"Response to the gaze park occupiers was swift and violent. The protesters hung on and news spread of the crackdown, allied protests were seen all over turkey for several weeks, revealing discontent far beyond just infrastructure projects, and those two faced police crackdowns. President Recep Tayyip Erdoğan immediately began a hunt for provocateurs. The rioters but also doctors who tended those wounded in the crackdowns, the lawyers who defended them. Even now being associated with gezi park is a serious charge, especially if you're a thorn in mister Erdoğan's side. Osman kavalan is one of turkey's most respected civil society activists on April 25th, he was handed a life sentence for attempting to overthrow the country's government during protests almost a decade ago. The ultra zelensky is our turkey correspondent. He's not the only person to be sentenced in this trial. 7 other defendants who took part in the protests among them a filmmaker, a lawyer, an urban planner, and an architect where sentenced to 18 years in prison. And even by the standards of turkey's broken judiciary, this trial has been a farce. The charges against mister kavala and his co defendants were not only entirely unsubstantiated, but also involved a willful blurring of peaceful protest with armed insurrection and a coup attempt. How do you mean though how did we get here? Mister kavala was a patron of the arts, a businessman, a philanthropist, and one of the champions of a reconciliation between Turks and Armenians. He has campaigned in the past for recognition of the Armenian Genocide. He was arrested in late 2017. He was then tried on charges related to the gezi park protests, which engulfed turkey in 2013, and he was acquitted in 2020, but he was also arrested just hours later on separate charges also unsubstantiated related to a coup attempt against turkey's president Recep Tayyip Erdoğan. An appeals court then overturned the acquittals in the gezi park case, which led to the retrial, which has just concluded. Basically cavalla was arrested on one set of charges acquitted, re arrested on separate charges, convicted on charges of which he had been acquitted in the first place. When the European court of human rights ordered mister kavala's release, turkey's government refused, and when the American ambassador to turkey in 9 of his European colleagues asked turkey to abide by the ECHR ruling, mister Erdoğan nearly had them expelled, saying their statements were an insult to turkey's judges and prosecutors. Use autistic. Kim said entirely about almas. And that the Turkish judiciary was free from interference. So how did the defendants respond to these sentences being handed down? Well, mister kavala was not present at the trial. Some time ago, he decided that he would not attend in person. And in his closing statement, speaking by video link, he called the case a judicial assassination. Moments after the verdict was delivered, two of his co defendants, John athalia, a lawyer, and mugel, an architect, stood inside the courtroom in front of a crowd of shocked, onlookers, some of them wiping away tears. Mister attila shouted, they will now take us to silly, but we know that we will not bow to tyranny. He was referring to an infamous prison outside Istanbul. So the implication here is that mister Erdoğan has had a hand in this. Why should he? Why not leave it to the courts? Well, in cases like this one, in cases that our politically charged, the Turkish judiciary tends to do the government's bidding. And mister Erdoğan is personally believed to have been pulling the strings in the case. He had once accused mister kavala of being an agent of the billionaire investor George Soros or as mister Erdoğan called him the famous Hungarian Jew. And in fact, a few days after the verdict was handed down, mister Erdoğan referred to kavala as the Turkish Soros. And prosecutors also said that mister kavala and other defendants had instigated and bankrolled those 2013 anti government protests. The most damning evidence they found were wiretapped phone calls, which documented mister kavalas plans to provide protesters with a plastic table in some pastries. So that should give you an idea of the kind of evidence that have been used in the case to incriminate mister kavala and his co defendants. So that flimsy evidence this or what you call a farcical trial. What effect will that have on relations between turkey and the west? Well, those relations are already strained because of the kavala case. And the verdict will surely damage relations further. America's response, a statement urging turkey to release mister kavala, a statement that called his conviction unjust and an example of judicial harassment of civil society was even more harshly phrased than the one that almost got its ambassador kicked out and you officials have also roundly condemned the decision. And will mister Erdoğan care about all that condemnation? I'm a third one might care somewhat, but he cares less about the international outcry than he does about the impact of this decision domestically. Mister Erdoğan is facing a crucial election next year, both presidential and parliamentary and by ensuring a guilty verdict and such a long sentence for the gezi park defendants and the life sentence for mister kavala, he has made it clear that descent in turkey risks being equated with treason. "There have been large demonstrations in front of a courthouse in Istanbul against the life sentence handed down to philanthropist Osman kavala. He's been charged with attempting to overthrow the government and has already spent four years in prison. In what many say is a politically motivated crackdown on dissent ahead of next year's election. Hannah lucinda Smith is a journalist and the author of Erdoğan rising the battle for the soul of turkey, and she joins me now from Istanbul. Hannah good morning to you. Who is Osman kavala? So Osman kavala is one of the most prominent civil society activists in turkey. He's the son of a very rich industrial dynasty, and he's used his wealth to set up all sorts of cultural projects, particularly ones that kind of showcase and promote took his cultural and ethnic minorities. So publishing houses art centers really highlighting Turk is really, really rich kind of multicultural background, so highlighting the works of people of Armenian descent of Greek descent. Now, the reason why elsman cavalla, according to the government has been targeted in this trial, Erdoğan says that he was the behind the personal behind the scenes coordinator of the gezi park protests in 2013. These were huge street protests, mostly young people in their teens and 20s, protesting against Erdoğan. Protests started against the redevelopment of a green space in central assemble and swirled into huge anti government protests. Now, for several years, that kind of laid quiet Edwin didn't really do anything about it. But then in 2017, having sealed his power after the coup attempt against him, having changed the constitution to turn his system into a presidential one rather than a parliamentary one. Erdoğan then started pursuing these cases against people that he accuses of organizing the gezi park protests and the most prominent of those is Osman cavalla. Why has this particular case prompted demonstrations outside the courthouse? I mean, because it's clearly such an egregiously politicized trial. Osman cavallo was arrested in October 2017. He was originally accused of simply coordinating the gezi park protests. He was then released. He was acquitted a couple of years ago. Immediately, literally as he was driving away from the prison, was rearrested. And then further accused of being involved in the 2016 coup attempt. And we have to say that these decisions to rearrest cavalla retry on different things come straight after comments have been made by Erdoğan saying that it's not right that he's been released. So it's very, very clearly, although Erdoğan and people in the Turkish government like to say that, you know, the justice system is independent and this is just a judicial decision. It's so clear that this is a completely politicized trial. And in fact, I spoke to kavala a year ago, we communicated by letter while he's being held in slavery prison in Istanbul. And this is exactly what he said. He said the only chance of me being freed from prison is not going to be through a judicial process. It's going to be if the political world changes in turkey. So I mean, it's clearly after the political elite. I mean, I don't think it's right to call him a political elite. So I think we can certainly call him a culturally, and what's really interesting to Erdoğan gave his first statement about cavallo's conviction last night, again he repeated these claims about him being involved, it's very high level in coordinating the gezi park protests. He also repeated something that he said, again and again over the years, he called the Soros of turkey. He claims that he's this kind of shadowy figure using his wealth to manipulate Turkish politics. But I think the kind of aim here is clear. These protests in 2013 were a really, really shaky moment for Erdoğan. They were the biggest mastery protested faced. In fact, you know, it was really the first time since he came to power in 2003 that he'd really been challenged on this kind of street level. It was like a kind of awakening of the Turkish youth I guess they suddenly said, we're not happy with the way this country is going. Now, if you think about whether those kind of protests would happen today, despite the descent that the country has taken since then in terms of economy in terms of human rights, democratic freedoms, you know, it's just almost unthinkable because these kind of trials have real chilling effect. A lot of the kind of people who participated in gezi back in 2013, mostly educated people western looking Turks have either left the country or they're just too scared to do anything. You know, I just can not imagine you similar protests breaking out today. Although there have been these protests in front of the courthouse, I mean, who's doing that and I mean, it must be a pretty brave act to stand up there. It is a brave act. And I wouldn't be at all surprised if some of those people who are protesting now and you have to, you know, it's small scale. It's nothing on the scale of gezi. You know, if they didn't have legal cases against them as well. Yeah, so as kavala was convicted, and we should also say it's not just a life sentence. He's got its aggravated life, which is in turkey means he has no chance of parole and he's going to be spending his time in prison in solitary confinement. It's absolutely the harshest sentence that you can guess in turkey. So yeah, there were boos broadcasts in the courtroom as that sentence was passed. Also, we should say it wasn't just cavalla, there was 7 other defendants, including lawyers, civil society activists, also accused of the same thing who've been given 18 years in prison each. So yeah, they're supporters were, I mean, I guess Erdoğan would say, you know, the kind of people you would expect to see, but people who are concerned about civil society, people who concerned about the rule of law, journalists, these kind of people. These are the people who are still trying to fight back against this kind of mounting authoritarianism mounting chill on free speech and any kind of protest against Erdoğan's government. This is about holding people accountable fighting impunity and it's not a war on drugs it's a war on crime in a war on evil. I mean these people what they do. So evil and you know they. They need to be held accountable. Legally and judicially and fortunately the us has the laws and the capabilities to do that in a foreign setting. But that's what it's about. It's not about some failed drug war. It's about holding people accountable and getting some kind of justice for the victims. You know the people that were victimized so when people talk about that you know i was watching the other night i mean they make such a big deal on these streaming shows the other night i saw the one on john wayne gezi of you know what hit thirty one bodies buried under his house and you know how much attention a serial killer gets in the us. These guys are so far beyond that. I mean these guys are on the scale of like beyond serial killers. These guys are on the scale of lay there like stalin or a mousy talking there mass morose paul doing it you know for profit and for their own aggrandizement and that's where i mean. Look at the comparison and and the affected the direct effect. They have on the us and all the issues and problems that's caused and people's lives ruined and people dying and it continues on and on but that's where i think people need to really look at it and say you know that's what what's great about the us is we believe in that and we no matter where you are and at the end of the day where we're eight agent so we're working to protect the us and protect our citizens and our national security but in order to do that it also obviously helps immensely with the countries we're working in. You know to jointly try and combat this because you talk about being victimized you talk about the police that are killed with impunity. The military people that are killed with impunity. The attacks and things that happened with impunity in mexico you know that the there there don't have the structure the systems to be able to effectively address. This and you know the us and the sacrifice personal sacrifice of a lot of heroes and heroic people on both sides on the mexican side and the side is is really what brought this about. And that's what should be pointed to as an example not not torn down by the prior to the president political system in mexico. That says all this was us violating our sovereignty.
