The president can push back, but not in the first four days. And that already gets us toward the last five days of this presidency. And if the president after those four days insists that he is able to perform his job, and the vice president and Cabinet disagree The ball, then moves to Congress. But at that point, it doesn't matter what happens because Congress has 21 days to deliberate and at that point, presumably in terms of the immediate danger from a sitting president. We're home free. Indeed, it is a whole different ballgame because impeachment is a past looking measure toe look at previous transgressions, and that's where we're essentially wielding what we all remember you don't need a particularly long memory was only last year holding a political trial. Essentially an investigation in the House and a trial in the Senate. And in this particular situation, the investigation is going to be very brief because the facts are known to all of us. They happened. Out in public in broad daylight in front of all of us. And if anything, they're just looking more and more serious By the minute, the more we learn about what could have happened and not just what happened. I want to go back to the 25th of mimics. I think you said something important that I might may have erred in in my introduction, and I think a lot of people are just assuming the 25th amendment but remove the president from office. But that's actually technically not what it does. It just takes power away from him. Tell me about that distinction. Exactly. Basically, the 25th amendment is therefore present who cannot fulfill the functions of office. So all the functions. The actual performance of the job falls to the vice president under those circumstances, but the president remains the president. From family. So in many ways, this is a less serious for less punitive measure. It's more of a forward looking emergency measure to basically save us from someone who was unable or or unstable in an emergency situation. Someone didn't even fire and taking their money and then probably goingto. Actually, That's the good part. It would concern me if they were taking really Second Amendment guns and turning them over. Yeah, yeah, that's true. They try to before now they're doing it. In Philadelphia and, you know, I noticed it worked. It worked, didn't it? It's going to work in Kenosha everywhere else. They tried to imagine a California California where where I understand the law just took effect out there. They're red. They're new Red flag. Gun law takes effect. I think today to take just 15 seconds to say what a red flag gun confiscation is so law passed in about 20 anti gun states. Which says that someone who hates you can go into a judge throw a serious of unsubstantiated allegations You're never consulted in the first thing that happens is a SWAT team arrives at your home at 3 A.m. in the morning, ready to ransacked your house. Confiscate your guns. And if you were this, as Gerri Willis did in Ferndale, Maryland, shoot you to death. My guess is that Ah crime is going to continue to go up in California will probably go up faster as a result of California's anti gun policies and But basically it's a one party state. I'm not at all sorry I do not want a guy who lied about serving in Vietnam and did some stolen valor valor writing my gun laws do you welcome back to the Shonda lash I don't want anybody to think I write my gun laws Lindsey Graham and I just wanna let you know he was great on the camera stuff sometimes I like it sometimes he says stuff I just war I just laughed my head off. another time he tries to sell you out like what he's doing right now with red flag was. if you I do not follow me on social media yacht to because I shared both on Facebook as well as on Twitter top ten reasons and they're more than ten. but top ten reasons why you should oppose red flag loss. ten handy dandy list just ten. I can give you way more. and and these individuals we got Blumenthal and grandmother Pushin there's not a single one of these guys can explain how they how they would work. so let me let me put it like this. and I've said this a million times before. well maybe not like this I think that the red flag what proposal is some of the most dangerous legislation we have ever seen. put that put guns aside you don't even I don't care if you don't like guns I don't care if you are not a hunter I don't care if you don't have your concealed carry permit I don't care what gun rights group your remember up or what gun rights group you're not a member of I don't care this will affect you. it will affect you regardless because this is a complete inversion of innocent until proven guilty that's number one red flag laws or an inversion of innocent until proven guilty the standard of evidence is low do you know that Vermont out of the seventeen states and then you have the district of Columbia that are past red flag was Vermont is the state that has the highest evidentiary standard and it is probable caught their their their theirs is up it probably because everyone else is below that which is essentially in because they're all ex parte procedures meaning they can have you can be targeted and you're not even in court nor do you have to even be told have advance warning you're not even in court to know that this is happening she can't defend yourself you're not there in the room and so basically the judges making a decision based on one side of the story and a lot of these different states almost anybody can report you but. it is the standard of evidence is low and and again while the state was very so many different people not just family can report you. that's what you have to think of number two again with the ex parte order advance notice is not required and you don't even have to be in the room for the petition to be granted meaning you must wait to defend yourself most of these laws provide zero penalty for abuse and there is not a single state law of the seventeen that allows for a civil cause of action against false accusers so good luck trying to recoup any cost. now time it varies in this is number three as to how long respondents have to wait until they get their day in court a study that was conducted specifically on Indiana's law which says that they have a fourteen day wait revealed that the average wait time isn't in fact fourteen days it's nine months. right still late all rights denied. now Dave ugh compel who's done some great research on this has noted that of the four states with the oldest gun confiscation laws and that's what these are the red flag orders just call gun confiscation laws Connecticut Indiana California and Washington no research and I wanna bold and underline there's no research none has revealed any at all statistical reduction in crime. now there have been mixed results where it concerns suicide. and compel also noted that one third of these orders are improperly issued against innocent people. one third. now. number five no advance notice is given ahead of serving a red flag order. that worked out horribly for a sixty one year old Maryland man named Gerry Willis in because I know it's important for progressives because they like to check boxes and put people in categories here's a sixty one year old black man from Maryland Gerri Willis. it was about well after five in the morning when they were when he realized someone was at his house he gets up. and he answers the door thankfully there was a it because I I I it also brings up the question you can be doing no knock warrants like house is gonna work. Gerri Willis had a red flag order served on him and he was shot and killed many answers door early in the morning before the sun was up a little after five AM. we already had one person losers live over this this puts law enforcement officers in a horrible position of forced of enforcing these orders number six. counsel is not provided meaning you don't get an attorney to defend yourself paid for if you are falsely accused. now the Blumenthal draft does but that is a little solace considering. what you're giving up. now you could be like a Florida man named Jonathan carpenter he is waging a very expensive court battle right now to clear his name and reclaim his property because he had the same name as that of a drug dealer on a on whom a red flag order was served except the red flag order was served on the wrong Jonathan carpenter. And that's not even true in the parkland shooting. That's not true the school had the ability to do something. They didn't the the the the FBI had the ability to do something. They didn't the police had the ability to do something. They didn't right. However, this is an idea that if there's a bunch of people around you. You could say if we all think that, you know, this person is a dangerous got a lot of guns. He's making me nervous. So we could go to somehow the judge the government and say, hey, this guy's a real problem. And hopefully, they would look into it. Okay. That's the theory behind. Yeah. Let me let me tell you. If you have an argument with a neighbor, they'll be able to turn you in just saying, I think you might be he might be dangerous, and they have to go in and take your weapons, and they take them for a year. There's no no, no, no judge ruling on whether this is a legitimate claim. Nope. They would be able to a judge would be allowed to take your judge your guns and suspend your second amendment rights for up to a year after they've been taken. But you don't even hear that side of the story. You don't you don't you're not you're not there. They can take your guns. They listen to the person, and they can keep your guns for up to a year. This is what happening Gerri Willis in Maryland. It happened last year an angry family member wanted to get back at him after having an argument he told police that he needed to have his guns taken away an officer showed up at five o'clock in the morning demanded that he surrender all of his firearms. He refused. A scuffle broke out and he was shot and killed by police. He was never charged with anything. It was a disgruntled neighbor. And he's like you can't come in my house and just take my guns. This is a GOP Bill. Instead of police or prosecutors having to go to a judge and say somebody is mentally ill. Or they broke the law the burden of proof is completely shifted. It is now shifting to the gun owners having to prove that they are. Okay. They have to prove after the guns have already been taken that they deserve to have their rights back. The gun owner is not even invited to be at the hearing where the confiscation is. I declared imagine this without the rights you'd have to prove your sanity before you were able to speak freely. You you'd have to prove are worthy before things. Like, I mean, even like voting, right? I mean, the whole point of the I know it's really hard to imagine a society that says let's say that you have to prove you're not a racist. Because of something that you tweeted, or are you you have to prove that you didn't sexually assault someone, but they claimed it online and the population has declared you a rapist or whatever is institutionalizing what we'd have later mob culture. Yes. It's exactly that. It's very. Scary especially when it comes to a constitutional, right? I mean again, like you're not allowed to infringe this. If you want to here's an idea where this is a situation where a random person can start saying that you they feel your unstable and that right goes away. Not because you've been convicted of something not because they just like you a doctor or somebody has said at least with some authority that you have instability, mentally or you've been confined to an institution, and they take them first. Then they show you the case. That's not. I mean, that's that's not America. Constitutional. This is the Republicans this Lindsey Graham, Lindsey Graham cares at all about the constitution. I mean, he he's you know, what I mean if that's our friends. Right. Enemies. Right. All right. There's an another imagine what Bernie Sanders does as president states. I did you see the California wrap that that came out and said the only way to really control guns is to is to change the second amendment and ban all guns, and they're now starting a petition to to repeal the second amendment. I good for him. First of all because he's right. Yes. The only way to to to infringe on people's gun ownership rights is to repeal the second amendment. Now. That's the only the very beginning of that process. And you're not gonna like the other steps because then after that were to happen states all over the place, which put it in their state constitution, you'd have to pass a whole nother. Yes amendment that would ban to repeal and ban at the same time, which will be even harder then you'd have a society with four hundred million guns on it with let's say three hundred million of them in the hands of people who have no intention of giving them back to you. So good luck going door to door to collect three. Three hundred million guns around this country. They won't do it though. They'll do it like they did in Germany German. Remember, the German people? They they were hunters. They went out and they shot their own food. There are a lot of guns in Germany. So what did they do? I they did the national database. So they knew exactly who had what guns then instead of confiscating you had to turn them in. And it was it started out. I think is ten year penalty if you didn't. And then after a few months, they gave you a warning and said, by the way anyone seen with a gun will be shot, no questions asked. So then those people who didn't turn in their guns were actually shot going to the police station trying to turn their guns in. That's why the population was was toothless when when Hitler really started doing bad things. There's no one that could stop them because they had all the guns. Right. Just a quick side note twenty twelve that's when Venezuela lost their right to guns because. That wonderful utopia socialism utopia. Yeah, they thought the guns would be dangerous in the hands of the people. So that's why they can't fight back to throw that in there. Interesting. Interesting parallel there. Yeah. I mean, I think that look the this'll be almost impossible to do in the United States almost impossible because so. What I don't think. So no, you don't you think this population? You think with the culture that has been ingrained here the most heavily armed? They will say this as an insult the most heavily armed society in history of the planet. Well, yeah, we are. That's because this this whole guaranteeing people's rights right to bear arms has put together a country that is almost impossible to go door to door. That is being passed in Washington state that the sheriffs have said we're not going to enforce and I've told you before support your local sheriff because your local sheriff is the one who will stand between you and your guns you and the constitution or the U and whoever wants to take the constitution away. We're seeing this now happen in Washington state. And now they're coming after the sheriff's because they are saying this is unconstitutional, and we will not abide by this.
