former federal prosecutor Jessica Roth a professor at cardozo law school The questionnaire that Scottie David filled out during jury selection shows he answered no when he was asked whether he or anyone closed him at previously been a victim of sex abuse He testified that he had been sexually abused on multiple occasions when he was a child but he denied that he lied intentionally said he had been distracted by thoughts of a recent breakup How does that strike you Because to me being distracted on the question which is central to the trial is sort of odd Well as I understand it he also said that he was you know it was late in the day It was an honest mistake And as the government argued in its brief opposing the motion for a new trial this was a lengthy questionnaire This was I believe toward the end and it was one of multiple sub parts And so the question is whether it's credible and whether the judge believes his testimony that he was not intentionally withholding that information but failed to appreciate that the question was calling for an answer with respect to his own history or even to appreciate what the question was calling for at all because he was tired or distracted That was question 48 Have you or a friend or family member ever been the victim of sexual harassment sexual abuse or sexual assault Question 25 asked jurors whether they their relatives or friends had ever been a victim of a crime and he also answered no to that So my understanding is that he gave a similar answer that it was inadvertent that he didn't appreciate what the question was calling for but that again he didn't intentionally withhold any information And it's really going to come down to whether the judge found him credible in that explanation for why he didn't answer yet Maxwell's lawyers argue that they didn't have the ability to question him about possible bias and that they would have tried to get him dismissed So no matter if he did it unintentionally or intentionally isn't this the kind of juror that the defense should get a chance to knock off the jury Well if he had answered yes to these questions that disclose his relevance on history of sexual abuse there would have been follow-up questions for him as there were for other perspective jurors who disclosed that they had also been the victims of sexual abuse There were other such prospective jurors And when they disclosed that information they were asked additional questions to inquire into whether they could be fair and impartial jurors in the case So if this juror had given a similar response yes disclosing his own history of sexual abuse those very same questions would have been asked But it's not conclusive of the motion before the court of whether or not he himself had been a victim of sexual abuse in the court would also have to decide whether or not he could have nevertheless had been a fair and impartial juror It was a very inquiry that the court would have engaged in upon his disclosure of this information And that was the kind of information that court was trying to elicit at the hearing on the motion for a new trial which was essentially to ask the follow-up questions to try to get at the very same inquiry the court would have been engaged in during the board year process had he answered the question in the affirmative The first time around So to play devil's advocate here he swore multiple times that his experience did not affect his ability to judge Maxwell's case impartially but isn't it obvious that his past abuse made a difference because he said it did he told several media outlets that he raised his childhood abuse during deliberations to sway other jurors who doubted the testimony of some of the government's witnesses against Maxwell So don't his statements to the media disprove what he said on the stand Well one of the challenges at the court faces in deciding this motion is that the court is precluded from considering any statements or other information about what was said during the jury deliberations in deciding the motion So even though it's been reported in the media what he said during the deliberations referencing his own history of sexual abuse those statements anything about what happened in the jury room can not be part of the court's inquiry at this juncture And so instead with the court is focused on is what is the nature of his history with sexual abuse Is there anything about the particulars of his abuse or about essentially how he has processed and reacted to it as evidenced by how he responded during the war of your process Is there anything about all of that that would suggest that he was not a fair and impartial bias So the court is really cabined in terms of what it can consider in deciding whether he is a juror who would have been struck for cause I did. Just goes to show attend those q-and-as. Listen to them, watch them on YouTube after the fact if you're not a patron. Because you got the early scoop on this, but you've been looking into whether Ghislaine Maxwell might be able to secure a new trial on appeal. What fresh hell is this? Yeah, this is a real possibility and I want to talk about the underlying legal standards. So here's what happened in that trial. One of the jurors, Scottie David, is alleged to have lied during voir dire. In particular, it is alleged that he said he had no prior history of sexual abuse. And then, during jury deliberations, brought up his sexual abuse as a way of convincing jurors, right? As a way of sort of working through the emotions that jurors were having. And again, remember the baseline rule is courts don't invade the sanctity of the jury deliberations. It would be a 100% appropriate if you hadn't lied to say, hey, I'm a survivor of sexual assault, like take this into account into consideration. This is why we have trials by jury. Let's break down the operative law and facts. First, facts, voir dire. In a big case like this, you get written screening questions, right? Because if you answer in a way that is disqualifying, then you don't have to bring those folks in and separately question them. And you know you're going to go through an awful lot of folks. Those screening questions included have you or a family member ever supported lobbied petitioned protested or worked in any other manner for or against any laws regulations or organizations related to sex trafficking, sex crimes against minor sex abuse or sexual harassment. You can understand why that would be important. Witnesses in this case may testify claiming sexual abuse or sexual assault. Would you have any difficulty assessing the credibility of a witness claiming sexual assault or abuse just like you would any other witness? The one that's relevant here, I think. Have you or a friend or family member ever been the victim of sexual harassment sexual abuse or sexual assault? This includes actual or attempted sexual assault or other unwanted sexual advance, including by a stranger acquaintance supervisor teacher or family member. So Scotty David then went did a bunch of press interviews and said he was not asked about his sexual abuse history during the process and that he just sort of, I think his words were I flew through the questionnaire. But the evidence is either left blank or said no to those questions. Did not indicate a prior history of sexual abuse and did in fact have a prior history of sexual abuse. So, Glen Maxwell moved pursuant to rule 33 of the federal rules of criminal procedure for a new trial, and that is really simple. It says, upon the defendant's motion, the court may vacate any judgment and grant a new trial if the interests of justice so requires. And then you have to follow that either within 14 days if it's a procedural issue or within three years if it is newly discovered evidence. I think finding out what the jury member said would count as new evidence, although usually it doesn't matter. They met both deadlines. So I also wanted to add I thought this might be interesting. The notice that a rule 33 must be made on the defendant's motion for a new trial. That is unlike a civil motion for new trial, which can be made to have the judge's own motion. The judge has no power to order a new trial for a defendant because that would potentially involve double jeopardy problems. So when galene Maxwell moves for a new trial, she is effectively waving her objections to the right against double jeopardy to be tried twice for the same offense. Because she's saying, yeah, okay.
