That's actually really really hard for me to grapple with because on the one hand i absolutely want there to be more systems in place to protect children. I really want that. But on the other hand i don't want that pursuit to then enable systems that could harm entire populations through misuse where the cure ends up. Having its own kind of disease that affects society. I won't say it's worse than the disease because it's hard for me to think of things that are worse than child abuse but it could be another bad consequence of that solution and the eff warns that various governments and regimes around the world already are standing up to take advantage of apple's decision and find ways to turn it to their own purposes for the you know the the aim of surveillance and the f. f. is adamant that apple's choice ultimately weakens security and privacy. They're actively involved in all of this funding some of the groups in particular the group that that's behind the Michigan New York Virginia rallies that Donald Trump tweeted about right because he had his own hand. I'm sure in making those I mean. He's actively said that. Oh Yeah He. He's actively saying that. He has all of the power. The people are getting pushed around or the people doing the pushing of the people. Doing the pushing no the people who were there protesting the cops are there to make sure that nobody got really hurt. But that didn't stop these people from hurting people who were protesting their protest. Yeah and a lot of these people were carrying guns. Yeah it was open. Carry season out there. It was which because that's what that's really about. Which if you're having a I know there are people who would argue this. But in my opinion a protest with guns is not a peaceful protest. No because the gun automatically is a sign of intimidation not right. If it's I mean that's how I feel if you have a rally with a bunch of people with guns that scary. Yeah with people with guns. That looks to me. A Lot. Like a military formation a rebel group of militia a peaceful protest in this case they weren't marching basically a peaceful protests. There does the other side feel that they can also protest so do you have equal protests anti protest groups going on in protests. Like this one where there was a lot of open Kerry. There was a lot of angry yelling people. There was no chance for an anti protest to develop because those people would have been in actual danger right and the whole point of this protest was too loudly and very aggressively. Threatened the government. Yeah and got away. Scot-free technically everyone in that protest committed a misdemeanor by being there yet but committee and getting charged with and actually be punished for are very different and also. There's no way that the state of Idaho could arrest more than a thousand people. Oh please tell me that. There's no way to tell if even five percent of them have guns. Yeah Yeah. Don't Put a Ring Camera in Your Bedroom
"So a few years back I gotta ring in the mail. It wasn't a proposal indecent or otherwise from a fan it wasn't a cock ring or an engagement ring. It was a doorbell ring. The Home Security Company now owned by Amazon briefly advertiser on the podcast sent me and Terry one of their products their most popular product which is basically a high tech doorbell. That's also a camera so if you have a ring doorbell someone rings your doorbell it calls your phone and you can see video of whoever's outside your door and there's a speaker on a too so you can talk to that person outside your door. The idea as I understood it at the time. was that someone when might ring your doorbell because they wanted to rob your house but they WanNa make sure you weren't home first before breaking down your door and if you didn't have rain they know you weren't home in break in but if you did have a ring you could speak to the robber on your front. Porch and the robber would go rob someone else's house because they would think you were at home because you were speaking to them them through your ring but the Ring Doorbell Camera. It's so clunky and distinctive even on doorbell like in appearance that I thought it would have the opposite effect. If you were talking to someone view your ring instead of opening the door shouting through the door you're basically league leading all those polite doorbell ringing robbers out there. I have announced on my campaign website. Which is Jacob for Liberty Dot Com that I want to win the North Carolina primary and I went to win it big in two thousand sixteen gene? Gary Johnson got twenty five hundred votes in that primary well to put things in perspective. Hillary Clinton got seven or eight hundred thousand Donald. Donald Trump got seven or eight hundred thousand. Okay I want like quadruple. The number votes the Gary Johnson got in and so it's a nonbinding primary but nonetheless. This gives me a chance to do what I like to do. I like the campaign I like to interact with people. So I'm I'm down there campaigning. Among a large part part African Americans and went to the bus station in downtown Raleigh just introducing myself to people and giving them a campaign card like a little combination card brochure. And it is it's important to know your rights. That's what this comes down to is knowing your rights within supreme court cases. And also just knowing your rights by based on the law that comes out, which a supreme court case would make it anyways. It's the law of the land. Exactly. So let's talk. Let's talk about this new case that that the freedom foundation is brought yet. So I'm going to provide some context with Janice. Janice was a supreme court decision decided and June of two thousand eighteen the core got rid of mandatory agency fees and also requires that public employees opt and to pain dues what that means is the union. Must obtain public employees affirmative consent. This means that the employee has to know their rights under Janice and voluntarily agree to give up those rights. So that's the context of our class action that we have going on. This good. This lawsuit involves five teachers who were pressured into signing a commitment card about two to three weeks before the Janice decision the union just left these their commitment cards and their mailbox and said, we need you to sign this right away. No explanation for it at all. They even told our lead plaintiff. We need you to hurry up and sign this. We have to avoid Janice. They ended up signing it because at the time they thought well, I'm gonna have to pay money to a union. Anyway, I might as well I felt like they they had no other choice. So they signed the card after the Janice decision. They finally learn about their rights, which is that they don't have to pay money to a union or join the union to keep their job and they wanted to exercise that right? So they came to us and Saint ASI asking the freedom foundation where the firm that really leads the fight and freeing people. From forced unionization. They came to us asking us to help them opt out. We, you know. Brought them through the steps of opting out, you know, and the the union really made it very difficult for people to opt out a they required. They had to send it to the and then they had to send a hard copy to their local union, and then they had to have several interviews with their union Representative. But in the end the union, let them out, but it's still forcing them to pay union dues, which is I I would love to get more into the details of this because it's so confusing to how you know, if you it seems like such a blatant disregard over what the law is. And and yet people thumbed their nose at supreme court precedent or out in laws in general all the time. And and this is so blatant. So new this is an old case that you know, you can you can hide behind the the mystery of years of. This largest maybe not being applied or something like that. But this is brand new. Yes. So go ahead. The the the the the court automatically put the burden on the union to show that the employees waive their rights, and the reason they did that is because our organization the freedom foundation actually wrote in a meek is brief to the supreme court really advocating for an often requirement because through the freedom foundation's experience with helping no partial public employees opt out they learned that unions are knocking to tell. Public employees of their rights. We have to put the burden on the union and even with this burden on the union, which is they have to show that the employee's can sent it. They're still trying to circumvent the law. Well, I mean, it's it's one of those things where you have an agency like the union rookie. I want to touch back on the meekest. Brief just in case anyone doesn't know. That's just a. An opinion. That's given to the core. It's called the friend of the court, basically, just sending in a an opinion that supports or is against a particular position within the case. Yes. Okay. Thank a persuasive piece. Yeah. Saying. Telling the court what? Yeah. And giving their own reason their own supporting or against a particular. So anyways with regards to and we do have to take our first break in just a second. Here. We're we're going to get in a little bit more in detail as to the background of how we got to this position. Because I think it's important to know the context, and we're going to stay away from the politics on this, even though there are political, I guess dividing lines on it. It is important to know that it's either you kind of agree with the required union dues or you don't. And we're going to talk about why one might be better than the other. Because there is a rabid assault on our rights right now, not just in Washington state, but all across the country, and he hopes to get regular speaking gigs. I seriously don't here's my position was sixteen thirty nine in a look in the I I'm telling you that as as a guy, I am a human being I fully believe it's my duty to not follow this law. It said another our constitution Washington. State says that the law the the citizens initiative must contain the full clear and complete text of the measure this initiative, objectively does not this isn't open for interpretation because you can look at the initiative, and you can go through and I can show you side by side, the areas that were struck out the areas that were not put in what people signed did not contain the full clear and complete text of the measure. That's really important because it's in the constitution and backed up on the CW. It's very disturbing to me that the supreme court looked in a unanimous decision said, no that doesn't matter. This time are actually what they said is it's not within our power to kick the initiative back, but it's clearly unconstitutional. I do think we have a duty to look at something. That's so objectively bad to say. Yeah, we're not going to do that. Yeah. I again, we have a process in the state. We actually as voters can choose for something which happened here. Then we have an appeals process which happened here. Then we have a final decision on an appeals process, which happened here at some point you have to assume that one of those filters would have actually prevented something from moving forward in this particular case, I don't actually have a problem with this being law one and two if you are a cop, I would rather that you enforce especially something that was passed by ballot measure by a wide margin. This was not a squeaker. This was not because no one bothered even challenging it on the vote itself because it was such a landslide so enforce it every, but the thing of it is is even within the within the letter of the law. If you read this law, there is all kinds of interpretive levels where they can choose to or not to enforce something. The problem is when they get out and say, look, I am a constitutional expert who has. I've never been to law school and never studied this. Maybe the studied this issue as a hobbyist, and it's not my job to even make those determinations yet, I'm going to make those determinations. I don't know. I don't have a whole lot of patience for that. And I'm the one who raised on the show. I don't have a whole lot of patients for cops taking the law into their own hands, regardless of political persuasion, and we agree that that is a dangerous thing. And by the way, what you said was really well said, and I can I can I can hear where you're coming from. So, but I look at examples like, Bob, Bob, Ferguson, so Bob Ferguson, the state attorney general's actually spending most of the time running for governor in my assessment, he's fighting against of turning some records over. So there's a there's a lawsuit ongoing. The freedom foundation is suing Bob Ferguson for interacting with unions because there was a supreme court ruling that made it illegal unconstitutional. Mike for government to force people who are home health care the right to work. Yes. I want to be home healthcare workers large working for, you know, often the family members someone who's ill to have to give their Medicare monies to unions. The unions apparently helped Bob Ferguson, and Jay z with legislation around this and the freedom foundation. Did a public document requests? And Ferguson set them the documents that they wanted except he he blacked out or his his team did all the guts of the documents Deere Bob signed, Bob. So he is refusing to turn these over. I just don't think that Bob Ferguson or Jamesy or anyone has a moral leg to stand on when they say respect the law when he wouldn't even turn over the documents between he and the unions. But that's still he is actually I mean in this case, and I know where on technicality because I'm a big we're both believe big believers in transparency, and he should have sent them back. They are accusing him of colluding with the unions. They don't they don't have any proof of colluding with the unions. They felt like through the public records act. They would get proof. So they received this information. The what is it? So free market legal group decided to sue for this information did not get it. And now they have every right to challenge that they did not meet the freedom of information act standards, which is what the Seattle times and the Associated Press have done at a variety of levels of government, including our legislature right now. So. They still have a fight out in front of them. I don't really have. I mean, they haven't actually.
