Interview With Ryan Herz
"Well did afternoon everyone and welcome to another podcast from frames magazine my name is scott olsen and today i am talking to a member of the frames community ryan hers. Orion's work is all over our group. It is engaging it is provocative. It's the kind of work that you look at. And you're you're going to have a response to it. Personally i find it absolutely thrilling. An end fascinating ryan good afternoon. How're you doing pretty good. how are you. i'm doing great. You're out in santa monica california. Did tell me what you see out your window. What kind of day is it out there. It's pretty much seventy five degrees Another perfect Or another shitty day embarrass dice. All right well. I i envy you that here on the planes as it's gray and cold and snow ian winners coming in. You began your photography career when you were twelve years old and you came across an old range finder in a drawer. Tell me that story. Tell me how you got started in photography. Yeah i think actually it was more like it was about ten and i found an old contacts range finder in a drawer. Not being used. And i think it had been forgotten and somehow i latched onto it and i'm not quite sure how i learn to use it but i did and then a few years later there was a huge fire. One of those big california brushfires in my neighborhood. And i somehow got it together and took very poor pictures of the fire and the planes and i thought that was great in the photo bug was planted right then never left me. What what is it at age. Twelve or thirteen over that sent you out to photograph the fires versus. Just run away head you already been smitten a little bit by capturing images or what was the. What was the motivation there. I'm seventy three. That's a long time ago. There was always something about getting the images. I remembered i have one cute picture of me in my cub scout uniform with the context around my neck. My cub scout had turned backwards. So i don't know what pretended you were taking pictures. That bill was getting in the way where you go. that's right. we started the whole movement. There you go there you go. You also mentioned that. You took a two day seminar when you were in college with eugene smith that taught you as you claim the appreciation of the photo essay. Well okay i mean. Obviously we know what photographs are. What do you mean by the photo essay well especially with gene. Smith's work at life magazine. Was that former. You got to use eight or ten pictures. Basically to tell a story not a book nada along scale project but something you would go into for probably a few weeks and try and get eight or ten pictures. That convinced it all now. In his case obviously he was a master at it and obviously each composition was better than the last and medium and talking to him a little bit and observing him. Gave me a lot of input. Into what i want to do in the future and also what. The possible costs were because this is about nineteen seventy he had been fighting with various editors for basically his career and it was to the point then when he had recorded. I don't know how he'd recorded. But he ed recordings of his conversations with various editors and how they didn't understand what he was doing at the time and he actually broke into tears at one point in front of about thirty five forty people other points he was brilliant and other point see was certainly technically a master. So that was very insightful. I thought he was a rather troubled man at the time. And i had hopes for his future and lo and behold a year later he started minamata which obviously was a large-scale book project that was very very successful in lead to some of his best images. There's a good lesson. They're on both sides of success and working through the the struggle when people don't appreciate the kind of stuff that we're trying to get out there. I don't think that's unique to photography. I think musicians. I think writers. I think dancers all when they come up against a border are gonna meet resistance Border is is there because of some evolution of the form hasn't quite grown that direction. I bring that up. Because i am looking at your project called unseens which you subtitle street. Photography in the age of photoshop street photography is supposed to be the very real the documentary the untouched. And here you are really playing with that form so tell me about surrealism in street photography telling me about unseens. Where did it come from. What are you doing. Well in terms of surrealism. I've always considered myself and have a healthy dose of that. And i think a lot of the street photographers in france. Were surrealist their hearts. Certainly critize and man ray were surrealist and it was a thread that went through everything back then in paris at the time when everybody found the like and that was really the birth of the street. Photography movement my estimation anyway Unseens are a little different. They're not different than street photography in that they are not planned. They are not set up

"I just take those statements as really a point of passion and supported, supporting and representing their universities and their student athletes. And so I understand again. We have 14 institutions and Big 10 conference and we've been together a plan for us to continually be together and work to work collectively, to make sure that we're doing everything that we possibly can. To make sure that we keep our conference grown. We keep our conference very strong, academically and also very strong athletically. Look, you cannot discount anything. Anything in 2020. I think we've seen that time overtime overtime. You can't discount anything. But these conferences have bylaws. These conferences have rules that dictate your participation. These conferences have rules that basically say you're stuck with us. I mean, depending on where you go conference the conference. It may say all of the teams are committed for the next three years. We actually have conferences that say, Listen. You are stuck here with us unless we as a team collectively agree to vote you out for a minimum 100 years? Yes, that actually exists. And so I mean, let's think about college football as it's supposed to operate. In an academic structure. That place is university schools of higher education. You know, we say all the time that these athletes are student athletes. Well, what's the reality? If if we're really just trudging forward for them to play football isn't the point. First of all for them, they have an education. We're talking about moving conferences just so they can play football. When is the last time anybody prioritized education the same way I forgot. Educations really haven't been prioritized the same way that athletics event If you are gonna have AH, players who are going to transfer out I don't know how that's gonna happen. Where does the academics come in? Isn't that always how it's been painted. That this isn't in an academic transfer that this is Ah, hardship Transfer. What are we going to do? We're getting ready to. Ah, basically start classes. You know any minute now, any day now universities across the country. What? We're just gonna open up dorm space. We're just gonna transfer scholarships were just going to move people out the way so the football players can play and what has always supposed to have been, you know, an academic thing first in an athletic things second. And you know Scott Frost from Nebraska. He's not the only one Gene Smith, the Ohio State athletic director, he would prefer to play too. We're would have preferred to play. We very aligned in our position that we felt that we could. They could happen, but we knew that the possibility to postpone and castle It was a real possibility. Yeah, well, we've known it's a possibility for a long time, but what we never had from any conference and it's not just the Big 10 and the Pac 12 because they actually put their foot down today and said, Listen, we'll try to explore this next year. It's just the fact that that everybody goes around doing what they want to do. Ryan Day was on ESPN College football alive, and he basically said we might need to explore playing outside of the Big 10. Listen. We need to look at every option, and that's the only option the time we need to explore it. That's something that we can possibly do, because if it is, and that's what's best for our kids, then certainly we need to look at that. Do it. Are we going to see Ohio State participate in the Big 12 the S E. C and N a A. C C. I just explained to you the difficulties of actual players like Justin Fields all of a sudden transferring and continue on continuing on his college career. You know, so lots of jokes today. Just talking about how Justin fields. This is a problem opportunity for him to go back to the SEC and rejoin Georgia. I think that's a little bit too much of a pipe dream. Someone like Justin Fields. The reality is, unfortunately, unless Ohio State, you know, gets that that exemption, quote unquote play, you know, out of conference games. I guess that's a loophole that will allow these teams to quote unquote play out of conference. We probably have seen the last of Justin Fields in college football. The reality is we can play spring football and this is really on ly to save billions of dollars when it comes down to Tel television rights fees. Guess what. Everybody loses money. The games are now on the advertising rates go down. We might see college football in the spring. Not because you're going to see the best prospects not because you'll see Justin fields out there throwing around touchdowns but strictly to fill and try to complete some of these television contracts and try to execute them. Because Justin Fields He ain't playing in spring. This guy's going to be getting ready for the NFL draft. Why would he play in the spring? Risk, injuring himself, then going to the draft and and even if he didn't get hurt, why is he going to play twice in a year? Why is he going to play football year round? On what planet does that make any type of sense? This This whole situation is unfortunate and at this point in time, or be it personally, I don't believe That college football is necessary. Look if the A C C The Big 12 and the SEC are so hell bent on going ahead and playing football, then go ahead and do it. Be prepared for the consequences because you can have in a CC doctor who says we feel that it's safe enough to play. Okay, fine. You feel it's safe enough to play by my own means go ahead and do it. But just be prepared for the consequences. Be prepared for the worst case scenario. The Big 10 The Pac 12 said No Mass, not necessarily because they were, you know, afraid of a reaction from the public. The public, including myself, has beaten a month for the past several weeks the past several months. They ultimately don't want tohave their jobs on the line. They don't want of players unfortunate death. They don't want an injury hung around their necks. And I get it. And I'm I'm disappointed. I wanted to see Justin Fields play. I would still like to see trouble. Lawrence play I'd like to see who Congar out and pick up Ah Heisman Award. I think we have a lot of talented players. I love watching college football because I like seeing the next generation of NFL players. That's why I watch. That's why I love the game, and unfortunately, I may have to rely on my recollection from the past several seasons. But it's just really unfortunate for the players that there hasn't been a straight forward plan that the didn't lay out any guidance that they didn't say anything. Besides, hey, we're going to leave this to you to make your own individual decisions without hanging us up out there. Every single person responsible has basically passed the buck. Players wanna play obviously. Coaches want to play. And I don't necessarily think it's a good idea. But at this point it looks like the S E. C is going to go on so they cannot go anymore. It looks like the Big 12 is going to go on so they can't go anymore and at the A. C C is definitely going to do the same. It looks like the Sun Belt conference is in the same space. And if all of these organizations if all of these conferences want to play Go do it. I personally don't think it's a good idea. I hope that we don't get a situation where a player gets sick. We're gonna have positive test cases. And I know some teams have fared much better than others. No harbor on Michigan. He is quick to tell you. Hey out out of 800. We've only had 11. Well, the big tent in the Pac 12 They don't want to see one serious injury out of 11. They didn't want to be on that list of players who have, unfortunately come down, not with side effects, but with complications, heart issues. Nobody wants that..
College Athletes Forced To Sign Coronavirus Waivers To Return To Campus
"The last couple of days you certainly seen stories circulating the various schools are requiring players for voluntary workouts to sign waivers. We had Alan Green on earlier from Albany. said they talked about it. They decided not to. So. What does it really mean I? Know what it sounds like. It sounds really bad does heather has done some reporting on that and so much else, and she joins us from ESPN. Heather, great W on. It's always a pleasure. I know you know what it means, but I'll let you take the audience through the process. We said hello to you. Hey Paul. Thanks for having me on I. I think the best way to describe. It is through reporting, which is what Ohio state athletic. Director Gene Smith told me when I spoke to him last night and I asked him. Is this a way to protect yourself? Is it a liability issue? and His answer was no. This is not a legal document. That's why we're calling pledge, and that's because athletic directors throughout the country are concerned about what happens when these college kids leave the confines of Control of athletic facilities. And you know this is, this is the concern as departments are bending. Bending over backwards Paul to not only meet CDC guidelines, but to exceed them to protect these student athletes, but as soon as these players Wanna go to their favorite Taco bar to their girlfriend's house or the other bar whatever it might be all bets are off, so gene Smith is saying is we put this plan in place to try to get them to promise to us that? When they leave the athletic facilities, they will wear a mask. They will social distance. They will be responsible and do what they can to protect themselves the team and stop the spread of the corona virus. I'm glad you explained that. Because we've all been reacting with our is Eyebrows raised heather beyond that. You can't just look at your television and get a snapshot that the numbers are going up because we're. We're in a different spot here. Fourteen weeks in. We were weak, one two or three, but. Some of this negativity comes at really inopportune time as college football moves, everything else moves toward an opening what? What is your reporting? Tell you about where we are well. I've been on the phone all day. Actually trying to answer that question because things are changing and I spoke to Florida. Athletic Director Scott Stricklin today, because he's in Florida where cases arising, and he's still very optimistic. That college football is going to start on time and we're. They are located. I don't WanNa. Use the word safe, but they don't have a lot of cases within their outlet department right now in the community that they're in and you know I was on there. Zoom call last week with. With her doctors and they did a fantastic job again putting things in place to protect student athletes. Now you go to Houston where they had to shut down everything because there were not only six positive cases, but the keeping they were symptomatic. I don't know what to what degree, but that's important because it reminds everyone that they are student athletes. Yes, they are not invincible. Nobody knows exactly how this is going to impact the person that actually gets infected by so I think that's important to remember and I also talked to big twelve. Commissioner Bulls beat today. Yes I'm still very confident that we're going to have a college football season. You're going to see college football games, but it's going to be interrupted. It might be at levels at different places based on the resources that they have going to have outbreaks. Some schools will be able to handle them. Some schools will not and then finally I just hung up with Shane Lyons. Who is the chair of the Football Oversight Committee and he had a great quote, he said the coronavirus is controlling us. We are not controlling it. So as he said as I, sit here today I. Think we're going to have a college football season, but anybody who tells you that they actually know is lying.

Is the NCAA willing to go far enough on name, image and likeness rights?
"It was not an insignificant day on Tuesday for the history of College Athletics Not an insignificant day but is it reasonable to say not a significant as some people initially thought because I thought the incident way they're really good at this type of thing they wanted to create a headline and they created a headline and the way that the initial tweet that gets hit re tweet a million times is like the instable a board of governors votes unanimously that sounds great to allow student athletes to benefit from their name image likeness and people are like whoo finally this thing is happening and then you're like well let me click this Lincoln read more about it then read more about it and it's basically like the intimately board of Governors voted unanimously to allow student athletes to benefit from their name image and likeness but not in this way and not in this way and we're not going to go for that and we're not going to go for that and so they put so many guidelines or the or or go to try to keep so many guidelines in place that it doesn't open this up nearly as much as I would want a lot of would want California lawmakers would want and I really do think we can get into this momentarily it creates more issues that they'll have to deal with that they don't deal with now and I don't want to say it's impossible because I get frustrated when I hear inside officials say something is impossible it's not impossible figure it out so perhaps it's not impossible but it does seem very very difficult to try to thread this needle to thread we want to allow student athletes to benefit from their name would you like this rights like any other student athlete but this won't stand this won't stand won't stand and I personally can't figure out how you can make all that work maybe you can but even gene Smith interesting the Ohio State Athletic Director Dan Walk in our friend who works at USA Today was in Atlanta at these meetings and even gene Smith when asked by Dan how are you going to allow students to benefit from their name image and likeness but not have this turned into a recruiting tool of some sort in gene actually said that's the elephant in the room very hard to figure out and so like I tweeted good luck if this is the this is the path you're going down good luck 'cause I it's a it's a needle that's difficult to threaten yeah but I mean g Smith is not incorrect and what he's saying there but for decades this has existed in college athletics in terms of recruiting imbalances advantages. I will I will not sing the song with you again hairs on podcast 'cause we don't need to go down that road but I do have good news because you know what the consternation the backlash of cynicism skepticism toward the AA that was put on display. about forty five minutes after this this press release got center I actually at one point we were about twenty minutes away from media members is going to actually announced today that college athletes wouldn't even be allowed to accept scholarships like it cuts the blowback actually got a little bit over the top of here's what guess what so walk and talks to mark and Mark Emmer admits on the record here's the here's the exact quote there's no question the legislative efforts in Congress and various estates has been a catalyst to change it's clear that schools in the presidents are listening in heard loud and clear that everyone agrees that this is an area that needs to be addressed that combined with this quote from Californ- governor Gavin Newsom who released a statement after all this down he said in part California will be closely watching as the process moves forward to ensure the rules ultimately adopted are aligned with the legislation passed this year you know what if the parish can't get its bylaws to a level that are going to satisfy the public that's one thing but if it can't get there to a level that it can satisfy the politicians that's another and the good news is this is my prediction I don't see how it doesn't wind up this way it might take two years for your six years we're we're getting there okay you can have cynicism over what the won't do I get that are going to make sure this happens and if and last step might be significant court battles maybe even to the Supreme Court level but I spoke with congressman out of North Carolina who abreast to me supreme disappointment in the lack of detail here from the AA and also expressed a real intent Zaire to get legislation on the House floor in the summer of twenty twenty so that this can all be enacted in ratified by January of twenty twenty one ought to be clear GP there we have a long way to go with this and getting to the House floor is no Gimme that has a clear to the Senate and then it's going to need the president's signature to become law aw but my view on this is if we get to April and the instable a is saying all right we're going allow ABC and D- and not allow Asia I ultimately think that will be immaterial because I think at the federal level most importantly because the state level this is also going down the NC double A. is going to have a situation GP where we have twelve states enacting all this stuff allowing it and then it's going to really really GonNa go to twelve different states and say all you schools are banned from postseason play that's nightmare that's not going to happen so I do think while people might have issues with their own politicians and government this is really close to a bipartisan issue at that level as well and that's what's ultimately will force the installation hand I have issues in the short term with what the instantly Willem won't do but I think long term Mr admitted today that what has been done in California hastened this issue why shouldn't we believe that it will hasten it again and ultimately be the decider not the installation it comes to national oversight and consistency of

Those qualities are the thread photographer, Robert Frank. Shoe managed passion, believe whatever he will doing unusual. I don. But it can be seen as very much in keeping with his time. As a new aesthetic was planting itself in America. He was part of a wider sense in various artistic communities of enfranchising sound in franchising gestures by photographing them loosely and recording them continually WT Lehman is the author of deliberate speed a study of American culture in the nineteen fifties. I gather he wasn't publicizing when he was doing. He just had faith sometime. We would catch up with what he was about. And that seems to me what a lot of these people were doing. There was a turning away from an official popularity believing in kind of the future of a personal popularity. He wanted to reveal something.
Urban Meyer's retirement: What did university president Drake have to do with it?
"And urban Meyer. And even though he had relatively good season winning the big ten of beating Michigan again, I think that Chas them really began to wear on urban Meyer months ago. Why do you think that is? Well, because I think urban Meyer is someone who who needs to be reassured. And I think when he knew he lost the faith of the president of the university. He knew at some point it would come to an end. And I think because Ryan day was already there because the season started progressing fairly well urban Meyer. I think went to gene Smith at some point. And he was also sick. Stephen, I I mean, your point earlier on I taken for those who didn't hear it was quite significant on that. Yeah. I mean without health issues, we would not be having this conversation. But I think that added to the it's like, you're making beef stew. You just keep throwing stuff in there. And I think that was part of the part of the mix. And ultimately, I think he decided it was this was a good time to walk away. Paul. I know we're just speculating here. But if the president indeed, if there was a divide a separation of sorts, do you think it was because urban Meyer have how urban Meyer handled the press conference? A when it was announced that he would be suspended for three games, or do you believe it's because the president felt to some degree? He was an enable in the whole Zac Smith fiasco involving domestic violence against his now ex wife. I think it's the latter. Stephen A think urban Meyer was an enabler. I think he looked the other way because he was too close to Zack Smith, remember, not regurgitate everything.

"Eight five five two one two four CBS eight five five two onto forty two. Twenty seven is the number. If you want to jump on board. But does he also give me a follow shoot me? A tweet on the good old. Cesspool of Twitter at Zack killed that's Z. A C H G E L be the big news from yesterday. And it's not shocking because we've had weeks and weeks of speculation. We're the news did vacillate and the reports that vacillate as if you're on a seesaw urban Meyer will stand is state urban Meyer will retire urban Meyer will stay for the next season. And then handed off the Ryan day or he's going to stay longer than you expect. It was a never ending urban Meyer rumor mill over and over and over and over again, it was spinning. And it just a constant circle of rumors with Arben Mayer. Well, we finally got our answer yesterday as the highest state held a press conference with Ryan day, gene Smith and then urban Meyer and urban Meyer did announce following the Rose Bowl up against Washington. He will be stepping away from being the head football coach at Ohio State Ryan day will take over. So they're probably many reasons for this, and they were documented the headaches with this health and people can say what they want about urban Meyer and the health, and whether you believe it or not. Watch him up against Maryland. He just didn't look healthy he didn't. And I wish him the best in terms of health. Now, you also have the aftermath of these act Smith situation, and the only has to blame for that is himself and keeping him so long and probably the big reason why I did that was the loyalty to the lake great Earl Bruce because that of course, is the mentor vision overs was the grandfather of Zack's meant. So there was a loyalty connection there and keeping on giving Zac Smith another chance, but regardless of if the abuse that happened with him and his wife. His ex wife at the time. There were enough signs regardless of that just on its own that Zach Smith should have been fired. Whether it was the. You know, the trip to the strip club. Whether it was the alleged reports of him saying he was going to recruiting trips with high schools and not actually doing so showing up late or even gene Smith recommending urban Meyer that they should fire. Zac Smith, then that not happening. So urban Meyer kept this guy around and then ended up hurting Emma costing three game suspension. And then also the state of the program. It's in a very good spot right now, all they do is beat Michigan. All they do is with a ton of games. And they're in the conversation for the college football playoff each and every year. So it's a good time to walk away. If you weren't comfortable with the situation anymore, or if you're helpless, so bad, and you can feel okay walking away, even though it's tough because he handed over to Ryan day someone that, you know, very well who's that an incredible jersey the incredible journey at the age of thirty nine and has quickly risen through the ranks New Hampshire. Boston College temple to stops. In the NFL with chip Kelly with the eagles in the forty Niners, then comes to Iowa State takes over in the interim for three games on the suspension of urban wins them all and now, we'll get a chance when more many more games into the future. So the news yesterday isn't shocking. But get to if it's going to be the end Ferber Meyer, not in college football and just a second. But let's just reflect a little bit on his legacy. And there's two ways to look at his legacy, and there's many chapters obviously in the history book of urban Meyer, which is an extraordinary career and an extremely successful career. But there's on the field and then there's off the field and we took off the field a little bit. But let's touch on the field urban Meyer. No, matter what way you view him. Whether it's in a positive or negative. Whether he's beat your team a bunch of times, or you can't stand the more you love and you genuflect, though. You gotta think the guy is one of the all time, great coaches, even if you can't stand him there has to be at least a respect for what he's able to do on the field. Things happen off the field may annoy and deserving. Lisa deservedly. So because there's been things that he's done the field that have annoyed me as well. That's pretty well documented if you listen to be on the weekends or when I fill in framing.

"This next question is completely unrelated to that one in it's still mentions Cam Newton in ready, Haberson sue. The show is awesome. Bruce. Curse words are amazing. So keep up the good work. I know you. Yeah, go for that sometimes. Yes. My question, if the urban Meyer eighty situation went down a non blueblood university led by less heralded coach, would the outcome of three game suspension have been the same or is it too much conjecture in conjecture? And then he says, also stewards completely wrong around not having Cam Newton rated higher in his top fifty players list. Thank you for that. Is your feelings you start take that one? I, yeah. I mean, I think if he was not a national championship coach, I think if he were you what I was thinking about this, the other day, the situation with retry Zona they wasted no time forcing him out there over report that was troubling just like this report was troubling. There was no two-month investigate are two week investigation or anything. They just said pack your bags and move on. And I think that's how would have been handled if he were either a eight and four, nine, three kind of coach at Ohio State or. Or you know somebody of the profile retiree gets had at a school like Zona. Yeah, I, it's hard to say like, like you said, it's a little bit of conjecture and a hypothetical. I mean, because I think we had talked about this. What if he was eight and four trying to coach or seven and five? I mean, it's hard to say that it wouldn't be. It wouldn't be different. But yeah, I, I don't know. I mean, mileage is probably would be different. It's just there's so many factors that go into it. You know, would the of been with the a d. gene Smith Hanley have been much different. I think there's a lot of a lot of. Shoulder shrugging going out with this one. Yeah. And I, the other thing you can't separate out is the thirty eight million dollar buyout because if it were not that if it were something more affordable mean you can basically fire a coach for any reason you want. So this was one where they had to be have ironclad proof that he did something that would violate his contract in really that report is full of a bunch of things that we can all agree or ethically morally wrong, but I don't know that any of them would be an automatic trigger no-brainer fire him for 'cause you won't lose a wrongful termination lawsuit, etcetera. Yeah. Next this next one I need you to open up the people. Okay. Is actually a really fun game. I like when our readers come up with these phone game for us to play. Remember that pool a couple of years ago where hit graphs, teams that added up to a certain win total. This is kinda similar from Joe Simmons, longtime on will listener new athletic subscriber. "All of our guests join us on the shell Pennzoil performance line been talking a lot about what came out of the OSU investigation. The findings revealed yesterday after a press conference with urban Meyer and eighty. Gene Smith therefore preventing media from being able to kind of dig into some of the facts that came out of that reporting. A lot of people say. Free del that the lead investigator, Mary Jo White seemed to just be carrying water for OSU, giving them what they were looking for. That's not to say that the facts are omitted, but more so that their massaged the way she writes about it, the language she uses the brakes that she gives to those involved in certain things seemed to be out of a playbook that caused them to spend eleven hours to get to the point where they could say suspension stick around. They found a way to keep urban Meyer as coach of the Ohio State football team, sir. That in the end, that's what it boils down to that. Everything came to the conclusion that urban Meyer is still in place and gene Smith, because this certainly seems like gene Smith learn nothing from the trestle scandal. What we saw was a lack of institutional control under his watch where an employee was misbehaving, acting unprofessionally and potentially beating his wife over the course of several years and continued to be employed. And if you don't and haven't seen the litany. The of offenses from Zac Smith beyond the allegations of abuse. Those are important because those would get anyone else fired minus any other allegations. And if there was ever a question, so who the most powerful person on a college campus was and who makes the Old Dominion decisions at these big time programs. It's almost always the head football coach, especially of a successful program because gene Smith and the chance for Peterle to to make the change in a few years ago. Astor reminder to make the change suggested it to him about Zach Smith in it didn't happen also worth noting that Mary Jo White's claims that there were requests from both this investigation and the paper at OSU four records from urban Meyer's phone somehow weren't seen or addressed until after some Brett mcmurphy reporting came out that caused urban Meyer to talk to a fellow employees about what might be found and how to make his texts delete anytime. More than a year in advance. She was getting paid fifteen hundred dollars an hour to do this. That's enough money for them to recover text messages. It's expensive. It's worth it. If you want them. If she had wanted those wanted those techs, she could have gone after them. She could have also recommended a new policy mandating that all of the athletic department electronic records and communications be preserved that. It's a violation of policy to do something like he did, which is to delete all of the evidence when he's midway through an investigation. Good luck in your first press conference been Mirer whenever you come back after that TCU game because any reporter worth his or her salt at this point isn't an ask about what happened on that third down point in the second quarter. They're going to say urban, what? Why do they do you believe all these text messages prior to a year ago, if you felt you had nothing to hide. Well, here's what Mary Jo White said yesterday about what she said. Urban Meyer did wrong coach Meyer was in fact aware of the twenty fifteen law enforcement investigation into allegations of domestic violence by Zach Smith. He was informed of that investigation by athletic director. Gene Smith in the fall of twenty fifteen and both coach Meyer and athletic director. Gene Smith regularly Ma. Monitored the progress of that investigation for a period of months. Although the investigation did not alternately result in any charges or an arrest, coach Meyer and AD gene Smith, although acting in good faith did not report the investigation of Zac Smith for domestic violence in two thousand fifteen to compliance as we believe they should have. Although law enforcement had not brought charges at the time that coach Meyer and eighty Smith became aware of the investigation. The compliance function would have been in the best position to assess whether to conduct an internal investigation into the allegations, had they known about them. Couple of things to note..

But if you know the old saying, if you feel like somebody maybe doesn't have your back like you think they should that does change things, whether Myers. Wrong to maybe think that, you know that's up to conjecture and whether he actually does think that he didn't say that last night. So. "Of the day urban Meyer head coach of, Ohio State University football team and gene. Smith athletic director in Ohio State both suspended without pay for the first three weeks of the, season for urban Meyer the first three games of the season and this after the findings From an independent investigative committee which conveniently enough was made up of three members of the Ohio State board, of trustees that were ultimately in on this decision at the end When their, findings came through on the investigation surrounding urban Meyer and the university's handling of allegations of domestic violence pertaining to former Ohio State assistant Zack Smith Now in all this again Is two different, conversations that are seemingly happening not saying, one doesn't affect the other but yesterday in that press conference with urban Meyer got up in front of a group of people and really only I. Heard apologize for one thing this is urban Myers. Apology from the press conference yesterday I did a. Poor job at media day it's a big. Reason why we're here today I was not being as complete as accurate as I should have been at media day and afterward but, there is no intent to mislead my, role is a set a good example in instance I did not live up to the university's standards the suspensions are tough but I fully accept them. I wish I could go back and make different. Decisions but I can't so it's an apology for. Not being prepared enough at that press conference Alright seem strange but. Then again this is about what urban new and. That was what came up with that press conferences what did you know about the. Situation and Mary Jo White who's the lead investigator on this case former Commissioner. Of the securities and Exchange Commission had this to say about what urban new and what he urban reported coach Meyer was in fact aware of. The two thousand fifteen law enforcement investigation into allegations of domestic violence by Zach Smith he was informed of that investigation by athletic director. Gene Smith in the fall of twenty fifteen and both coach Meyer and athletic director gene Smith regularly, monitored the progress of that investigation for. A period of months although the investigation did. Not ultimately, result in any charges or an arrest first and. Last Michael junior here, on ESPN radio and the. ESPN app so now that confuses me did urban Meyer, not have to. Report anything to anyone because it sounded like what she said is gene Smith told urban Meyer hey we're investigating this it sounds like he was the one that news is, delivered to now the. Way it's lumped and the way it is summarized for everyone is urban Meyer and gene Smith, failed to report this to compliance. And, what we're. Led to believe, is that they monitor this situation in good faith and believed that they were going to. Handle it as information came up which is not the protocol? But if urban Meyer told gene Smith, we were always led to believe he was absolved in this situation now speaking of absolving because as you read through they released after this press conference twenty three pages of documents about the findings of this committee twenty three pages of documents. That they're counting on no one really going at. Reading but there are a lot of people who did and Matt Schick who works. At ESPN here is one of our fine hosts on a number of programs. That you see went through and clicked the few of the statements in the document of the one that to me at ESPN underscore Schick on. Twitter if you want to go and look at these and I've re- tweeted them on my timeline but I thought it was interesting In a portion of this statement this is what the committee said we accept that in July, two thousand eighteen coach Meyer. Was deeply absorbed in football season and, wanted to focus on football big ten media days the firing of. Zac, Smith the day before the first time coach, Meyer had fired a coach was, also on his mind as was the eroneous media reports of, a felony arrest for Zac Smith in two thousand. Fifteen again urban Meyer and Ohio, State of said there was no arrest in two thousand fifteen in the instance in the allegation of domestic violence were police showed up but they said there was no arrest made this is the interesting part we also learned during the investigation that coach Mayer has sometimes had significant memory, issues in other situations, where he had prior extensive knowledge of events he is also periodically taking medicine that can negatively, impair his memory concentration and focus What So with that in mind with that statement there to me that, says we can justify whatever we want to after this because this is a guy that might just not remember things the right. Way he's not outright. Lying and that was another thing that was said last. Night we don't believe urban Meyer intentionally lied at big ten media, day so it's just unintentional because you've got that as a. Backdrop now you've got that as a catchall because once you've woven that into these, statements It seems. Like in my mind you can get away with whatever conclusion you, wanna draw as you read through the documents there's a lot. Of things that will lead you to believe that there was something to hide here Talking about urban Meyer maintains the. After the two thousand nine arrest of Zac Smith at Florida that bulls. Zachary Smith and Courtney Smith victim and? All this who was not mentioned once. In the press conference by anyone from Ohio State. Until the very end when a, reporter prompt to asked urban Meyer about this was his. Response what message you have for. Courtney Smith.

"Amy Lawrence Those two statements don't jive those two statements. Do, not go together which is why I want you to hear them side by side. I the Ohio State lead investigator Mary Jo White thing that urban Meyer. In gene Smith both have a very Very core value they keep it as a core value. That they respect women That's something that is really important to them respecting women And then, you hear Urban Meyer say I followed my heart, and not my head And I allow my loyalty to, zak's grandfather who was like a mentor to urban Blind him when it came to How he saw. The relationship between Zach and Courtney those two things don't go together If, you have a respect for women A sincere commitment to respect for women is Mary Jo White indicates Then why didn't you have A concern for Courtney In a way that would cause you to follow through It's after hours with Amy Lawrence on CBS sports radio There's a couple of things from the investigation the, report that's come out now About twenty three pages that. Jump off the page at me While urban, Meyer did report the two thousand fifteen incident too gene Smith who is his superior as the athletic director Neither one of them Then went ahead and told Their supervisors and. The people above gene Smith they never went and told anyone else And their explanation is. That well he wasn't charged with anything So they explained it away Because of the legal process. And so it wasn't necessary To follow it up. The flagpole it wasn't necessary To continue on up the chain of command and to alert anyone. Else that there was a pattern of behavior now and even if urban Meyer only, knew about two thousand nine and two. Thousand fifteen which we now know is. Not true there were other patterns of behavior there he was worn for going to strip clubs when they were on trips to. The point where admire actually amended his coaching handbook also putting in there a. Lot about no pornography on OSU computers. Or devices and so there were other red flags there. Were other warnings So. This pattern of behavior Was not enough for urban Meyer gene Smith to to go to their superiors to go to. Other officials inside Ohio State and that's where coach says that he followed his. Heart and not, his head in other words he. Was attached to Zach Smith he liked the kid any also really had a loyalty to. His family to. His grandfather it's always blinded That's why you have to go to someone who doesn't have that. Same blind loyalty And yet for some reason gene Smith didn't follow up either That's the whole idea of having a system of checks and. Balances is so you're not. The only one making a decision so there are other voices they're more objective. Reactions in a case like this And so as best we can tell that's why. Ohio State of suspending these. Guys because while they did sort of follow protocols They didn't allow anyone else outside the department to get involved they didn't open this, up and, make it public knowledge in fact Jean Smith says he didn't even know about the two thousand nine incident when I I'm. Sorry Ohio State that did even know, about the two thousand nine incident wanted wanted. To allow urban Meyer at higher Zac Smith That they didn't do a background check but for whatever reason This thing in two, thousand nine didn't pop And so, they didn't do enough of their own homework but urban Meyer and gene Smith also did not help them by offering as much information as they had Gene Smith failed To. Alert anybody else no issue about this repeated pattern, of disturbing behavior and the red. Flags was Smith So in other words urban Meyer and gene Smith, chose to keep it in house And I'll say it again that's why there is a protocol that's why you are supposed to involve other people. And make sure other, people know so that your emotions do not cloud your judgment But they didn't do that And so now both of them will serve, a roughly three weeks suspension I have huge regret for my. Inability to be the effective leader should have been in this particular situation The greatest pain that I have is. The people that I serve. Every single day five hundred. Sixty five employees go to work with every day the thousand close student athletes we worked for every day Gene Smith. The athletic director who will. Be suspended until September sixteenth All. Right so I'm seeing some of, your tweets coming. In a law radio haven't opened up, Facebook yet but I will it's named after the, show People keep asking me should he have been fired in. "The two questions that I need I'm looking to see get answered is one is at if Zac Smith was pulled off the recruiting trail by gene Smith because urban Meyer did in fact, tell him what he heard about through the Texas change between Courtney Smith and his wife. If that is is if that is the actual accurate time line of events than why was he allowed to stay on staff for as long as he did, and then why was he fired? That's one piece and then to is, is I guess the the similar aspect of it is that what is gene Smith's role in all of this? And will he will he. Emerge unscathed from all of this Pat. Great questions. You know, the fact is, you know that nobody is disputed that that that those things happen that that you know that there've been Meyer wasn't formed and that that he, you know, took it through proper protocol and the Zac Smith was brought in to to meet with Jean Smith and then yeah, why there was a decision made that everything's fine. I don't know. I mean that that to me, especially since if you're urban, this was a second domestic violence allegation. You know, there was one in two thousand nine in Gainesville, and and he was actually arrested then, although it was not charged and that, you know, that's always been the question to me is why was there such a seemingly high tolerance level for a guy that was really problematic employees? And that was before we even knew about some of the other stuff. And then yet gene Smith part amiss. Where does the buck stop? What did he do. Do what we're what was his actions and why was there no further action taken there. I don't know. I know urban Meyer's in charge of hiring and firing his staff like most coaches are, but especially coach his level and magnitude. But he also has a boss in a boss would be able to theoretically step in and say, you know, we don't need this guy athletic department, but he did work for three more years. And so hopefully we'll get some more explanations of that here. But when this all this is wrapped up and what do you think Pat the odds that the only lesson for urban Meyer out of this is that he needs to when he speaks into a microphone understand that Buckeye family is not the only group of people in the United States that deserve a proper explanation as to what's going on inside the Buckeye building and program. Central question is did Arben Meyer do what he was obligated to do with the information that Zac Smith Head allegedly abused as wife Beyond that it's urban Meyer do. What he should have done there's a. Difference between obligated and should I think Meyer in his statement last week pretty much made it clear that he did know about. The two thousand fifteen alligators despite what he said at the. Press conference in Chicago Big ten media days And now it's a question and he claims that he reported it to who should. Have reported it to so, then the question becomes, if he did that what did Ohio? State handled it properly. There's so many things we don't know why we're waiting. For the

"And you know, I just I had trouble buying anything that the guys guy says one more point than that fall statements that urban Meyer put out roughly week or so ago. And that point about following procedure, alerting supervisors, whatever it was supposed to do that that to me just reeked of of lawyer, language crafting right there. You know, corks follow procedure corks report things to their bosses head coaches who are CEO's of football team report things, and then take the action that think is big right. Thing to do. And I think that language that wanna two things it either gave the university excuse throw the out and keep Meyer. Or if they throw Meyer out, gives Myers lawyer an argument for getting paid out on his contract because he can say, I complied with the letter of the law so to speak with my contract, it sure didn't seem very head coach like behavior kid, your former CEO in in the world of hospital administration. I, I don't know if in hospital in the hospital world, whether you hired Lou ribbon committee is to investigate things, but, but I'm really interested in how you view this six person panel that ultimately, at least we're told they will adjudicate the urban Meyer case. I think your impression is correct Paul, the fact that it's fifty fifty insiders and outsiders makes it by definition not independent and probably if they wanted to really be independent, they would let gene Smith to his job by appointing a committee who would investigate within his athletic department. And the board itself would appoint a truly independent committee to investigate gene Smith urban Meyer Andy athlete department. 'cause the board has responsibility protect the institution. They don't know at least wouldn't have known at the time of gene. Smith had lied to them or Meyer had lied to them for both. They've got to protect the interest of the institution and so you know, truly independent, they would have have both and they wouldn't have had trustees representing the board. They would. They would have out had four or five outsiders, maybe two trustees because you need some connection there to the board. But this fifty fifty thing look kinda looks like the dies cast, doesn't it? Smoothie genuine in and I bring this up because you you're on college campuses, you're NFL locker rooms quite a bit. You don't. We don't. You don't reveal and we certainly don't know where you've been, but you've seen a lot. You test players, you test young players. You just NFL players other sports as well. When when you heard Jalen hurts, talk the other day. What did you hear. First thing I heard a guy who was hurt and that's understandable. What does he fall? Nineteen twenty years old. It'd be twenty on tomorrow. Holy cow. Can you imagine any of us at our age with our experienced enduring publicly, what he has endured after the performances that he's had and then at crunch time and his second championship game, he gets replaced by the guy who who throws the winning touchdown, okay, that that stuff. And it sounded like he was. He was almost like talking like a courtroom case where he's out like he'd been convicted of something but never had a right to speak. His piece confronted accusers and those hurt feelings came out. But I also thought he sounded like a guy who was kind of resigned to his fate and and that too crazy about it and look, he's a, he's an acute competitor. Think the biggest challenge these coaches have, whether it's Meyer or Swinney smart saving. They recruit eighty five thoroughbreds and they gotta figure out how to keep sixty of them. I'm happy well about twenty five, maybe thirty of them play and and so he he's hurt by that. But it also last thing I thought I heard from him..

"They did about twelve thousand kids they helped out and this year I'm sure they're prepared, for at least that much. If not more newsies God bless. You and. Keep it going so we know the Ohio State story continues to swirl fourteen days that's, the word from the investigative committee they're going to have the investigation. Completed within fourteen days for Ohio house. Speaker JoAnn Davidson is going to serve as chairwoman it's a six. Person working group and Mary Jo White former, chairwoman of. The US securities and Exchange Commission will lead that investigative team you wonder too I mean I know there's so much else going. On but just think about Ryan, day Ryan day the acting head coach You just. Wonder what it's like day to. Day on campus because Greg Xiang has been head coach Kevin Wilson has been a head coach day has not been head coach and I mean. I don't think you have to be like super brilliant in the. Ways of public relations to see why. He is the pick but it still would be kinda weird and you. Know. When you're so used I mean if you. Talk to people that have played team sports I mean the head coach is the focal point you get all of what you do. And the tenor. And the, attitude and the culture of the team it's, set by the head coach and your head, coach is not there So, and you, know with administrative leave I mean are. They are they talking to coach Meyer on the phone I mean is he like do they have webcam. Setup so he leaves he can monitor I don't know anything about that But administrative leave while you're right I mean, we've got Bill Conley who was one of the best. About his reporting we know Zach Smith now has. Done interviews with local media and national media gene Smith, still has yet to tell his version of the events It's interesting too because Zach Smith. Is said Jean not only knew of the allegations but pulled them off the. Road during a recruiting trip about three years ago as a result Thought it was interesting I think, it was USA today sports actually, sent a reporter to Mr Smith's home over the weekend they knocked and nobody answered the door And you know whether it's, hanging with friends or you, know you're standing in line. At the food Carter I mean take your spot I think most people say at least to my ear, if you fire urban Meyer you, gotta fire gene Smith so I. Don't know if that's what's being talked about, in the investigative committee or. On campus, or anywhere but at least. To our ear no talk yet from gene Smith so we're, keeping our eyes and ears open and we continue the story in fact we'll. Talk more about, it former coach Bill Conley will, join us live here at seven twenty five right now traffic and weather. "Use the tackle app. Let's tackle today t. a. k. l.. Zac Smith, the guy that was the center of the urban Meyer story. The reason that been Myers on leave the reason that urban Meyer had to issue a statement today saying that he followed the rules. He did what he was supposed to do. He's giving interviews Zac Smith is listen to. This is an interview from ESPN and he basically pulled a whole bunch more people into the middle of this Cobra twenty fifteen on the road recruiting in Virginia Beach. I got a phone call as I'm standing on the field from gene Smith athletic director, one. He doesn't call often every now and then he does. So I knew something was going on. He said his ACA, we need to get on next back. You need to get back here. Okay, what's going on? He said, well, apparently your wife's making accusations of domestic abuse of in pal. We just got a phone call so we need to get back here October the end of October tweeted, Halloween? Yeah, whenever it happened, I I think it was NFL Tober so I did that flew back. I went with my divorce attorney Denis Horvath. I went to volunteer to go meet with the police. That's when we just talked about met with them, went through all the charges walked away from it, and it seemed like this is just a bunch of accusations that are are going. They aren't going to go anywhere because I didn't do anything illegal. And so I went back and then to work, we had practice. I went to practice and urban pulled me off the practice field. And when he pulled me off the practice field, he said, what the hell's going on, what is this? What is this? I told him, I laid it all out for my said. Apparently my ex wife is trying to get me charged with domestic abuse. I don't know from incidents that happened throughout our marriage years ago and some more recent, but I went down and met with the pal. Police explained both sides of the story I volunteered to do that, and I didn't ever hit her. So I don't know what what else? And he looked at me said, Zach, if you, if you hit her your fire immediately and I looked at him. I said, coach, I hit her. I wouldn't come in here. No, how you feel about that? If I hit her, wouldn't even come to work. I would know it's over its narrator. Never hit her. Well, there are text messages that say, otherwise, there are text messages from Zac Smith to his wife, ex wife, Courtney Smith, basically confirming that he has hit her. So that scene in the fugitive you, you care to revise your your story, right? That's this right. I, I like the part two, whereas all I know how you feel about launching their wise have shown up to work. I would have fired myself urban done these things. Urban Meyer is that rare guy who is distasteful of domestic violence? I know how you feel about it. I mean, if there were other coaches in, I would go wouldn't wouldn't get a second, but you hit my wife on the way to work just to please you. I know he was probably trying to do right by somebody in that. I couldn't tell you who he was trying what he's trying to do too. So he's trying to look like the good guys who so against domestic violence that he would fire himself from his job had he done something that agrees. I think he's trying to look like he's not betraying a person like urban Meyer who has clearly stuck beside him far longer than he should have through gene Smith under the bus. Gene Smith knows gene Smith didn't do anything about it. Gene Smith, same thing urban Meyer's doing by the way. Yeah. Gene Smith part is interesting because now of a sudden he has questions to answer new in two thousand fifteen that this was going on..
