"Okay so after he was convicted. Pell was sent to jail awaiting sentencing. We didn't actually hear about it for a while. Because there was a suppression order but when that was lifted him every last year. Australians finally found out what had happened good evening. The unforgivable sins of Australia's highest ranking Catholic are no longer a sacred cardinal. George Pell once considered one of the pope's trusted lieutenants is facing time in prison after a jury found him dead in March judge sentenced. George Pell to six years in prison with the non parole period of three years and eight months. That means you become eligible to apply for all after serving this non appropriate. You release on parole will be matter entirely for the Parole Board. I declare the fourteen days imprisonment. You have already served in pre sentence detention time Reckon as already having served on the sentences that post interestingly though he did get to technically keep his job as a cardinal and the Vatican secretariat for the economy. That's because the Vatican has said since the start. It wants to wait until all the avenues for appeal have been exhausted. Before it makes any moves to stripped of his title and position and the appeal started almost straightaway to white long For confirmation of that and when the pill appeal went to Victorian Court of appeal that was led by Britain Walker as say. What was that appeal based on? What were the arguments that the that were making at that point? Essentially the Court of Appeal argument was that it just wasn't open to the jury to find pill guilty beyond reasonable doubt The compliant we know has been considered to be very convincing by the certainly the second jury obviously quite a few jurors in that first jury who couldn't reach a unanimous decision. Obviously founding pretty convincing as well but pills argument at the Victorian Court of Appeal was they were just so many other witnesses and so many other issues in the case that even if the jury believed compliant they really should have taken into account What was going on in the Cathedral at the time and we constantly heard the activities and the the hustle and bustle of the back rooms of the Cathedral. After that Sunday mass back in ninety six it was constantly described as a hive of activity and the pill tame food arguments like they were just too many people around that it was impossible that the archbishop of Mobin fully robed who'd go into the priest's sacristy possibly with the door open and then in a period of five to six minutes Assault too young choirboys. The court heard were pleading with him to be going so The Pill Tame said. It was just an implausible for that to happen. They're all sorts of other arguments. Like the fact that Church tradition. Maine's the archbishop is never left alone in his robes. He's always got a a church official with him is also these alibi. Evidence which is quite important and we might hear a bit about that in the High Court appeal. A couple of the church officials gave evidence both at the trial and The argument again came up with the Court of Appeal that they remember cardinal pill on after Sunday mass boothby out the Front Grading Persians. So they argued. There was no way that he could be in the back. Room Assaulting those boys. Nobody could actually recall admittedly. It's long time ago in ninety six having seen these two young choirboys scour off from the coral procession and and the trial certainly heard a lot of evidence about the rituals involved in the the strict procedures. So that was another thing that the Pill Tame said. Look all as factors must have Lift the jury with some raising doubt and it just wasn't good enough that the jury was so convinced by the complainant. I needed to take into account all effect as will both the result of that appeal. It was a majority decision of the Victorian Court of Appeal Stephen and basically the judges in the majority said. Nah It was totally fair enough for the jury to bake convinced by the complainant's evidence he was not a lie. He wasn't a fantasist and he's evidence was completely believable. And the rest of the evidence the so-called obstacles that the pill tame put up just wasn't strong enough and that it was absolutely fair enough that the jury believed the witness the complainant but Justice. Weinberg the dissenting judge said he had quite a few problems with the compliance evidence. And then all of those obstacles all is other factors. The PILL TAME foot up. Should've left The jury with raising doubt as to pills guilt and lift him with raise notebook. Doubt as pills guilty will so after that first attempt in a Victorian appeal failed. There was no question the pels legal team is GONNA keep on. Finding and the Knicks step legally was the High Court which brings us to today which could turn out to be the last step in George pels legal fight if it is possible can we I guess. Try and reduce down the central argument. That pels defense team is expected to make today. Guess the central argument is that no matter. How convincing the complainant was in his evidence. It just wasn't open to a rational jury to conclude that the prosecution had eliminated all reasonable. Dash is oppose lawyers really arguing that the majority of the Court of Appeal judges caught up wrong when ruled that the evidence of the surviving compliant was just so convincing that it eliminated any doubt raised by the other evidence. So all of those things pills tame is just saying the jury and the Court of Appeal judges should have wide. That up looked at that obstacle evidence and that it wasn't open to the jury to be convinced beyond reasonable dash that that pill was guilty despite the fact that they obviously believed the complainant's evidence so in a way it's kind of George pels defense team is arguing that this witness was so compelling has actually ended up almost perverting the integrity of those usual mechanisms where you need to consider all the all the other evidence. Yes that's right that they were just so convinced by the evidence of this man who's now In his lights thirties he was abused as a thirteen year old that they didn't look at other obstacles but the prosecution says Nano. Look there are a couple of things that make not only is the main. Ah So convincing. But he's evidence as well and I point to the fact that the complainant was able to identify the room that he was abused in. And that was the priest's Sacristy at Sin Patrick's cathedral the interesting point. Ease that normally pill would be heading back to the archbishops sacristy to take off his robes. And and go through the rituals associated with his role after a solemn mass but it was being renovated at the time so the complainant didn't get it wrong. Hey didn't say it was the Archbishop sacristy he knew that it was the priest sacristy where pill was a pill was using temporarily so the prosecution says look. That's a really strong point. He knew it was that room. How else would he know that? If he hadn't been abused their the complaint was also able to identify the features of that Roman described them Quite clearly despite the elapse of time. Some Wood paneling in that sacristy also with the wine was located so the prosecution says that makes his evidence all the more convincing. They also argue that things like the alibi evidence that the papal Guy. That evidence and said look I so pill standing with him on. The steps of the Cathedral was definitely there. That's what he did every week. The prosecution argues that those witnesses weren't so strong And that their evidence wasn't so convincing so it seems like George PELS legal. Tame is basically complaining that they were being asked to do an unreasonable toss that will being asked to prove their client's innocence Whereas really old I should've had to do was establish a reasonable doubt. Is that right? And what's the distinction there? Yes Ah the pill. Tame will be arguing that the majority judges in the appeal court sort of reverse the owners of pro hyphen required Pale to establish his actual innocence of the sort of accused. The judges a basing their decision on believing the complainant alliance so yes. There is That that question of whether the onus of proof was reversed The prosecutors the Victorian director of Public Prosecution Refutes that argument and says that the majority in the court of Appeal in Victoria didn't raise an on the basis of belief in the complainant but they did review the whole of the evidence As well as making an assessment of the complainant's credibility and reliability. So I think in terms of that onus of proof Argument we can probably expect the high court to raise issues around that movie hearing more about that over the next couple of days. Okay so what are the potential outcomes from today's appeal? The main options would appear to be that the High Court Refuses Special Leif and that'll in the case and who will stay in prison most triple. I think. Think that is unlikely. So they could grant special leave and dismiss the appeal. That'd leave George Pill in prison there to serve out his sees or perhaps he's threes eight months non parole period if they grant the special leave and allow the appeal. That will end this case and it would mean George pill is cleared and must be frayed Immediately a notice law. Some legal commentators have said that Special leave could be granted and the case sent back to the Victorian Court of Appeal or they may even ask the pill team or the director of public prosecutions to provide more argument. Saw or information but I think the main thing we'll be watching for is If the appeal is dismissed and pill stays in jail or if the appeal is allowed and we would then say George Pill released from jail as soon as possible after that decision was handed down it is expected though that it might tighten months for the High Court to actually hand. Its decision.

And it's just so I mean, he was so pumped up with drugs. You know, his body's probably still perfect. He he died in two thousand nine to him sold ten years almost an years ago. Yeah. The divers say did the the kids. The now adults talk about how they feel about his death or. I didn't see the documentary. I understand it's about to come out. Maybe even tonight is the first part. So despite Pels lawyers arguing for leniency based on the flavor of the rape, the dude literally referred to it in court as plain vanilla penetration. G in his lawyer said that yeah, Pell was convicted in December. Despite that awesome argument his council requested an extension of his bail. So that he can have knee surgery at the judge figured it was about to spend a lot of time on his hands and knees. So he granted that request. Ultimately, though that request was withdrawn and the motherfucker has finally behind bars awaiting sentencing on March thirteenth, and if any of his future so happen to be listening. I hear he has no issue with plain vanilla penetration. Yes. No big deal. Watch out for the flu though. He gets those for a while. Yeah. Right. We'll be able to fly at all. Tax free sort of thing something or other not like in the United States where it's like some corporation. Right owned by the church owns everything and whatever Lodhi, blah, or however there they've structure themselves. That's how warm instructors them to pay taxes on a lot of. No, absolutely not. But nonetheless. The this is all part of the. Cardinal pell. George pell. Yeah. His thing. Yeah. There was father to reiterate and all of you. Don't in Australia cardinal, George. Pell was convicted of child molestation Yan your country. You don't know about it because they're not allowed to tell you. But we're telling you so there there you go. But nonetheless, this guy John Ellis, former altar boy who was sexually abused at the age of thirteen by his parish, priest. Yeah. In the name of eight father Aidan, Doug and just sounds wrong. That guy's definitely going to be a molester. Father Aiden, Doug. And I don't know why whatever that is whatever that means Aden. A button anyway, Ellis sued Duggan. The and the trustees of the Roman Catholic church for the archdiocese of Sydney as well as cardinal, George Pell. But the New South Wales court of appeals found Pell and the trustees were not proper defendants in the proceedings it ruled the trustees didn't control Duggan, and we're responsible for his conduct. And couldn't be sued sounds bitches in the way that like, yeah. You know, any organization is responsible for, you know, people in their employees or well like you just are right? Well, the new laws are like doing away with that sort of rule or that interpretation of the law of it's retroactive can people who have previously been barred from suing go back and sue now, I don't know how that would work. I would assume they probably could go because the art. Ical does talk about you know, a lot of lot of the people a lot of the victims of this kind of abuse are now aging to the point where they may not actually bring a suit forward. I mean, this was you know, probably twenty shears ago that this that the suit was. Initially. Dismay and everything. Yeah. So so this is a huge this a huge deal a big deal. And this is important the the whole point of being able to sue the organism is that. Now, these trustees can be and have now have the responsibility of being watched ox, right? Yeah. They if they're going to be held responsible. If the organization is legitimate going to be held responsible. They can't just hang the guy out to dry, and then and call it a day. Yeah. And yeah. So now, there's going to be systems in place to protect and shield the organization that means actually. Dealing with problem priests. I mean, we'll see it's what should happen, right? Yeah. Because that's theoretically, how it works here too. But anyway. I know. So we'll see. Well, I wanna talk about. A religion. You know, I I've been I've talked about sort of feminist doings and goings on in India. I'm gonna talk about feminists doings and goings on right here in these United States. Yeah. We obviously said no spinning learn foosball. You're not allowed to spin. And now back to the headlines in our lead story tonight. There's a legal tradition in Australia that when a high profile person is convicted of say sexually molesting children. But still faces another trial for say sexually molesting other children the court issues a gag order to the media on that first conviction. So as not to taint the jury pool in the upcoming trial. Of course, these orders only count, if you're an Australian news outlet that being said, I'm sympathetic to the goal of the gag order. So ustralian listers just talk amongst yourselves for a moment. Start paying attention again. When you hear allies strained punt attempt at the beginning of the next story. And by the way, I'll give you guys a topic say can talk amongst restrained yet, the drop bear is neither drop nor a George pelvic to bunch kids. All right. A bunch of kids. So now, the trillions are gone. We can say that first of all the Southern Cross is a wildly unimpressive. Constellation has nothing on a Ryan that we don't put that shit all the flags and our fucking hemisphere, people Jesus. Wow. Feels good to get it out. There hope that they think we only think like sharks and bad assery when we think of their country. No, no, also cite note cardinal George Pell child molesting child molester that molest children notice I didn't say allegedly. Yeah. That's because that motherfucker was convicted by unanimous jury last Tuesday. Now details are hard to come by at this point because of the gag order. But multiple reports from reputable American sources have confirmed that he was found guilty of molesting two choir boys in the late ninety s and will face sentencing in early twenty nineteen which is also when he'll go on another trial for molesting two other boys at a public, swimming pool and Ballarat a public swimming. Like, how does that even happen? Yeah. George bells just like all right giant game Marco Polo. But versus me, you're all close your eyes, everyone at this public pool. Closed your eyes. Well, okay, wait. But this gag order is to prevent a jury from being biased in the second trial is this guy's a convicted rapist not pertinent station. They're not going to bring that up could convicted. We'll Lester I'm sure they will it's still going to be like appealed or whatever. So anyway, so we should say Pell is the highest ranking Vatican official ever convicted in the child sex abuse scandal. And that's the title he'll likely retained until we find out that Frankie doodle dandy did some dueling of his own appel is the third ranking Vatican official or at least he wasn't till last Tuesday. After that, it was reported that Pell was removed from the pope's inner, circle, I guess there's a couple of different ways, you can take that given the nature of the scandal and to be super clear. He was promoted to this position after the allegation that led to this conviction Roach, and when you're talking about Catholic priests raping children credible allegations, all but redundant. So they gave him this job knowing full well that. He molested kids and yet there will still be Catholics after this. Gag order is lifted and also for nothing I stray, but maybe come up with another name for your. Let's keep quiet about the molesting than gag order. Poor taste poor taste. And in square peg round hole. News tonight. Thanks to a recent article by author and sociology, professor, Kelsey Burke.
