school Rich these campaign finance provisions are a little technical Tell us about the provision at issue here So senator Cruz is challenging I can't fairly minor provisions of federal election law which deals with candidates who lend their own campaigns money And then want to get that loan paid back by the campaign after the election is over So Santa Cruz lands his campaign $260,000 Under the law he can be paid back in full any money the campaign receives before election day and also any money $250,000 that the campaign receives after election day The law says that you can't be paid back beyond the $250,000 for any money that comes in after election day So again he lent his campaign money the losses that that's alone And candidates will do this typically early in the campaign before they actually raised a lot of money It's kind of a seed money So candidates can make a loan to their campaign particularly as seed money And then later as the campaign has gotten contributions they can pay the candidate back That's all with pre election day money With post election day money they can still play the candidate back but only with up to $250,000 of post election day contributions After that they can still pay him back they have any money in their account but they can not accept and use any more post election day contributions any more than $250,000 to repay their debt to their own candidate And what's the reason behind regulating the repayment of candidate loans in this way Well the reason behind it is once it's after the election of course your guy is one Technically if the issue also applies to candidates is lost But the problem comes up hey the candidate has won And this could become a way of currying favor with the winner Moreover the money is not going to go to pay for any electioneering The reason campaign contributions are treated as protected campaign contributions and not gifts which could be prohibited by ethics laws or can be treated as bribes is because they're used to pay for election activities Well at this point the election is over So a contribution to the candidate's campaign should be used to pay back the candidate looks a lot like a direct payment to the candidate In these are all arguments unlike the two others we discussed today it seemed like there was a divide between the liberal and conservative justices What were the conservative justices concerned about Well the conservative justices still see this as an indirect but real limit on the ability of a candidate to campaign But candidates will be reluctant to advance money to their campaigns if they can't get fully reimbursed So one point they make is that this operates as an indirect kind of limit on the ability of candidates to raise and spend money A second point that's raised by some of them I think justice Kavanaugh in particular was the law still capped the amount of donations that a donor could give to the campaign to pay back the candidate That cap is the $2900 cap That would apply And in fact part of the oral argument was 86 people could give that permissible $2900 That's how you get to $250,000 If 86 people could give the $2900 to pay back the $250,000 loan why not 87 Why not the next person And that's the issue Why not the next person As long as there's a cap on the size of the donation to the campaign committee they don't see a corruption So there's this no urgency to try to find these women. And so it's just such a sad case because I think we often think about how when a non native gossipy, there is urgency. There is they get the media attention all over the world, especially recently with the girl named Gabby potato. I think that was her name. I mean her case was everywhere. And I remember saying something through a video on native women running about how we're happy that she was found. We're happy that she had, but a lot of times when these native women go missing, you know, some of them don't even have an article about them. These families are just waiting and no one's helping them. And that's really, I think hard to see when everybody in the world was searching for her. And so we're as native women as native people. Both of these shows talk about people not usually covered in true crime shows. People of color. So when another missing person case got really big this year, it made both John one and Connie, think about how these cases are covered, and thought about. And how much that depends on the background of the person missing. And when I first saw Gabby, potatoes, you know, disappearance get the coverage that it did. I thought about Jermaine and thought about all of the similarities. This morning, the desperate father of Gabby potato, appealing to the country for help. "He's only 22. He is fresh out of high school and college. He is a young kid, and you're not more worried about that. I think pretty much suck. Sadly, the remains of Gabby potato were discovered in grand teton national park two days later on September 19th. Her body was found after two YouTubers reviewed personal footage. They took of their own trip to the tetons, and which they noticed a van that resembled that of Gabby's. One of the YouTubers Jen Bethune said we came across a white van that had Florida plates, a small white van. We were going to stop and say hi, because we're from Florida, too, but the van was completely dark. There was nobody there, so we decided to continue on our way. Gabby's body was found in that general area where they banned live people too, I guess. Yeah. The Bethune have not been the only people online to speak up about their encounters with the couple. TikTok user, Miranda baker, posted a series of videos saying that she and her boyfriend gave a ride to a hitchhiking man they believed to be Brian. At grand teton on August 29th. She claimed that the man told them he needed to go to Jackson, about and after about 20 minutes, she mentioned that they were also heading to Jackson hole, and he immediately became agitated and asked to be dropped off. She said they let them out near Jackson dam and that he walked across the street and into a crowded car park, presumably to find someone else to give him a ride. Right away, a press conference was delivered in which they confirmed that the remains found the park were out of Gabby. A few days later, it was ruled that her death was believed to be a homicide. Just this past Tuesday, we found out that she had been strangled to death by human force, which is otherwise referred to as throttling. Following occurs when someone is strangled manually by someone's hands or fingers so no blankets aren't used, no rope, no one like this. Hands and fingers. Which is notoriously known as a crema fashion. Everybody says that it's always been known in like the crime community that someone that strangles, someone it's usually someone that you know that strangles a person. It's usually the heat of the moment. Those kinds of things. So it very much indicates that it's probably someone that she knew. And they also said that her body had they presumed that her body had been out there for three to four weeks. Before they found her. Although Brian has not yet been named a suspect in Gabby's murder, and still remains a person of interest, there is an act of Warren out for his arrest. Between 30th, between August 30th and September 1st, Brian allegedly used Gabby's Capital One bank card and pin number to make unauthorized withdrawals and charges of more than a $1000, which is a felony..

And why aren't they required to share even if it was from like the preserve maybe like security or something saying to move the vehicle or whatever. Why wouldn't you provide that information. They left the car there on wednesday so that he could drive it back. They return on thursday to retrieve the car and then report brian missing. I think literally one million percent that it was an escape plan and his parents are involved one hundred percent. His parents are helping him. One thousand percent think that his parents are helping him. maybe they don't know the extent of it. Maybe they don't really know the full details. But i definitely think that they know some of it like an are helping him and that's a. I'm not helping my as mom. I'm not i'm not. i'm just not like i. i would rather be known as like a snitch. That gave up my son in a murder case but like i'm not helping my son get away with murder. I'm not gonna do it. I've thought about this. If i was in this situation as a parent i would force my child to cooperate with law enforcement. That doesn't mean that. I wouldn't hire my child. An attorney right right right but they would be forced to cooperate. Like this is insane to me. A lotta people have sent me messages saying that. Possibly his parents are helping him and don't want him to speak because of his mental illness and because of the schizophrenia That maybe they're trying to help because they know that he emotionally snapped And isn't isn't mentally right. And so in a but a lawyer. Good lawyer is going to help with that correct. That's not something that makes you like. Why are you wanting to help them. Run away versus having explaining the situation. If that were the case and if that were the truth you would have documents to prove all of these things like. He is schizophrenic or he. Is you know There is an imbalance or something along those lines like you. would you would have. And why would the parents not come if he is truly diagnosed schizophrenic. Why would his parents not go to law enforcement and say. Hey this is what we we know our child as schizophrenic. He suffers from mental illness. These are things that we have seen in the past. This was when he showed up at home. This is the phone calls that we had provide some type of information like you. These parents are going to be charged and should be right at this point. They should be. But i did see. That are actually back on the property. So that didn't take long for them to treat it like a crime scene and move out on either. They didn't find anything or they found everything that they needed. They're back on their back on you. You have to consider that there wouldn't have been enough time based off of the timeline for gabby to have been there right. So what they're looking for is probably like laptops tablets. league electron. Yeah any type of clothing. That might have those types of things. I think is probably what what they're looking for. You know they're not probably taping off like a murder scene or something Right one thing that. I did want to touch on before we go is. I have seen this thing going around instagram and twitter. It says stop using gabby potato and her case and his excuse to say that we need to teach our daughters to leave toxic and abusive relationships teacher signs not to be abusive teacher signs to take no for an answer. Answer teacher sons to be and do better I feel like okay to both of those right like we do need. People who do have daughters do need to teach their daughters to leave toxic and abusive relationships and be able to have an open communication to feel safe to be able to assist them doing that if they find themselves in this situation but we also do need to teach our son's not to be abusive to take no for an answer and to be do better like all of that above is collectively true. Right right absolutely. I agree but also it is hard sometimes if if someone doesn't disclose if there is mental health issues at play or you know you don't really know somebody you just never know. Either you know. Unfortunately for this situation i do think that there are. There are other factors and you could tell by the domestic Situation that happened where the cops were called while they were driving in so this to me seems like there was there were there was definitely factor other factors but i agree with all of it. You have a you have to do both but also you can't. I mean i think of situations that i've been in. It's like you can raise someone to be to your to the best of your ability and at twenty five point six seven years old. They're not reiter abusive or they. You know you can't. That's not how raising them. You get what. I'm saying right just because you know you raise them to. The best of your ability doesn't mean that they're going to continue to be that way outside of your raising you know so right at some point. They do make their own choices. And it's out of your hand. So but i don't know what. The parents not cooperating. I don't. I don't have a good feeling about that situation. That's for sure.
